GENERAL CONDITIONS 010000 - 1

SECTION 010000 - GENERAL CONDITIONS

PART 1 - GENERAL

1.1 RELATED DOCUMENTS

A. Drawings and general provisions of the Contract, including General and Supplementary Conditions and Division 01 Specification Sections of the solicitation, apply to this Section.

1.2 SCOPE OF WORK

A. All required general construction and coordination to construct the Readiness Center Addition for the Hawaii Army National Guard, at Kalaeloa (Kapolei), HI, including, but not limited to site development, concrete work, masonry, metals, wood and plastics, thermal and moisture protection, doors and windows, finishes, specialties, equipment, mechanical, electrical and communications work indicated or implied by the provisions of the solicitation, project manual, specifications and drawings.

1.3 DIVISION OF WORK

A. The various divisions of the Specifications shall not be considered as segregations of the material and labor involved. The arrangement and order of these divisions have been made for Government convenience only, and it is not the intent, nor shall it be so construed, that work included in any one division must be performed by a particular trade or subcontractor.

1. Any item mentioned under any division heading must be supplied even though it is not specified under the heading for the respective work, but is shown on the Drawings. No claims for extras arising out of real or alleged error in such arrangement or order of the various divisions will be given consideration.

2. The organization of the specifications into divisions, sections, and articles, and the arrangement of the drawings shall not control the Contractor in dividing the work among subcontractors or in establishing the extent of the work to be performed by any trade.

3. Reference FAR Clause 52.236-21, entitled "Specifications and Drawings for Construction."

1.4 CONTRACTING OFFICER’S REPRESENTATIVE

A. The Contracting Officer’s Representative (COR) has the authority to delegate certain duties of the government to other government employees which will be designated in writing. A copy of the designation letter will be provided to the Contractor.

1.5 OPERATION AND MAINTENANCE MANUALS

A. One hundred (100) days prior to Contract completion, the Contractor shall submit to the COR three (3) copies of spare parts lists and Operation and Maintenance Manuals for training, operation and maintenance of each piece of operating equipment and for all parts and equipment requiring future repairs, servicing, adjusting, etc. Coordinate requirements of this provision with the requirements of Section 017823 “Operation and Maintenance Data”. Failure to furnish approved, bound (binded) manuals in the required quantity in the time indicated will be cause for the Contracting Officer to hold or adjust the retained percentage in accordance with Contract Clause “Payments Under Fixed Price Construction Contracts”. For equipment or systems requiring personnel training and/or acceptance testing, the final O & M data must be approved by the Contracting Officer prior to the scheduling of the training and/or testing.

B. Spare parts lists shall contain the following listed information:

1. Quantity of parts required for 120 days and one (1) year of operation.

2. Description of each spare part.

3. Drawing number and shop drawing reference.

4. Part equipment code number.

5. Unit price of each item.

6. Total price of all items.

7. Procurement lead time with particular attention to long lead times.

8. Name and address of nearest supplier.

9. Such remarks and data as the manufacturer may consider pertinent.

10. Complete parts list of all replaceable items.

C. Operation and Maintenance manuals shall consist of a complete service and overhaul section as well as contain operation (including control schematics), trouble shooting, and recurring maintenance instructions. For more detailed requirements refer to individual sections of the Technical Specifications. Include the following:

1. Name, address, phone number and trade of all subcontractors.

2. Complete maintenance instruction; name, address and phone number of installing contractor, manufacturer’s local representative, for each piece of operating equipment.

3. Narrative consisting of instruction for equipment and systems to include:

a. Description of system and intent.

b. Start-up procedures.

c. Emergency procedures.

d. Shut-down procedures.

e. Maintenance instructions including service and overhaul.

f. Wiring diagrams and trouble-shooting guidelines.

g. System layout diagrams/schematics.

h. Notable features of the system, including normal and abnormal operating condi-tions.

i. References to specific manufacturer’s equipment manuals for details.

4. Catalog data on plumbing fixtures, valves, water heaters, heating and cooling equipment, temperature controls, fans, electrical panels, and service entrance equipment, hoists/cranes and light fixtures.

5. Instructions for use in training, operation, and maintenance of each item of operating equipment.

6. Manufacturer’s name, type, color designation for ceramic tile, resilient floors, carpeting, windows, doors, cast stone, terra cotta, paint, roofing and other materials.

D. Prepare data in the form of an instructional manual for use by Government's personnel.

1. Format

a. Size: 8-1/2 inches x 11 inches

b. Text: Manufacturer's printed data, or neatly typewritten.

c. Provide reinforced punched binder tab, bind in with text. Fold larger drawings to the size of the text pages.

2. Provide fly-leaf for each separate product, or each piece of operating equipment.

a. Provide typed description of product, and major component parts of equipment.

b. Provide indexed tabs.

3. Cover: Identify each column with typed or printed title "OPERATING AND MAINTENANCE INSTRUCTIONS". List:

a. Title of Project.

b. Identity of general subject matter covered in the manual.

4. Binders:

a. Commercial quality three-ring or post type binders with durable plastic covers.

b. When multiple binders are used, correlate the data into related consistent group-ing.

c. O&M Manuals shall be prepared for each individual facility of multi-facility pro-jects.

E. Prior to final inspection or acceptance, fully instruct Government's designated operating and maintenance personnel in the operation, adjustment and maintenance of all products, equipment and systems. Operating and maintenance manual shall constitute the basis of instruction. Re-view contents of manual with personnel in full detail to explain all aspects of operations and maintenance. Minimum Training Time: two (2) hours.

F. Posted Operating Instructions: All major items of mechanical equipment shall have posted in a convenient and appropriate location operating instruction consisting of description of system operation, including necessary diagrams keyed to valve and piping identification systems. One set of instruction shall be 36” x 24” for posting on the wall. The instructions shall be laminated on both sides with clear plastic laminate. Two sets of laminated 8 ½” x 11” instructions shall be provided with the Operation and Maintenance manuals.

G. Provide an electronic copy of Operation and Maintenance manuals in PDF format acceptable to Contracting Officer’s Representative. Electronic copies shall be organized in the same se-quence and using the same nomenclature as hard copies. The Contractor may engage, at no ad-ditional cost to the Government, an electronic document preparation service to provide the elec-tronic copies.

1.6 AVAILABILITY OF CADD DRAWING FILES

A. After award and upon request, the electronic "Computer-Aided Drafting and Design (CADD)" drawing files will only be made available to the Contractor for use in preparation of construc-tion drawings and data related to the referenced contract subject to the following terms and con-ditions.

B. Data contained on these electronic files shall not be used for any purpose other than as a con-venience in the preparation of construction drawings and data for the referenced project. Any other use or reuse shall be at the sole risk of the Contractor and without liability or legal expo-sure to the Government. The Contractor shall make no claim and waives to the fullest extent permitted by law, any claim or cause of action of any nature against the Government, its agents or sub consultants that may arise out of or in connection with the use of these electronic files.

The Contractor shall, to the fullest extent permitted by law, indemnify and hold the Government harmless against all damages, liabilities or costs, including reasonable attorney's fees and de-fense costs, arising out of or resulting from the use of these electronic files.

C. These electronic CADD drawing files are not construction documents. Differences may exist between the CADD files and the corresponding construction documents. The Government makes no representation regarding the accuracy or completeness of the electronic CADD files, nor does it make representation to the compatibility of these files with the Contractors hardware or software. In the event that a conflict arises between the signed and sealed construction docu-ments prepared by the Government and the furnished CADD files, the signed and sealed con-struction documents shall govern. The Contractor is responsible for determining if any conflict exists. Use of these CADD files does not relieve the Contractor of duty to fully comply with the contract documents, including and without limitation, the need to check, confirm and coordinate the work of all contractors for the project.

D. If the Contractor uses, duplicates and/or modifies these electronic CADD files for use in pro-ducing construction drawings and data related to this contract, all previous indicia of ownership (seals, logos, signatures, initials and dates) shall be removed.

1.7 ELECTRONIC MAIL (E-MAIL) ADDRESS

A. The Contractor shall establish and maintain electronic mail (e-mail) capability along with the capability to open various electronic attachments in Microsoft, Adobe Acrobat, and other simi-lar formats. Within 10 days after contract award, the Contractor shall provide the Contracting Officer a single (only one) e-mail address for electronic communications from the Contracting Officer related to this contract including, but not limited to contract documents, invoice infor-mation, request for proposals, and other correspondence. The Contracting Officer may also use email to notify the Contractor of base access conditions when emergency conditions warrant, such as hurricanes, terrorist threats, etc. Multiple email address will not allowed. It is the Con-tractor's responsibility to make timely distribution of all Contracting Officer initiated e-mail with its own organization including field office(s). The Contractor shall promptly notify the Contracting Officer, in writing, of any changes to this email address.

1.8 MECHANICAL, ELECTRICAL AND TELECOMMUNICATION ROOM COORDINATION

LAYOUT DRAWINGS

A. Contractor shall submit layout drawings including appropriate elevations and sections for each Mechanical, Electrical and Telecommunication Room showing the room arrangement he pro-poses for all pieces of equipment and appurtenances thereto (viz., air conditioning equipment, boilers, compressors, hot water tanks, pumps, electrical control panels, ducts, piping, lighting fixtures, electronic sensors, telecom panels, etc.), that are to be located in the room. Mechani-cal, Electrical and Telecommunication room Layout Drawings shall be identified and submit-ted in the manner specified for "Contractor Submittals." Equipment rooms shown on the draw-ings shall be of adequate size to accommodate equipment of the required capacities, as availa-ble from several manufacturers, with sufficient space left for access, servicing, removal, etc.

The use of equipment items with dimensions such as to crowd the space will not be permitted.

B. Prepare drawings at accurate scale and sufficiently large to show locations of every item, in-cluding clearances for installing, maintaining, disassembly of operational units, pulling of con-ductors in raceways, dissipation of heat, current insulation (gap and interference protection), safety, movement of operational elements and similar requirements. Prepare drawings to in-clude plans, elevations, sections and details as needed to conclusively show successful coordi-nation and integration of the work.

C. In addition to Mechanical, Electrical and Telecommunication Rooms, prepare coordination drawings for other locations where space limitations dictate.

D. These drawings shall be submitted along with bound volumes of all parts, equipment and ma-chinery submittals of Divisions 23-27.

E. Coordinate requirements of this provision with the requirements stated in Section 013100 “Pro-ject Management And Coordination”.

1.9 HAZARDOUS MATERIALS USAGE

A. The Contractor shall establish hazardous materials (HM) storage and distribution system when HM is to be used. All HM required to support the contract shall be reported using the Contrac-tor HM Identification Form to the Contracting Officer’s Representative, who will in turn notify Hazardous Material Pharmacy (HMP) or other applicable personnel. The Contractor HM iden-tification Form will be provided to the Contractor at or prior to the Pre-Construction meeting.

Additional HM needed by the Contractor shall be identified to the COR for approval by the HMP. (See Attachment 18A.).

B. The Contractor planning to use HM for the work shall register, through the COR, with the in-stallation HMP prior to start of work in order to support the installation’s compliance with Ex-ecutive Order 12856, federal Compliance with Right-to-Know Laws and Pollution Prevention Requirements.

C. The Contractor shall maintain a Contractor HM Identification Form for all HM on the job site for inspection/verification.

D. The Contracting Officer’s Representative will verify that the HM identified to HMP is the only HM in use on the job site.

E. The Contractor shall provide the following to the HMP:

1. Provide a list of each material and quantity of material for all proposed HM Hazardous Material (HM) shall be construed to mean any item that is:

a. A health hazard or physical hazard as defined in 29 CFR, 1910, 1200 (c).

b. Regulated in its disposal by EPA under 40 CFR.

c. Hazardous as defined by DOT regulations under 49 CFR.

d. Hazardous as defined by the Dangerous Goods Regulations of the International

Air Transport Association.

2. Provide a material safety data sheet (MSDS) for each item on the HM list.

3. Typical examples of hazardous materials used on the job site include, but are not limited to:

a. Petroleum based liquids/gases (gasoline, kerosene, diesel, propane, butane, acety-lene, etc.)

b. Explosives

c. Adhesives and glues

d. Shot charges for anchor systems

e. Volatile solvents (such as PVC cleaner and glues, paint thinners)

f. Non-water based paints.

g. Liquid sealants

h. Epoxies and coating systems

i. Acidic or Alkali cleaners

F. The Contractor shall establish a construction-specific HM storage and issue location that fully complies with Federal, State, and local environmental regulations. Materials issued shall be tracked for quantities used. Unused materials shall be inventoried and removed from the instal-lation prior to close-out of the contract or expiration date of the HM. Reports of materials de-livered, used and removed from the installation shall be submitted to the Contracting Officer’s Representative monthly and prior to contract close-out.

G. The Contractor shall comply with all Federal, State and local environmental standards.

H. The Contractor shall accompany the Contracting Officer’s Representative and the installation Environmental Manager (EM) on project close-out inspection to ensure all used and unused HM have been removed from the installation. This requirement shall not be a punch list item and must be accomplished prior to the Government accepting beneficial occupancy of the facil-ity or construction item.

I. Any material suspected of being hazardous that is encountered during performance of a project shall immediately be brought to the attention of the Contracting Officer, at which time a deter-mination will be made as to whether hazardous material testing shall be performed. If the Con-tracting Officer directs the Contractor to perform tests, and/or the material is found to be of a hazardous nature requiring additional protective measures, a contract modification may be re-quired, subject to equitable adjustment under the terms of the contract.

J. The contractor is advised that friable and/or non-friable asbestos-containing material may be encountered in project areas. Friable asbestos-containing material is any material that contains more than one percent asbestos by weight, and that hand pressure can crumb, pulverize or re-duce to powder when dry. Non-friable asbestos-containing materials are materials in which asbestos fibers are bound by a matrix material, saturate, impregnate or coating. Non-friable as-bestos-containing materials do not normally release airborne asbestos fiber during routine han-dling and end-use. However, excessive fiber concentration may be produced during uncon-trolled abrading, sanding, drilling, cutting, machining, removal, demolition, or other similar ac-tivities. 29 CFR 1910.1001 shall be referenced in the event asbestos-containing materials are encountered. Friable asbestos-containing materials are not authorized for use in new construc-tion or maintenance projects.

1.10 ENVIRONMENT PROTECTION

A. General: Environmental pollution is defined as the presence of chemical, physical, or biologi-cal elements or agents which adversely affect human health or welfare; unfavorably alter eco-logical balances of importance to human life; affect other species of importance to man; or de-grade the utility of the environment for aesthetic purposes. The control of environmental pollu-tion requires consideration of air, water, and land, and involves noise, solid waste management and management of radiant energy and radioactive materials, as well as other pollutants.

B. Applicable Regulations: The Contractor and his subcontractors shall comply with all applica-ble laws and regulations concerning environmental pollution control and abatement, and all ap-plicable provisions of the Corps of Engineers Manual, EM 385-1-1, entitled "Safety and Health Requirements Manual," as well as the specific requirements stated elsewhere in the contract specifications.

C. Protection Of Land Resources: It is intended that the land resources within the project bounda-ries and outside the limits of permanent work performed under this contract be preserved in their present condition or be restored to a condition after completion of construction that will appear to be natural and not detract from the appearance of the project. Insofar as possible, the contractor shall confine his construction activities to areas defined by the plans or specifica-tions. Contractor's attention is directed to the requirements of Contractor Clauses entitled:

1. "Clean Air and Water"

2. "Hazardous Material Identification and Material Safety Data"

3. "Protection of Existing Vegetation, Structures, Equipment, Utilities and Improvements"

4. "Operations and Storage Areas"

5. "Cleaning Up"

D. Dust Control: The Contractor shall prevent the generation of dust due to his operation in con-struction zones, along haul routes, in equipment parking areas, and in waste areas. This action may consist of water sprinkling or an equivalent service. Coordinate requirements of this pro-vision with requirements of Section 018113.14 “Sustainable Design Requirements - LEED v4 BD+C, New Construction” for compliance with the requirements of Sustainable Sites Prerequi-site 1 Construction Activity Pollution Prevention.

E. Implementation: Prior to commencement of the work the Contractor shall:

1. Submit a plan for implementing this section for environmental pollution control;

2. Meet with representatives of the Contracting Officer’s Representative to develop mutual understandings relative to compliance with this provision and administration of the environmental protection program.

F. Additional Requirements:

1. Environmental Compliance: The contractor shall comply with all Federal, State, and local environmental laws and regulations. In case of a conflict among these laws and regulations, the most stringent law or regulation shall apply. If as a result of Contractor noncompliance with any environmental law or requirements, the Government incurs any cost, (e.g. the cost of cleaning up a hazardous waste spill) the Contractor shall indemnify the government and provide reimbursement for these costs. If a federal, state or local regulatory agency assesses any fine, penalty, or fee against the Government that is attributable to Contractor noncompliance with any environmental law or requirement, the Contractor shall indemnify the Government for the amount of the fine and other Government costs attributable to the violation. In the event of Contractor noncompliance with any applicable environmental law or regulation, the Contracting Officer’s Representative will determine whether the Government or the Contractor is responsible for abating or correcting the violation. This provision is not intended in any way to waive the Government’s rights under any other provision of the contract.

2. Material Approval Submittals: The contractor is required to submit material approval submittals on Form AF 3000. Submittals will consist of furnishing descriptive literature (manufacturer’s data) and material safety data sheets for all Hazardous Materials used during this project. Unless otherwise specified, all materials used for this contract shall be new and unused. In all instances where a product containing non-hazardous components can be substituted for a product with hazardous components. Material Data Safety Sheet (MSDS) will be provided to Contracting Officer’s Representative.

3. Hazardous Waste: If the Contractor uses Hazardous Materials in the performance of the project, that in turn generates Hazardous waste, in addition to complying with ALL Federal, State, and Local Environmental Laws and Regulations, the contractor must also comply with the applicable Hazardous Waste Management Plan (HWMP) procedures by notifying the Hazardous Waste Manager regarding the Use, Storage and Ultimate disposal of any Hazardous Wastes (HW) generated. The HW must be disposed of within applicable Laws and Regulations, for timeliness and proper Manifesting requirements.

The Contracting Officer’s Representative’s appointed representative must review and sign the waste profiles/waste analysis, Land Ban restriction forms (if applicable), and all HW manifests for waste that is generated on the site, prior to shipment off the Installation. Questions regarding the disposal of HAZ Waste should be forwarded to the Contracting Officer’s Representative. Should the United States Government be held liable for any neglect or improper actions by the contractor or any subcontractor regarding removal or disposal of any hazardous waste, the contractor shall reimburse the Government for all such liability.

1.11 GOVERNMENT INSPECTION

A. The Contractor shall notify the Contracting Officer’s Representative.

1. At least 72 hours before work is to start.

2. When a work stoppage of more than 48 hours duration is anticipated.

3. At least 24 hours in advance of returning to work after a work stoppage.

4. At least 72 hours in advance of desired time for final inspection.

B. Failure to make the arrangements specified above may result in nonacceptance of work.

1.12 PERMITS

A. The Contractor shall obtain an approved Work Clearance Request Form from the Contracting Officer’s Representative prior to commencement of any work.

B. Notify the Contracting Officer at least 48 hours prior to starting excavation work. Contractor is responsible for marking and verifying all utilities not marked. The Contractor shall verify the elevations of existing piping, utilities, and any type of underground obstruction not indicated or specified to be removed. But indicated in locations to be transversed by piping, ducts, and other work to be installed. Verify elevations before installing new work closer than nearest manhole or other structure at which an adjustment in grade can be made. Work shall be scheduled to hold outages to a minimum. Utility outages and connections required during the prosecution of work that affect existing systems shall be arranged for at the convenience of the Government and shall be scheduled outside the regular working hours or on weekends. Contracting Officer may permit utility outages at his discretion. Contractor shall not be entitled to additional pay-ment for utility outages and connections required to be performed outside the regular work hours. Requests for utility outages and connections shall be made in writing to the Contracting Officer at least 14 calendar days in advance of the time required. Each request shall state the system involved, area involved, approximate duration of outage, and the nature of work in-volved.

C. The Contractor shall obtain an approved Welding, Cutting and Brazing Permit, from the Fire Department having jurisdiction prior to welding or starting any open flames at least 7 calendar days prior to work.

D. Other Federal, State and local permits may be required as referenced in FAR clause 52.236-7 entitled "Permits and Responsibilities."

E. Burning of trash or rubbish is not permitted on project site.

1.13 SITE SECURITY/ACCESS/EGRESS

A. Install substantial and durable temporary enclosure of partially completed areas of construc-tion, with locking entrances, adequate to prevent unauthorized entrance, vandalism, theft, and similar deleterious effects and violations of the subject project.

B. Where materials and equipment must be temporarily stored, prior to and during construction, and are of substantial value or attractive for possible theft, provide secure lockup and enforce strict discipline in connection with the timing of installation and release of materials, so that the opportunity for theft and vandalism is minimized.

C. The following is information pertaining to law enforcement and security policies established by

the HI ARNG at Kapolei. Questions or comments that concern law enforcement must be di-rected to the Security Forces (phone number to be provided by the Contracting Officer’s Rep-resentative) on post, and the Contracting Officer’s Representative.

1. Speed Limits: Speeding is not tolerated on post. Speed should never exceed 15 mph.

Radar detectors are illegal and speed limits are strongly enforced.

2. Reserved/Prohibited Parking Areas:

a. Reserved parking is marked by signs listing the person or category for whom the space is reserved or stating which type of decal is required to park in the space.

b. Prohibited parking is marked by sign or yellow paint on the curb.

c. Parking on the grass or seeded areas is strictly prohibited unless it is required for contract completion.

3. Crosswalks: Motorists are required to yield to anyone in or about to enter a crosswalk.

4. Joggers/Cyclists: Motorists are cautioned to look out for high numbers of people engaged in exercise, especially during the middle of the day.

5. Traffic Citations: Violation of installation traffic rules could affect CONTRACTOR or individual access to the installation. All provisions of the laws of the State of Hawaii and Department of Defense, Department of the Army and Army National Guard Regulations are enforceable for all drivers on post. Actions taken as result of traffic citations:

a. Notification to employer with required actions.

b. Loss of installation driving privileges.

c. Fines.

d. Disbarment from the installation.

6. Weapons: No firearms, plastic explosives, fireworks, or any object which fires a projectile or explosive can be brought on post (except approved construction equipment).

Offenses of this nature will be referred to the local Sheriff’s Office or police department, the U.S. Magistrates Court, or the Bureau of Alcohol, Tobacco and Firearms.

7. Gate Closures: Anytime a security system is activated or a hostile act is committed on base, security procedures call for access gates to be closed until the “all-clear” is given.

Delays may occur when attempting to enter or depart the base during such an incident.

8. Controlled/Restricted Areas: Areas posted as Controlled or Restricted Areas (including the flightline, taxiways and ramps) are clearly marked with signs and constitute legal “No Trespassing” zones. Entry into these areas is strictly prohibited unless specific written authorzation is granted. Persons inadvertently entering a Controlled/ Restricted area will be apprehended by security personnel and treated as hostile until proper identity can be confirmed. Personnel should cooperate with security personnel in these types of situations since security personnel will continue to elevate force with resistance received.

9. Required Coordination: If required to block off a street or portion of a street, before doing so, and with as much advance notice as possible, CONTRACTOR shall coordinate with the Contracting Officer’s Representative.

10. Post Entry: Current vehicle registration, valid driver's license and vehicle insurance are mandatory when on Government property.

11. Locations to be serviced may include an area of the post that is “closed” to the public, pursuant to Sec 21, Internal Security Act of 1950, 50 U.S.C. 797 and, as such, only those persons granted permission may enter. It is, therefore, required that control be exercised over Contractor personnel while working on the post. To maintain this control, a listing of all Contractor personnel who will be working under the contract, must be submitted to the Contracting Officer prior to the start of work under the contract. The preferred

method of providing this list is via email, to the Contracting Officer’s Representative, unless notified otherwise. The listing shall include, but is not limited to: contract number, project number, employee name, and the estimated starting and ending date of each employee. Subsequent listings of all additions or deletions will be submitted as employees are hired or released.

12. During construction, the Contractor shall permit authorized post personnel access to the facilities within the work area. The Contractor shall provide protection to persons and property throughout the progress of the work.

13. In the event of a declared National Emergency, the Contracting Officer may be required to stop work on this contract for security reasons. Contractor shall ensure the Contracting officer has a current “Off Duty” contact name and telephone number at all times to facilitate notification.

14. The Contractor shall be responsible for compliance with all regulations and orders of the Commanding Officer of the Post, respecting identification of employees, movements on installation, parking, truck entry, and all other military regulations, which may affect the work.

1.14 INSTALLED EQUIPMENT

A. The Contractor shall furnish, upon completion of the project, a typewritten list, in triplicate, of all equipment installed in the facility and the installed cost of each item. In addition provide an electronic copy of the equipment list in PDF format. Furthermore, the listing shall include the location of each item-nameplate data and serial number.

B. Typically, the listing shall include: air conditioners, packaged HVAC units, condensers, fans, pumps, air compressors, transformers, unit heaters, regulators, direct current power supplies, motors, engines, motor- or engine-driven equipment, water coolers, generators, boilers, water heaters, kitchen equipment, coolers, meters, humidifier, dehumidifier, ovens, power units, fuel tanks, water tanks, reels, hydrants, fire detection and alarm equipment, emergency light sets, dishwashers, and like items of equipment.

C. Final payment will not be made to the Contractor until the Government has received and ap-proved the listing and electronic copy.

D. Coordinate requirements of this provision with the requirements of “017700 Closeout Proce-dures”.

1.15 FOREIGN OBJECT AND DEBRIS CONTROL:

A. The Contractor shall ensure that debris, equipment and material are not used, stored or accumu-lated in such a fashion so that, through use or due to other conditions, objects or debris are permitted to leave the Contract site as defined by the Contract Limit Line.

B. The Contractor shall submit a written plan to the Contracting Officer’s Representative for ap-proval detailing the Contractor's methods for foreign object and debris control. This plan, ap-proved or not, will not relieve the Contract of the responsibility or liability associated with for-eign objects and debris originating from, or associated with the Work or due to conditions re-sulting from the Work.

1.16 STANDARD WORKDAY/WEEK

A. Work shall normally be accomplished Monday through Friday, between the hours of 7:00 a.m.

and 4:00 p.m. local time, excluding national holidays and non-work days resulting from holi-days occurring on weekends.

1. The following Federal legal holidays are observed: New Year’s Day; Martin Luther King’s Birthday; President’s Day; Memorial Day; Independence Day; Labor Day;

Columbus Day’ Veteran’s Day; Thanksgiving Day; Christmas Day.

2. Note: Any of the above holidays falling on a Saturday will be observed the preceding Friday. Holidays falling on a Sunday will be observed the following Monday.

B. When the CONTRACTOR desires to work at other than the aforementioned times, he shall submit a written request to the Contracting Officer’s Representative for approval, and written approval thereof shall be required prior to proceeding with work.

1. The request shall be submitted at least three work days prior to the proposed performance of work.

2. The request shall indicate the day/days, time/amount of work, and reason why permission should be granted to perform work during nonstandard hours.

3. When the COR determines that additional inspection forces are reasonably available, the COR may authorize the Contractor to perform work during periods other than standard hours. However, if inspectors are required to perform in excess of their normal duty hours/days solely for the benefit of the Contractor, the actual cost of the inspection, at overtime rates, will be charged to the Contractor and will be deducted from the final payment of the Contract amount.

1.15 NO SMOKING POLICY

A. Smoking is prohibited within and outside of all buildings on post except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under ren-ovation. Discarding tobacco materials other than into designated tobacco receptacles is consid-ered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.

SECTION 010050 - SPECIAL CONDITIONS

PART 1 - GENERAL

1.1 RELATED DOCUMENTS

A. Drawings and general provisions of the Contract, including General and Supplementary Conditions and other Division 01 Specification Sections, apply to this Section.

1.2 LOSS PREVENTION AND SAFETY STANDARDS

A. General: It is the Contractor’s responsibility to ensure that all work accomplished in accordance with these documents is completed in a safe manner. Compliance, whichever is more stringent, with Occupational Safety and Health Administration (OSHA) Parts 1910 and 1926, Corps of Engineers Manual EM 385-1-1 entitled "Safety and Health Requirements Manual,” Government and other applicable laws, regulations, and standards is exclusively the obligation of the Contractor. The work site shall be subject to visits by representatives from the Governments Safety Office. Their objective is to ensure that all applicable Government and Occupational Safety and Health Administration (OSHA) regulations and standards are being complied with.

If a violation is discovered, it shall be brought to the attention of the Contracting Officer’s Representative (COR). They will coordinate with the Contractor to correct the violation(s).

OSHA may and has performed no-notice inspections on NGB work sites.

1. Safety Equipment: The Contractor shall ensure that safety equipment applicable to the project is available, serviceable, and properly used. Personal Protection Equipment shall be as prescribed by OSHA Standards.

2. Traffic Safety: The Contractor shall ensure that all personnel are advised to adhere to the posted speed limits.

3. Job Site Hazards: Areas such as ditches, trenches, and holes create a potential hazard to personnel. Potential hazards are required to be guarded and illuminated during the hours of darkness.

4. Mishap Reporting: In the unlikely event of a mishap involving Government personnel, equipment, or property, the COR must be notified.

5. Safety Staff: Before work begins, the Contractor shall submit copies of all safety programs and policies, including but not limited to, Lockout/Tagout, Confined Space, Hazard Communication Programs, and Safety and Health Program, along with the name and location of their on-site OSHA competent person.

6. OSHA Compliance: The Contractor is required to comply with the Occupational Safety and Health Act (OSHA) OF 1970 and the OSHA Standards 29 (Code of Federal Regulations) 1910 and 29 CFR 1926.

7. Record Keeping: The Contractor shall keep records of any accidents involving property damage or injury occurring on their job, and shall report such accidents immediately to the COR. When the COR becomes aware of non-compliance with safety standards that

may cause injury to Government personnel or damage to Government property or equipment, Contractor shall take immediate steps to correct the situation.

8. Common Violations: Some common Contractor violations on Government installations include: Failure to properly ground electrical equipment; failure to fence off excavations;

failure to park vehicles properly; failure to wear seat belts; excessive speed; failure to yield to pedestrians; violating smoking regulations; improper scaffolding; and inadequate shoring/sloping of excavation and trenches.

B. Special Requirements: The following requirements often need special emphasis:

1. Work areas shall be kept adequately lighted while work is in progress. Outdoor operations shall be adequately lighted and barricaded at night.

2. Building materials stored near the job site shall be properly piled and covered. All stairways, corridors, and passageways shall be kept free of loose materials, debris, and other hazardous obstructions.

3. Trestles, ramps, scaffolds and similar structures shall be designed and constructed to safely support the loads to be placed on them.

4. Suitable signs, barricades, and warning lights shall be used at locations where men are working close to streets or motor traffic.

5. All mechanical equipment shall be inspected at frequent intervals and kept in safe operating condition. All moving parts of the equipment shall be fitted with effective guards that must be in place at all times while machinery is in operation.

6. Mobile equipment operated on the streets shall conform to all laws and regulations governing motor vehicles. Local regulations shall be strictly observed. When construction proves hazardous to normal street and roadway users, traffic shall be controlled or warned by flag persons, signs or barricades.
