52.212-2 Evaluation—Commercial Items (Jan 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer/quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

1. Past performance

The technical evaluation factors other than price, when combined, are approximately equal to price. Price will not be a numerically weighted factor in the evaluation of proposals. If the two or more highest rated technical proposals are considered to be essentially equal in terms of technical competence, price may become the determinative factor in making an award.

Ratings: All technical factors will be rated using an adjectival approach utilizing the following adjectival ratings: Excellent, Good, Satisfactory, Marginal or Unsatisfactory. An Unsatisfactory proposal will not be considered for award.

PAST PERFORMANCE:

The past performance evaluation will take into account the guidelines outlined at FAR 15.305(a)(2) Past Performance Evaluation. The Contractor’s past performance will be evaluated according to the following factors and questions:

Quality of Product or Services Did the customer get what was specified?

Did the customer consider the final product high in quality?

If warranty issues arose, were they promptly corrected?

Timeliness of Performance

Was the contract completed on time? If not, reason why not (growth work, contractor delay, Government delayed?)

Business Relations

How was the customer service?

Was the Contractor committed to customer satisfaction?

Would you use this company again (Why/Why not)?

Subcontracts Were subcontractors involved? Comments?

PRICE –

(a) Award, if made, will be made to the responsible offeror whose proposal, conforming to the solicitation, is determined to be the best value to the Government, past performance, performance risk, price and other factors considered. In selecting the best overall offer, the Government will consider the value of each offer in terms of the evaluated technical quality offered for the price. The relative quality of offerors will be based upon their ability to meet or exceed the minimum performance requirements of this solicitation resulting in less risk of nonperformance, defective performance, and late performance under the resulting contract. The quality in technical offers will be compared with differences in the overall price to the Government.

EVALUATION OF PRICE:

FOR THE PURPOSES OF EVALUATION, The total evaluated price of the offer will be determined by totaling the proposed prices of all the definite items, plus offer price for optional items, plus the composite labor hour extended total.

(1) DEFINITE ITEMS: These are the items, which, if there is an award at all, will be awarded. The proposal shall be evaluated to include the price for each definite item.

(2) OPTIONAL ITEM: These items may be awarded if funds are available or become available. NOTE: Evaluation of the optional items will not obligate the Government to exercise them.

(3) COMPOSITE LABOR HOUR RATE: The proposal shall be evaluated to include the proposal price for the Composite Labor Hour Rate multiplied by the estimated quantity of hours.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) The Government reserves the right to award a contract on the basis of evaluation of the original submission without discussions or call for Final Proposal/Quote Revisions.
