The purpose of this amendment is to:

• Reply to questions regarding subject solicitation.

• Replace B.1 Determination of Incentive Fee in its entirety.

• Remove reference to Proposal Requirements to provide Transition

Plans in Section L.9 General Instructions for the Preparation of Proposals Paragraph B Section 3 and Section M.

• Delete the third paragraph in H.19 Security Requirements

1. Reference: FAR 52.222-41 SERVICE CONTRACT ACT OF 1965 is incorporated in the RFP and requires the successor contractor to pay service employees no less than the wages and fringe benefits provided for in the applicable Wage Determination (WD) or Collective Bargaining Agreement

(CBA).

Request: CBP provide applicable Wage Determination (WD) and Collective Bargaining Agreement (CBA).

Answer:

Go to web site: http://www.wdol.gov/ to answer all questions concerning the Dept of Labor wages. The locations for this procurement are Nueces County, TX and Duval County, FL., as well as any proposed sites.

2. Question: Is there reference documentation on CARMAC and associated software tools? How can such documentation be reviewed?

Answer:

The CARMAC Users Manual is posted as part of this amendment. (see attachment 1)

3. Reference: Solicitation, Page 2, “Material and Aircraft Repairable”, Page 23, “Operational Performance Incentive”

Request: CBP provide Demand history for GFE and CFE Material and Aircraft Repairable items by year for last 5 years.

Answer:

Request: CBP provide Reparable fill rate by year for last 5 years

4. Reference: Solicitation Section B1, Page 23, “Incentive fees” – no reference is made to the depot performance fee in this section, including the incentive fee calculation examples, as is referenced in the QASP Pages 19 and 21

Question: Is there a depot management incentive fee that needs to be added to section B?

Answer: No

5. Reference: Solicitation, B.1 Determination Of Incentive Fee – Pages 23 & 24

– “During each quarter, the Government will inspect at least 34 aircraft.”

These inspections will be conducted by the Government on a no notice basis.

For each aircraft that fails a Government inspection, the contractor will forfeit one-third of the earned fee earned for that quarter. If three aircraft fail an inspection, 100 percent of the fee earned for Launch Rate and Mission Completion for that quarter is forfeited. See Tab 8 of Attachment 2 (Government Aircraft Inspections) for details.

Request: Please provide Tab 8 of Attachment 2 and any other pass/fail criteria for the aircraft inspections.

Answer:

Section B.1 has been replaced in its entirety. (see attachment 2)

6. Reference: Solicitation, Section M, M.3 “Evaluation Criteria,” Page 92 states “…Proposal Risk and Past Performance are of equal importance and are more important than Cost/Price. Within the Proposal Risk factor, the subfactors are listed in descending order of importance. Evaluation factors and subfactors are as follows:

Factor 1: Proposal Risk

Subfactor 1: Program Management

Factor 2: Past Performance

Section M, M.3 “Evaluation Criteria,” Page 93 states “… A Proposal Risk Rating (Table 1) will be assigned to each subfactor under the Proposal Risk Factor, i.e., Program Management and Transition.”

This is in conflict with section L, Page 89, which we assume to be correct.

Recommendation: Under Section M, Factor 1: Proposal Risk, Page 92:

- Change Subfactor 1 “Program Management” to “Technical Approach” to match Section M to Section L

- Add new Subfactor 2 “Transition”

Answer:

Transition is not a subfactor and is hereby removed from cited paragraphs.

7. Reference: Performance-Based Statement of Work, Page 8, Section C.5.2.9 “Aircraft Support Equipment” - The Contractor shall subcontract GSE maintenance beyond the site capability.

Request: CBP provide a list of all support equipment and special tools at each location

8. Reference: Performance-Based Statement of Work, Page 8, Section C.5.2.10 “Calibration Program”

Questions: What is the inventory of CBP equipment that requires calibration?

Is there a current interagency agreement to perform any or all of these services? If an approved government source of repair and/or calibration, will there be any cost to the contractor?

Equipment is calibrated locally at no cost to the contractor.

9. Reference: Performance-Based Statement of Work, Page 8, Section C.5.2.11 “Survival Equipment” - The Contractor shall institute a program to inspect, repair, and certify all personal and aircraft survival equipment.

Question: Is there a current interagency agreement to provide any or all of these services on survival equipment?

Answer:

Interagency and commercial agreements are in place for survival equipment.

10. The third paragraph in Section H.19 Security Requirements is hereby removed in its entirety. The remainder of H.19 remains unchanged.
