The Offeror shall submit a Pre-Deployment Plan which identifies all major actions and timelines required to obtain aircraft; obtain the necessary regulatory certifications; hire and train personnel; obtain and deploy initial required supplies, equipment and spare parts; deploy the proposed aircraft; and performance start.
The plan shall detail the deployment actions in paragraph format, and provide reasonable milestones in chronological order. The Government desires an operational date of on or about 1 January 2017 for the Task Order.
Operational date is defined as the date all aircraft, personnel, and other necessary resources are in place and prepared to fly missions in support of this task order. Offerors proposing aircraft operational dates closer to the desired operational date will be more favored
(3) Volume III: TO Factor 3 – Past Performance. No past performance information is to be submitted for the Task Order. Past Performance Information submitted for the IDIQ will be utilized in the Past Performance evaluation for the Task Order.
(4) Volume IV: TO Factor 4 – Price. Offerors shall submit its proposed pricing for the Task Order on the CA Task Order Price Table, RFP Attachment 7, based on the instructions therein. The unit rates proposed shall not exceed any prices proposed for the IDIQ. Offerors may provide information to support or justify the pricing proposed. The electronic version of proposal shall include the CA Task Order Price Table in Microsoft Excel format to facilitate price analysis. Offerors are not prohibited from submitting a PDF version as well.
4. Submit any questions concerning the RFP in writing. Questions will be answered in writing and provided to all offerors via FedBizOpps. Due to the time required to research questions and provide an answer, questions received less than ten (10) calendar days prior to the due date of offers specified in this solicitation may not be answered. Questions should be submitted in the following format:
Reference: Section ______, Page_____, Paragraph ____ Question:
Questions shall be submitted to:
Ms Denise E. Cameron at denise.e.cameron.civ@mail.mil or Ms Dorothy Delrosario at dorothy.h.delrosario.civ@mail.mil
5. Protest Instructions. Any protests to the agency, as defined by FAR 33.103, shall be submitted to the Contracting Officer at the address provided in the Addendum to FAR 52.212-1 Paragraph (b)(1) above, or electronically to denise.e.cameron.civ@mail.mil.
52.212-1 Paragraph (c) of FAR 52.212-1 entitled “Period for acceptance of offers” is tailored to read as follows:
The offeror agrees to hold the prices in its offer firm for 180 calendar days from the date specified for receipt of offers. Before this expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-1 Paragraph (e) of FAR 52.212-1 entitled “Multiple Offers” is revised to read:
The government will not consider multiple offers presenting alternate terms and conditions for satisfying the requirements of this solicitation.
52.212-1 Paragraph (g) entitled “Contract award (not applicable to Invitation for Bids)” is tailored to read:
The Government intends to evaluate offers and award approximately four contracts without discussions with offerors. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
52.212-1 Paragraph (h) entitled “Multiple awards” is tailored to read:
The Government intends to award approximately four (4) IDIQ contract as a result of this solicitation. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
FAR 52.212-1 Paragraph (l)(7) Debriefing is added:
Debriefings may be provided in writing, orally, or in person, at the Government’s discretion.
(End of Addendum)
FAR 52.212-2 Evaluation – Commercial Items, revised
(a) This provision has been revised in its entirety. Evaluation will occur as follows:
(1) The Government intends to award approximately four (4) Fixed Price Indefinite Delivery Indefinite Quantity (IDIQ) contracts and one Task Order as a result of this solicitation to the responsible offerors whose offers, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered.
The Government intends to award without discussions but may hold discussions if determined necessary by the Source Selection Authority. If necessary, a Competitive Range will be established for the purposes of holding discussions with the most highly rated offerors. Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a price and technical standpoint. Subjective tradeoff procedures will be utilized in accordance with FAR Part 12, Part 15.101-1 Trade-off Process and DoD Source Selection Procedures.
(2) To receive an IDIQ or Task Order award, the offeror(s) must (1) be deemed responsible in accordance with (IAW) FAR Part 9, (2) conform to the required terms and conditions, and (3) represent a best value to the Government, price and other factors considered. Additionally, when US Flag carriers are reasonably available, preference for award will be given to US Flag carriers in accordance with the Fly America Act. These considerations may result in award to a higher rated, higher priced offeror, where the decision is consistent with the evaluation factors and the Source Selection Authority (SSA) reasonably determines that the superior non-price factors of the higher priced offeror outweigh the cost difference. However, the Government will not pay a price premium that it considers to be disproportionate to the benefits associated with the proposed margin of service superiority.
(3) The Government will first evaluate proposals for award of IDIQ contracts. Successful offerors providing DoD Approved Air Carriers for fixed and rotary wing support will receive a contract upon notification of award.
Successful offerors not providing DoD Approved Air Carriers for fixed and rotary wing support will receive a conditional successful offeror notification indicating a contract will be awarded if the Offeror’s fixed and rotary wing carriers are DoD approved within four (4) months from the date of notification. Additional time will be granted if a delay in receiving DoD approval is determined by the Contracting Officer to not be the fault of the carrier. Upon receipt of DoD Approval, a contract will be awarded therefore, the Government anticipates award of IDIQ contracts could be staggered until the DoD Approved Air Carrier process can be completed.
(4) Task Order Eligibility/Award. The Task Order solicited with the IDIQ requires fixed and rotary wing services to be performed by DoD approved carriers. As such, to be eligible for the task order award the offeror must
(1) receive an IDIQ award and (2) at the time of proposal submission, have DoD approved carriers for both fixed and rotary wing services to perform the Task Order. IDIQ award recipients without DoD approved air carriers will not be eligible for future task order awards until DoD approval is received. The Contractor and the proposed air carriers must have a Facility Clearance of SECRET, or higher, to be eligible for award of this Task Order. Award of this Task Order is subject to a continuing need of the Government and availability of funds. Funding may be provided incrementally based upon Congressional appropriations.
(5) The following factors shall be used to evaluate each offer:
Factor 1: Basic Eligibility Factor 2: Technical Capability Factor 3: Past Performance Factor 4: Price
(6) Relative Order of Importance: Basic Eligibility will be rated as Acceptable or Unacceptable. Past Performance is significantly more important than Technical Capability, and when combined, non-price factors are significantly more important than Price. This order of importance is applicable to both the IDIQ and the Task Order.
(b) IDIQ Evaluation. The Government will review each Offeror’s proposal to ensure general compliance with the terms of the solicitation as well as ensure all the necessary documentation has been provided in the Business Proposal as instructed by FAR Clause 52.212-1, Instructions to Offerors, as amended in this solicitation. The Factors will be evaluated in the following manner for the IDIQ:
(1) IDIQ Factor 1: Basic Eligibility: Each Basic Eligibility subfactor will be evaluated on an Acceptable or Unacceptable basis. Offerors must be rated Acceptable for all Basic Eligibility subfactors in order to be eligible for award. Proposals will first be evaluated to determine if they meet the basic eligibility requirements.
(A) Subfactor 1 - DoD Approved Air Carrier. To meet this basic eligibility requirement, the operators of all proposed aircraft must (1) be on the DoD Approved Air Carrier Listing maintained by US Air Force, Headquarters Air Mobility Command (AMC/A3B) at the time of proposal submission, or (2) have submitted the necessary documentation to demonstrate the proposed carriers are eligible for DoD approval at the time of award as determined by AMC/A3B.
(B) Subfactor 2 – Continuous Equivalent Service. To meet this basic eligibility requirement, the Government must determine the proposed carriers have at least 12 months of continuous service, generating revenue, equivalent to the services sought by DOD. In accordance with 32 CFR 861, “Equivalent to the services sought by DOD” means service offered to qualify for DOD approval must be substantially equivalent to the type of service sought by DOD. “Continuous” service means the carrier must have performed revenue-generating services of the nature for which DOD approval is sought. This determination will be obtained from HQ AMC/A3B. (C) Subfactor 3 - Certification Documentation. To meet this basic eligibility requirement, the offeror’s FAA or CAA Certification Documentation must be current and complete as of the date of proposal submission. The offeror demonstrated the proposed aircraft owned by the air carrier was on the aircraft operator’s Operations Specification at the time of proposal submission. Supplemental Type Certificate information, as applicable, was provided and approved by the Federal Aviation Administration (FAA) or Civil Aviation Authority (CAA). The CAA shall be determined by the Federal Aviation Administration as a Category 1.
(D) Subfactor 4 - Aircraft Ownership. To meet this basic eligibility requirement, the offeror must provide proof the carrier owns, or is leasing, the proposed aircraft. In the case of a lease agreement,, the agreement must be current, binding upon both parties if the offeror is awarded a contract, and demonstrate the offeror’s ability to provide aircraft for the entire contract period of performance.
(E) Subfactor 5 - Aircraft Operation and Control. To meet this basic eligibility requirement, the Offeror must confirm (1) the proposed carriers will operate the aircraft proposed for that carrier, (2) the Offeror will have access to commit, task, and employ the proposed aircraft upon receipt of a task order award where such aircraft have been proposed and (3) that response must be consistent with other documents submitted with their proposal.
(F) Subfactor 6 - Fly America Act Preference. Offers shall be evaluated to determine the Fly America Act participant category. Fly America Act participant categories will be assigned as follows (listed in order from highest priority to lowest priority):
Category 1. US Flagged Aircraft (pursuant to, Title 49, Subtitle VII, Part A, subpart I, Chapter 401, 40118-Government-Financed Air Transportation that has been incorporated in to the FAR Part 47.4 Air Transportation by U.S. Flag Carriers).
Category 2. Foreign Flag Aircraft
(2) IDIQ Factor 2: Technical Capability Proposal. The Government will evaluate each offeror’s Technical Proposal and determine to what degree the proposed approach meets or does not meet the threshold performance and capability requirements through an assessment of strengths, weaknesses, and deficiencies of the proposal.
Performance proposed above the mandatory minimums requirements identified in the solicitation may result in a higher rating. In addition to proposed performance and capability requirements, the Government will evaluate the risk for disruption of schedule, increased cost, degradation of performance, the need for increased Government oversight, and/or the likelihood of unsuccessful contract performance. The Government will assign a combined technical/risk rating for each technical subfactor of each eligible offerors proposal in accordance with the table below. The Government will not award to an Offeror having a Red/Unacceptable rating for any subfactors of the Technical Capability factor.
Color Rating RATING DESCRIPTION Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green Acceptable Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red Unacceptable Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
(A) Technical Subfactor 1 - Technical Approach. The Offeror’s Technical Approach clearly describes quality aircraft types, equipment, and personnel which are capable of achieving the objectives of the TASC IDIQ Performance Work Statement (PWS), and specifically addressed each subtask of Task Area 2 Operational Services and Task Area 3 Ground Support. The Aircraft Identification Table lists aircraft which are capable of meeting the fixed wing, rotary wing, and Casualty Evacuation (CASEVAC) requirements. The minimum experience and qualifications identified by the Offeror for pilots, copilots, site leads, and lead maintenance personnel reflect experience and qualifications indicating successful performance in an austere environment. The proposal provides an adequate approach and understanding of the requirement, with little or no potential to cause increased cost or degradation of performance.
(B) Technical Subfactor 2 – Quality Control Plan. The Quality Control Plan describes risk management procedures and an implementation approach that will ensure safe and reliable air transportation in accordance with Federal Aviation Regulation 135 and 32 CFR 861 (PWS para 4.2) . The Quality Control Plan described risk management procedures which mitigate operational risk hazards inherent to air transportation in austere locations.
(3) IDIQ Factor 3: Past Performance. The Government shall evaluate each offeror’s performance information using questionnaires and other performance information to assign each offeror a Confidence Assessment Rating.
Past performance information may be obtained from any sources available to the Government, to include, but not limited to, the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), or other databases; interviews with Program Managers, Contracting Officers, Fee Determining Officials; Defense Contract Management Agency; and commercial sources.
(A) The Government will begin its evaluation by first determining the recency and the relevancy of each past performance effort being evaluated. To be considered a recent effort, the effort must be currently on-going or have been completed within 3 years of proposal submission. The following definitions will be utilized to determine the relevancy of each past performance effort:
RATING DESCRIPTION
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
(B) After the government has determined the recency and relevancy of each past performance effort, the Government will evaluate the overall quality of the Offeror’s past performance. The past performance evaluation does not establish, create, or change the existing record and history of the offeror' s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well (quality) the offeror performed those past contracts. Based upon the recency, relevancy, and quality of the Offeror’s overall performance record, the Government will assign the offeror a single past performance confidence assessment rating as defined below. This rating reflects the Government’s confidence in the offeror’s ability to successfully perform the requirements of the solicitation based on the overall performance record.
RATING DESCRIPTION
Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Unknown Confidence (Neutral)
No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
Limited Confidence
Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence
Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
(C) An Unknown Confidence rating will be treated neither favorably nor unfavorably in any trade-off decision. However, the Source Selection Authority may determine a Substantial Confidence or Satisfactory Confidence rating to be worth more than a Neutral Confidence rating in any best value tradeoff determination.
(D) Offerors may be asked to respond to adverse past performance information to which the offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports a less than satisfactory rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.
(E) In evaluating past performance, the Government will give greater consideration to past performance efforts deemed most relevant to the effort described in this solicitation.
(4) IDIQ Factor 4: Price. The Government will determine whether the proposed IDIQ prices are fair and reasonable, balanced, and realistic.
