The below section references the inclusion of PMA tonnage assessments into the commodity rates.
How should contractor include such charge in the rate, when tonnage assessments are charged in various ways and are dependent on each specific piece moved? In past contract cycles this has been charged as pass through, and charged at the PMA published tonnage rates.
a. 4.5.1.1 Commodity Pricing. The USG shall compensate the Contractor for each single vehicle, trailer, container, or aircraft the Contractor handles. The Unit of Measure (UOM) shall be i.e., EACH (EA) for single pieces e.g. (Containers, Vehicles, Orphaned trailers, and/or Aircraft. Commodity category (25,35, 44, 45, 60, 61, 67) - EA)), PMA imposed assessments (short-ton and container fees) shall be included in each payable commodity, prime vehicles/trailer combinations will be considered one piece. Breakbulk (BB) Cargo the UOM used is “Measurement Ton (MTON)” Breakbulk commodity (40) - MTON)), BB secondary loaded, nested, or stacked on cargo beds or trailer will be considered part of prime vehicle/trailer and counted as part of the prime vehicle or trailer. Stacked flat racks shall be counted as one piece.
9 20-Feb-25 The section below references 5-minute increments. This does not align with the ILWU/PMA CBA (sections 3.33/3.34 of the PCLCD). How should we address this?
a. 4.11.2 Overtime Pay. The USG shall only pay overtime when overtime is necessary and is worked, the contractor shall when directed by the COR/OO work requested overtime (to include meals, weekends and holidays), or when its more advantageous to complete vessel or terminal services. Overtime hours worked shall be rounded to the nearest 5-minute increment. The USG will not pay overtime for the Contractors management or supervision.
10 20-Feb-25 The below section references the Port of Oakland which is not part of this RFP. Is this intended? If so, please provide referenced PWS.
a. 4.14 Equipment Rental Rates (EQR) (Port of Oakland). Equipment rental (rates), shall be used to compensate the contractor for use of its CFE/MHE when approved by the COR/OO, as defined by its use elsewhere in this PWS, EQR applies to equipment owned and operated by the Contractor, and used while handling USG cargo in conjunction with XL ordered services. The Contractor shall provide an hourly and/or daily rate for CFE/MHE listed in (schedule 4) of the SOR, daily rates shall imply 24-hour period, time starting when CFE/MHE is in place and ready to be used.
11 20-Feb-25
6. The below section states the inclusion of operator in equipment rental rates. Please clarify which commodity rates should include operator. Our understanding is that extra labor work would have an equipment charge and a separate operator charge. Is this the intent?
a. 4.14.1 For all commodity operations the Contractor’s CFE/MHE, its driver/operators, gear, riggings, spreader bars, POL’s, materials, and supplies shall be inclusive of all commodity activity work (i.e., (loading or discharging) vessel, CULT assets (commercial truck and rail), cargo transfers, towing, striping/stuffing/unstuffing, etc.)). All CFE/MHE used during the course of this contract used for the above, shall also include requirements mentioned in section 4.6 (Port of Oakland) of the PWS.
12 20-Feb-25 Several sections of the PWS reference the requirement for ILWU personnel to have a CDL or Class A/B license. This is outside of ILWU/PMA CBA jurisdiction. How should the contractor address this?
