L. INSTRUCTIONS TO OFFERORS

Instructions, Conditions and Notices to Offerors

L.1. PROPOSAL REQUIREMENTS

1.1 This section provides general guidance for preparing proposals as well as specific instructions on the format and content of the proposal. The offeror’s proposal must include all data and information and must be submitted in accordance with these instructions. Any offeror who submits proposal that does not include all the required information as described in this section may be considered ineligible for award. The offer shall be compliant with the requirements as stated in the Performance Work Statement (PWS) and Attachments as well as the terms and conditions of the Request for Proposal (RFP). Non-conformance with the instructions provided may result in an unfavorable proposal evaluation. Proposals that are submitted after the submission deadline will be rejected and not considered for evaluation. Material contained in proposals that exceed the requisite page limit will be disregarded and not considered in the evaluation.

1.2 The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The proposal should not simply rephrase or restate the Government's requirements, but rather provide convincing, factually-based explanation on how the offeror intends to meet these requirements. Offerors shall assume that the Government has no prior knowledge of their facilities and experience, and will base its evaluation on the information presented in the offeror’s proposal.

1.3 Elaborate brochures or documentation, binding, detailed artwork, or other embellishments are unnecessary and are not desired.

1.4 The proposal acceptance period is a minimum of 120 calendar days from date of submission. The offeror shall make a clear statement in the proposal documentation volume that the proposal is valid until this date.

1.5 In accordance with Federal Acquisition Regulation (FAR) Subpart 4.805(b)(5)(i) (Storage, handling, and disposal of contract files), the Government will retain one copy of all unsuccessful proposals. Unless the offeror requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.

1.6 Proposals Containing Exceptions

Proposals containing exceptions, conditions or other deviations from the RFP’s terms shall not be accepted and shall be deemed ineligible for award.

1.7 Electronic Reference Documents

All referenced documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) web site at http://www.fbo.gov. Potential offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.

1.8 Amendments to Solicitation

Changes to the solicitation prior to the deadline for receipt of proposals will be executed via issuance of SF-30, which will contain a summary of changes to the solicitation. The SF-30 will be available on http://www.fbo.gov under the announcement number of the solicitation. Offerors are encouraged to check the solicitation announcement regularly to verify issuance of amendments. Offerors shall acknowledge receipt of any amendment and provide confirmation upon submission of the offeror’s proposal. Any unacknowledged amendments in the offeror’s proposal will be considered incomplete.

1.9 Solicitation Questions.

Any formal communications such as requests for clarifications, questions and/or information concerning this solicitation must be submitted in writing via email to the following:

Ms. Kadian Ferguson, Contract Specialist at kadian.L.ferguson.civ@mail.mil.

The Government will answer all questions provided that the questions are received by 11:00 a.m. (EST) on 12 November 2013. The Government reserves the right not to respond to any questions received concerning this solicitation after the question receipt date and time above. Accordingly, Offerors are encouraged to carefully review all solicitation requirements and submit questions to the Government early in the proposal cycle.

Answers to the solicitation questions will be posted on FedBizOpps as an amendment to this solicitation.

1.11Discrepancies.

If an offeror believes that the requirement in these instructions contain an error, omission, or are otherwise unsound, the offeror shall notify the CO in writing with supporting rationale immediately, but no later than ten (10) days after release of the solicitation. SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

SECTION M. EVALUATION FACTORS

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options, including the potential 6-month option to extend services, to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) An Unacceptable rating under any factor or sub-factor or a No Confidence rating under the Past Performance evaluation factor will make the proposal unacceptable overall and ineligible for award.

M.1 INTRODUCTION. This section outlines the basis for evaluation of the offerors’ capabilities and proposals submitted in response to the solicitation. The evaluation criteria describe the scope of the evaluation to be performed on each proposal. Section L of the RFP describes the proposal content and format requirements.

M.2 BASIS FOR AWARD

Award will be made to the responsible offeror whose offer, conforming to the solicitation, represents the best overall value to the Government, given the outcome of the Government’s evaluation of each offeror’s management, technical proposal, past performance, price proposal and professional employee compensation plan.

In selecting the best overall offer for award, the Government will consider the quality offered, which includes all non-price factors, preferentially over the evaluated price. The relative quality of offers will be based upon the Government’s evaluation of the offeror’s ability to exceed the minimum performance requirements of this solicitation and the risk of non-performance, defective performance or late performance under the resulting contract.

The quality of offers will be considered the primary qualifying criteria, with price calculated as a determining factor between offerors of superior rating. The Government may award on the basis of a proposal with superior ratings even though it may result in a higher price to the Government.

M.3 EVALUATION FACTORS

The offer must be reasonable in both technical approach and total price.

Pursuant to FAR 52.215-1(f), Instructions to Offerors-Competitive Acquisition (JAN 2004), the Government may evaluate offers and award contract(s) without discussions with offerors. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

To arrive at the best value decision, the Technical Evaluation Committee (TEC) will evaluate the technical factors and the Source Selection Authority (SSA) will base the source selection decision on an integrated assessment of the submitted proposals in accordance with the evaluation factors and sub-factors established within the solicitation.

Evaluation of all timely received proposals will be based upon an integrated assessment of the evaluation factors and sub factors listed below. Award selection will be made in accordance with FAR 15.101-1 (c) and section M of the

RFP.

In selecting the best overall value, the following factors will be considered: Key Personnel (Pass/Fail), Professional Employee Compensation Plan (Pass/Fail), (1) management, (2) technical, (3) past performance, and (4) price to the Government. Price will not be a numerically weighted factor in the evaluation of proposals and the importance of price does not bear a linear relationship to the importance of the technical proposal and past performance. The importance of price in the evaluation for award will depend upon the differences in evaluated technical quality and in past performance among offerors and, as stated above, will increase as the differences decrease. The following evaluation factors will be used for this source selection:

Key Personnel (Pass/Fail)

(1) Management:

a. Organizational Structure

b. Quality Control Plan

c. Ability of Organization to Respond to Problems

d. Safety and Health Plan

(2) Technical Requirements:

Factor 3: Past Performance The Government will evaluate the offeror’s quality of performance on its previous/or current, relevant** projects by using a combination of the following methods:

Relevance Schemes: The Past Performance Evaluation Panel will assign a relevance rating based on the offeror’s past performance information.

RELEVANCE RATING: The Government will evaluate the relevance of the offeror’s past performance prior to assessing the offeror’s confidence rating. This rating is a measure of how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. Each project referenced in will be assigned one of the following ratings:

Rating Definition Very Relevant

(VR)

Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.

Relevant (R) Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant (SR)

Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.

Not Relevant

(NR)

Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

The Government will evaluate the offeror’s quality of performance on its previous/or current, relevant** projects by using one or a combination of the following methods:

- Awardee search in FAPIIS and SAM- In accordance with Subpart 9.104-6 and FAR 9.405(d)(4)

- Contacting references as provided in Section M: Past Performance

- Provide references from 3-5 from similar experiences in the same capacity

- Review of information available from U. S. Army Corps of Engineers Construction Contractor Appraisal Support System (CCASS), Architect/Engineer Contract Administration Support System (ACASS), Contractor Performance Assessment Reporting Systems (CPARS), Past Performance Information Retrieval System (PPIRS), and other commercial sources

- The Contracting Officer’s knowledge of the offeror’s past performance

- Interviews with other Government or commercial personnel contacts not provided by the offeror

** Relevant Project is defined as:

- A contract for facility systems and operations support services

- The total contract value is at least $500,000.00;

- The offeror must be the prime contractor;

- If the referenced contract has expired, the end date of the contract performance must have occurred within the last 60 months from the date of the proposal submission deadline;

- If the referenced contract is an active contract at the time of proposal submission, the start date of the contract performance must have occurred no less than 60 months from the date of the proposal submission deadline.

Each offeror’s past performance will be evaluated as part of the Government’s overall evaluation of best value. At a minimum, this evaluation will take into account past performance information submitted as a part of each offeror’s proposal including information regarding predecessor companies, key personnel who have relevant experience and subcontractors that will perform major or critical aspects of the requirement. For those offerors without a record of relevant past performance or for whom information on past performance is not available, the offeror will receive a neutral past performance rating. Offerors with a negative past performance rating will be afforded an opportunity to address alleged deficiencies. \ Past performance as a prime contractor will be weighted more heavily in the relevance determination.

Using the method as described in this section, the Government will assign a rating that indicates its degree of relevance in the offeror’s ability to successfully perform the proposed contract requirements based on its performance on similar contracts in the past Confidence Scheme: The Past Performance Evaluation Panel will assign a confidence rating based on the offeror’s past performance information.

CONFIDENCE RATING: The second aspect of the past performance evaluation is to determine how confident the Government is based on the offeror’s recent/relevant performance record, that the offeror will successfully perform the required effort. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.
