ADDENDUM 52.212-2
52.212-2 EVALUATION ADDENDUM – COMMERCIAL ITEMS (Oct 2014)
Paragraphs (d) and (e) are added to read as follows:
(a) The Government will award one contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered: The following factors shall be used to evaluate quotes:
A. Factor I – Technical (Acceptable/Unacceptable) B. Factor II – Price (Fair & Reasonable/Not Fair & Reasonable)
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for the option to extend services to the total price for the basic requirement. Evaluation of options shall not obligate the government to exercise the option(s).
(c) A written notice of award or acceptance of a quoter, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party.
Before the quote's specified expiration time, the government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(d) Basis for contract award - This acquisition is conducted under FAR Part’s 13, Simplified Acquisition Procedures, Subpart 13.5 and Part 12, Acquisition of Commercial Items of the Federal Acquisition Regulation (FAR). Quotes will be evaluated using the factors identified in FAR 52.212-2, Evaluation – Commercial Items and this addendum. Noncompliance may be grounds to eliminate the quote from consideration for contract award. Award will be made on the basis of Lowest Evaluated Price of the Quote whose technical factor is rated “Acceptable.”
Specifically, by submitting a quote the quoter understands and accedes to all the terms and conditions of this solicitation.
The evaluation process shall proceed as follows:
Following the RFP closing date, proposals will be checked for compliance with Proposal Preparation Instructions in Addendum to FAR 52.212-1(b). A Compliance Checklist is included to help the offeror ensure all compliance checks are met. Failure to materially comply with all Proposal Preparation Instructions will result in the proposal being found noncompliant with the solicitation. Noncompliance may be grounds to eliminate the proposal from evaluation and consideration for contract award.
Next, Technical Worksheets will be evaluated by the Technical Team and receive a rating of Acceptable or Unacceptable. In the event more than four (4) proposals are received, the Contracting Officer (CO) may make the determination to limit the number of Technical Worksheets evaluated. If the CO makes this determination, the four (4) lowest Total Proposed Price (TPP) Proposals will be evaluated first.
All proposals not evaluated will remain in the queue until the first evaluation is complete, if one of those proposals are rated acceptable the remaining proposal will be filed and the acceptable proposal will move on to the price evaluation.
However, if the CO determines it’s in the best interest of the Government, additional proposal(s) may be evaluated. If none of the first four (4) Technical Worksheets receive a rating of acceptable then the next four (4) or remaining proposals if less than four (4) will be evaluated. In order to be rated as Acceptable, the Technical Proposal must provide sufficient detail identifying how the Offeror intends to meet the Government’s minimum requirements as stated in paragraph (d)(1) below. Proposals deemed Unacceptable are those that fail to meet the Government’s minimum requirements.
Following the technical evaluation, all technically acceptable quotes shall be categorized in order of lowest to highest Total Quoted Price (TQP). Beginning with the technically acceptable quote with the lowest TQP, the Government will then evaluate pricing as quoted in Attachment 2, Schedule of Rates Excel (.xlsx) spreadsheet to determine fair and reasonableness using one or more techniques set forth in FAR 13.106-3. If it is determined the technically acceptable quote with the lowest TQP has fair and reasonable prices, the Government will complete a responsibility determination IAW the criteria specified in FAR 9.104-1. If found responsible, the evaluation process stops at this point as that quote represents the best value to the Government. Award shall be made to that quoter without further consideration of any other quotes.
If the technically acceptable quote of the lowest priced quoter cannot be determined fair and reasonable or if the lowest priced quoter is found to be non-responsible, the next lowest priced quoter will be evaluated in accordance with the paragraph above. This process will continue until a quote is evaluated to have an Acceptable Technical Worksheet, fair and reasonable prices and the quoter is deemed responsible or until all quotes have been evaluated.
The Contracting Officer at any time may inquire about any quote if additional information or a revised quote is required. The Contracting Officer may inquire about all, none, or as many quotes as needed, however, the Contracting Officer shall treat all quoters fairly and impartially, in accordance with FAR 1.102-2(c)(3).
The following factors shall be used to evaluate quotes:
1. Factor I: Technical Quote
The Technical Worksheet will be evaluated as Acceptable or Unacceptable, as defined below:
Rating Description Acceptable Technical Worksheet clearly meets the minimum requirements of this solicitation.
Unacceptable Technical Worksheet does not clearly meet the minimum requirements of this solicitation.
Technical Quote. To be rated Acceptable, the quoter must provide a completed Technical Worksheet (Attachment 3), which clearly describes in sufficient detail how the quoter will achieve the objectives in the worksheet in accordance with the Performance Work Statement as defined by the minimum requirements listed in the Technical Worksheet (Attachment 3). The Government will evaluate the quoters response to each item in the worksheet to determine if the quoter adequately demonstrates the capability to successfully conduct Stevedoring & Related Terminal Services. If any of the minimum requirements in the Technical Worksheet (Attachment 3) are rated Unacceptable, the entire Technical Worksheet will be rated Unacceptable. Failure to complete the Technical Worksheet in its entirety may render a quoter ineligible for award. See Technical Worksheet for specifics.
2. Factor II: Price.
The Government utilized the Schedule of Rates Excel (.xlsx) spreadsheet to capture quoter’s total quoted price.
In order to be considered for award, total quoted price must be determined fair and reasonable. The data contained in the price quote shall be utilized by the Government to analyze the Quoter’s pricing using one or more techniques set for tin FAR 13.106-3.
The quoter shall complete and submit the Schedule of Rates (Attachment 2), as its price quote. The price quote shall be submitted as an attachment to an email and contain no hidden formulas or external links. The Government utilizes the Schedule of Rates Excel (.xlsx) spreadsheet to capture the Total Quoted Price (TQP) for evaluation and award purposes. The TQP consist of all unit price rates quoted in highlighted cells for the contract lifecycle, 12-month base, four (12) month options and the 6-month extension of services. Failure to input a unit price in any highlighted cell shall be construed as the quoter’s intention to quote a price of zero (0). However, quoters may be considered ineligible for award if all required pricing is not complete.
In order to be considered for award, price must be determined fair and reasonable using one or more techniques set forth in FAR 15.404-1(b)(2). Upon contract award, this data will form the basis for any price adjustments pursuant to the Revision of Prices clause, DFARS 252.247-7002, and, as such, must provide the means of determining the application of any requested adjustments and calculating the revised unit prices.
(e) The Government reserves the right to award no contract at all depending on the quality of the quotes submitted and availability of funds for the requirement. The Government intends to evaluate quotes and award a single IDIQ contract without discussions. Therefore, the quoters are advised, their initial quote should contain the most favorable terms and reflect its best possible performance potential.
