About this file
This is a Questions and Answers (Q&A) document for solicitation HE125426QE067, issued by the Department of War (DoWEA) Pacific West District for physical fitness equipment to be delivered to Humphreys High School in Korea.
The solicitation requires delivery and installation of fitness equipment by October 30, 2026. A vendor questioned whether the 90-day lead time typically required for selectorized and strength equipment production, combined with US Flagged Vessel shipping to Korea, customs clearance, and installation, could be extended; however, the government confirmed the delivery deadline is firm and will not be extended due to the urgent nature of the requirement and its direct impact on DoWEA's mission. Regarding regulatory compliance, a vendor inquired whether Buy American Act or Trade Agreement Act provisions apply to the purchase; the government responded that specifications were not based on any specific brand but reflect generalized minimum requirements of the requiring activity and directed vendors to Section I of the solicitation for applicable provisions and clauses. On technical compliance, the government clarified that quoters must meet all listed equipment specifications in Attachment 2, and any "No" response to specification requirements will render the quotation technically unacceptable, regardless of quality or dimensional differences between domestic and foreign-made products.

01 General Solicitation
The government's solicitation states that delivery and installation must be completed prior to 30 Oct 26. That's an unreasonable expectation.
CONUS fitness projects generally have a 90-day lead time for selectorized/strength equipment. Production of the machines carries a 60–90-day lead time. Then the items must be shipped via US Flagged Vessel to Korea, pass customs, deliver, then install. Please provide a 90-day lead time ARO.
Due to the urgent nature of this requirement and its direct impact on DoWEA’s mission, the delivery deadline is firm and will not be extended.
02 General Solicitation
It appears that the government got most of their basic specifications from a Swedish brand of equipment that makes their equipment in China. Is the Buy American Act or Trade Agreement Act going to apply to this purchase?
Specifications were not based off any specific brand. The specifications listed are generalized which reflect the minimum requirements of the requiring activity.
Refer to Section I of this solicitation to review the applicable provisions and clauses for this effort.

When completing attachment 2, if a vendor checks "no", does it mean their product will be deemed non compliant? For example some of the dimensions for US made equipment will be larger or different than Chinese made items which are lower in quality.
Quoters must meet all listed equipment specifications. A “No” response to any specification will render the quotation technically unacceptable.
