0010 Joint Venture Agreement, Volume III, Does the Joint Venture contractor also have to be a Hubzone contractor?
CFR 13 § 126.616
A joint venture may submit an offer on a
HUBZone contract if the joint venture meets all of the following requirements:
(a) HUBZone joint venture. A qualified
HUBZone SBC may enter into a joint venture with another qualified
HUBZone SBC for the purpose of submitting an offer for a HUBZone contract. The joint venture itself need not be certified as a qualified HUBZone
SBC.
(b) Size of concerns. (1) A joint venture of two or more qualified HUBZone
SBCs may submit an offer for a
HUBZone contract so long as each concern is small under the size standard corresponding to the NAICS code assigned to the contract and the
HUBZone joint venture in the aggregate may exceed the size standard provided the procurement meets the following conditions:

(i) For a procurement having a revenue-based size standard, the procurement exceeds half the size standard corresponding to the NAICS code assigned to the contract; and
(ii) For a procurement having an employee-based size standard, the procurement exceeds $10 million.
(2) For a procurement that does not exceed the applicable dollar amount specified in paragraph (b)(1) of this section, a joint venture of two or more qualified HUBZone SBCs may submit an offer for a HUBZone contract so long as the qualified HUBZone SBCs in the aggregate are small under the size standard corresponding to the NAICS code assigned to the contract.

Section L, Vol 1.A states: The Offeror shall submit a minimum of three to a maximum of five references.
The Offeror shall submit a maximum of three references that can provide information regarding the Lead Design
Firm’s relevant past performance.
Provide with the proposal a letter from all subcontractors that will perform major or critical aspects of the requirement, consenting to the release of their past performance information to the prime contractor.
Questionnaires shall be submitted to the
Government by the individual or the organization listed as the reference.

MACC, a letter of "bondability" on the Surety's letterhead stating the offeror has the bonding capacity available is required of each proposer responding to the order. The purpose of this letter is to put the bonding company on notice that their client is proposing on a project. This letter does not require the proposer to incur cost. The bonding company will provide it upon a client's request. A bid bond in the amount of 20% for each Task Order may be required in lieu of a bondability letter.”
The TASK ORDER Submission
Requirements and Evaluation states, “A letter of bondability on the Surety's letterhead stating the offeror has the bonding capacity available is required for this proposal, per the aforementioned IDIQ MACC contract.”
The SF1442 states that a bid guarantee is required.
Please verify if a bid bond is required.

CLIN item includes a quantity on
12,000,000 with a unit of “Lot”. Are we required to develop a Unit Price and extend that towards the “Lot” of
12,000,000? If so, what is the scope of work we are to develop the unit prices for?
Pricing should only be provided for
Task Order 0001/Seed Project. Pricing for Task Order 0001 shall be provided in Volume III-Cost/Price, Tab C.

MACC? Is the contractor that is awarded Task Order 0001 automatically part of the short listed
GC’s for the MACC solicitation with the intent to award five or more Indefinite Delivery Indefinite
Quantity (IDIQ) Construction Contracts.
The awardee of Task Order 0001 will be to one of the five MACC awardees.
0019 Is this project tax-exempt? Ref. FAR 52.229-3 MC 9/24/13
0020 On page 106 of the RFP, “Tab B:
Letter of Bondability Each offeror shall include a notarized letter from its surety certifying the offeror’s bonding capacity. Offerors must possess a minimum aggregate bonding capacity of $50,000,000 and a minimum per-contract bonding capacity of
$10,000,000 to be eligible for award.
Offerors possessing less than the minimum bonding capacity will be considered not responsible.”
However, in clause 52.216-19, (b) (2)
“Order Limitations” you indicate that the maximum aggregate contract value for any one contractor is $10,000,000.
It is unclear why the government is requiring an aggregate bonding capacity 5 times greater than the value of contracts it can award to the contractor? Further, given that this solicitation is a HUBZone set-aside and the firm must be a small business to be HUBZone, even if the firm has a
$50 mil aggregate bonding program, selection for award would most likely tie up the selected firm’s entire bonding program which clearly would not be in the best interest of any small business and especially given the guaranteed minimum is on $10,000
The bonding capacity remains the same per Vol III, Tab B.
FAR 52.216-19(b) states, Maximum order. The Contractor is not obligated to honor:
(1) Any order for a single item in excess of $10,000,000;
(2) Any order for a combination of items in excess of $10,000,000; or
(3) A series of orders from the same ordering office within 7 days that together call for quantities exceeding the limitation in subparagraph (1) or (2) above.
The Government is requiring a min aggregate bonding capacity of $50 million, because it is estimated that each
MACC participant will be awarded multiple task orders during the period of performance. The maximum task order amount is $10 million per task order, not the aggregate.

The untended consequence of the government’s stipulation would in affect be hampering the entities ability to develop with no promise of any work and would eliminate many otherwise qualified small HUBZone certified contractors. Therefore, we request the bond capacity of section K be reduced to $5 million single and $10 million aggregate. Please advise.

It is not required to be the same projects, but can be.
0028 Can the lead design firm and teamed members provide a single letter that serves both as a letter of commitment and a letter of consent?
Subcontractor consent should be provide with the past performance information.
Letters of commitment should be provided in Vol II, Section A.
You may combine them, but they shall be included in both Vol I and Vol II.

This would seem to give unfair advantage to incumbent contractors.
Would the Government consider removing this factor in evaluating
LPTA?
The evaluation method is best value for the MACC basic. The seed project evaluation method is LPTA and does not include a past performance evaluation. The factors for the seed project are Technical and Price only.
In regards to the past performance evaluation for the MACC basic, considering the CO’s knowledge of and previous experience with the Offeror will not give an unfair advantage to incumbent contractors.
This would be equivalent to other CO’s knowledge of and previous experience with offerors that are not the incumbents.

MACC SOW 8.0 Personnel
Requirements Chart is being amended to make the minimum qualifications more clear. Professional Licensure is an option for the Program Manager, for the
Project Manager and for the Design
Project Manager. In lieu of the Program
Manager having one of the listed certifications or professional licensure
(see revised Key Personnel Chart), the
Program Manager could instead possess
25 years of Construction Management experience. In lieu of the Project
Manager having one of the listed certifications or professional licensure
(see revised Key Personnel Chart), he could instead possess 20 years of
Construction Management experience.
