2007), was prepared for USIBWC in September, 2007. The Contractor shall review and comply with the requirements provided in the EA document.

B. A supplemental environmental assessment titled "Final Supplemental Environment

Assessment Flood Control Improvements to the Rio Grande Canalization Project in

Vado, New Mexico" dated July 2014 was prepared by USIBWC. The Contractor shall review and comply with the requirements provided in this EA document.

C. These documents list environmentally and culturally sensitive areas that need to be protected from any disturbances of construction activities. The environmentally and culturally sensitive areas that were identified on the document are identified below.

1. Biological Resources

a. Work should be schedule to occur outside of the bird breeding season whenever possible. The breeding and nesting season is from March 1 through August 31. If work continues into the bird breeding season the areas proposed for disturbance will be surveyed in order to avoid the inadvertent destruction of nests and eggs

2. Natural Resources

a. Equipment cannot be parked, staged, or used under large, mature trees. Keeping equipment away from the large, mature trees will prevent incidental damage to the tree and prevent compression of the root ball.

D. The Contractor shall abide by New Mexico Clean Water Act §401 permit (SWQB File

1204) issued on April 21, 2015 except for number 8. The Contractor is only responsible for reseeding and regrading the site; all other requirements under number 8 will be the responsibility of USIBWC.

E. The Contractor shall abide by the general conditions of the USACE Clean Water Act

§404 permit (SPA-2010-00393-ELP) issued on June 2, 2015.

1.5 PRESERVATION OF CULTURAL AND NATURAL RESOURCES AND THE

ENVIRONMENT

A. If the Contractor initiates changes to the Contract and USIBWC approves the changes, the Contractor is responsible for obtaining clearances and coordinating with the appropriate regulatory agencies.

B. Culturally Sensitive Areas

1. If a site, building, or location of historical, archeological, educational, or scientific interest is discovered within the right of way, cease all work immediately, secure the site from further disturbance and possible vandalism, and notify USIBWC . The site, building, or location will be investigated and evaluated by USIBWC.

June 2, 2015 Environmental Information

USIBWC RFP IBM15R0002 Page 00.31.24-3

C. Del Rio Drain

1. The project will impact the Del Rio Drain which is owned and operated by the

Elephant Butte Irrigation District (EBID). Study results indicate that EBID was listed in the National Register of Historic Places (NRHP) as an historic district in 1997.

The period of significance for EBID is 1906-1942. The district is listed in the NRHP under Criterion A for its association with agriculture and under Criterion C for its engineering and design. Based upon existing documentation, the proposed removal and replacement of the Del Rio Drain will have negligible effects on historic significance of the overall irrigation district. USIBWC and NM SHPO have made the determination that the work under this project will not have an adverse effect.

1.6 OTHER CONSIDERATIONS

A. The Contractor is required to ensure that all Environmental Permits, Issues, and

Comments (EPIC), which are included within the Contract Documents are followed and implemented to ensure potential impacts are avoided.

1.7 USE OF GEOLOGIC MATERIALS ON A FEDERALLY FUNDED PROJECT

A. To ensure preservation of historical and archaeological data, when the Contractor, the

Construction Contractor, or any subcontractor proposes to use a borrow pit/source/quarry for soil, rock, or gravel, the source must first be approved by the COR to ensure compliance with Section 106 of NEPA (36 CFR 800).

B. Submit a map showing the location of proposed sites to the COR at least forty five (45) days in advance of use.

C. Take no action to use or alter the proposed location until written approval for site use is received from the COR.

D. If the quarry or borrow site already provides materials for NMDOT, USACE, or other governmental agency, a copy of the environmental approvals from said agencies may be provided to the COR.

E. Include permission for Government access to any geological source locations.
