The SF330 will not be required. JH 9/24/13
0004 Does the government want a completed SF330 package for the entire design team or just the Lead
Design Firm?
0005 Does the SF330 (or the referenced appendix) have a page limit?
0006 Is the SF330 considered “reproduced section(s) of the solicitation document”? If that is the case, does that mean that it is not subject to the same font restrictions of the proposal documents?
The SF330 will not be required. JH 9/24/13
0007 Vol II – Tech Proposal Section A provides the Key personnel proposed.
Section C requires the list of Key personnel. As the page count for Vol

The Offeror is to provide pricing for

0016 SECTION 21.0
“BONDABILITY/BID BOND” states:
“For every Task Order placed on the
MACC, a letter of "bondability" on the Surety's letterhead stating the offeror has the bonding capacity available is required of each proposer responding to the order. The purpose of this letter is to put the bonding company on notice that their client is proposing on a project. This letter does not require the proposer to incur cost. The bonding company will provide it upon a client's request. A bid bond in the amount of 20% for each Task Order may be required in lieu of a bondability letter.”
The TASK ORDER Submission
Requirements and Evaluation states, “A letter of bondability on the Surety's letterhead stating the offeror has the bonding capacity available is required for this proposal, per the aforementioned IDIQ MACC contract.”
The SF1442 states that a bid guarantee is required.

GC’s for the MACC
This procurement consists of one solicitation with the intent to award five or more Indefinite Delivery Indefinite
Quantity (IDIQ) Construction Contracts.
The awardee of Task Order 0001 will be to one of the five MACC awardees.
0019 Is this project tax-exempt? Ref. FAR 52.229-3 MC 9/24/13
0020 On page 106 of the RFP, “Tab B:
Letter of Bondability Each offeror shall include a notarized letter from its surety certifying the offeror’s bonding capacity. Offerors must possess a minimum aggregate bonding capacity of $50,000,000 and a minimum per-contract bonding capacity of
$10,000,000 to be eligible for award.
Offerors possessing less than the minimum bonding capacity will be considered not responsible.”
However, in clause 52.216-19, (b) (2)
“Order Limitations” you indicate that the maximum aggregate contract value for any one contractor is $10,000,000.
It is unclear why the government is requiring an aggregate bonding capacity 5 times greater than the value of contracts it can award to the contractor? Further, given that this solicitation is a HUBZone set-aside and the firm must be a small business to be HUBZone, even if the firm has a
The bonding capacity remains the same per Vol III, Tab B.
FAR 52.216-19(b) states, Maximum order. The Contractor is not obligated to honor:
(1) Any order for a single item in excess of $10,000,000;
(2) Any order for a combination of items in excess of $10,000,000; or
(3) A series of orders from the same ordering office within 7 days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above.
The Government is requiring a min aggregate bonding capacity of $50 million, because it is estimated that each
MACC participant will be awarded multiple task orders during the period of performance. The maximum task order

$50 mil aggregate bonding program, selection for award would most likely tie up the selected firm’s entire bonding program which clearly would not be in the best interest of any small business and especially given the guaranteed minimum is on $10,000 over five years. The untended consequence of the government’s stipulation would in affect be hampering the entities ability to develop with no promise of any work and would eliminate many otherwise qualified small HUBZone certified contractors. Therefore, we request the bond capacity of section K be reduced to $5 million single and $10 million aggregate. Please advise.
amount is $10 million per task order, not the aggregate.

0025 Can each member of a JV submit 5 projects if the JV has no past performance?
No, the Offeror, which in this case would be the JV (excluding Lead

(excluding Lead Design Firm(s)) shall submit a minimum of three to a maximum of five references total.
0027 In Volume II, Section C.a. are these 5 prime contractor projects and 3 lead design firm projects supposed to be the same as the Past Performance projects?
It is not required to be the same projects, but can be.

0029 In Volume II, Section D, can the government please confirm that the

with the page limits do we need to have this section twice?
Yes. MC 9/24/13
0030 Can Form J-1a and Form J-2a be converted to Word so that they can be more easily incorporated into the proposal?
You may convert these to Word Format;
however, the page count for each form shall not change.

0031 What percentage of construction must be complete for a Lead Design Firm’s project to be considered very relevant?
*A project submitted for past performance information must satisfy all of the following criteria in order to be considered “Very Relevant”:
(1) The contract value is between
$300,000 - $10,000,000 for design-build construction project
(2) The Offeror is the prime contractor
(3) The Offeror’s lead design firm is the designer of record

increased to 25 pages.
0038 "In determining acceptability, the
Government may also consider factors including the Contracting Officer's knowledge of and previous experience with the offering firm,...."
This would seem to give unfair advantage to incumbent contractors.
Would the Government consider removing this factor in evaluating
LPTA?
The evaluation method is best value for the MACC basic. The seed project evaluation method is LPTA and does not include a past performance evaluation. The factors for the seed project are Technical and Price only.
In regards to the past performance evaluation for the MACC basic, considering the CO’s knowledge of and previous experience with the Offeror will not give an unfair advantage to incumbent contractors.
This would be equivalent to other CO’s knowledge of and previous experience with offerors that are not the incumbents.

(7) on the proposed furniture drawing

Can we provide a quote for this

016 It looks like they are using 3h lateral files as locations for printers, etc. I’d suggest we spec an additional laminate top for these files. The typical KOP

022 The office in Suite Z with (2) BX stations is going to be tight. The return against the door violates ADA code and we don’t think the room is wide enough for (2) wardrobes. The proposed test fit plan shows them overlapped
See answer #019 JH 9/24/13
023 The F office in Suite Z is narrow and the space to get past the peninsula doesn’t look sufficient on their test fit plan. If we did KOP, we could use the teardrop table. If it was AO to sub for

Section M)
036 Do the key personnel that we list in our proposal need to have security clearance or can that be done once the contract is awarded?
Refer to Section H of the Solicitation, under Security Requirements.
037 Reference Section 8.0. The RFP requires both the Program Manager and the Project Manager to have atleast one of the following certifications in addition to 15 and 10 years of experience: Certified
Construction Manager, Project

Under the D/B Contract the DOR will develop design documents to include PL for egress requirements per WHS –
