52.212-3 Information Regarding Responsibility Matters (Jan 2011)

(a) Definitions. As used in this provision—

“Administrative proceeding” means a non-judicial process that is adjudicatory in nature in order to make a determination of fault or liability (e.g., Securities and Exchange Commission Administrative Proceedings, Civilian Board of Contract Appeals Proceedings, and Armed Services Board of Contract Appeals Proceedings). This includes administrative proceedings at the Federal and State level but only in connection with performance of a Federal contract or grant. It does not include agency actions such as contract audits, site visits, corrective plans, or inspection of deliverables.

“Federal contracts and grants with total value greater than $10,000,000” means—

(1) The total value of all current, active contracts and grants, including all priced options; and

(2) The total value of all current, active orders including all priced options under indefinite-delivery, indefinite-quantity, 8(a), or requirements contracts (including task and delivery and multiple-award Schedules).

“Principal” means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).

(b) The offeror [ ] has [ ] does not have current active Federal contracts and grants with total value greater than $10,000,000.

(c) If the offeror checked “has” in paragraph (b) of this provision, the offeror represents, by submission of this offer, that the information it has entered in the Federal Awardee Performance and Integrity Information System (FAPIIS) is current, accurate, and complete as of the date of submission of this offer with regard to the following information:

(1) Whether the offeror, and/or any of its principals, has or has not, within the last five years, in connection with the award to or performance by the offeror of a Federal contract or grant, been the subject of a proceeding, at the Federal or State level that resulted in any of the following dispositions:

(i) In a criminal proceeding, a conviction.

(ii) In a civil proceeding, a finding of fault and liability that results in the payment of a monetary fine, penalty, reimbursement, restitution, or damages of $5,000 or more.

(iii) In an administrative proceeding, a finding of fault and liability that results in—

(2) If the offeror has been involved in the last five years in any of the occurrences listed in (c)(1) of this provision, whether the offeror has provided the requested information with regard to each occurrence.

(d) The offeror shall post the information in paragraphs (c)(1)(i) through (c)(1)(iv) of this provision in FAPIIS as required through maintaining an active registration in the Central Contractor Registration database at http://www.ccr.gov (see 52.204-7).

(End of provision) C.

Pages 45 through 46 of the solicitation are revised as shown on the attachment to the Amendment. Offerors are advised to utilize these pages when submitting their proposal to the solicitation.

The responses to the following Request for Clarifications are as follows:

QUESTION NO. 1:

SF-1449, Block #8, Standard Form 1449, block #8 of this Request for Proposal shows an offer due date of 04/28/11 2PM; pre-solicitation dated 3/25/11 as well as solicitation dated 3/31/11 on www.fbo.gov is showing response due date of 4/29/11. Which is the correct date?

ANSWER:

Offerors are advised that the due date to submit proposal for this requirement is 29 April 2011 at 2:00 P.M., Pacific Standard Time.

QUESTION NO. 2:

D-Item-01, Temporary Services/Provide, paragraph 3.3.8; sub-paragraph 3.3.8 under Table 1 of D-01 mentions heavy lift equipment usage 7 days/or 40 hours. Contractor computation is 7 days x 8 hours = 56 man-hours. Please specify what is the correct heavy lift equipment usage requirement. Is it 56 man-hours or 40 man-hours?

ANSWER: This temporary service is for all lifts not included anywhere else in the contract for the convenience of the cutter. Since the contractor is already on site it helps the cutter to be able to have easy access to heavy lift equipment. The cutter will work with the contractor to ensure an easy and smooth working relationship and will usually request the use of the equipment at least 24 hours in advance. Since most of the Coast guard lifts are simple they are done around the contractor’s schedule, instead of having a full 8 hour work day of lifts. This is why only 40 hours is cited. Therefore this item is requesting the use of heavy lift equipment for up to 7 separate days or 40 hours of equipment usage time, whichever one comes first.

QUESTION NO. 3:

D-Item-05, M/E Lifting & Realignment Crankline Repairs, paragraph 3.1.2; paragraph 3.1.2 states “The contractor shall provide the services of two technical representatives, a technical representative to oversee engine alignment and repairs…etc.” Can the Government specify by company’s name(s) the two technical representatives needed to oversee engine alignment and repairs? Further reading of this particular work item only identifies Fairbanks Morse Company; if so the second technical representative is unknown or unclear.

ANSWER:

Revision 1 of the specification will clarify this matter. Revision 1 is incorporated and is available as an attachment to the amendment. In summary. there are 3 main technical representatives referred to for this requirement: a Fairbanks Morse (FME) technical representative, alignment technical representative, and Coast Guard technical representative. The key milestones during the contract performance period is when the FME and alignment technical representatives are needed as indicated in the specification and the CG technical representative should be present for the majority of the contract period.

NOTE: If the awarded Contractor has the capability to do an alignment they can also be the technical representative. However, if the contractor does not have the capability they must provide a subcontractor as the technical representative and still meet the requirements of the specification. As stated on page 34 and 44 of the specification, the specific requirements for the engine alignment and laser alignment tool are outline.

QUESTION NO. 4: D-01, Temporary Service Provide, Table 1, paragraph 3.3.8

Heavy Lift Equipment 7 days/or 40 hours, please define this request, is this for a forklift or crane? What capacity? Duration/frequency 7 days in a row or 40 separate 1 hour lifts, every other day?

ANSWER: See response to Question #2 above. Additional guidance is given in the SFLC Standard Spec paragraph 3.3.8. Also, as further clarification the Coast Guard primarily would like a crane that is able to make lifts in and out of the turbine plenum chamber. The main convenience of this temporary service is to avoid the administrative burden of extra condition found reports.

QUESTION NO. 5: Work Item D-03, No. 1 Main Diesel Engines Lube Oil Coolers, Clean & inspect for Debris, paragraph 3.3.1 makes reference to MDE Flushing, is that covered by a separate contract?

ANSWER: MDE flushing as referred to in D-03 paragraph 3.3.1 has been changed to wiping with lint free rags. The Coast Guard may decide to contract out a separate full hot oil flush it it is determined it is needed at a later time.

QUESTION No. 6: Work item D-04, No. 1 Main Engine Repairs, paragraph 3.8.1 makes reference to “Main Diesel Engine Lube Oil Flush” as included in this package, however, no such item is included?

ANSWER: As stated above answer to Question #5, the flushing requirement was removed and only a cleaning with lint free rags is required after the machining work is done.

QUESTION No. 7: Work Item D-04, No. 1 Main Engine Repairs, paragraph 3.3.2 states “A copy of the Fairbanks Morse Technical Representative’s damage assessment and repair recommendations is included at the end of this specification item”. This is not included, please provide.

ANSWER: These documents are incorporated to this amendment as an attachment.
