TO: Tuolumne County Board of Supervisors
FROM: Annie Hockett, Health and Human Services Agency Director
SUBJECT: Rescind Resolution 78-25 and adopt a new resolution declaring 18740 CA-
108, Jamestown, California (Assessor’s Parcel Numbers 059-050-030-000 & 059-050-031-000) statutorily exempt from review under Section 15268 of the California Environmental Quality Act (CEQA) and stating the intent to donate the property to a housing sponsor through the issuance of a request for proposals.
Background On September 23, 2025, the Board adopted a Resolution declaring the County-owned property located at 18740 CA-108 in Jamestown, California (APNs 059-050-030-000 & 059-050-031-000), also known as the Miner's Motel, to be surplus property and exempt from the provisions of the Surplus Land Act (SLA). The Resolution directed staff to follow Housing and Community Development (HCD) guidelines for disposition, including the issuance of a Notice of Availability and negotiations under Government Code §§ 54220– 54234.
Following adoption of the Resolution, County staff received updated guidance from HCD clarifying that because the property qualifies as exempt surplus land, the County is not required to follow the Notice of Availability and negotiation procedures under the SLA.
HCD further advised that an RFP process is the appropriate method of disposition in this situation.
To remain compliant with HCD requirements related to the Encampment Resolution Funding (ERF) grant and to ensure an open, transparent, competitive award process, staff recommend rescinding the previously adopted Resolution and adopting a new Resolution that authorizes issuance of an RFP for development of affordable housing on the site.
Process Because the property is considered exempt surplus land, the County is not required to follow the SLA’s Notice of Availability process. Instead, consistent with HCD guidance:
• The County will issue a 30-day Request for Proposals (RFP).
• The RFP will be sent directly to all parties who previously expressed interest.
• The RFP will follow the County’s standard procurement procedures.
• Responding entities must meet HCD-approved affordable housing requirements, including appropriate deed-restriction levels.
• Any proposed award will require HCD approval, consistent with ERF grant conditions.
Rescinding the original Resolution is necessary to remove references to SLA processes that no longer apply.
Land Use/General Plan/CEQA The site consists of two parcels totaling 1.18± acres that are zoned C-1 (General Commercial) under Title 17 of the Tuolumne County Ordinance Code with a General Plan land use designation of General Commercial (GC). Pursuant to Table 1.3 of the Technical Background Report of the Tuolumne County General Plan the C-1 zoning is consistent with the GC General Plan land use designation.
The purpose of the GC General Plan designation is to provides for a variety of sales and service establishments which serve both the residents of Tuolumne County and its visitors.
This designation is found within urban areas and along highway corridors. Operation of transitional and supportive housing would be consistent with the purpose of the GC designation.
Pursuant to Section 17.14.1(E) of the Tuolumne County Ordinance Code, “Transitional housing and supportive housing within a permitted single-family dwelling or multifamily dwelling,” “Supportive housing in other structures besides single-family dwellings or multifamily dwellings,” and “Residential care homes of any size regardless of state licensing” are permitted in the C-1 zoning district, which would allow for the intended use.
The proposed action was found to be exempt pursuant to Section 15312 of the State CEQA Guidelines because the disposition of surplus government property that is not located in an area of “Statewide, Regional, or Area wide significance” as described in Section 15206(b)(4) of the State CEQA Guidelines is exempt. The property is not located in an area described in Section 15206(b)(4) of the State CEQA Guidelines.
The CEQA Guidelines contain exceptions that if present on a project site, prevent a project from proceeding with an exemption. These exceptions are listed in Section 15300.2 of the State CEQA Guidelines and include situations such as a project resulting in damage to scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway, being listed as having documented hazardous waste on the site, containing historical resources, having cumulative impacts, or the site having unusual circumstances leading to an environmental effect. None of the exceptions listed in Section 15300.2 apply to this project.
Recommendation:
Staff respectfully recommends the Board of Supervisors rescind Resolution 78-25 and adopt a new resolution declaring 18740 CA-108, Jamestown, California (Assessor’s Parcel
Numbers 059-050-030-000 & 059-050-031-000) statutorily exempt from review under Section 15268 of the California Environmental Quality Act (CEQA) and stating the intent to donate the property to a housing sponsor through the issuance of a request for proposals.
