HTC711‐18‐R‐CC04 Questions and Answers 14 Jun 2018

Question # Section/Para Category Reference Question/Comment Government Response

1 Attachment 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes The Total Est Price per Route appears to be miscalculated on CLINS 0103 and 0107.

That is correct. The Total Estimated Prices per Route are as follows ‐

CLIN 0103: $3,850,011.20; CLIN 0107: $3,849,769.00.

Revised accordingly via Amendment 0001.

2 Attachment 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes

The XOP "placeholder" passenger routes in CLINs 0112‐0146 indicate a Large Passenger aircraft type and 400 ACL. Please confirm if this is a maximum passenger requirement that can be accommodated on one or more aircraft and aircraft types (e.g.

medium). As you are aware, there is only one aircraft capable of a 400 ACL and very little remaining in service. As solicited, these 400 ACL CLINs comprise 285 total trips and 68% of the proposed large passenger fixed buy. Please confirm the intended ACL and/or range.

The intended ACL for CLINs 0112‐0146 is 350‐400 passengers. Revised accordingly via Amendment 0001.

3 Attachment 4 Commitment Atch 4, Sec II, para a, c

Just to clarify‐‐‐‐ Appendix 3A and lease conformance is only for FY19/20 base period and if 2 year option goes into effect then Appendix 3A and lease conformance will need to be updated at that time.

The Appendix 3A and lease conformance submitted with your proposal is for the base period (FY19/FY20); however, IAW Atch 4, Sec II, para c, "CRAF Aircraft Revalidation, Basic, and Performance Data Sheets (Data Sheets 81, 82, and 83, respectively, Attachments 8a, 8b, and 8c) and associated Computerized Flight Plan (CFP) and updated Appendix 3A shall be submitted not later than 1 Jul of each year, or as needed, for any changes from the Contractor’s previous year’s submission IAW Atch.

8."

Atch 4, Sec II, para a. has been revised to include the following:

"Minimum aircraft commitment shall be maintained during each two‐ year period of performance (i.e. entitlement interval)."

Atch 4, Sec II, para c. has been revised to include the following:

"If there are no changes, resubmission of said documents is not required."

4 Attachment 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes

Are the attached fixed awards only for FY19 contract year 01‐ October 2018 through 30 September 2019?

Asking because the offer letter states the following:

The period of performance will consist of a base period (1 Oct 2018 through 30 Sep 2020) Will the FY20 come out as fixed or expansion ?

Attachment 12 to the RFP is for the FY19 Fixed Award only. The Period of Performance for the Base Period of any IDIQ contracts awarded will be for 2 years (1 Oct 2018 through 30 Sep 2020). FY20 requirements will be awarded via a Task Order IAW the procedures outlined in Atch 4, Commitment, Entitlement and Ordering Procedures.

5 Atch 12 & 4 Initial Task Order/

Entitlement

Attachment 12, FY19 Fixed Award Routes Route 0059 /Attachment 4, Commitment, Entitlement and Ordering Procedures

(1) [Is International Short Range Carrier] restricted to making offers on Route 0059 due to the leg lengths being less than 2,350 NM?

(2) Does the government differentiate entitlements between the long‐range section and the short‐range section or are the entitlements aggregated and parceled out amongst all medium cargo aircraft?

(3) If there is a differentiation between long and short range, will Route 0059 will be awarded as Short Range?

1. Carriers can offer on routes they are capable to perform.

2. It is just medium class.

3. N/A

RFP Questions and Answers

6 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes

Are the KDOV‐OKBK flights notional or actual. There are no pax flights historically out of KDOV. Withdrawn – I see the note on line 1358 saying they are Notionals.

a. Will the APOE be confined to East Coast and APOD to the ME region?

B. Will Ferry be a deciding factor?

c. Will cancellation fees be paid if actual mission is not placed?

Unlike the Notionals released to date the note on row 1,358 for not mention this.

d. Why list Notionals from the ME and back as well as from Asia?

PAC and back? Are you planning to pay ferry From/To CONUS to bring the aircraft back or expecting the carrier to keep an aircraft in that region?

Route has been revised to KDOV‐OKBK‐KDOV.

7 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes

The idea that there are airplanes based in OKBK available for partial utilization doesn't make sense either and would create extreme amounts of ferry. [Carrier] laid out the KDOV and OKBK round trips and assuming you would sit a max of 2 days before de‐positioning, the 124 KDOV originating flights would take 131 PO/DEPO one ways;

and assuming you would sit three days before de‐positioning the OKBK aircraft (which would kill the utilization), the 123 OKBK flight would take 103 Trans‐Atlantic ferries to achieve. This amount of ferry assumes all flights are being operated by one carrier, which they wouldn't be, which will increase the ferry even more.

a. Is it your intention to group these missions together?

Route has been revised to KDOV‐OKBK‐KDOV.

8 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes Given those inefficiencies, what assumptions, should we make about ferry, especially since we won't know what we will get awarded.

Route has been revised to KDOV‐OKBK‐KDOV.

9 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes

Is the assumption that these operations will continue as in the past?

In other words, will actual ferry be paid on all Fixed mission for Large, except the PE BWI‐IUD‐BWI as well as the Medium PE trips?

Also, the ACL ranges on the Large Fixed missions are a dramatic change from historical operations. Are you intending to eliminate all large aircraft with Pay ACLs less than 350, on the one hand and eliminate the Charter Configured B744 on the other. Shouldn't all of the Large Fixed missions except the Channel BWI‐IUD‐BWI be and ACL range of 330‐435?

Ferry will be negotiated when required.

Requirements for Large Passenger Aircraft (except for channel missions) have been revised to reflect an ACL range of 330‐435.

10 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes CLIN 0142 shows 1 Trip but 2 dates – 5/29 & 5/30 CLIN updated to reflect 2 trips.

11 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes

CLINS 0097 through 0109 – Movement of the ACL requested (noted PAX counts times the weights) cannot be operated in the number of trips listed – Is the number of trips just a placeholder? How should we Bid?

The number of trips is an estimate. Submit your offer to meet the ACL requirement in the timeframe allotted.

12 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes You have used an ACL of 260 to calculate the trip costs for Medium PAX – historically there have not been any awards at 260 – all 240 – do you anticipate that changing?

Awarded ACL will be IAW the Rates and Rules and offered aircraft. The trip cost is an estimate.

13 Atch 12 Initial Task Order Attachment 12, FY19 Fixed Award Routes

CLIN 0045 has OJAQ listed as a point of circumnavigation – this route does not require that carriers circumnavigate Iraq. (the route on CLIN 0044 does require circumnavigation due to FAR117 rules – it correctly has the OJAQ insertion).

If circumnavigation is not required, please annotate accordingly on Attachment 12 of your proposal submission in the Remarks section.

14 RFP

Teaming

Arrangements RFP, Section H‐11 (2), pg. 19

Will the Teaming Agreements be held for the duration of the CRAF contract (potentially six years), or could they be negotiated every two years prior to the renewal?

(2) The term of the agreement shall correspond to the contract terms and period. This means each two (2)‐year period of the contract plus six

(6) months and the entire period of an CRAF activation thereafter.

15 Atch. 4 Fixed Award RFP, Atch 4, ‐‐Section I: (g), (pg. 1) Similar question on bidding Fixed Buy – Will carriers have the ability to rebid every two years?

(g) Fixed awards (also known as Fixed Buy), refers to requirements purchased on a 12‐month basis and awarded via Task Orders on 1 Oct of each Fiscal Year (FY).

16 Atch 12 Ferry Miles Attachment 12, FY19 Fixed Award Routes Ferry Mile Request? Is this a rate or number of miles, etc.? Number of Miles

17 Amendment 0001 Proposed Unit Price Attachment 12, FY19 Fixed Award Routes Tab #3, the Proposed Unit Price, should this field be filled in with the rates from the Uniform Rates document?

No. Tab #3 is for Domestic Activation‐‐Cargo. Offerors proposing rates for Domestic Activation shall complete Tabs #2 and/or #3.

18 RFP

Teaming

Arrangements RFP, Section L‐4 (1), Page 52

Are teams required to provide a single submission via AMRDEC (SAFE), or do team members individually submit their offers?

Does the Government require hard copy submissions?

Teams are to provide a single submission. No hard copies are required.

19 RFP

Domestic Price

Proposal RFP, Section L‐4 (1) c, Page 54

Does the Domestic Activation price proposal take the place of the Domestic Charter Airlift Services contract?

No. The Domestic Activation price proposal is for Domestic CRAF Activation IAW, RFP, Atch1‐PWS, Section A5.7.

20 PWS Cancellation Attachment 1, 1.2.2., Page 10

Why is the Government allowed to accrue one no‐cost cancellation per quarter? This is a unilateral consequence to the carrier and not at consistent with commercial industry practice. At the very least, the carriers should be allowed compensation based on length of notice: Cancellation up to 61 days prior to flight 50% of the total price Cancellation 60‐31 days prior to flight 85% of the total price Cancellation 30 days prior to flight 100% of the total price.

This is the Government's requirement. This requirement is not new and this language was merely transferred from Section H of previous solicitations/award to the PWS.

21 Attachment 12 Notional CLINS Attachment 12

What is the likelihood of all notional CLINs 0110‐0146 being awarded as solicited with later APOE and/or APOD changes?

Carriers will be required to make expensive fleet decisions and investments based on the CONUS to CENTCOM missions being validated.

The requirements are based on the best information the Government has currently. However, please provide as much information as possible in the remarks section of your proposal WRT impact in your ability to perform these missions in the event there are changes.

22 RFP Substitute Service RFP, Section I.1

Please confirm that acceptance of fixed buy CLIN awards will obligate carriers to operate the missions in lieu of subservicing to other carriers under circumstances not caused by delays or unscheduled maintenance.

The CO may authorize substitute service IAW TRANSFARS 5552.247‐ 9002: Contractor's Failure to Provide Service.

23 Attachment 12 Circumnav Attachment 12, FY19 Fixed Award Routes

CLIN’s 0060 and 0073 in this solicitation show a live miles of 16,606 (less than the current CLIN for the “Navy run” [] handle which includes circumnavigation miles – total 19,046). Similarly, also note that 0074 (Navy run less a BAH stop eastbound) mileage does not seem to include the circumnavigation required to get to HDAM.

Appreciate your clarification/confirmation that the mileage for these CLIN’s will include the circumnavigation required into and out of HDAM.

The miles reflected on Attachment 12, FY19 Fixed Award Routes are the number of miles per COINS. Please include any request for circumnavigation miles in the remarks section for that CLIN in your proposal.

24 Attachment 12 CLIN 0074 Attachment 12, FY19 Fixed Award Routes [ ] also would like to suggest that 0074 should include an eastbound stop in BAH/OBBI.

The Government cannot make the requested change on this route.

25 Attachment 12 Initial Task

Order/CLIN 0062 Attachment 12, FY19 Fixed Award Routes

Can you please advise if EGUN will be added to CLIN 0062 (Route 19)?

No revisions are anticipated for CLIN 0062.

26 Attachment 13 Domestic Services Attachment 12, FY19 Fixed Award Routes WRT response 17 above: Given that tabs 2 &/or3 are for Domestic activation, should this spreadsheet actually appear within the Domestic Solicitation then?

The Domestic Solicitation does not include the Domestic CRAF Activation requirements.

27 RFP, Attachment 1, PWS Reliability PWS, Section 2, Service Delivery Summary

If a carrier's 3 month Reliability through September 2018 would have meant they were in the penalty for the month of October 2018 under the current rules for Service Delivery, will they start fresh as of Oct 1, 2018 and only incur penalties under the new language from Oct 1, 2018 going forward?

Yes, Reliability tracking will start fresh on 1 Oct 2018 with the award of a new contract.

28 RFP, Attachment 12 Mission Routing Attachment 12, FY19 Fixed Award Routes Can carriers submit suggestions for more efficient mission routings?

Yes, in writing per the RFP instructions for submitting questions/concerns.

29 RFP, Attachment 12 Initial Task Order/

Entitlement

Attachment 12, FY19 Fixed Award Routes /Attachment 4, Commitment, Entitlement and

Ordering Procedures

On the FY19 contract, given the volume of CLINs being requested, how are the awards going to be made? What we would like to understand is for each CLIN a carrier/team offers on will they receive their entitlement on that CLIN assuming they offer enough to meet their entitlement? There are so many different lines this year that it is difficult to sort through them so the award process needs to be fully understood.

Awards will be made IAW the procedures outlined in RFP, Attachment 4, Commitment, Entitlement and Ordering Procedures, understanding there will likely be exceptions based on coordinating carrier preferences which will be discussed with the carriers prior to final mission assignments.

30 RFP, Atatchment 1 PWS Page 4, Section 1.1.1.2.

Aircraft captain, lead flight attendant should be removed. The charter contractor representative should be the only one that is communicated to – [] believe if all carriers canvassed they do not have crew members being responsibilities other than their own specific duties as outlined in their CBA's.

No change to the referenced paragraph is being made at this time.

31 RFP, Atatchment 1 PWS Page 5, Section 1.1.2.6. PLANNING WEIGHTS

It should be noted that planning weight cannot be used in execution of mission – all weights must be actual passenger and baggage weights along with baggage piece count so there is no confusions as we have seen planning weights provided on manifests.

No change to the referenced paragraph is being made at this time.

32 RFP, Atatchment 1 PWS Page 5, 1.1.2.7.1. LOCATIONS WITH CURRENTLY

CALIBRATED SCALES

Baggage weights and piece count must also be included. No change to the referenced paragraph is being made at this time.

33 RFP, Atatchment 1 PWS Page 05, 1.1.2.7.2. LOCATIONS WITHOUT

CURRENTLY CALIBRATED SCALES;

1.1.2.7.3 ACTUAL WEIGHTS

Actual weights must be used and provided for passengers not just baggage.

No change to the referenced paragraph is being made at this time.

34 RFP, Atatchment 1 PWS Page 07, Section 1.1.4.5.1, Since the domestic contract has no applicability to this requirement, if flight is departing from CONUS, it should be able to following same applicability as domestic contract for domestic departure locations.

No change to the referenced paragraph is being made at this time.

35 RFP, Atatchment 1 PWS Page 08, Section 1.1.10, BAGGAGE SERVICES

What constitutes baggage should be defined. Passenger charters are unable to carry cargo disguised as personal baggage. Should define that cargo type commodities or anything that is not personal baggage as well as non‐ acceptable hazardous goods cannot be carried in baggage.

No change to the referenced paragraph is being made at this time.

ROUND 2

36 RFP, Atatchment 1 PWS Page 08, Section 1.1.10.1, CHECKED BAGGAGE

LIABILITY

Baggage tendered is untraceable, no verification that carrier received missing bag in question. Baggage should be tagged appropriately to verify that carrier received missing bag at point of origin.

No change to the referenced paragraph is being made at this time.

37 RFP, Atatchment 1 PWS

CHECKED BAGGAGE OR DELIVERY CHARGES AND

DAMAGE AND PILFERAGE CLAIMS:

There should be a time frame by which any identifiable loss is identified. Many times claims are made months after mission operated.

No change to the referenced paragraph is being made at this time.

38 RFP, Atatchment 1 PWS Page 09, Section 1.1.10.2 PETS

Where its states “The contractor shall make every effort to ensure the safe passage of pets and ensure pets are loaded last and properly secured prior to departure.” does this mean that all limitations, exclusions and embargo’s for each carrier apply?

No, the Contractor shall comply with the Government's requirements.

39 RFP, Atatchment 1 PWS Page 10, Section, 1.2.1.1 General

All days in the clause refer to calendar days Typically a day starts at 12:00AM and ends 24 hours later at 11:59PM. If counting a “day” starting from some other time during the day, the contract has to specify this. For example, the contract would say that USTC can cancel within 24 hours (1 day) from a specified event, like, from the date/time stamp on the email forwarding the task order to the carrier or define the time of which constitutes the calendar day for clarity.

Section 1.2.1.1. defines "days as a continuous 24 hour period". No change to the referenced paragraph is being made at this time.

40 RFP, Atatchment 1 PWS Page 10, Section 1.2.2.1, 1.2.2.2, 1.2.2.3 NO

COST CANCELLATIONS

There is no such thing as a no‐cost cancellation from a carrier perspective, there is always a cost to the carrier, standard cancelations fees should apply as they do in all commercial contracts for all activity by which an ward has been made, aircraft held and committed, activity planned and crewed. There is always a cost to the carrier which is lost and never recovered. Crews committed must be paid by CBA.

No change to the referenced paragraph is being made at this time.

41 RFP, Atatchment 1 PWS Page 12, Section 1.3 Cargo Services Should note that cargo can only be tendered for cargo flights not passenger flights.

No change to the referenced paragraph is being made at this time.

42 RFP, Atatchment 1 PWS Page 26, Section 4.2.3.1. NON‐AIRCREW

SECURITY CLEARANCES

Overall CRAF planning is very broad. Is this meant to be this broad or meant to be in reference to a CRAF activation or to include any and all peace time flying CRAF contract encompasses by any and all involved with any sort of planning from any one department entity within a carriers operation.

This is meant to include any and all aspects of CRAF planning, preparation and any activation.

43 RFP, Attachment 12 Initial Task Order Attachment 12, FY19 Fixed Award Are you only soliciting B744 aircraft for the passenger requirements?

As of today this is the current ACL requirement, however, carriers may offer aircraft with a lower ACL for consideration.

44 RFP, Attachment 1

PWS

(Cyber Security) Appendix 6‐ Cyber Security Please explain the difference, if any, between CUI and DTI.

The Department of Defense defines CUI as information categorized as "For Official Use Only," "Law Enforcement Sensitive," "Unclassified Controlled Nuclear Information," and "Limited Distribution." While some data that we would share with our Transportation Service Providers (TSPs) could fall into one of these categories, not all data would. But since we are concerned that our potential adversaries could use our DTI to disadvantage us, we require our TSPs to treat all DTI with similar protections under the requirements of NIST 800‐171, as modified by the table enclosed within the contract, "Modified NIST SP 800‐171 Requirements."

45 RFP, Attachment 1

PWS

(Cyber Security) Appendix 6‐ Cyber Security

In the CRAF contract, it was determined the information the government shares is not CUI, does the same hold true for DTI under this contract? If not, please explain the differences.

Department of Defense Manual 5200.01, Volume 4, governs the definition of CUI. Most DTI will likely not be CUI. But there may be data from DTI that also meets the DoD definition of CUI. For example, one of the subcategories of FOUO is Personally Identifiable Information (PII). If USTRANSCOM entrusts PII to its TSPs, the TSPs must protect that PII as it would any other CUI. But since we are concerned that our potential adversaries could use our DTI to disadvantage us, we require our TSPs to treat all DTI with similar protections under the requirements of NIST 800‐171, as modified by the table enclosed within the contract, "Modified NIST SP 800‐171 Requirements."

46 RFP, Attachment 1

PWS

(Cyber Security) Appendix 6‐ Cyber Security

3. If DTI is disaggregated, is it still considered DTI?

a. Since much of this information resides on DoD websites (WAWF, GOPAX, unencrypted emails..), it may be disaggregated when received or certain items are "pulled" from the system.

Even when disaggregated, DTI remains DTI and TSPs must protect under the requirements of NIST 800‐171, as modified by the table enclosed within the contract, "Modified NIST SP 800‐171 Requirements."

47 RFP, Attachment 1

PWS

(Cyber Security) Appendix 6‐ Cyber Security

In addition to the above, please provide specific DTI examples as it relates to this contract for cargo and passenger missions with respect to "planning, ordering, shipping, tracking, and invoicing"

Example DTI could include, but is not limited to, dates, ports of embarkation and debarkation, numbers of passengers, weight or dimensions of cargo, existence of hazardous materials, names and other PII of passengers, load plans, mission ID, cargo descriptors, price quotes, names and contact information of transportation officials, etc.

48 RFP, Attachment 1

PWS

(Cyber Security) Appendix 6‐ Cyber Security

Will DTI be clearly marked to avoid any confusion about what is or what is not DTI?

No; all data the TSP develops or receives from a USTRANSCOM entity while performing this contract is DTI and must be must protected under the requirements of NIST 800‐171, as modified by the table enclosed within the contract, "Modified NIST SP 800‐171 Requirements."

49 RFP, Attachment 12 Initial Task Order Attachment 12, CLIN 0062 Alternative dates were submitted for consideration for CLIN 0062.

The Government is not able to revise the schedule for CLIN 0062 as suggested.

4 paragraph 4

For aircraft that are in the process of a stair‐stepped retirement over the contract period, how are these to be calculated in the carrier’s aircraft commitment requirements? The exact number is fluid and subject to change considerably over the next 2 years. Do we include the fleet as of now or what we expect to have at the end of the contract period?

IAW RFP, Attachment 4, page 1, Section 2, (a) Contractors shall maintain the Government’s minimum CRAF capable aircraft commitment as outlined [within Atch 4] and included on the Appendix 3A. CRAF capability is determined by compliance with the technical performance requirements identified in Section III []. Minimum aircraft commitment shall be maintained during each two‐year period of performance (i.e.

entitlement interval). In the event an assigned aircraft becomes unavailable, the carrier (or team) is responsible for replacing that aircraft in the fleet. Contractor’s fleet build/assignments may be reviewed annually for necessary adjustments based on fleet changes.

Therefore, the committment requirements will be calculated on your fleet as of now.
