SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

The following have been modified:

Addendum to FAR 52.212-1 Instructions to Offerors-Commercial Items (Jun 2020).

Paragraph (b) entitled “Submission to Offers” is deleted in its entirety and replaced with paragraph (b) “Submission Information” below.

Paragraph (c) entitled “Period of Acceptance of Offers” is tailored to read: “The Government requires a minimum of 180 calendar days for acceptance of offers submitted in response to this solicitation.”

Paragraph (d) entitled “Product Samples” is deleted in its entirety.

Paragraph (f) entitled “Late submissions, modifications, revisions, and withdrawals of offers” is deleted in its entirety and replaced with paragraph (f) “Late submissions, modifications, revisions, and withdrawals of offers” below.

Paragraph (g) entitled “Contract award (not applicable to Invitation for Bids)” is tailored to read:

“(g) Contract Award. The Government intends to evaluate offers and award a contract without discussions. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. The Government reserves the right to award no contract, depending upon the quality of the offer submitted and the availability of funds.”

Paragraph (h) entitled “Multiple Offers” is tailored to read: “The Government will not consider multiple offers presenting alternate terms and conditions for satisfying the requirements of this solicitation.”

Paragraph (j) entitled “Unique entity identifier” is deleted in its entirety.

Paragraph (l) entitled “Debriefing” is deleted in its entirety and replaced with paragraph (l) “Debriefing” below.

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission Information.

Each volume shall include a cover page including Offeror name, title of the proposal, volume number, and solicitation number. Provide a table of contents with sufficient detail to easily allow the location of important elements.

(3) Proposals shall be clear, concise, and include sufficient detail for effective evaluation and to substantiate the stated information. Proposals shall not rephrase or restate the Government’s requirements, but shall provide convincing rationale to address how the Offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their company or experience and will use this information to evaluate the offer.

Statements that the offeror understands, can, or will comply with the PWS; statements paraphrasing the PWS or parts thereof; and phrases such as “standard procedures will be employed’ or “well known techniques will be used,” etc., will be considered unacceptable.

(4) Page Limitations. The page limits are inclusive of any charts, diagrams, and/or other graphics. The cover page and table of contents are excluded from the page limitation. All pages shall be numbered. Times New Roman 12 point font shall be used except for figures, tables, and diagrams where smaller is acceptable as long as it is readable. Excess pages exceeding the maximum limits will not be read or considered in the evaluation.

Submission Requirements:

Volume I – Business Proposal. The Business Proposal shall include all documents/information required by the solicitation but is not part of the Technical Capability, Past Performance or Price Proposal Volumes. This includes all documents requiring signature or completion by the Offeror, such as the SF 1449, solicitation amendments, and RFP Offeror Information Sheet. By submitting a Business Proposal, the Offeror assents to the contract terms and conditions as written in the RFP, with attachments. The Business Proposal shall comply with the instructions below. Offerors shall identify the individuals authorized to negotiate with the Government and obligate their company contractually. Only an authorized official of the firm shall sign the required documents.

(1) The offer shall be submitted on SF 1449, Solicitation/Contract/Order for Commercial Items. Offerors shall complete blocks 12, 17a, and 30 a, b, and c of the SF 1449.

Offerors shall ensure the information in Block 17a is consistent with the company information in the System for Award Management (SAM). Complete Block 17b, if applicable.

(2) The Offeror shall complete/submit the RFP Offeror Information Sheet

(Attachment 6 of this solicitation).

(3) Acknowledgement of each RFP Amendment. Amendments to the solicitation, if any, shall be acknowledged by signing and submitting a copy of the amendment(s) with the proposal. Only an authorized official of the firm shall sign solicitation amendments.

(4) FAR 52.212-3 Alt I Offeror Representations and Certifications--Commercial

Items. After the Offeror has completed annual representations and certifications electronically via the SAM Website located at https://www.sam.gov/portal, the offeror shall complete only paragraphs (b) of this provision. If the offeror is unable to submit the annual representation and certifications electronically via the SAM website, the Offeror Representation and Certifications shall be submitted with the proposal by printing the document and completing any applicable clause fill-ins.

(5) The Offeror shall complete/submit any applicable clause fill-ins including the necessary fill-ins and certifications to including, but not limited to, FAR 52.204-24, 52.204-26, 52.209-7, 52.212-3 Alt I, 252.247-7022, 252.239-7009, 252.247-7023, 252.247-7023 Alt I.

(6) Organizational Conflict of Interest (OCI): As required by FAR 9.5, the

Government will ensure no organizational conflict of interest are present. If any such conflict of interest is found to exist, the Contracting Officer may disqualify the Offeror or determine that it is otherwise in the best interests of the United States to contract with the Offeror and include the appropriate provisions to avoid, neutralize, mitigate, or waive such conflict in the contract awarded. The Offeror shall provide the Contracting Officer with complete information of any previous or ongoing work that is in any way associated with this acquisition, or related acquisitions. The Offeror shall submit a mitigation plan that addresses actual or perceived conflict of interest related to the services required by this effort for Government review. The Government will conduct an independent assessment review of any submitted OCI Mitigation Plan to determine if any actual or perceived OCI exists and what further actions are necessary, if any. Additionally, the Government will monitor contract performance for emerging areas of conflict of interest and take action considered necessary to avoid, neutralize, or mitigate conflicts. If the Offeror believes there is no OCI, a statement as such shall be included.

Volume II - Technical Approach (shall not exceed 35 pages). Contractor shall provide a technical approach using Adobe or Microsoft Word that meets the overall PWS requirements and demonstrates all procedures, methodologies, and innovations proposed in the following areas:

(1) Soliciting customer satisfaction surveys through multiple stages (listed in PWS section 1.1) to ensure 40% response rate. Contractor shall clearly define the medium(s) to be utilized (e.g. text message, email, website, combination, etc.) and the process flow. Quotes shall include a narrative of how the proposed medium(s) and process flow will maximize customer response rate.

(2) Managing the distribution and collection of 100,000 surveys monthly and 1,000,000 surveys annually while protecting Personally Identifiable Information (PII) as listed in PWS section 1.2.

(3) Ramp-up plan including clearly identified activities required and the timeframe for accomplishing each PWS task. Transitioning into task order performance includes being fully integrated with a Government IT system within 90 days as defined in PWS sections

1.3 and 1.7. A ramp-up plan shall be utilized in any task orders that require integration with additional Government IT systems. Contractor shall submit a narrative discussing ability to adjust submitted ramp-up plan to integrate additional Government IT systems.

(4) Contractor may submit proposed changes to Appendix 2 including questions

(different or altered), images, graphics, etc. in order to maximize customer participation and response rate. Submissions should include any pictures or demonstrations necessary for the Government to observe what the customer will receive within surveys. Submissions shall include a narrative of how proposed changes will garner a higher response rate or otherwise benefit the Government. If no changes to Appendix 2 are submitted, the contractor shall clearly describe how Appendix 2 as currently constructed will garner the highest response rate and how no change could increase the benefit to the Government.

NOTE: Customer satisfaction shall be measured on a five-point likert scale, with the top three responses counting towards satisfaction. Rating system of responses between 1 (minimum score) and 5 (maximum score) must remain unchanged.

Volume III - Past Performance. The Offeror shall provide no more than three (3) examples of Government or commercial contracts/work efforts which they consider both current and relevant.

Current efforts are those that are currently ongoing or were performed within the last three years of solicitation issuance date. Relevant past performance means the references have a logical connection to the work described in the PWS in terms of complexity and nature. A reference is defined as a single contract or task order for actual performance.

Each Offeror shall provide a Past Performance Reference Submission Sheet (Attachment 4) for each reference submitted.

Subcontractor Past Performance may be submitted. If offerors choose to submit subcontractor Past Performance, they shall submit a narrative outlining the aspects of performance for which each subcontractor will be utilized under the CSS contract.

Past Performance Questionnaire. Offerors shall complete Section 1 of the Past Performance Questionnaire (Attachment 5) and send to each of the Offeror’s references identified in the proposal. The Past Performance Questionnaire shall be completed by the identified Point of Contact (POC) for each reference provided and emailed directly to the Contract Specialist and Contracting Officer. If more than three (3) questionnaires are received, the government will only evaluate the first three (3) that are received. Note: The Contracting Officer will not accept surveys emailed by the Offeror. Offerors should use every diligent effort to follow-up with each Office/Agency to ensure the Contracting Officer receives the past performance questionnaires no later than the offer due date/time. The responsibility to send out the Past Performance Questionnaire rests solely with the Offeror. Once the questionnaires are completed by your reference points of contact, the information therein shall be considered procurement sensitive and shall not be released to you, the Offeror. Completed Past Performance Questionnaires should be submitted via email to michael.d.heth.mil@mail.mil, cassandra.a.range.civ@mail.mil, and nicholas.a.vanosdale.civ@mail.mil.

Volume IV – Price. The offeror shall submit proposed rates for each Contract Line Item Number (CLIN) by completing the pricing schedule (Attachment 2). Do not alter the format of Attachment 2. Offers without proposed rates for each CLIN will be determined incomplete and un-awardable.

(f) Late submissions, modifications, revisions, and withdrawals of offers.

(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.

(2)

(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and-

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government’s control prior to the time set for receipt of offers; or

(C) If it was the only offer received.

(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes information obtained through an electronic commerce method authorized by the solicitation, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Offers may be withdrawn through an electronic commerce method authorized by the solicitation if received at any time before the exact time set for receipt of offers.

(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:

(1) The agency’s evaluation of the significant weak or deficient factors in the debriefed offeror’s offer.

(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.

(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.

(4) A summary of the rationale for award;

(5) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

(End of Provision Addendum)

Addendum to FAR 52.212-2 Evaluation-Commercial Items (Oct 2014).

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Evaluation will be conducted in accordance with (IAW) FAR Part 13, Simplified Acquisition Procedures, and Part 12, Acquisition of Commercial Items. To receive an award, the offeror(s) must (1) be deemed responsible in accordance with FAR Part 9,

(2) conform to all required terms and conditions, and (3) represent the best value to the Government price and other factors considered.

(1) The following factors shall be used to evaluate offers:

(i) Business

(ii) Technical

(iii) Past Performance

(iv) Price

(2) Evaluation Criteria Importance. Business proposals and offerors’ past performance will be rated on an Acceptable/Unacceptable basis. Technical proposals will be evaluated as more important than Price.

(3) Evaluation Process. The Government will first evaluate offerors’ Business proposals and past performance records for acceptability. The Government will then comparatively evaluate the Technical proposals of those offerors found to have acceptable Business proposals and past performance records. Price will be evaluated but not rated. The offeror found to be the best value to the Government in terms of technical superiority and price will be awarded a contract. This may result in an award to a higher rated, higher priced Offeror where the decision is consistent with the evaluation factors and the Government reasonably determines that the superior technical approach of a higher priced Offeror outweighs the price difference. However, the Government will not pay a price premium that it considers to be disproportionate to the advantages associated with the proposed margin of technical superiority.

(b) The above factors shall be evaluated in the following manner:

Factor 1 – Business Proposal. Each offeror’s Business proposal will be evaluated to determine if it complies with all terms and conditions of the solicitation. Business proposals shall be submitted in accordance with the instructions to offerors and will be evaluated as Acceptable or Unacceptable.

Business Proposal Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.

Unacceptable Proposal does not meet the minimum requirements of the solicitation.

Factor 2 – Technical Proposal. Offerors’ Technical proposals will be evaluated on a comparative basis in accordance with FAR 13.106-2(b)(3). Technical proposals should be logical, realistic, demonstrate a thorough understanding of the entire PWS, and describe how they will result in accomplishment of all requirements. Comparative analysis will evaluate the probability of proposals to result in superior accomplishment of all requirements, and the identified relative technical advantages to the Government in the following areas:

(1) Offeror’s proposed approach to soliciting customer satisfaction surveys through multiple stages (listed in PWS section 1.1) to ensure a 40% response rate. The Government will evaluate offerors’ submitted narratives discussing how proposed medium(s) and process flow support the offeror’s approach will ensure a 40% response rate.

(2) Offeror’s proposed approach to managing, distributing, and collecting 100,000 surveys per month, and 1,000,000 surveys per year, while protecting Personally Identifiable Information (PII) as listed in PWS paragraph 1.2.

(3) Offeror’s proposed ramp-up plan including clearly identified activities required, timeframes for accomplishing each PWS task, and detailed approach to fully integrating with a Government IT system, including a narrative discussing the ability to adjust the ramp-up plan to integrate additional Government IT systems at a later date.

(4) Offeror’s proposed survey questions (if different than Appendix 2), images, graphics, pictures, etc. demonstrating what the customers will see when receiving a survey, and a narrative of how the approach will garner maximum customer participation and the highest response rate.

If no changes to Appendix 2 are submitted, the Government will evaluate the contractor’s submitted narrative describing how Appendix 2 as currently constructed will garner the highest response rate and how no change could increase the benefit to the Government.

NOTE: Customer satisfaction shall be measured on a five-point likert scale, with the top three responses counting towards satisfaction. Rating system of responses between 1 (minimum score) and 5 (maximum score) must remain unchanged.

Factor 3 – Past Performance. Offerors’ (including any subcontractors’) past performance will be evaluated on an Acceptable/Unacceptable basis using Past Performance surveys submitted by the offerors’ POCs and other information independently obtained from Government or commercial sources (i.e., Past Performance Information Retrieval System, Federal Awardee Performance and Integrity Information System, any other reasonable basis available to the Contracting Officer).

Each past performance effort will first be evaluated on the basis of currency and relevancy.

Current efforts are those that are currently ongoing or were performed within the last three years of solicitation issuance date. Relevant past performance means the references have a logical connection to the work described in the PWS in terms of complexity and nature. Any past performance effort deemed not current OR not relevant will not be utilized in the Government’s past performance evaluation. Offerors with no current/relevant performance record shall receive the rating “Unknown” meaning the rating is treated neither favorably nor unfavorably.

Past Performance Proposal Acceptable/Unacceptable Ratings Rating Description Acceptable Based on the offeror’s (including any subcontractors’) current/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Unacceptable Based on the offeror’s (including any subcontractors’) current/relevant performance record, the Government does not have a reasonable expectation that the offeror will successfully perform the required effort.

Factor 4 – Price. Price will be considered in determining the best value Offeror. In order to be considered for award, the TEP must be determined fair and reasonable. The Offeror’s proposed pricing will be evaluated for reasonableness using one or more of the techniques set forth in FAR 13.106-3. Proposed pricing will also be evaluated to determine that all prices are complete (all price fields in the Attachment 2 have been entered and/or extended as required). The Government may determine a price proposal is unacceptable if the prices proposed are materially unbalanced. Unbalanced pricing exists when, despite a fair and reasonable TEP, the price of one or more line items is significantly overstated or understated and poses an unacceptable risk to the Government.

Options. FAR 52.217-8, Extension of Services Clause, is included in this RFP. The Government will consider the total evaluated price of each offer when making a best value decision. The Government will evaluate the offeror's total price by adding the total price of the base requirement, all option periods, and the total price for the 6-month Extension of Services. Pricing for the 6-month Extension of Services will be based on the unit prices proposed in the offeror's final option period.

Offerors shall not submit a price for the potential 6-month Extension of Services. The government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Basis for contract award. This acquisition is being conducted under FAR Part 13, Simplified Acquisition Procedures, Subpart 13.5 and Part 12, Acquisition of Commercial Items of the Federal Acquisition Regulation (FAR). Offers will be evaluated using the factors identified in FAR 52.212-2, Evaluation -- Commercial Items (Oct 2014), and FAR 13.106-2, Evaluation of Quotations or Offers.

(e) The Government intends to award a contract without discussions with respective offerors.

The Government, however, reserves the right to conduct discussions if deemed in its best interest.

(f) Communication conducted to resolve minor or clerical errors will not constitute discussions, and the Contracting Officer reserves the right to award a contract without the opportunity for proposal revision.
