Clause states the successful offeror must have a final Top Secret Facility Clearance (FCL) from the Defense Security Service (DSS) Facility Clearance Branch (FCB) during the period of performance.
Question: According to the DSS FCB, it takes an average of less than 30 days to upgrade a company from SECRET to TOP SECRET. In order to increase competition and improve opportunities for qualified SDVOSBs to perform the work, will the government consider bids from qualified SDVOSBs that have an approved SECRET FCL and use the time period from Contract award to the start of the period of performance (transition period) in order to process a TOP SECRET FCL per the DD-254 (attachment 8)?
PWS Attachment 1, Section 12.2
Yes. The RFP language in all applicable documents will be changed to read, “an offeror must be able to obtain a TOP SECRET facility clearance”. A TOP SECRET facility clearance will not be required at time of award, but must be obtained by 180 days after the contract effective date.

2
Clause states in order to be eligible for award, the offeror must provide proof of a valid final Secret/Top Secret Facility Clearance (FCL) from the Defense Security Service (DSS) Facility Clearance Branch (FCB) with its proposal.
Question: The Government indicates that a valid final Secret or Top Secret would be acceptable. In order to eliminate all doubt and remove conflict with other paragraphs within the PWS, will the government edit this clause to allow Offerors that have valid final SECRET FCLs to be eligible for award?
Addendums Attachment 9, Section D. ii. page 5 Yes. The RFP language in all applicable documents will be changed to read, “an offeror must be able to obtain a TOP SECRET facility clearance”. A TOP SECRET facility clearance will not be required at time of award, but must be obtained by 180 days after the contract effective date. Therefore, a SECRET FCL will be eligible for award.

Clause states offerors must present proof of a valid final Top Secret Facility Security Clearance (FCL) with the submission of their proposals. Non-conformance with these instructions may result in removal of the proposal from further evaluation.
Question: Given the short timelines necessary to obtain final Top Secret FCL with appropriate awarded contract paperwork (DD254), is it the government's intent to limit competition only to SDVOSBs with existing TS facility clearances? In order to increase competition and potentially provide a better solution to EMSS users, will the Government consider allowing Offerors with valid SECRET FCLs to bid on the effort with the caveat that the awardee must obtain its final Top Secret prior to the performance start date?

Question: Will the government allow the Facility Clearance of Subcontractors to satisfy the TOP SECRET FCL requirement for the RFP?
Addendums Attachment 9, Section: D. ii.
The prime contractor is required to hold the facility clearance. The prime contractor must be able to obtain a TOP SECRET facility clearance. A TOP SECRET facility clearance will not be required at time of award, but must be obtained by 180 days after the contract effective date.

Question: If the three positions that require TS-SCI clearance are subcontracted to partners / teammates that have an active TOP SECRET FCL, will the government allow the Facility Clearance of those Subcontractors to satisfy the TOP SECRET FCL requirement for the RFP?
PWS Attachment 1, Section 12.2 – 12.3
No, however see the revised FCL requirement.

6
Clause states Quality Assurance is critical to ensure accurate and timely delivery of all products required under this contract, and to ensure that all items perform as required. Contractor shall be certified ISO-9001:2008 for the delivery of all items required by EMSS.
Question: Given that this is a 100% SDVOSB set aside contract and that the ISO 9001:2008 certification process is normally something associated with larger businesses, will the government allow for the ISO-9001:2008 certification of partners and subcontractors to satisfy the ISO9001:2008 requirement for this effort?
PWS Attachment 1, Section 6.2.7
Yes

The Government references including offeror information on the SF 1449, but one was not included in the solicitation documents. Will the Government please provide a SF 1449 for this effort?
Attachment 9, FAR 52.212-1, page 1
No. The SF 1449 is not applicable when using the combined synopsis/solicitation. Solicitation states on page 1, paragraph (1), it is in accordance with the format in Subpart 12.6. (12.603(b)). Reference to SF 1449 has been removed from RFP.

The Government requests the offeror’s OCCI Mitigation Plan both in Volume II – Technical, and Volume V – Contract Documentation. Will the government please confirm the OCCI Mitigation Plan is only required to be submitted once, and within Volume V – Contract Documentation? Offerors may still address their lack of OCCIs or reference their OCCI Mitigation Plan in Volume II – Technical, but with the limited technical page count it would be counterproductive for the Government to require offerors to submit the OCCI Mitigation Plan itself within the technical volume.
Attachment 9, (viii) Proposal Organization, (B) Volume II, Technical; (E) Volume V, Contract Documentation 7,12
Yes, the OCCI Mitigation Plan is excluded from page count and may only be submitted once.
N
9
Will the Government please increase the page limit for Volume II – Technical by ten pages, to a total limit of 35 pages? 25 pages is an extremely limited space to provide all the requested technical information, as well as to fully address all the requirements for the sample task order. An increase of ten pages would enable a more thorough technical response while still addressing all sample task order requirements.
Attachment 9, (vi) Table 1, Proposal Organization, 6
Yes. The new page limit for Volume II is changed from 25 pages to 35 pages.
Y
10
The Government states “2. You must provide completed pricing information in the CLIN spreadsheet.” This is usually provided in Section B, however, no Section B was included in the solicitation documents. Will the Government please provide a Section B for this effort?
Attachment 9, (E) Volume V, Contract Documentation 12, page 12
A combined synopsis/solicitation does not have Section B. Attachment 2 are spreadsheets for Labor Rate Tables.

"...In order to be eligible for award, the offeror must provide proof of a valid final Secret/Top Secret Facility Clearance (FCL) from Defense Security Services (DSS) Facility Clearance Branch (FCB) with its proposal....Offerors must present proof of a valid final Top Secret Facility Security Clearance (FCL) with the submission of their proposals."cognizant Defense Security Service representative, Mr. Juan Carillo, he informed us that the Attach_9_Addendums document section referring to Facility Clearance Requirements should be changed as follows regarding Secret and or Top Secret statements: ADDENDUM TO 52.212-1, (ii) should read as follows: "...In order to be eligible for aware, the offeror must be able to obtain a valid final Secret/Top Secret Facility Clearance (FCL) from Defense Security Services (DSS) Facility Clearance Branch (FCB) with its proposal....Offerors must be able to obtain a valid final Top Secret Facility Security Clearance (FCL) with the submission of their proposals."
The reason for this proposed change is due to the fact that a prospective contractor cannot apply for its own facility clearance, the procuring activity or cleared prime contractor must submit a request to clear the prospective bidder. This can be done via either a signed and completed DD Form 254 or letter from the procuring activity or cleared prime contractor requesting the bid validating the need for the clearance.
It would seem that requiring a Top Secret Facility Clearance at the time of submission of a bid significantly limits the number of Service Disabled Veteran Owned Small Businesses able to participate and gives an unfair advantage to contractors currently executing contracts that have a Top Secret FCL requirement currently employs personnel with Top Secret clearances and maintains them on our JPAS account, however we don’t currently have a contract that requires a Top Secret FCL. Our DSS representative indicated that “contractor name” has in place all the necessary requirements to upgrade our FCL from Secret to Top Secret. We respectfully ask that you consider this change to the wording in Attachment 9 and the corresponding change to the DD254.
Attachment 9, Addendums to 52.212-1, (ii), page 5 of 31
The RFP language in all applicable documents will be changed to read, “an offeror must be able to obtain a TOP SECRET facility clearance”. A TOP SECRET facility clearance will not be required at time of award, but is expected to be obtained by 180 days after the contract effective date. Therefore, a SECRET FCL will be eligible for award.

. Additional Follow-up :
We will be forced to sever the relationship in pursuing EMSS if we are forced to have a Top Secret Facility Clearance at the time of offer as opposed to during contract performance.
“Contractor name” is not at all suggesting that we cannot fulfill the requirement to obtain and maintain a TS FCL. On the contrary, our DSS Representative stated that we have everything in place to ensure upgrade to a TS FCL as soon as we have a sponsoring contract. He also counseled that it is not possible to get one for this contract without being awarded this contract. “Contractor name” has current Secret FCL and employees with Top Secret clearances.
Our position is that it is a significant limiter to competition if the offeror must have a final TS FCL at bid submission rather than during contract performance.
Further, Section 6.8 in the PWS reads, in part:
The initial start-up period will be established on a per task order basis after award and shall be completed six months after award of the basic contract or task order whichever occurs first… We ask that you amend the Addendums to the Instructions to Offerors as suggested below.
ADDENDUM TO 52.212-1, (ii) to read as follows:"...In order to be eligible for award, the offeror must be able to obtain a valid final Secret/Top Secret Facility Clearance (FCL) upgrade from Defense Security Services (DSS) Facility Clearance Branch (FCB) within the 6 month transition period....Offerors must be able to obtain a valid final Top Secret Facility Security Clearance (FCL) upgrade within the 6 month transition period”
PWS
Section 6.8 Yes.

Sample Task Order related: Is current training material to be provided as GFE? Is the TO labor rate table missing hours for project manager and logistics analyst lead? (there is tasking for those rates in the SOW but no hours allowed). There are no Contractor site hours stated for the FSRs – are they intended to be either deployed or on leave the entire 12 months?
Attachment 2
Current training material will be provided as GFI. Reference Attachment 2, Sample Task Order tab. Only the labor categories and designated locations (e.g., Government Site or Contractor Site) with hours assigned to them by the Government are to be used to accomplish the work within the Sample Task Order PWS. Offerors are only required to input the applicable hourly labor rate based on the Government-selected labor categories and corresponding hours assigned. The hourly labor rates must not exceed the offeror’s ceiling rates for the applicable period of performance (e.g., Year 1). The summation of the labor category totals plus the provided ODC of $500,000 (e.g., total proposed price) will be the only price factor considered and evaluated for the Sample Task Order (e.g., there is no need to consider/factor-in leave or any other deployment status into the price). Moreover, Offerors should only use or reference these Government-selected categories when completing the technical/management aspect of the Sample Task Order proposal.

There are conflicting statements regarding COMSEC. DD254 states no COMSEC required but PWS Task 7, 6.7.3 and 6.7.4 state COMSEC requirements.
PWS
Task 7, 6.7.3 and 6.7.4 The offeror must be able to comply with COMSEC storage laws and regulations. The offeror must be able to store and ship COMSEC. These requirements will not be enforced at time of contract award, but are expected to be achieved by 180 days after contract effective date. The applicable RFP documents will be updated accordingly.

No clauses or instructions for payment/invoices instructions; subcontracting; travel costs; and payment for overtime. Does the Gov intend to incorporate additional clauses into the solicitation to cover these topics?
RFP and Attachment 9
Clauses 52.212-4 and 52.219-14 are included in the solicitation which address payment/invoice instruction as well as subcontracting.
Pricing for all future contract actions (including, but not limited to proposal and billing of future task orders, modifications) will be firm-fixed-price (FFP) and restricted to the labor categories and fully burdened labor rates established in the offeror’s proposed FFP Schedule of Rates. The use of uncompensated overtime is not encouraged, see FAR 37.115-2(a). However, if the offeror’s proposed labor rates are adjusted for uncompensated overtime and this practice is supported by the offeror’s accounting practices, the offeror must provide the supporting data in accordance with FAR 52.237-10. The offeror shall indicate within the price proposal if uncompensated overtime will be used and also include a copy of its policy addressing uncompensated overtime.
Travel invoicing instructions have also been added to the PWS.
No additional clauses are expected to be incorporated before the proposal due date.

The Government clearly requires through the PWS for the contractor to support all EMSS services and devices. However, sections 6.1.15, 6.5.10, 6.5.12, 6.6.2, and 6.6.10 make specific restricted references to DTCS, only one technology in the larger EMSS portfolio. Will the Government reword these 5 sections to incorporate all EMSS products to be consistent with the rest of the PWS, and to allow for contractor responsibility on new technologies which may be incorporated into the EMSS program over the life of the contract?

The Government makes multiple references to supporting missions in the USCENTCOM AOR including Afghanistan and Iraq, and similarly in this section addresses the need for experience and compliance with Theater Business Clearance (TBCs). However, the Government does not address the need for compliance of Host Nation business and labor laws including commercial business licenses, corporate registrations with partner nations, and other prerequisite conditions before US companies can perform in many USCENTCOM countries specifically mentioned in the RFP. Will the Government incorporate a requirement for the contractor to demonstrate compliance with these Host Nation prerequisite conditions?

The Government states that “The Contractor shall support the customer in all technical aspects of the intelligence reporting system and provide guidance and advice on utility options.” Will the Government please clarify what is meant by the “intelligence reporting system?” Does the Government mean command and control (C2), or a Common Operating Picture (COP)?
Attachment 1, PWS Para 6.5.7
Offerors may assume “intelligence reporting systems” are command and control (C2) or like systems. The intent of this requirement is for the contractor to be able to discern information from common C2 or like systems and recommend to the Government ways to best use the fielded capability (for example, DTCS) as a result of the information being produced by the C2 system.

The Government is requesting work to be completed in Afghanistan (PWS Para 6.5.9). In order to successfully perform these services, the contractor MUST have an Afghanistan business license. Please be advised that the transition of this contract poses a serious risk to the Government if the contractor does not have this necessary license at the time of award. Will the Government consider incorporating a requirement for the contractor to have an active Afghanistan business license at the time of proposal?
Attachment 1, PWS Para 6.5.9
Proposals will be evaluation in accordance with the stated evaluation criteria in the solicitation.

The requirement “…to employ educated…to mean at least a bachelor’s degree….” does not seem consistent with Attachment 3, Personnel Qualifications, which describes each labor category in functional and technical terms which neither require nor imply a need for a bachelor’s degree to meet the labor category descriptions, and successfully perform those functions. Is it the Government’s intent that every labor category require a bachelor’s degree? To which labor categories is the Highly Qualified Expert (HQE)/Subject Matter Expert (SME) (para 6.6) to apply? Our experience is that college degrees do not equate to ELOG HQE/SME qualifications, capability, or performance. We request that the Government reconsider the requirement for bachelor’s degrees.
Attachment 1, PWS Para 6.6.4, Attachment 3, Personnel Qualifications, Attachment 1
Reference Attachment 6, “PWS”, article 6.6.4 which read, “The Contractor shall employ highly-trained, educated, and experienced personnel” is replaced with new language that does not stipulate the requirement of any degree, only experience consistent with the description provided in Attachment 3. In this instance the Highly Qualified Expert (HQE)/Subject Matter Expert (SME) pertains to the COCOM Liaison position as described with Attachment 3 as amended.

These sections seem to require COMSEC, however the DD254 (Attachment 8) does not require COMSEC. Will the Government please clarify?
Attachment 1, PWS Para 6.7.3 and 6.7.4 The offeror must be able to comply with COMSEC storage laws and regulations. The offeror must be able to store and ship COMSEC. These requirements will not be enforced at time of contract award, but are expected to be achieved by 180 days after contract effective date. The applicable RFP documents will be updated accordingly.

The Government’s evaluation criteria demonstrates the high importance of Past Performance. However, by allowing a “Acceptable / Not Acceptable” wherein a “No Response” is counted as an “Acceptable” score, prospective bidders are incentivized not to respond to the Government’s request for Past Performance at all since doing so guarantees an “Acceptable” rating. Will the Government change the evaluation criteria to a “Color Rating” similar to the Technical and Management sections so as to not reward a lack of response, and to give a weighted consideration for the strength of the contractor’s Past Performance references?
Attachment 5, Ratings,
Table 3, Ratings for Past Performance

This section makes reference to “Theater Business Clearances” which are processes implemented by a US Combatant Command (i.e. USCENTCOM), however does not speak to the requirements imposed by Host Nations such as business and labor laws including commercial business licenses, corporate registrations with partner nations, and other prerequisite conditions. Since this STO specifically seeks to gauge the contractor’s ability to perform in Afghanistan and Iraq, will the Government require the contractor to demonstrate its compliance with Host Nation laws in these countries?

Attachment 6, STO PWS, Transition Support Page 2, 7
The labeling is correct as written. “Task Area 8”, as referenced under the “Scope” section within the Sample Task Order PWS, is provided to sufficiently map Task 7, “Transition” back to the parent PWS (Attachment 1).

We do not understand the rationale for the Government adding the total cost from the Sample Task Order and the full 5 year (+ 6 month option) IDIQ rate table for the total price consideration. This effectively treats the Sample Task Order as if it were another option period on the master contract, it does not put any significant weighted consideration for the Offeror’s price response to the Sample TO. Typically a sample TO is the evaluated criteria and the IDIQ rate table is considered separately. Will the Government please clarify its intent?
Attachment 9, Addendum to 52.212-2(a), Factor 3, Price, (a) and (c) Page 15, 16
The sample task order is not another option period and will not be awarded. For evaluation purposes, it is included in Factor 3. The sample task order is also included in the evaluation for the technical/management Factor 1
Y
41
The language in the referenced FAR clause says that, “The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement,” but does not speak to the incorporation of the Sample Task Order for evaluation or price consideration. The language on page 16 says that the evaluated price will also include the Sample Task Order. Please de-conflict and clarify.
Attachment 9, 52.212-2 (b), Addendum to 52.212-2(a), Factor 3: Price, (a) and (c) Page 12, 15, 16
Subparagraph (b) as the title specifies it is referring to options. The overarching price evaluation under Factor 3 addresses total evaluated price and all elements which are included: “The total evaluated price is the sum of the proposed labor rates for each labor category multiplied by the corresponding estimated hours for all five years, the optional 6 month extension period, and the price of the Sample Task Order (reference HC1013-16-R-0014, Attachment 6).”
Y
42
The Government states, “Contractor-proposed labor categories must be cross mapped to the Government-provided labor categories.” The Government’s intent is unclear. If the contractor is proposing a new labor category (including price in Attachment 2 and description in Attachment 3), why / how is the contractor to cross-map into an existing Government-provided labor category? What is the Government expecting from a “cross-map” to an existing labor category if the contractor is proposing a new technical skill set and price?
Attachment 9, Addendum to 52.212-2(a), Factor 3: Price, (b)
“Contractor-proposed labor categories must be cross-mapped to the Government-provided labor categories” means offerors may use their own corporate unique titles to satisfy the labor category descriptions specified by the Government, the offeror just needs to sufficiently articulate their category relative to ours.
Y
43
Will the Government please clarify if a written cost narrative is required? If so - what content should be included in the narrative; and if no written cost narrative is required, will the Government please clarify where offerors are to include their pricing notes?
Attachment 9, Addendum to 52.212-1(b), (C) Volume III - Price Page 8, 9
Attachment 9, Addendum 52.212-1(b), paragraph 2.1.3.3 states that offerors are permitted to submit an addendum when proposing. There is no page limitation for the Price, Volume III, which may include a cost narrative with content determined by the offeror which supports Price in Word or PDF format.

In Technical Sub-Factor 1 – Remote Mobile Telecommunications Services Management, the Government requires only that offerors demonstrate their knowledge of mobile systems and devices, and that knowledge of satellite-based systems is preferred. 100% of the systems under this contract are satellite based. Knowledge of satellite systems should not be merely preferred, but rather required. Further, 100% of the satellite systems for the EMSS office are on the Iridium constellation, and experience with Iridium satellites specifically should also be required. Will the Government consider incorporating these requirements?
Attachment 9, Addendum to 52.212-2(a), Sub-Factor 1 – Remote Mobile Telecommunications Services Management Expertise
No
N
45
| The Government states that offerors for whom past performance information is not available will receive an “acceptable” rating for the past performance factor. This defeats the purpose of including a past performance volume.
