1) The deadline for submitting questions is set as August 24, 2016.
2) DELETE Amendment 0001 Section L.20 Proposal Submission Instructions, REPLACE with the following:
L.20 PROPOSAL SUBMISSION INSTRUCTIONS
GENERAL INSTRUCTIONS
(i) Executed SF1442. Offeror shall insert its company name and address in Block
#14, telephone number in Block #15, acknowledge all amendments in Block #19 (if applicable), name and title of person authorized to sign in Block #20A, signature in Block #20B, and offer date in Block #20C of the SF1442. In addition, offeror shall provide the DUNS Number, CAGE code, and Federal Tax ID number with its proposal. If proposing as a joint venture, offerors shall provide the DUNS Number and Cage code for the JV and the members of the joint venture. Offerors shall ensure acknowledgement of amendments.
(ii) Phase I Proposal Format: Do not exceed the page limitations set forth below.
Non-Price Proposals will be 8 ½” x 11” paper except for fold outs used for charts, tables or diagrams which may not exceed 11” x 17”. A page is defined as one face of a sheet of paper containing information. Typing shall not be less than 12 font, Arial. Total page limitation for non-price proposal is 56 pages. Past Performance Questionnaires/CCASS/CPARS forms, and Organizational Chart are excluded from the page limitation.
(iii) SAM registration. Offeror, including Joint Venture (JV) offerors (registration must state the NAME of the JV) shall ensure current registration on the SAM Website, www.sam.gov, including Annual Representations and Certifications are complete and updated for this procurement. If a Representation or Certification as required by the RFP is not provided in SAM, include the representation or certification in your price proposal.
(iv) FAPIIS Certification. Offeror shall ensure Federal Awardee Performance and
Integrity Information System (FAPIIS) Certification as required by FAR 52.209- 7, Information Regarding Responsibility Matters (July 2013).
(v) VETS-4212 registration. Offeror shall ensure a current VETS-4212 report has been submitted to the Department of Labor website https://vets4212.dol.gov/vets4212 if the offeror is required to submit. An email confirmation of submission can be requested and received by the offeror from the DOL website and submitted in the price proposal. If the offeror is not required to submit a report to VETS-4212, include a brief statement stating that the offeror is not required to submit a report. Visit the VETS-4212 website at https://www.dol.gov/vets/vets4212.htm for details concerning if your company is https://vets4212.dol.gov/vets4212 https://www.dol.gov/vets/vets4212.htm required to submit a VETS-4212 report and to request an email confirmation of submission.
(vi) Note: The SAM, FAPIIS and VETS-4212 registrations must be in the name/CAGE/DUNS of the offeror identified on the SF1442.

The Government must receive your proposal no later than the time and date specified in Block 13 of Standard Form 1442.
Instructions for preparation and organization of Phase I proposals are summarized below. Phase II proposal instructions will be provided after the completion of Phase I via amendment In order to effectively and equitably evaluate Phase I proposals, the Source Selection Evaluation Board must receive information sufficiently detailed to clearly describe the offeror's technical approach and performance capabilities.
“SPECIFIC PHASE ONE INSTRUCTIONS
Offerors are to submit proposals entitled “NMACC Phase One Volume #1 Proposal” in three ring binders to include the SF1442, SAM, Section K Completed Representations and Certifications, VETS-4212, and documentation addressing Phase One Evaluation Factors - (1) Corporate Experience, (2) Design/Build Management Approach, (3) Capacity to Support the DHS/Coast Guard, (4) Past Performance, (5) Safety Strategy, and DART Rating, and (6) Organization and Key Positions. Provide one original hard copy and three hard copies in binders. Tabs need to clearly identify each section of the binder. Also include a compact disc that has the proposal on it. Offerors must adhere to the Evaluation Factor page limits and requirements.”

Further Request for Information Received:
26) On page 27 of 88, under item H.22 Subcontracting Plan, it states if the offeror is a large business they must submit a Small Business Subcontracting Plan per FAR 52.219-9. Also, in Section J, Attachment J.3, Sample Subcontracting Plan is provided. Is a Small Business Subcontracting Plan required in the Phase I submittal? If so, where does it go in the Phase I document?
ANSWER: The Small Business Subcontracting Plan will a required submission in Phase II.
27) In Section J, on Page 49 of 88, Attachment J.4 is referred to as OFCCP Participation Goals for Minorities and Females. Later, on Page 62 of 88, it appears that a link to an Adobe Acrobat file was pasted into the RFQ file but it can’t be opened. Can Attachment J.4 be provided to offerors?
ANSWER: See Amendment 0002 language above
28) Starting on Page 63 of 88 and running through Page 71 is Section K, Representations and Certifications. Are executed copies of these Representations and Certifications required in the Phase I submittal? If so, where do they go in the Phase I document?
ANSWER: See Amendment 0002 language above
29) On Page 79 of 88, item L.18 Bonds, we are told a Bid Guarantee is required (20% or $3M whichever is less). Note that item 13b on the SF 1442 is also checked indicating that an offer guarantee is required. Is a Bid Guarantee required in the Phase I submittal? If so, where does it go in the Phase I document?
ANSWER: This will be a Phase II submission requirement.
30) On Page 79 of 88, item L.19 Instructions for Submitting Questions Regarding Solicitation, instructions are provided for asking questions, but no deadline for submitting them is provided.
When is the deadline for asking questions?
ANSWER: Deadline for submitting questions will be set for August 24, 2016.
31) At the bottom of Page 79 of 88, under item L.20 (i) Executed SF 1442, are instructions on completing this form. Is an executed original of the SF 1442 required in the Phase I submittal? If so, where does it go in the Phase I document?
ANSWER: See Amendment 0002 language above.
32) On Page 80 of 88, the next to last paragraph under item L.20 states “Submit your proposal packages to the Facilities Design and Construction Center, at the address shown in Block 8 of Standard Form 1442.” Block 8 (Address offer to) of the final SF 1442 says See Section L. Can you please confirm the address where offers should be submitted?

33) We would like a clarification on several answers provided in Amendment 0001. The Government’s answer to Question 12 was No (regarding submitting FAPIIS Certification with proposal). Later the Government’s answer to Question 23 is again No (indicating that items including SF 1442, DA 4073, Reps/Certs, FAPIIS and VETS-4212 responses do not count against the page limits). Then the Government’s answer to Question 25 clarifies what specific entities must submit Reps/Certs, FAPISS and VETS-4212. If FAPISS information is in fact not required (per the answer to question 12) then why wasn’t this explained in the answers to Questions 23 and 25? We are going with the answer to Question 12 which says FAPISS information is not required in the Phase I submittal, please confirm.
ANSWER: Offerors should submit the SF1442 with Phase I proposal. FAPIIS: It is sufficient to complete and submit FAR 52.209-7 as part of Section K - Representations and Certifications.
Representations and Certifications, SAM Registration, and VETS 4212 Registration are to be submitted with Phase I proposal and placed behind the SF1442. These do not count towards the page limit.
34) Factor 1, Corporate Experience, page 82: If the offeror has an executed teaming agreement with a key subcontractor, can we use past relevant projects completed by the key subcontractor as offeror experience? If yes, where would the Government like the offeror to place the teaming agreement within the proposal?
ANSWER: The executed teaming agreement should be included behind the SF1442 within the proposal. The teaming agreement does not count towards the page count. See Amendment Language regarding past relevant projects.
35) Factor 1, Corporate Experience, page 82: At this Phase 1 stage, would Letters of Commitment suffice for key subcontractors, and would their past relevant projects be considered with the same relevancy as any other project?
ANSWER: Letters of Commitment should be included behind the SF1442 and do not count towards the page count. See Amendment Language regarding relevant projects.
36) Factor 1, Corporate Experience, Section B. Design Team: RFP states that “one page of photographs may be provided with each EIF.” Will the government allow one page of photographs for all proposed EIFs or only for design EIFs?
ANSWER: The Government will allow one page of photographs for all EIFs. The one page of photographs will not count towards the page count.
37) Factor36, 1 Corporate Experience Section A Construction Team Experience: Will projects that feature design-build scope relevant to the projects types outlined in Section C.1. Scope of Work yet are slightly above the $4-$100M dollar range be considered relevant or non-relevant?
ANSWER: The Government will consider design-build scope relevant projects with dollar values above the specified range as relevant.
38) Factor 4 Past Performance: Please confirm that the offeror can use PPQs obtained in previous procurements as stated on page 86 of the solicitation. If so, and we have a copy of that completed and signed PPQ in our possession, please clarify that these PPQs do not need to be sent in the Contract Specialist on 9/6/16 and may be submitted within our proposal on the proposal due date.
ANSWER: Offerors may submit copies of PPQs obtained in previous procurements with the proposal on proposal due date. Only new PPQs being filled out for this procurement must be sent, by person filling out the PPQ, directly to the contract specialist on 9/6/16.
39) Section M.3, Factor 1a, Construction Team (iii) on page 83, discusses providing projects the construction/design team has worked on together. Do these have to be completed projects or can they be ongoing projects?
ANSWER: Offeror may submit ongoing projects; however, the project must have been ongoing for a minimum of a year.
40) Are ongoing construction projects acceptable for M.3, Factor 1a. Construction team (i) or do they have to be completed projects?
ANSWER: Offeror may submit ongoing projects; however, the project must have been ongoing for a minimum of a year.
41) Please confirm that a project submitted for Factor 1 that diplays scopes of work listed within FAR 2 or NAICS 236220 but are not directly listed within the C.1 scope of work will be considered relevant and similar scope as a project submitted which shows experience as directly listed in C.1 scope of work.
ANSWER: The Government will consider projects demonstrating experience with scopes of work defined in FAR 2 or NAICS 236220 as relevant; however, may not be considered as having a similar scope as those outlined in C.1.
42) Section L.17 Joint Venture (JV) Agreements, pages 78 and 79 of 88: Offeror is an existing joint venture with its own EIN, DUNS, and CAGE Code. The offeror joint venture is also registered in Systems for Awards Management (SAM). The existing Joint Venture Agreement (JVA) includes items 1a through and including 1e, pages 78 and 79 of 88, and the date of the JVA was executed. While the JVA has been executed by each partner to the joint venture, pursuant to the law under which the joint venture was created the signatures of the joint venture partners to the JVA are not notarized. Please confirm that a notarized declaration under penalty of perjury, that is, a statement under oath, by each corporate member who executed the JVA, stating that joint venture is in compliance at the time of proposal submission with all applicable laws, rules, and regulations and that he/she is the corporate official who executed the JVA will suffice.
