Mr. Delay:

BOGGS ENVIRONMENTAL CONSULTANTS, INC. (BEC) is pleased to present the findings of this Limited Subsurface Investigation conducted at the USDA-ARS Knipling-Bushland U.S. Livestock Insects Research Laboratory, 2700 Fredericksburg Road, Kerrville, Texas 78028-5915 (hereinafter referred to as subject site).

The objective of the Limited Subsurface Investigation is to evaluate the presence of pesticides and metals in soils and drinking water supply due to onsite application and testing of insecticides on cattle and related waste activities that included wastewater from washing cattle directed to drying basins and laboratory sanitary waste directed to septic systems at the subject site. A site vicinity topographic map is provided in Figure 1.

Potential contaminants of concern include Organochlorine Pesticides, Organophosphorus Pesticides, and Priority Pollutant Metals (13), and Mercury (Hg+2). Potential Areas of Concern (AOCs) included the following:

Soils within drying basins or downgradient of septic systems located southeast of current or former Buildings #19, #20, #21, and #22;

Soils within drying basins or downgradient of septic systems located southwest of former Buildings #24 and #26;

Soils downgradient of a former laboratory and septic system in Building #23 (previously demolished);

Soils downgradient of septic systems, former pesticide disposal area (PDA), and incinerator located southeast of current Buildings #11, #12, and #13;

Soils downgradient of septic system and former water cistern southwest of Building #4;

Soils within the stormwater collection and surface runoff area in the grazing areas through the western section of the subject site;

Soils downgradient of current laboratories in Buildings #37, #38, and #39

Soils from an upgradient location adjacent to the water holding tank for Well #1 in the northwest corner of the site to use as a control sample.

BEC subcontracted and directed Vortex Drilling of San Antonio, Texas in the conduct of direct push (Geoprobe®) soil sampling to retrieve desired samples. The following sections summarize the soil and water supply investigations.

Limited Subsurface Investigation

USDA-ARS KBUSLIRL

2700 Fredericksburg Road Kerrville, Texas

SECTION 1.0 TEXAS 811 & CONTRACTED UTILITY MARK OUT

Vortex Drilling contacted Texas 811 to mark subsurface public utilities in the area of the investigation. The only subsurface utility marked by Texas 811 was the Atmos natural gas pipeline through the southern section of the subject site. On March 25, 2019, BEC staked out the locations of the soil borings.

BEC contracted Ground Penetrating Radar Systems, Inc. (GPRS) to conduct the utility screening in the area of each marked boring on March 26, 2019. GPRS utilized a 400 MHz GPR antenna that is typically capable of detecting objects several feet deep to avoid subsurface features such as underground septic systems, drain pipes, or water lines within a 10-foot radius of each staked boring location.

Nearly all of the staked boring locations were cleared of subsurface anomalies. Borings B-2 and B-11 were adjusted two feet from the original staked boring locations to avoid potential subsurface linear features. A sample location diagram is provided as Attachment A.

SECTION 2.0 SUBSURFACE SOIL SAMPLING

The subsurface soil sampling was conducted on April 5, 2019. Vortex Drilling utilized a direct push method for subsurface soil collection (i.e., “GeoProbe®” direct push methodology). The tracked Geoprobe® 7822DT unit was equipped with a hydraulic driven hammer with stainless steel rods and sampling spoon with dedicated plastic sleeve sampling tubes to collect continuous soil samples to a depth of five feet below ground surface (bgs) at most of the borings. An attempt was made to extend two borings to a depth of 10-feet bgs to evaluate the depth of shallow groundwater. Refusal due to bedrock was encountered at 8-feet bgs at Boring B-7 and also at 9-feet bgs at B-8.

Groundwater was not encountered in the soil borings.

Seventeen (17) soil borings were conducted and were identified as B-1 through B-17. Soil samples were collected continuously to a depth of 5-feet bgs at most borings. The Geoprobe® unit could not access the drying basins located in the northwest section of the site. Therefore, Vortex Drilling utilized a hand auger to collect the soil samples from the bottom of two drying basins identified as borings B-3, B-4 and B-5 with the bottom of the basins extending to depths of approximately 6-feet bgs. Refusal with the hand auger was encountered at depths 2-feet bgs within the bottom of the drying basins for borings B-3, B-4, and B-5. A Site Vicinity Map and Sample Location Map are provided in Attachment A. Site photographs taken during the subsurface investigation are provided in Attachment B.

BEC retrieved soil samples from each 1-foot interval to a depth 3-feet bgs at each boring with the exception of borings B-3, B-4, and B-5 where a maximum depth of 2-feet bgs was achieved due to refusal. Soil samples from each sampling interval were placed in laboratory supplied sampling jars, labeled, and placed in a cooler with ice. Boring logs, provided in Attachment C, described soil characteristics encountered at each boring. The soil samples were permitted to equilibrate for a minimum of ten minutes after packaging.

Subsequently, BEC performed vapor headspace measurements of each depth-discrete soil sample for total volatile organic compounds (TVOCs) concentrations utilizing the "MiniRae 2000™" (SN# 110-010930), a portable photo-ionization detector (PID). TVOC screening concentrations ranged from 0 - 2 parts per million (ppm) which are considered insignificant as ambient air concentrations during sampling were within the same range. Recorded TVOC screenings are included in the boring logs presented in Attachment C.

A total of 45 soil samples were collected for laboratory analysis as described further in Section 4.0.

2700 Fredericksburg Road

SECTION 3.0 SAMPLING OF WATER FROM WATER SUPPLY WELLS

On April 8, 2019 BEC collected water samples from two onsite water supply wells identified as Well-1 and Well-2.

The locations of the supply wells are identified on Figure 2. Prior to sampling the well pump was activated via control equipment located in the well shed adjacent to the two wells. The spigot at each well head was opened and allowed to discharge for 20 minutes prior to sampling. BEC collected the water samples in laboratory supplied sampling containers, which were labeled and placed in a cooler with ice. A total of 2 water samples were collected for laboratory analysis as described further in Section 4.0.

SECTION 4.0 LABORATORY ANALYSIS OF SOIL AND WATER SAMPLES

Forty-five (45) soil samples were submitted to Eurofins TestAmerica (TestAmerica) of Pittsburgh, Pennsylvania for the analysis of the following Contaminants of Concern (COC):

Organochlorine Pesticides by EPA Method 8081B;

Organophosphorus Pesticides by EPA Method 8141B;

Priority Pollutant Metals by EPA Method 6010C; and Mercury by EPA Method 7471B

Two water supply samples were also shipped to TestAmerica for the analysis of the following COCs:

Organochlorine Pesticides by EPA Method 8081B;

Organophosphorus Pesticides by EPA Method 8141B;

Priority Pollutant Metals by EPA Method 6010C; and Mercury by EPA Method 7470A.

All samples were preserved in accordance with EPA analytical method requirements during collection, packaging, and commercial courier shipment to TestAmerica. BEC ensured all samples were listed on Chain-of-Custody with signatures secured from each party handling and delivering the samples to TestAmerica.

4.1 LABORATORY ANALYTICAL RESULTS FOR SOILS

Table-1 Summary of Soil Analytical Results is provided at the conclusion of this report. TestAmerica’s laboratory Certificates of Analysis for soils is included in Attachment D. BEC compared the soil analytical results to the "Tier 1 Protective Concentration Levels (PCLs) for Human Health" established by Texas Commission on Environmental Quality (TCEQ) for Residential and Commercial/Industrial Soils. These PCLs maybe viewed on the TCEQ website as listed hereinafter: https://www.tceq.texas.gov/assets/public/remediation/trrp/2018-PCL-Tables.pdf.

a. Organophosphorus Pesticides: no detectable masses of were identified in the laboratory analysis of soils.

b. Organochlorine Pesticides: were identified in Soil Borings B-3, B-4, B-5, B-6, B-7, and B-8. Sample B4-A collected 0-1 foot below the ground surface (bgs) at the drying basin southeast of Building #19, had concentrations of Aldrin at 260 micrograms per kilograms (ug/kg) and Dieldrin at 620 ug/kg which were the only samples to exceed the PCL action levels for Organochlorine Pesticides.

The concentration of Aldrin in sample B4-A exceeded the following three (3) TCEQ PCL action levels:

Residential Soil (combined) concentration of 50 ug/kg;

Residential Soil to Groundwater Ingestion PCL of 100 ug/kg; and Commercial Soil to Groundwater Ingestion PCL of 230 ug/kg.

2700 Fredericksburg Road

SECTION 4.0 LABORATORY ANALYSIS OF SOIL AND WATER SAMPLES

4.1 LABORATORY ANALYTICAL RESULTS FOR SOILS

b. Organochlorine Pesticides: (continued)

The concentration of Dieldrin in sample B4-A exceeded the following three (3) TCEQ PCL action levels:

Residential Soil (combined) concentration of 150 ug/kg;

Residential Soil to Groundwater Ingestion PCL of 49 ug/kg; and Commercial Soil to Groundwater Ingestion PCL of 110 ug/kg

c. Priority Pollutant Metals:

Selenium (Se): Detectable masses of Selenium present in all 17 borings ranged from 2.1 milligrams per kilogram (mg/kg) to 4.6 mg/k which all exceeded the Residential and Commercial Soil to Groundwater Ingestion PCL of 1.1 mg/kg.

Lead (Pb+2): Although several of the soil samples exceeded the lead (Pb+2) Residential and Commercial Soil to Groundwater Ingestion PCL of 3 mg/kg, they do not exceed the Texas background concentration of lead at 15 mg/kg. TCEQ considers the higher concentration between background metals and the PCLs as the action level.

Additionally, soil samples from soil borings B-3, B-4, B-5, B-6, and B-7 have various metals that exceeded Texas background concentrations.

Copper (Cu+2) concentrations in soil samples B3-A, B3-B, B-4A and B6-C ranged between 24-60 mg/kg and exceeded the Texas background concentration of 15 mg/kg for Copper.

Nickel (Ni+2) concentration of 11 mg/kg in sample B6-C exceeded the Texas background concentration of 10 mg/kg for Nickel

Zinc (Zn+2): concentrations in soil samples B3-A, B3-B, B-4A, B-4B, B5-A, B5-B, B6-A, B6-B B6-C, and B7-A ranged between 45-360 mg/kg exceeded the Texas background concentration of 30 mg/kg for Zinc.

Mercury (Hg+2): concentrations in soil samples B3-A, B3-B, B-4A, B4-B, B6-B, and B6-C ranged between an estimated concentration of 0.062 - 0.61 mg/kg and exceeded the Texas background concentration of 0.04 mg/kg for Mercury.

4.2 LABORATORY ANALYTICAL RESULTS FOR WATER SUPPLY WELL SAMPLING

No Organochlorine Pesticides and no Organophosphorus Pesticides were identified in the analysis of water supply samples from Well-1 and Well-2.

The only priority pollutant metal identified was Zinc with an estimated concentration of 7.3 micrograms per liter (ug/L) in sample Well-1 and an estimated concentration of 3.3 ug/L in sample Well-2. The concentrations of Zinc in the two water supply samples were well below the U.S. EPA maximum contaminant level (MCL) established for Zinc at a concentration of 5,000 ug/L and the Texas groundwater ingestion PCL for Zinc at a concentration of 7,300 ug/L established by TCEQ.

2700 Fredericksburg Road

SECTION 5.0 FINDINGS

Based on analytical results, BEC presents the following findings:

Aldrin and Dieldrin concentrations in sample B4-A exceeds TCEQ Residential Soil and Residential Soil –to- Groundwater Ingestion PCLs.

Concentrations of Selenium in all 17 borings exceed the Texas background concentrations and exceed the TCEQ Residential Soil-to-Groundwater Ingestion and Commercial Soil-to-Groundwater Ingestion PCL.

Soil samples from soil borings B-3, B-4, B-5, B-6, and B-7 have various metals (i.e., Cu+2, Ni+2, Hg+2, Zn+2) exceeding the Texas background concentrations.

No Organochlorine Pesticides and no Organophosphorus Pesticides were identified in the analysis of water supply samples from Well-1 and Well-2. The only priority pollutant metal identified was Zinc, however, the concentrations of Zinc in these two water supply samples were well below the U.S. EPA maximum contaminant level (MCL).

SECTION 6.0 RECOMMENDATIONS

Based on reporting requirements under the Texas Risk Reduction Program (TRRP), as made available on TCEQ website (https://www.tceq.texas.gov/assets/public/remediation/trrp/releasesTRRPrev.pdf), further investigation is required, as organochlorine pesticides-in-soil concentrations are present at the subject site and exceed certain TCEQ PCLs. TRRP requires evaluation of potential impact of these COCs to surface/groundwater, prior to determining applicability of TCEQ TRRP reporting requirements. If COCs have not impacted surface/groundwater conditions, then the release is not reportable to TCEQ.

Additionally, TRRP requires a Tier 1 Ecological Exclusion Criteria Checklist be completed to address (evaluate) metals that exceed Texas background levels.

BEC advises, based on TCEQ regulations, Tier 1 Ecological Exclusion Criteria Checklist requires groundwater investigation and surface water sampling to evaluate if contaminants of concern have impacted onsite groundwater or surface water conditions.

BEC also recommends the proper removal and disposal of soils containing elevated concentrations of Aldrin and Dieldrin in the drying basin located southeast of Building #19.

Based upon a discrete interview with a TCEQ representative in the Remediation Program, if soils that exceed the Tier 1 Residential Soil (combined) PCL are to remain onsite, then it would be necessary to post a notice on the Property Deed that soils impacted by a contaminant over the residential standard is present onsite.

SECTION 4.0 LIMITATIONS

The findings of this report are based on and limited to the soil borings locations selected, depth of the samples collected for laboratory analysis, selected analyses, as well as the assumptions, conditions, and qualifications set forth in this report. This report was prepared by BEC for use by Merrick and USDA-ARS. Any other use of, or reliance on, this report by any third party is at that party's sole risk.

Receipt:

The samples were received on 4/2/2019 at 9:20 AM and 4/3/2019 at 9:40 AM; the samples arrived in good condition, properly preserved and on ice. The temperatures of the 3 coolers at time of receipt were 1.3º C, 2.5º C and 2.8º C.

Receipt Exceptions:

The following samples were listed on the Chain of Custody (COC); however, no samples were received. This is due to two missing coolers. B-1A (180-88395-1), B-1B (180-88395-2), B-1C (180-88395-3), B-2A (180-88395-4), B-2B (180-88395-5), B-2C (180-88395-6), B-3A (180-88395-7), B-3B (180-88395-8), B-4A (180-88395-9), B-4B (180-88395-10), B-5A (180-88395-11), B-5B (180-88395-12), B-6A

(180-88395-13), B-6B (180-88395-14), B-6C (180-88395-15), B-7A (180-88395-16), B-7B (180-88395-17), B-7C (180-88395-18), B-7D (180-88395-19), B-8A (180-88395-20), B-8B (180-88395-21), B-15A (180-88395-42), B-15C (180-88395-43), B-16A (180-88395-44), B-16B (180-88395-45), B-16C (180-88395-46), B-17A (180-88395-47), B-17B (180-88395-48) and B-17C (180-88395-49).

These samples were delivered by FEDX and received at the laboratory a day later.

Organochlorinated Pesticides:

The following sample B-4A (180-88395-9) was diluted to bring the concentration of target analytes within the calibration range. Elevated reporting limits (RLs) are provided.

The following sample B-4B (180-88395-10) was diluted due to the nature of the sample matrix. Elevated reporting limits (RLs) are provided.

No additional analytical or quality issues were noted, other than those described above or in the Definitions/Glossary page.

Organophosphorous Pesticides:

The continuing calibration verification (CCV) associated with batch 180-274692 recovered above the upper control limit for Dichlorvos. The samples associated with this CCV were non-detects for the affected analytes; therefore, the data has been reported.

The continuing calibration verification (CCV) associated with batch 180-275053 recovered above the upper control limit for Dichlorvos. The samples associated with this CCV were non-detects for the affected analytes; therefore, the data has been reported.

The matrix spike / matrix spike duplicate (MS/MSD) precision for preparation batch 180-274814 and analytical batch 180-275053 was outside control limits. Sample matrix interference is suspected.

The continuing calibration verification (CCV) associated with batch 180-275053 recovered above the upper control limit for Demeton, Total.

The samples associated with this CCV were non-detects for the affected analytes; therefore, the data has been reported.

No additional analytical or quality issues were noted, other than those described above or in the Definitions/Glossary page.

Metals:

Due to sample matrix effect on the internal standard (ISTD), a dilution was required for the following samples: B-1A (180-88395-1), B-1B (180-88395-2), B-1C (180-88395-3), B-2A (180-88395-4), B-2B (180-88395-5) and B-2C (180-88395-6). All analytes referencing the indium internal standard required dilution due to the indium internal standard counts being low and outside the 70%-130% control limits.

Antimony was also reported from dilution due to the concentration being less than the negative reporting limit.

The matrix spike / matrix spike duplicate (MS/MSD) recoveries for prep batch 180-275122 were outside the control limits for antimony.

Sample matrix interference and/or non-homogeneity are suspected because the associated laboratory control sample (LCS) recovery was within acceptance limits.

Due to sample matrix effect on the internal standard (ISTD), a dilution was required for the following samples: B-4B (180-88395-10), B-5A

(180-88395-11), B-5B (180-88395-12), B-6A (180-88395-13), B-6B (180-88395-14), B-7A (180-88395-16), B-7B (180-88395-17), B-7C
