TO: Tuolumne County Board of Supervisors

FROM: Annie Hockett, Health and Human Services Agency Director

SUBJECT: Consideration of adopting a Resolution declaring 18740 CA-108, Jamestown, California (Assessor’s Parcel Numbers 059-050-030-000 & 059-050-031-

000) surplus property, declaring the property statutorily exempt from review under Section 15268 of the California Environmental Quality Act (CEQA) and stating the intent to donate the property to a housing sponsor.

Background

The Board of Supervisors provided direction to dispose of the property for the purpose of developing permanent housing/operating pursuant to the Grant terms. As such county staff are seeking Board approval for the disposition of the parcel of land located on Highway 108 in Jamestown, California.

• The Assessor’s Parcel Numbers are 059-050-030-000 & 059-050-031-000

• This property is also known as the Miner’s Motel

• The size of the parcel is 1.18 acres

• The zoning for this parcel is C-1, which is General Commercial District

• The parcel is not utilized by the County

• This parcel qualifies as exempt surplus land if the recipient will be deed restricting the property so that all units will be considered affordable housing

Process

The process associated with disposing of the property and subsequently donating it to a

Housing Sponsor is as follows:

Pursuant to Government Code section 54222, the BOS will declare the property surplus and find it is not needed for public use.

The Board of Supervisors will state its intent to donate the property to a Housing Sponsor pursuant to Health and Safety Code section 50074 or other public entity who must operate the property as affordable housing pursuant to Encampment Resolution Fund Grant Program

Round 3 Lookback Disbursement (ERF) for the remainder of the grant period, which runs through March 31st, 2027.

After the Board of Supervisors declares the property is surplus, the County will follow the

Surplus Land Act process. There will not be bid process at this time.

Fiscal Impacts

This Resolution will have no impact on the general fund. The associated property was initially purchased with ERF.

Land Use/General Plan/CEQA

The site consists of two parcels totaling 1.18± acres that are zoned C-1 (General

Commercial) under Title 17 of the Tuolumne County Ordinance Code with a General Plan land use designation of General Commercial (GC). Pursuant to Table 1.3 of the Technical

Background Report of the Tuolumne County General Plan the C-1 zoning is consistent with the GC General Plan land use designation.

The purpose of the GC General Plan designation is to provides for a variety of sales and service establishments which serve both the residents of Tuolumne County and its visitors.

This designation is found within urban areas and along highway corridors. Operation of transitional and supportive housing would be consistent with the purpose of the GC designation.

Pursuant to Section 17.14.1(E) of the Tuolumne County Ordinance Code, “Transitional housing and supportive housing within a permitted single-family dwelling or multifamily dwelling,” “Supportive housing in other structures besides single-family dwellings or multifamily dwellings,” and “Residential care homes of any size regardless of state licensing” are permitted in the C-1 zoning district, which would allow for the intended use.

The proposed action was found to be exempt pursuant to Section 15312 of the State CEQA

Guidelines because the disposition of surplus government property that is not located in an area of “Statewide, Regional, or Area wide significance” as described in Section

15206(b)(4) of the State CEQA Guidelines is exempt. The property is not located in an area described in Section 15206(b)(4) of the State CEQA Guidelines.

The CEQA Guidelines contain exceptions that if present on a project site, prevent a project from proceeding with an exemption. These exceptions are listed in Section 15300.2 of the

State CEQA Guidelines and include situations such as a project resulting in damage to scenic resources, including but not limited to, trees, historic buildings, rock outcroppings, or similar resources, within a highway officially designated as a state scenic highway, being listed as having documented hazardous waste on the site, containing historical resources, having cumulative impacts, or the site having unusual circumstances leading to an environmental effect. None of the exceptions listed in Section 15300.2 apply to this project.

Timeline

One the Board of Supervisors declares the property as surplus, a draft Notice of Availability will be sent to Housing and Community Development (HCD) for approval and then staff will take the following steps:

• The County will issue written public notices of availability of the property for the purpose of developing permanent housing/operating pursuant to the Grant terms to any local public entity as defined in Health and Safety Code section 50079, and

Housing Sponsors. The County will send notice of availability to HCD, to public entities within the jurisdiction and to Housing Sponsors who have expressed interest in developing low- and moderate-income housing inviting interested parties to respond to the County with a notice of interest.

• Interested parties have 60 days from the date of the notice to express interest in acquiring the property, meaning they contact the County in writing and advise the

County they wish to negotiate the price and terms. The interested party must respond within 60 days after the County’s Notice of Availability is sent via certified mail or via email. The Notice of Availability will indicate the AMI 80% Deed restriction and 100% affordable housing deed restriction in accordance with HCD guidance.

• If the County receives a letter of interest from an entity, then a good faith negotiation period of a 90-days begins (Government Code 54223). This begins after the 60-day period is complete. The County can engage in negotiations w/ multiple entities during this 90-day period to attempt to reach agreement with one of the entities. If terms can’t be agreed upon during the 90-day period, the County may dispose of the surplus property without further compliance with the Surplus Land Act and potentially start the bid process.

• In accordance with Government Code section 54227, priority will be given to entities who meet the definition of Housing Sponsor pursuant to Health and Safety Code section 50074 and are eligible to operate the property as affordable housing pursuant to the Encampment Resolution Fund Grant Program Round 3 Lookback

Disbursement.

Recommendation:

Staff respectfully recommends the Board of Supervisors adopt a Resolution declaring 18740

CA-108, Jamestown, California (Assessor’s Parcel Numbers 059-050-030-000 & 059-050-

031-000) surplus property, declaring the property statutorily exempt from review under
