SECTION I - SUPPLIES OR SERVICES AND PRICE/COSTS

1.0 CONTRACT TYPE

This will be a multiple award Indefinite-Delivery-Indefinite-Quantity (IDIQ) Contract. The types of Task

Orders (TO) that will be issued against the MFR IDIQ may be Firm-Fixed Price (FFP), Time and Materials

(T&M), or a combination/hybrid of these two (2) contract types, in accordance with Federal Acquisition

Regulation (FAR) Part 16.5, Indefinite-Delivery Contracts. The FFP and T&M CLINs will be established/awarded at the IDIQ level and will be identified as such in the resultant contract Price Tables.

This Contract will be issued in accordance with Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items and FAR Part 15, Contracting by Negotiation for the Department of Homeland

Security to obtain Modular Firing Ranges (MFR) that are non-permanent, meaning that they can be moved, as a temporary structure, or broken down and re-erected at another location. These ranges could be single enclosed modular, mobile, and/or open floor plan configurations.

The Northern American Industry Classification Industry (NACIS) code for this requirement is 332999 All

Other Miscellaneous Fabricated Metal Product Manufacturing.

2.0 PRICING

See Standard Form (SF) 1449 and the Microsoft Excel Attachment B MFR Sample Pricing Template

2.1 Firm-Fixed-Price (FFP) Task Orders

For FFP type task orders, the quantity of each item ordered will be multiplied against the rate listed in the contractor’s catalog price, or as negotiated if lower rates are proposed for the task order; and the cumulative extended total of all items ordered will define the firm-fixed price for task order. Section II Paragraph 3.0

Subparagraph a, b and c shall be procured under a FFP basis.

2.2 Time-and-Material (T&M) Task Orders

For T&M type task orders, the quantity of hours ordered from each labor category will be specified as deliverable hours billable at the ceiling rates specified in the contractor’s catalog price, or as negotiated, if lower rates are proposed for the task order. Other Direct Costs (ODC) will be included under T&M CLINs.

Materials will be estimated for each task order and may include applicable indirect costs computed in accordance with the contractor’s established accounting practices, subject to the indirect ceiling rates established in the contract. For T&M type task orders, profit on materials is not allowable. The cumulative extended total of all labor categories ordered plus materials/applicable indirect costs will define the task order ceiling price. Section II Paragraph 3.0 Subparagraph d shall be procured under a T&M basis.

3.0 BASE AND OPTION PERIODS

The term of this MFR DHS-Wide Multiple Award IDIQ contract is a five (5) years, with a one (1) year base period and four (4) one-year option periods. Task orders may be issued at any time during the base and/or option period. The performance periods will be specified in the task orders and may include option periods which extend task orders up to twelve (12) months beyond the expiration date of this contract.

SECTION II - SPECIFICATIONS/STATEMENT OF WORK (SOW)

Department of Homeland Security (DHS) Office of the Chief Readiness Support Officer (OCRSO)

Modular Firing Range

1.0 BACKGROUND

Across DHS Components there are approximately 72,000 armed agents and officers required by policy to qualify with various firearms on a quarterly, semi-annual, or annual basis, depending on the policy of their respective programs. The agents are located in all 50 states and at minimum, Puerto Rico, Guam, American

Samoa, the United States Virgin Islands, and the Northern Mariana Islands. DHS Law Enforcement programs are having an increasingly difficult time finding adequate ranges for firearms qualifications which are required to maintain a proficiently trained, armed work force. Further complicating the qualification requirements, are the hundreds of locations across the country in which agents and officers are assigned.

Because of geographical dispersion, access to traditional range sites that are government owned and operated are difficult at best as many are shutting down or no longer operational for use which then requires travel funds and overtime for employees to travel to available sites for qualifications. Additionally complicating the situation, many field offices rely on state and local law enforcement agencies and or private or commercial facilities for range services and are subject to their availability and policies.

2.0 SCOPE

The scope of this initiative is to promote a more efficient method for DHS law enforcement personnel to receive firearm certification training across the country by allowing delivery and access to self-contained

Modular Firing Ranges (MFR). Essentially, MFRs are indoor firing ranges that are true 360-degree positive ballistic containment (Service Danger Zone) (ZERO-SDZ), ventilation systems, bullet traps, target systems, shooting stalls, lighting, communications, security access systems, control rooms with ballistic glass viewing windows, range entry vestibules / sound locks, automation systems, anti-ricochet treatments, and comprehensive acoustic treatments.

The equipment is modular, moveable, and scalable to accommodate law enforcement personnel in numerous locations across the country who are required to complete mandatory firearm training requirements based on their respective component policies.

3.0 OBJECTIVE

The objective of this acquisition is to procure firing ranges that are non-permanent, meaning that they can be moved, as a temporary structure, or broken down and re-erected at another location. These ranges could be single enclosed modular, mobile, and/or open floor plan configurations. Any range proposed shall include delivery, turn-key installation, “train the trainer” instructional services and instructional materials, provisions for periodic maintenance services, and emergency repair services.

The Government will seek to procure the capabilities described within this SOW with any combination of the four tracks listed below:

a. Buy/own- no Operations and Maintenance (O&M) services included- To be leveraged only if

O&M capability already exist within specific government entities (FFP)

b. Buy/own- O&M services included (FFP)

c. Fee as a service (lease) (FFP)

d. Emergency O&M services (T&M)

Any elements of the included requirements may be purchased in any combination or as a stand-alone requirement to adequately meet the unique need(s) of DHS. MFRs shall meet all applicable federal regulations, codes, and standards for commercial modular structures and firing ranges, including safety standards from the National Institute of Occupational Safety and Health (NIOSH), American Section of the

International Association for Testing Materials standards, and Occupational Safety and Health

Administration (OSHA), Environmental Protective Agency (EPA), state environmental regulations, and

National Fire Protection Agency (NFPA) regulations. Specific standards and regulations include but are not limited to: regulated waste management, lead and noise exposure, lead dust level testing, fire protection, mechanical, electrical, and plumbing standards.

4.0 REQUIREMENTS

4.1 The Government requires any/or all of the following three (3) types of firing ranges:

4.1.1 Commercially available Modular Firing Ranges:

4.1.1.1 Two lanes per unit minimum.

4.1.1.2 Ability to order in 25 yard, 50 yard, and 100 yard configurations.

4.1.2 Commercially available Mobile Trailer Firing Ranges:

4.1.2.1 Two lanes per unit minimum.

4.1.2.2 Ability to order in 25 yard configurations.

4.1.3 Commercially available open floor plan Modular Firing Ranges for tactical fire firearm qualifications that provides:

4.1.3.1 The ability to move side to side- Personnel shall be able to safely fire at the target area from a distance of 36” to the maximum range distance from anywhere on the range without obstruction.

Short “firing stalls” may be placed for each position at the maximum range distance.

4.1.3.2 6 lane minimum; capable of adding on additional lanes as needed.

4.1.3.3 Ability to order in 25 yard, 50 yard, and 100 yard configurations.

4.2 All three firing range solutions shall require the following types of capabilities, unless otherwise noted:

4.2.1 Personnel shall be able to safely fire at the target area from a distance of 36” to the maximum range distance from anywhere on the range without obstruction. Short “firing stalls” may be placed for each position at the maximum range distance.

4.2.2 Personnel shall be able to fire utilizing left, right, and under-side (i.e. for firing over a horizontal object like a wall or car hood) barricades at each firing position at the maximum range length. For ranges with a maximum distance greater than 25 yards, the range shall be able to accommodate moveable barricades/course of fire that can be placed on each firing line to allow for left, right, and under-side barricade shooting.

4.2.3 The interior of the range floor and walls shall be coated with commercial grade protective material with the ability to be recoated as necessary. The ballistics performance of the walls, floors, and ceiling shall have the capability to redirect small caliber rounds downrange without penetration and ricochet. Each range shall be equipped with walls, floor, ceilings, baffles, and a bullet trap sufficient to contain and absorb the energy from the ammunitions listed in Section II Paragraph 4.6, and options listed in Section II Paragraph 4.7 if requested as an option.

4.2.4 Each firing/target line shall be no less than 42, preferably 48+ inches laterally from the adjacent firing/target line.

4.2.5 Include an external red light, controlled from the master control station, to inform personnel outside the facility that the range is in use.

4.2.6 Include fire protection/suppression, in compliance with NFPA regulations.

4.2.7 Include all appropriate range caution, warning, and hazmat signs in accordance with OSHA standards.

4.2.8 Include land-line communication points (within each separate room, if applicable).

4.2.9 Include a loud speaker system, capable of communicating within the facility, in each room.

4.2.10 Complete interior sound absorption system in compliance with OSHA standards and regulations.

4.2.11 Integrated Heating, Ventilation and Air Condition (HVAC) systems that maintains a negative static pressure of -0.04+/- 0.02 inches of water gauge shall be maintained during range operations.

This gauge shall be visible and produce an audible tone if the pressure drops.

4.2.12 Complete interior lighting system capability of being dimmed to simulate varying low light conditions up to near complete darkness. Dimming shall be controllable from a centralized location and/or mobile control device.

4.2.13 The range shall have supply air and exhaust air, be fully thermostatically climate controlled for heating and cooling which is interlocked to ensure the supply cannot operate without the exhaust system running to ensure the range cannot have a positive pressure. This air flow system shall be delivered from behind the shooter through a full perforated radial plenum. The radial plenum or diffuser shall deliver a constant 50 to 75 FPM of air flow from ceiling to floor and meet the Department of Human and Health Services (DHHS)/OSHA/NIOSH published indoor range requirements.

Distribution of supply air shall be uniform, diffused and a near laminar flow down range to ensure that no lead, smoke, or air-borne particles get back to the shooter. All air shall move the full length of the modular range and shall exhausted in front of and through the bullet traps out through the ceiling and through a multi-stage filtration system. All air shall be exhausted to the outside of the module after being filtered through a minimum 99.97% High Efficiency Particulate Air (HEPA) filtration.

Shall be able to monitor filter integrity.

4.2.14 System shall maintain an interior humidity level between 30% and <50% to prevent health hazards.

4.2.15 The delivery and set up of the MFR to the designated location(s).

4.2.16 Programmable 90 degree turning target retrieval system.

4.2.17 Removable barricades to simulate shooting around and over obstructions.

4.2.18 Blast shield extensions to shelter adjacent shooter.

4.2.19 The Contractor shall provide full details on the warranty(ies) associated with the range.

4.2.20 Training on how to operationally control of the system. (See Section II Paragraph 4.8)

4.2.21 Provide full installation services of the system at sites designated by the government

4.2.22 Instruments to monitor the proper OSHA regulated interior lead & noise levels called out in

Section II Paragraphs 4.13.1 & 4.13.3.

4.3 The Contractor shall, as fully-priced options, include the following:

4.2.1 Blue and red strobe lights in the lighting system.

4.3.2 Retrieval and disposal of the MFR at the end of lifecycle.

4.3.3 Corrosion proof coating on the outside of the unit.

4.3.4 Drainage filters and cable connections/hook ups within concrete slab foundation for locations in hurricane/flood zones.

4.3.5 Vendor to provide site preparation services (pouring concrete pad/piers, install canopies, hook up utilities, and etc.) required prior to installing a system.

4.3.6 Storage areas for targets, miscellaneous items.

4.3.7 Lanes of greater distance at one side of range (i.e. 10 lanes at 25 yds. and 4 lanes of 50 yds.).

4.3.8 Facility shall be able to operate in its environment (i.e. snow, sleet, ice, environmental removal from around site).

4.3.9 Classrooms for weapons training.

4.3.10 Include emergency egress paths that do not require travel downrange from the firing line

(open floor plans only).

4.3.11 External lighting at the front and rear of unit for agent/employee safety and maintenance purposes.

4.3.12 Target retrieval system has the ability to be fully programmable to run scenario-based exercises. The target carrier/retrieval system shall be armored against round strikes.

4.3.13 Programmable 180 degree turning target retrieval system.

4.3.14 Maintenance and operational support of the MFR, to include corrective and preventative maintenance of all components within the unit. See Section II Paragraph 4.10 and 4.11.

4.3.15 Control room with:

1. Control room HVAC needs to be separate from range and any cleaning room HVAC systems.

2. Audio system that allows the range operator to communicate with the shooters.

3. Ballistic glass window to provide operator with a visual view of the firing lanes.

4. A table or shelf shall be provided for all controls, alarms, lighting and communication for the range.

4.3.16 Weapons cleaning room.

4.3.16.1 Weapons cleaning room large enough to accommodate cleaning tables/benches, cleaning materials, and work space for 6 people.

1. Include an emergency eyewash station, with appropriate signage.

2. Include all appropriate range caution, warning, and hazmat signs in accordance with OSHA

3. Be wired to support 220V, 50/60Hz electrical connection. Each outlet shall be marked with the appropriate voltage.

4. Include land-line communication points (as addressed above).

5. Include a public address system, capable of communicating within the facility (as addressed above).

6. Mechanical air handling system shall be included in this option.

4.3.17 Two separate fully plumbed single male/female washroom/restroom facilities, to be incorporated into any other module of the facility and include the following:

1. Include all appropriate range caution, warning, and hazmat signs in accordance with OSHA

2. Be wired to support 240V electrical connection. Each outlet shall be marked with the appropriate voltage. Installation of these outlets shall meet all applicable U.S. codes.

3. Include land-line communication points (as addressed above).

4. Include a public address system, capable of communicating within the facility (as addressed above).

5. Mechanical air handling system shall be included in this option.

4.3.18 Provide services to include disassembly & reassembly of MFR at new sites designated by the government.

4.3.19 General janitorial services.

4.4 Ammunitions:

All firing ranges shall be capable of firing small arm ammunitions up to the following caliber fired from any point in the range:

4.4.1 5.56mm or .223 caliber ammunition fired from an M-4 with a 10.5” barrel up to and including a full-size M-16 both semi and full automatic.

4.4.2 12 Gauge 3” magnum rifled slug fired from an 18” barrel.

4.5 The Contractor shall, as fully-priced options, include the following:

4.5.1 Armor protection rated for:

1. 7.62x51mm (Ball and target ammunition only) Bolt action and AR-10 style rifles.

2. 300 Win Mag Bolt action rifle with up to a 20” barrel.

3. 50 caliber (Ball and target ammunition only) Bolt action rifle and/or Barrett M82A1.

4.5.2 Spent brass/lead cleanup and removal in compliance with OSHA standards.

4.6 Bullet Traps

All impact areas/bullet traps shall:

4.6.1 Mitigate any fragmentation or splash back from rounds fired from the firing points.

4.6.2 Be fully and easily accessible from outside of the facility to aid in maintenance, cleaning, and the removal of spent rounds/projectiles.

4.6.3 Be matte in color to not reflect lights and/or laser aiming devices.

4.7 Facility Deliverables

4.7.1 The Contractor shall provide full design plans and specifications for the facility, including all options, to the Government for approval. The Contractor shall not commence manufacture/construction of the facility until Government approval of the design is received. Any deviation from the approved design plans and specifications that arise during install shall receive prior approval from the Government before implementation of the change.

4.7.2 The Contractor shall provide full technical specifications for electrical, water, sewage, and footer/foundation requirements to allow the Government to prepare the installation site prior to delivery, no less than six (6) months prior to delivery.

4.7.3 Upon installation, the Contractor shall provide full “as-built” drawings and diagrams for the facility, documenting any deviations for the originally approved plans.

4.7.4 The Contractor shall provide full details on the warranty(ies) associated with the range.

4.7.5 The Contractor shall provide a full timeline of events with dates, revising as necessary. The

Government reserves the right to do a first article inspection. Milestones include but are not necessarily limited to:

1. Design completion.

2. Manufacture completion.

3. Delivery to customer location.

4. Completion of installation and turn-key handover.

4.8 Training and Instructional Materials

4.8.1 The Contractor shall develop and provide a course of instruction, complete with lesson plans and instructional materials addressing how to operate the system functionally to include but not limited to: control panel operations, alerts and alarms, lighting, controlling HVAC, on a day to day basis that shall not void any warranty (ies).

4.8.2 The Contractor shall deliver this course with instruction as ‘train the trainer’ for to up to 20 people at regional DHS locations, to be conducted upon completion of installation and turn-key handover of the range facility. This course shall also be available upon future quarterly maintenance

/warranty visits as directed by the government.

4.9 Training and Instructional Deliverables

4.9.1 The Contractor shall submit all lesson plans and instructional materials to the government for approval no less than three months after the award of the contract.

4.10 Operations and Maintenance Services

The Contractor shall, provide the following O&M services, unless noted by the government:

4.10.1 The Contractor shall provide periodic preventative maintenance and repair services for all components associated with the firing range to include HVAC & HEPA filters at the Government’s locations of the firing range. This service plan shall supplement the manufacturer’s warranty(ies), providing coverage throughout the life cycle of the range.

4.10.2 The Contractor shall conduct regular site assessments of the facility, to include lead dust samples, timed with the maintenance visits, to provide the Government with regular feedback on the condition of the range, including future maintenance and repair needs.

4.10.3 The Government shall provide on-site storage space for required equipment, supplies, materials, and components for this maintenance.

4.10.4 To the extent possible, all components and high-wear materials (e.g., target systems, hazardous waste disposal equipment, HVAC filters (including HEPA filters), mechanical belts, Request for Proposal (RFP) HSHQDC-17-R-00052

Modular Firing Ranges Page 11 fuses, lighting, vacuum parts, communication systems components, bullet trap knife edges, etc.)

shall have commercially available replacements.

4.10.5 Contractor shall provide a spare parts list for field expedient repairs of equipment. This list shall include, but not necessarily be limited to, any/all non-commercially available parts for all systems to include vendors, and associated part numbers and stock numbers.

4.11 Maintenance Deliverables

The Contractor shall provide a completed site assessment checklist after each maintenance visit, detailing work performed, to include interior lead dust samples and detailing any identified future maintenance/repair needs, including timelines for those maintenance/repairs.

4.12 Emergency Repair Services

The Contractor shall provide emergency repair services at the location of the firing range upon request by the Government, with Contractor personnel, equipment, and materials to perform the necessary repairs within 1 week of the Contractor receiving the request for services.

Emergency services included but are not limited to HVAC Systems that removes lead dust down range break down, responses to Air/lead quality alarms (OSHA limit) goes off during qualifications, requiring that sound when cleanup services are required , and responses to interior noise thresholds

(OSHA limit) that are breached.

Contractors shall be escorted by designated government personnel throughout duration of emergency repair services.

4.12.1 Emergency Repair Services Deliverables

The Contractor shall provide a completed site assessment checklist after each maintenance visit, detailing work performed and detailing any identified future maintenance/repair needs, including timelines for those maintenance/repairs and projected costs.

4.13 Safety Requirements

All OSHA, EPA, NFPA, American Society for Testing Materials (ASTM) regulations/standards shall be followed to include but not limited to all federal, state, national, and construction standards.

In performing the contract, the contractor shall provide for protecting the lives and health of employees and other persons and for preventing damage to property, materials, supplies and equipment in accordance with the latest revision of the United States Army Corps of Engineers

(USACE) “Safety and Health Requirements Manuals” (EM 385-1-1) and “Occupational Safety and

Health Standards” (29 CFR 1910), ASTM E1728-03, and 2012 NFPA 286 Standard Methods of Fire

Tests for Evaluating Contribution of Wall and Ceiling Interior Finish to Room Fire Growth.

4.13.1 Ambient Noise (OSHA 29 CFR 1910):

1. Ambient noise levels, including the ventilation system noise, at the firing line shall not exceed 85 decibels, A-scale (dBA), and shall be considerably less to improve communication between shooters and the range official.

2. Short duration noise such as gunfire shall exceed the 85 dBA level and may be as high as 160 dBA. The range design shall prevent the reflection of these higher noise levels by using sound-absorbing materials where possible.

4.13.2 Acoustical Treatment (OSHA 29 CFR 1910)

Noise levels outside the range shall not exceed 85 dBA. Lower noise levels may be required depending on the specific uses of adjacent areas.

4.13.3 Airborne Lead within Range (OSHA 29 CFR 1910)

Federal regulations by OSHA (29 CFR 1910.1025) state that the permissible exposure limit

(PEL) to airborne lead in the workplace be limited to 50 micrograms per cubic meter (µg/m3) as a time-weighted average (TWA) over an 8-hour workday.

4.13.4 Lead Dust

Lead dust levels as measured from wipe samples according to ASTM E1728-03 taken behind the firing line, and in support areas adjacent to the range (including training, storage and HVAC maintenance areas) shall be less than 200 µg/ft2.

4.13.5 Carbon Monoxide

Carbon monoxide (CO) exposure levels shall be less than the OSHA 8-hr TWA PEL of 50 ppm

(parts per million) with a targeted goal of 25 ppm which is the 2011 ACGIH threshold limit value

(TLV).

4.13.6 Hazardous Waste

"Lead only'' wastes not sent for recycling shall be properly characterized in accordance with the

Resource Conservation and Recovery Act (RCRA), and managed in accordance with hazardous waste storage, labeling and disposal requirements unless testing proves otherwise.

4.14 Environmental Requirements

In accordance with DHS Directive 023-01 Rev 01 and Instruction Manual 023-01-001-01 Rev 01, Implementation of the National Environmental Policy Act (NEPA) all actions taken under this contract shall be in compliance with all applicable environmental planning laws and regulations, including NEPA. No action or portion of an action, including site preparation activities, may be taken until DHS has completed the appropriate NEPA review.

At the option of the government, vendor may be asked to provide the following:

4.14.1 Due Diligence Investigation:

A limited environmental site assessment that identifies the following: 1) all solid waste management units, hazardous waste management areas, and other environmental regulated points, inclusive of air emissions sources and water resources, within a 100 foot radius of the modular range lay down area; 2) a description and delimitation of any known soil or water contaminant plumes within 100 feet of the lay down area; 3) if the lay down area is an aggregate or unconsolidated media, collect a representative sample within the lay down area to determine if there is existing lead contaminates in the media. The objective of the limited environmental site assessment is to develop the record to demonstrate existing environmental conditions prior to placing a modular range. At the option of the government, vendor may be asked to provide soil sampling to document range usage is not contributing to soil or water contamination. Additionally, at the option of the government, vendor may be asked to provide an update to the limited environmental site assessment upon decommissioning and removal of the modular firing range to document site conditions.

4.14.2 NEPA Documentation:

At the option of the government, vendor may be asked to prepare documentation for utilization by the government to comply with the NEPA. All documentation shall be prepared in accordance with

NEPA, the President’s Council of Environmental (CEQ) regulations for the implementation of

NEPA, DHS Directive 023-01 Rev 01 Instruction Manual on the Implementation of the National

Environmental Policy Act, and DHS Instruction 023-01-001-01, Implementation of the National

Environmental Policy Act. All NEPA documentation shall be fully executed by the government prior to commencing any site activity, including site preparation or staging, in support of placement of a modular firing range. Should site areas be designated as environmentally sensitive by the government, vendor shall ensure the area is properly flagged and refrain from accessing or disturbing the site throughout the duration of this contract.

4.14.3 National Historic Preservation Act Compliance (NHPA):

At the option of the government, vendor may be asked to conduct investigations and prepare documentation for utilization by the government to comply with the NHPA. All documentation shall be prepared in accordance with the NHPA, the most recent guidance from the applicable

State/Tribal Historic Preservation Office, DHS Directive 017-1 Rev 00, Historic Preservation in

Asset Management and Operations, and DHS Instruction 017-01-001 Rev 00, Instruction Guide on the Historic Preservation in Asset Management and Operations. All NHPA compliance requirements shall be fully executed prior to commencing any site activity, including site preparations or staging, in support of the placement of a modular firing range. Should site areas be designated as environmentally sensitive by the government, vendor shall ensure the area is properly flagged and refrain from accessing or disturbing the site throughout the duration of this contract.

4.14.4 Endangered Species Act (ESA):

documentation for utilization by the government to comply with the ESA. All documentation shall be prepared in accordance with the ESA and the most recent U.S. Fish and Wildlife Service guidance applicable to the action. All ESA compliance requirements shall be fully executed prior to commencing any site activity, including site preparations or staging, in support of the placement of a modular firing range. Should site areas be designated as environmentally sensitive by the government, vendor shall ensure the area is properly flagged and refrain from accessing or disturbing the site throughout the duration of this contract.

4.14.5 Clean Water Act (CWA):

documentation for utilization by the government to comply with the Section 404 of the CWA, to include wetlands delineation. All documentation shall be prepared in accordance with the CWA and the most recent U.S. Army Corps of Engineers guidance applicable to the action. All CWA compliance requirements shall be fully executed prior to commencing any site activity, including site preparations or staging, in support of the placement of a modular firing range. Should site areas be designated as environmentally sensitive by the government, vendor shall ensure the area is properly flagged and refrain from accessing or disturbing the site throughout the duration of this contract.

4.14.6 Best Management Practices (BMP):

Vendor shall abide by all appropriate best management practices (BMPs) for the construction and operation of the modular firing ranges. At all times, vendor shall ensure that actions are being conducted in accordance with the appropriate laws and regulations.

4.14.7 Permits:

At the option of the government, the vendor shall obtain all permits necessary for the installation and operation of the modular firing range. Vendor shall abide by all applicable permit conditions in the execution of this contract. At all times, vendor shall ensure that actions are being conducted in accordance with the appropriate laws and regulations.

4.15 Certifications

4.15.1 ISO 9001 Certification for Manufacturing Process Controls of MFRs is required.

4.16 Personnel

Vendor shall provide an overall plan on how the Modular Firing Range program will be managed at the IDIQ and task order level to include but not limited to:

Recruiting and retaining personnel

SECTION III –PACKAGING AND MARKING

1.0 MARKING AND DELIVERY

The Task Order Contracting Officer Representative (TO COR) will approve the method in which Report

Deliverables are to be submitted and marked for delivery by the Contractor. Report Deliverables may be required to be submitted electronically and in hard copy. At a minimum, all Reports/Deliverables should reference the Task Order number for reference.

2.0 BRANDING

The contractor shall comply with the requirements of any DHS Branding and Marking policies. As a matter of law, Federal criminal statutes prohibit unauthorized uses of the DHS seal. In addition, DHS policy prohibits granting authorization for certain commercial uses of the seal. It is permissible to reference DHS in materials if the reference is limited to true, factual statements. The words DHS and/or Homeland

Security should appear in the same color, font, and size as the rest of the text in the document. Moreover, such references shall not imply in any way an endorsement by DHS of a product, company, or technology.

Requests to use the DHS seal shall be submitted using DHS Official Seal Usage Approval, available from the COR. SECTION IV – INSPECTION AND ACCEPTANCE

1.0 TEST, INSPECTION AND ACCEPTANCE

Each system delivered shall include setup, commissioning, and training performed by the modular containerized range supplier which will be accomplished on customer’s site.

Inspection and acceptance of the MFR shall be conducted by the government with the contractor present at the MFR site. Acceptance tests shall be scheduled to begin immediately after the contractor notifies the CO that installation is complete and all systems are fully functional. Acceptance shall consist of:

1.1 Functional Test.

Acceptance shall consist of a functional test of the lighting system, warning lights and alarms;

HVAC system; electrical power, connections, switches and outlets; bullet traps and bullet trap containment areas, target retrieval system, communications systems, and fire and smoke alarms.

1.2 Exit Criteria.

Exit criteria for acceptance shall be no deficiencies in this functional test, successful completion of the configuration verification and physical inspection and delivery of the required documentation.

Acceptance testing and system testing. The following tests shall be conducted to ensure effective operation of the ventilation. Should any items not work as required a detailed report with pricing shall be provided with a recommended schedule to get the MFR to 100% operational condition.

1.3 Smoke Tests

The contractor shall provide either a fog machine or “smoke bombs” in sufficient supply to complete testing. Release smoke in each lane along the entire height (between 1' and 5' off the floor). All smoke shall move from the MFR firing line to the bullet traps. Smoke going backwards between the shooting stalls and the bullet traps shall constitute failure of acceptance.

1.4 Air Flow Measurements

Design air flow at the firing line shall average 75 ft/min (feet per minute) plus or minus 10%. Air flow readings taken at shooters breathing zone levels for typical firing positions shall read no lower than 50 ft/min for each range shooting lane. Smoke tests at the firing line shall exhibit laminar flow to downrange locations. Lingering smoke or smoke that moves up range into a shooting stall shall require evaluation of corrective measures. The minimum air flow downrange of the firing line is 30 ft/min.

New systems shall be purge flow (once-through) systems only, unless recirculation is approved by

DHS environmental personnel. Approval is contingent upon demonstrating significant engineering solutions to maintain lead dust levels within established regulatory standards. Existing recirculation systems shall be allowed if they conform to the airflow requirements and are instrumented to detect operation outside of design parameters.

SECTION V – DELIVERIES OR PERFORMANCE

1.0 AUTHORIZED USERS

This Department-Wide Acquisition Contract is mandatory for use by the DHS and its Components in accordance with DHS Directive 060-01, Development and Use of Strategic Sourcing Contracting Vehicles, dated 8/24/12. DHS Component(s) Head(s) of Contracting Activity (HCA) that use another Federal agency to provide contracting support services may delegate procurement authority to allow the use of MFR contracts on the Component’s behalf.

2.0 MINIMUM DOLLAR AND MAXIMUM CONTRACT LIMITATION

(a) Minimum. The minimum guaranteed award amount for this IDIQ contract is $2,500.00 per contractor. Orders beyond the minimum will be determined by user needs. The exercise of the option period does not re-establish the contract minimum.

(b) Maximum. The maximum cumulative dollar ceiling value of all contracts in this multiple award procurement is established at $207 million.

(c) The Government has no obligation to issue TOs to the Contractor beyond the amount specified in subparagraph (a) of this clause. Once the conditions of subparagraph (a) have been met, the Contractor will continue to have the opportunity to be issued TO(s) under the Fair Opportunity to Compete provisions in Section

VI, Contract Administration Data.

3.0 PERIOD OF PERFORMANCE

The period of performance for this IDIQ Contract is five (5) years consisting of a base year and four (4) one

(1) year option periods to be exercised at the discretion of the Government.

Base Period November 17, 2017 to November 16, 2018

Option Period One November 17, 2018 to November 16, 2019

Option Period Two November 17, 2019 to November 16, 2020

Option Period Three November 17, 2020 to November 16, 2021

Option Period Four November 17, 2021 to November 17, 2022

4.0 TASK ORDERS PEFORMANCE PERIOD AND PRICING

Task orders may be issued at any time during the base and/or option periods. The performance period will be specified in the TO and may include option periods which enable a TO period of performance up to twelve (12) months beyond the expiration date of this contract. Task orders shall be priced using the rates provided in Section I, Supplies or Services and Price/Costs, that will be applicable to the task orders anticipated period of performance.

5.0 PLACE OF PERFORMANCE

The primary place of performance shall be specified at the Task Order level. The Department of Homeland

Security Government’s facilities locations include but not limited to all 50 states and at a minimum, Puerto

Rico, Guam, American Samoa, The United States Virgin Islands, The Northern Mariana Islands, and other

CONUS and OCONUS locations.

6.0 HOURS OF OPERATION

Hours of operation will be specified at the Task Order level. There may be occasions when Contractor employees shall be required to work other than normal business hours, including weekends and holidays, to fulfill requirements under this SOW.

7.0 DELIVERABLES AND DELIVERY SCHEDULE

All deliverables shall reference the IDIQ Contract number and the Task Order number. The contractor shall ensure that the Government will review all final deliverables to ensure accuracy, functionality, completeness, professional quality, and overall compliance with government policies, regulations, laws, and directives. Written documents shall be concise and clearly written.

7.1 Final documentation deliverables shall be provided in hard and soft copy using MS Office products as specified below. Daily, weekly, interim, informal deliverables and working-copy products may be provided by e-mail or disk, as arranged.

7.2 All DHS training materials (visual, digital, or print) shall use official DHS branding in accordance with DHS office of Public Affairs Brand and Identity Program Policy. Use of Contractor branding and logos shall only be used with permission from the DHS COR and shall not be used in conjunction with the DHS branding.

7.3 The Contractor, or Contractor’s carrier shall distribute items directly from the Contractor or

Contractor’s facility to the address(es) specified by the requesting organization at the time of order.

Delivery instructions of MFRs and O&M Services will be specified at the Task Order level.

8.1 Subcontracting Plan Reports

Large Businesses shall submit semi-annually reports which show compliance with their MFR IDIQ

Contract small business subcontracting plan. The Contractor shall submit its report via the electronic

Subcontracting Reporting System (eSRS) in accordance with the instructions on the website. The

Contractor shall ensure that their Subcontractors agree to submit its report via the eSRS when applicable. The Individual Subcontracting Report (ISR) and the Summary Subcontracting Report

(SSR) are available online at http://www.esrs.gov.

The work of the small businesses identified in the Subcontracting Plan shall be tracked against the

Prime’s proposed goals.

9.0 PRODUCT UPGRADE

9.1 The Contractor shall ensure continuity and availability of all products under the terms and conditions of the contract. When a Contractor’s product has changed, as a result of new technology or if the product is no longer available (e.g., discontinued production), the Contractor shall propose a replacement product, or equal or greater capabilities/value.

9.2 The Contractor shall be allowed to replace the product(s) on the contract once per option period. The new technology shall be approved by the IDIQ Level COR and IDIQ Level CO. Under no circumstances shall DHS incur additional costs for product upgrades, unless the cost variance is approved by the IDIQ Level COR and IDIQ Level CO and incorporated via formal contract modification.

9.3 Upon approval of a product upgrade, the Contractor shall retain resources necessary to meet all Task

Order requirements for the legacy product(s). If resources are not available to meet all requirements for the legacy product(s), the legacy product(s) shall be replaced with the Contractor’s new product to meet the requirements of the existing Task Order, at no additional cost to the Government.

10.0 GOVERNMENT FURNISHED INFORMATION

Government Furnished Information (GFI). The Government may provide information (e.g., technical data, applicable documents, plans, regulations, specifications, etc.) in support of a specific task. Such GFI will be specified in individual TOs.

The warranted IDIQ Level CO is the only person authorized to issue modifications to this MFR

IDIQ Contract. If the Contractor makes any Contract changes at the direction of any person other than the IDIQ Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the Contract to cover any increases in charges that may result. The IDIQ Contracting Officer has the authority to perform any and all post-award functions in administering and enforcing the IDIQ Contract in accordance with its terms and conditions.
