FINAL DRAFT Solicitation Questions, v6
April 26, 2016 Page 1
The following questions were asked in response to the FINAL DRAFT Solicitation:
Item Question Response
1. The question previously asked (Question 30) was whether a subcontractor who did not bid a particular labor category during the current competition could bid that labor category after award. The answer directed the reader to G.7, which deals with consent to subcontract. If consent has already been granted for Subcontractor A, is the Government saying that additional consent will be required if Subcontractor A now wants to bid a different labor category based on Work Assignment requirements?
Any changes to the contract after award require a modification, including subcontract changes.
2. It seems possible that the Work Assignments might require the addition of labor categories. Can the contractor add one or more labor categories after award, either for itself or for an existing subcontractor? What information would the Government require in order to make a determination?
Any changes to the contract after award require a modification. Work Assignment Responses may identify new / additional labor categories (and rates) for the Government to consider.
3. If an additional subcontractor is proposed on a Work Assignment after award, will their rates be added as ceiling rates?
Yes, any changes to the contract after award require a modification, including subcontract changes.
4. Will the Government specifically require bidders to describe assumptions regarding uncompensated overtime in developing their pricing, especially given that requiring staff to work uncompensated overtime will result in lower staff morale and inability to retain qualified staff?
Please see FAR 52.237-10.

Item Question Response
5. Given that the final contract does not incorporate the
Q&A responses, does the Government intend to update the appropriate sections of the solicitation to address the use of ceiling rates for invoicing?
FAR 52.216-7 provides for the payment of allowable costs. FAR 31.201-2 specifies how allowable costs will be determined. Only those costs of the contract are deemed allowable. The Contractor bears the burden of proving the allowability of any cost not specifically included in the contract.
