IBM15R0002, Rehabilitation of the East Vado Levee Questions & Answers
Question #1: Is it possible to have a roller, excavator and scraper added to the wage decision?
Answer #1: Per contract clause 52.222-6 Construction Wage Rate Requirements, additional classifications may be added to the contract if the following criteria is meet: (i) the work to be performed by the classification requested is not performed by a classification in the wage determination, (ii) the classification is utilized in the area by the construction industry; and (iii) the proposed wage rate, including any bona fide fringe benefits, bears a reasonable relationship to the wage rates contained in the wage determination. The awarded Contractor will initiate the request by preparing an SF 1444, Request for Authorization of Additional Classification and Rates. Please note, the Department of Labor is the ultimate decision maker in the rate for the classification.
Question #2: Is it a requirement to have Rail Road Liability Insurance Coverage for the duration of this project?
Answer #2: Railroad liability insurance is required anytime that work or activities take place within the BNSF ROW; this includes driving through the ROW. Most likely, this will encompass the entire construction period, but the actual time where the BNSF ROW is used will be left to the Contractor's discretion.
