52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in combined synopsis/solicitation paragraph(iv). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is $27,500,000.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted as specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during pre-award testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation.
(1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(j) Data Universal Numbering System (DUNS) Number. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database. The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS +4” followed by the DUNS or DUNS +4 number that identifies the offeror's name and address. The DUNS +4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the offeror to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. An offeror within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. An offeror located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The offeror should indicate that it is an offeror for a Government contract when contacting the local Dun and Bradstreet office.
(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. (b) Submission of offers:
(12) Other Instructions
(i) General Information

Written requests for clarification must be sent to the KO/CS at Elizabeth.S.Cardenas.civ@mail.mil and Lalisa.R.Long.civ@mail.mil.
(B) Discrepancies: If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the KO in writing with supporting rationale. The Government reserves the right to award this effort based on the initial proposal, as received, without discussion.
(C) Electronic Reference Documents: All referenced documents for this solicitation are available on the Federal Business Opportunities (FedBizOpps) web site at http://www.fedbizopps.gov. Potential offerors are encouraged to subscribe for real-time e-mail notifications when information has been posted to the website for this solicitation.
(D) Communications: Exchanges of source selection information between Government and offerors will be controlled by the KO and CS. Email will be used to transmit such information to the offeror and will include “Source Selection Information – See FAR 2.101 & 3.104” in the Subject line.
(ii) Offerors are requested to submit a written technical proposal and a price proposal in response to the attached Performance Work Statement (PWS) and Quality Assurance Surveillance Plan (QASP) and to also include response to the sample task order PWS. In order to be eligible for award, the offeror must be able to obtain aTop Secret Facility Clearance (FCL) from the Defense Security Service (DSS) Facility Clearance Branch (FCB). A top secret facility clearance will not be required at time of award but must be obtained by 180 days after the contract effective date. Therefore, a secret FCL will be eligible for award. Offerors must complete Blocks 6, 7, and 8 of the DD Form 254 with the appropriate information for their companies and any subcontractors (when applicable). The completed DD Form 254 must be submitted with your proposal. Information on submission of technical and price proposals is provided below. The proposal shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of statements asserted in the proposal. The proposal should not simply rephrase or restate the Government's requirements but rather shall address how the offeror intends to meet these requirements. Offerors shall assume the Government has no prior knowledge of their facilities and capabilities and will base its evaluation on the information presented in the offeror's proposal. The offeror's proposal must include all data and information requested by the RFP and must be submitted in accordance with these instructions. The proposal should address the requirements as stated in the PWS. Non-conformance with these instructions may result in removal of the proposal from further evaluation.
(iii) IAW DISA Acquisition Regulation Supplement (DARS) 52.209-9000, Organizational and Consultant Conflicts of Interest (OCCI), each offeror shall specifically identify in its proposal whether or not any potential or actual Organizational and Consultant Conflicts of Interest (OCCI), as described in Federal Acquisition Regulation (FAR) Subpart 9.5, exists for this instant procurement. If the offeror believes that no OCCI exists, the OCCI response shall set forth sufficient details to support such a position. If an offeror believes that an actual or perceived OCCI does exist on the instant procurement, the offeror shall submit an OCCI plan with the proposal, explaining in detail how the OCCI will be mitigated and/or avoided.
(iv) Page limitations, if applicable, are identified below and will be treated as maximums. If exceeded, excess pages will not be read or considered in evaluation of the proposal. The following items will not be considered when calculating page limits: cover page, table of contents, glossary, and OCCI mitigation plans. In the event any evaluation notices are issued, page limitations may also be placed on those. Page limitations shall not be circumvented by including inserted text boxes/pop-ups or internet links to additional information; such inclusions are not acceptable and will not be considered part of a proposal. The Government reserves the right not to consider for award any proposal that does not adhere to the administrative requirements of this RFP.
(v) Organization/Number of Copies/Page Limits. The offeror shall prepare the proposal as set forth in the Proposal Organization Table 1 below. The titles and contents of the volumes shall be as defined in this table, all of which shall be within the required page limits and with the number of copies as specified. The contents of each proposal volume are described in the information to offerors paragraph as noted in the table below. To the greatest extent possible, each volume shall be written on a stand-alone basis so that its contents may be evaluated with a minimum of cross referencing to other volumes of the proposal. Information required for proposal evaluation which is not found in its designated volume will be assumed to have been omitted from the proposal. Each volume may contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing may be used to identify sections. Additionally, each volume may contain a glossary of all abbreviations and acronyms used, and with an explanation for each. Glossaries do not count against the page limitations for their respective volumes.

I. Overview II. Transition Approach III. Proposal Detail
a. Technical Approach
b. Management Approach IV. Deliverables (to include detail)
(C) Volume III – Price. General Instructions.
1. Price.
1.1. Price Reasonableness and Completeness.
The Government will verify that all Attachment 2 figures have been priced, figures are correctly calculated, and prices are presented in a clear and useful format. Additionally, unbalanced pricing poses an unacceptable risk to the Government and may be a reason to reject an offeror’s proposal.
1.2. Price Information.
Under no circumstances shall this information and documentation be included elsewhere in the proposal.
1.3. Pricing Information Requirements.
It is anticipated that pricing of this action will be based on adequate price competition; but may be requested to submit other than certified cost or pricing data. If, after receipt of proposals, the KO determines that there is insufficient information available to determine price reasonableness and none of the exceptions in FAR 15.403-1 apply, the offeror may be required to submit cost or pricing data. Information shall be provided in accordance with FAR 15.403-5
1.4 The Offeror is required to submit a price proposal for the Sample Task Order.
2. Volume Organization.
2.1 Volume III Organization. The Price volume shall consist of the following sections:
Part A – Introduction Glossary of Abbreviations and Acronyms Additional Information as stated in Paragraph (C) 2.1.1 through Paragraph (C) 2.1.3.6, below.
Part B – Microsoft Excel Spreadsheet Individual Microsoft Excel Spreadsheets for:
Sample Task Order #ELOG-001 (Attachment 6) Labor Rate Table (Attachment 2)
Part C - Labor Rate Category Descriptions (Attachment 3) Part D – Other Information.
2.1.1 Part A – Introduction. Include table of contents and glossary of abbreviations and acronyms.
2.1.1.1 Glossary of Abbreviations and Acronyms. If necessary, provide a glossary of abbreviations and acronyms used with an explanation for each. Glossaries do not count against the page limitations for their respective volumes.
2.1.2 Part B – Microsoft Excel Spreadsheets. The price proposal shall be submitted using Microsoft Excel and shall include all formulas and calculations.
2.1.2.1 Individual Task Order Spreadsheet.
2.1.2.1.1 The offeror shall submit a price proposal for the requirements reflected in the sample task order, HC1013-16-R-0014, Attachment _6_ (Sample Task Order# ELOG-001) in Microsoft Excel.
2.1.2.1.2 The offeror’s price proposal for Sample Task Order # ELOG-001 shall include labor rates for those labor categories and hours specified in Attachment 6. All ODCs shall be include the Government ‘plug’ number of $500,000.

1May 2017 – 30 April 2018
2.1.2.1.4 Rounding. All prices provided shall be rounded to the nearest dollar.
2.1.2.1.5 Percentages. Percentages should be limited to two decimal points; for example 25 percent shall be reflected as .25, or in accordance with approved Defense Contract Management Agency (DCMA) rate percentages, which may exceed two decimal places (i.e., extend to four (4) decimal places).
2.1.2.1.6 Additional Criteria. All proposal amounts shall be proposed in U.S. currency and be valid for 240 days after the proposal due date.
2.1.3 Part C – Table of Labor Categories and Labor Rates.
2.1.3.1 The offeror is required to submit prices for all Government provided labor categories, for all of the contract years (Year 1 through Year 5), for the optional 6 month extension period, and for the sample task order. The offeror shall complete and submit HC1013-16-R-0014, Attachment _2_, “Labor Rate Table”. This table reflects the Government’s required labor categories for all work currently anticipated under the ELOG effort and will become a basis for determining price reasonableness in subsequent task order requirements for Firm-Fixed-Price (FFP) task orders. Descriptions for the labor categories are provided as HC1013-16-R-0014, Attachment _3_, “Labor Rate Category Descriptions.” The final negotiated labor rates shall be considered “ceiling” or not-to-exceed (NTE) rates, and thereby subject to further downward negotiation at the task order level. All labor categories must be priced for all of the contract performance periods. Failure to price all labor categories for all years (to include work performed on a Government site and work performed at the Contractor site) may result in a rejection of the offeror’s proposal. Evaluation of option shall not obligate the Government to exercise such option.
2.1.3.2 The complete Table of Labor Categories shall be incorporated into the resultant contract as an attachment to the schedule.
2.1.3.3 The Offeror is permitted to submit an addendum proposing commensurate labor categories in the same format as shown in the Labor Rate Table at HC1013-16-R-0014, Attachment _2_. Commensurate labor categories proposed within the addendum shall be cross-mapped to the labor categories provided as HC1013-16-R-0014, Attachment _3_, “Labor Rate Category Descriptions.” In order to reduce the analytical burden on the Government in assessing the correlation of commensurate labor categories and descriptions to the labor categories and descriptions established by the Government in attachments, it is desired that Offerors propose commensurate categories only when it is necessary.
2.1.3.4 If commensurate labor categories are proposed, a description of duties shall be submitted as an addendum to HC1013-16-R-0014, Attachment _3_, “Labor Rate Category Descriptions.” If commensurate labor categories are proposed, the addendum with proposed labor categories, prices and descriptions shall be submitted with the Price Proposal.
2.1.3.5 The Government reserves the right to include or to not include any commensurate labor categories so proposed.
2.1.3.6 The offeror’s proposed Labor Rate Table shall reflect the period of performance as follows:
Table 3, Period of Performance for Labor Rate Table
Contract Year 1
Month 1-12
1 May 2017 – 30 Apr 2018
Contract Year 2
Month 13-24

Contract Year 5
Month 49-60
1 May 2021 – 30 Apr 2022
2.1.3.7 Pricing for all future contract actions (including, but not limited to proposal and billing of future task orders, modifications) will be firm-fixed-price (FFP) and restricted to the labor categories and fully burdened labor rates established in the offeror’s proposed FFP Schedule of Rates. The use of uncompensated overtime is not encouraged, see FAR 37.115-2(a). However, if the offeror’s proposed labor rates are adjusted for uncompensated overtime and this practice is supported by the offeror’s accounting practices, the offeror must provide the supporting data in accordance with FAR 52.237-10. The offeror shall indicate within the price proposal if uncompensated overtime will be used and also include a copy of its policy addressing uncompensated overtime.
(D) Volume IV – Past Performance. Acceptable format in Word or PDF. Each offeror shall submit a past performance volume with its proposal, containing past performance information in accordance with the format contained in HC1013-16-R-0014, Attachment _4__, Past and Present Performance Information.
(1) Along with the information required in this paragraph, the offeror shall submit a consent letter executed by each prime or subcontractor, teaming partner, and/or joint venture partner, authorizing release of past performance information to the offeror so the offeror can respond to such information. References may be performed as prime contractor or subcontractor.
(2) Relevant Contracts. Submit information using the format contained in HC1013-16-R-0014, Attachment _4_, Past and Present Performance Information. Past and Present Performance Information for the offeror/prime/subcontractors on 3 recent (active within the past 3 years from the date of this solicitation) contracts that you consider most relevant in demonstrating your ability to perform the proposed effort. The total of Past and Present Performance Information references will not exceed 3. Total page count for this Past Performance volume is annotated above in Table 1, Proposal Organization. Include rationale supporting your assertion of relevance. Relevant is present/past performance effort which involved similar scope and magnitude of effort and complexities this solicitation requires. Not relevant is present/past performance effort which involved little or none of the scope and magnitude of effort and complexities this solicitation requires. Finally, the past performance evaluation team will review this past performance information and determine Acceptable/Unacceptable basis as identified in Table 7, Ratings for Past Performance.
(a) Specific Content. Offerors are required to explain what aspects of the contracts are deemed relevant to the proposed effort and to what aspects of the proposed effort they relate. This may include a discussion of efforts accomplished by the offeror to resolve problems encountered on prior contracts as well as past efforts to identify and manage program risk. The offeror may include management actions employed in overcoming problems and the effects of those actions in terms of improvements achieved or problems rectified. Categorize the relevant information into the specific technical/management subfactors used to evaluate the proposal.
(b) Organizational Structure Change History. Many companies have acquired, been acquired by, or otherwise merged with other companies, and/or reorganized their divisions, business groups, subsidiary companies, etc. In many cases, these changes have taken place during the time of performance of relevant past efforts or between conclusion of recent past efforts and this source selection. As a result, it is sometimes difficult to determine what past performance is relevant to this procurement. To facilitate this relevancy determination, include in this proposal volume a "roadmap" describing all such changes in the organization of your company. A pamphlet or other commercial document describing such reorganizations may suffice. As part of this explanation, show how these changes impact the relevance of any efforts you identify for past performance. Since the Government intends to consider past performance information provided by other sources as well as that provided by the offerors, your "roadmap" should be both specifically applicable to the efforts you identify and general enough to apply to efforts on which the Government receives information from other sources.
(E) Volume V - Contract Documentation. Acceptable format in Word or PDF. The purpose of this volume is to provide information to the Government for preparing the contract document and supporting file. If a document is listed under this volume as well as under a different volume, it only needs to be submitted once and is the offeror’s discretion as to which volume it is submitted in.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(End of provision)
ADDENDUM TO 52.212-2(a), Evaluation-Commercial Items is tailored as follows:
a. Basis for Contract Award Award will be made to the responsible offeror whose proposal is determined to represent the overall best value to the Government using a best value tradeoff evaluation process. Failure to comply with the terms and conditions of the solicitation or with the administrative requirements in Addendum(s) may result in the offeror being ineligible for award. With regard to the best value analysis for the award decision, the below evaluation factors and subfactors will be used in the best value trade off analysis.
b. Evaluation Factors and Subfactors
(1) Relative Importance of Factors and Subfactors. The relative importance of each factor and subfactor is as follows: Within the Technical/Management factor, the subfactors are of equal importance. The Past Performance Factor is less important than the Technical/Management Approach Factor. All non-price evaluation factors, when combined, are significantly more important than price.
(2) The following evaluation factors and subfactors will be used to evaluate each proposal.
The technical/management evaluation will be evaluated using a combined technical/management rating and risk rating. Subfactor ratings shall not be rolled up into an overall color rating for the technical/management factor. The combined technical/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings.
Factor 1: Technical/Management Color/adjectival ratings for all subfactors (1, 2 and 3) will be provided at the subfactor level. All components/elements included in the individual subfactor are equal in importance. Components/elements will not receive an individual color rating.
Sub-Factor 1 – Remote Mobile Telecommunications Services Management Expertise. Offeror shall clearly demonstrate that it possesses the expertise to meet the following requirements, and propose an approach to the following:
a) The offeror’s role(s), knowledge, and capabilities from administrative, logistical and technical standpoints with the fielding and management of electronic devices and those devices’ corresponding systems and sub-systems, PWS Task 1, Operational Support; Task 2, Logistical and Procurement Support;
b) The offeror’s understanding and knowledge of mobile systems and devices, including small form-factor devices such as handsets and radios. Emphasis on satellite-based systems is preferred, PWS Task 5, Technical Support;
c) The offeror’s ability to employ expertise and support as well as devise solutions in remote, hostile, and arduous locations world-wide, PWS Task 6 –Highly Qualified Expert (HQE) Support.
Sub-Factor 2 - Management Plan. The Offeror shall propose a management plan that demonstrates the following:
a) Organizational Structure (including teaming agreements, subcontractor management and staffing plan which identifies the size, scope and structure of the offeror’s ELOG organization to demonstrate that the offeror can perform the PWS requirements;
b) Cost Management Plan reflecting process and commitment to reduce and contain the overall cost of the contract during the total contract life;
c) Change Management Plan highlighting change management processes and procedures to include any management changes that addresses the offeror’s ability to grow and shrink its staff in response to changing work conditions.
This evaluation includes any management challenges unique to ELOG and the offeror’s plan to contain and reduce contract price/costs, and the offeror’s business processes identifying the offeror’s ability to respond on a worldwide basis to task order requirements to include the offeror’s capability to obtain appropriate access (such as passports, VISAs, etc.), DoD Common Access Cards and other Government badges, etc.
Sub-Factor 3 – Sample Task Order. The offeror shall demonstrate a clear understanding of the ELOG effort by preparing a response to the following sample ELOG task order delineated in the Table below (note: this exact task order will not be awarded):

*After Date of Contract (ADC)
Part C (1) The ELOG sample task order represents an area of work that may be performed under the ELOG effort during the five (5) year lifecycle of the contract. In response to this task order, the offeror shall include a detailed technical/management approach for accomplishing the tasks, address any management aspects associated with the tasks (including the process/procedure for the transition approach for the task order), and discuss any issues which prevent accomplishing the work as specified. Any suspense listed for a delivery is in business days.
The offeror’s proposed overall technical approach to delivering the services/requirements identified in the respective Sample Task Order PWS will be evaluated on the degree to which the offeror’s response demonstrates responsiveness, minimizes risk of unsuccessful performance and demonstrates an understanding of the requirements using systematic processes and procedures and/or solution-oriented ingenuity where appropriate.
Factor 2: Past Performance Offerors will be evaluated on performance under existing and prior contracts for similar products or services. Offerors shall submit no more than three recent past performance efforts for evaluation. Cited past performance efforts shall not exceed two pages. A current point of contact for each past performance effort shall be provided by completing the embedded Past Performance Reference sheet and including it with your proposal. References other than those identified by offerors may be contacted by the Government, and the information received may be used in the past performance evaluation. The Government reserves the right to obtain information relative to present and past performance on its own, in addition to that provided by the offeror. Past performance information may be obtained through the Past Performance Information Retrieval System, through interviews with program managers on past efforts, or from any other sources or databases known to the Government.
The Government will first determine if a past performance effort is recent by evaluating whether the effort was performed during the past three years from the date of the release of the solicitation. Next, the Government will determine if the past performance effort is relevant to the subject matter, scope and complexities of the overall IDIQ PWS. For those efforts determined to be recent and relevant offerors will receive a performance assessment rating of acceptable or unacceptable based on the quality of performance the offeror or subcontractor provided under the effort. The resulting performance assessment rating is made at the past performance factor level and represents an overall evaluation of contractor performance. Offerors without a record of relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably on past performance and, as a result, will receive an "Acceptable" rating for the past performance factor.
Factor 3: Price
(a) Price proposals will be evaluated to determine if they are reasonable and complete. The offeror shall submit pricing for all periods including a separate line item pricing for an additional 6 month period that may be authorized IAW FAR 52.217-8. See FAR 52.217-8 which authorizes the Government to require continued performance of any services within the limits and at the rates specified in the contract. These prices shall be identical to the proposed pricing in the 6 months prior to expiration of the final year of the contract. The Government will provide a Pricing Spreadsheet Template, (reference HC1013-16-R-0014, Attachment 2) that the offerors shall utilize in pricing their proposal. Within the price proposal, all offerors are required to provide fully burdened FP labor rates for all labor categories for both Government and Contractor Sites. The total evaluated price for each offeror will be calculated by applying Government estimated labor hours for each year of contract performance to each offeror’s proposed fully burdened firm fixed priced (FFP) labor rates for each labor category and both site locations. The offeror’s price proposal will be evaluated based on the total evaluated price. The total evaluated price is the sum of the proposed labor rates for each labor category multiplied by the corresponding estimated hours for all five years, the optional 6 month extension period, and the price of the Sample Task Order (reference HC1013-16-R-0014, Attachment 6).
Completeness: The Government will determine completeness of an offeror’s price proposal by verifying that HC1013-16-R-0014, Attachment 2 has been completed, figures are correctly calculated, and prices are presented in a clear and useful format.
Reasonableness: Proposals will be evaluated using one or more of the techniques defined in FAR 15.404 to determine price reasonableness. Adequate price competition is anticipated; therefore, the offeror’s total evaluated price will be evaluated using one or more of the techniques defined in FAR 15.404-1 in order to determine if it is fair and reasonable.
Unbalanced Pricing. Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable proposal, the price of one or more labor rates is significantly unbalanced as indicated by the application of price analysis techniques. The Government will analyze offers to determine whether they are unbalanced with respect to separately priced items. Offers that are determined to be unbalanced may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
(b) Due to the likely inability of any offeror to accurately estimate travel and material/equipment purchases associated with this requirement, the Government is providing plug numbers to be used by all offerors when proposing ODCs. Offerors are instructed to propose plug numbers for ODCs in the following EXACT amounts, however actual travel shall be authorized by the COR in writing prior to performance and will be paid IAW FAR Part 31.205-46.
Travel and Equipment ODCs Year 1: $600,000.00 Year 2: $700,000.00 Year 3: $800,000.00 Year 4: $900,000.00 Year 5: $1,000,000.00 Optional 6 month extension: $0 Sample Task Order: $500,000.00 These EXACT amounts shall include all audited markups and burdens and shall not be rounded or adjusted based upon independent decisions regarding actual anticipated ODCs. A proposal that fails to bid the plug numbers EXACTLY as provided may be excluded from further consideration.
Contractor-proposed labor categories must be cross mapped to the Government-provided labor categories.
(c) Total Evaluated Price. The offeror’s total evaluated price will be calculated by adding the proposed price of the base and all option years to the proposed price of the Sample Task Order. The proposed price for the base and all option years will be calculated by multiplying proposed labor rates for each labor category by the corresponding estimated hours specified by the Government in the Table of Labor Rates, HC1013-16-R-0014, Attachment _2_, and then adding the totals together along with the Government provided Plug ODC CLIN. The proposed price of the sample task order will be calculated by multiplying the proposed labor category rates in the “Sample T.O.” tab of HC1013-16-R-0014, Attachment 2 by the Government’s estimated labor hours, and then adding the totals together along with the Plug ODC CLIN.
c. Ratings
(1) Each technical/management subfactor will receive one of the ratings described in Table 5 below. The subfactor ratings will not be rolled up into an overall color rating for the Technical/Management factor.
The combined technical-management/risk rating includes consideration of risk in conjunction with the strengths, weaknesses, and deficiencies in determining technical ratings. Combined technical/risk evaluations shall utilize the combined technical/risk ratings listed in Table 5. Table 6 provides a definitions relating to the technical evaluation rating process.
