1. Wage Determination PA170005, Mod 2, dated 1/27/17, is hereby rescinded. The attached Wage
Determination PA170005, Mod 3, dated 4/14/17, is hereby incorporated into the solicitation.
2. The attached Pre-Proposal Conference Minutes, dated 4/19/17, are hereby incorporated into the solicitation.
3. The attached Attendee List for the pre-proposal meeting are hereby incorporated into the solicitation.
4. The attached GSA Form 850 (Contractor Information Worksheet) is hereby incorporated into the solicitation.
5. Offerors are reminded that the Government would like to receive RFIs by 5/2/17, and may not be able to answer questions in a timely manner after that date. Please send RFIs by email to

On all machines with booms, jibs, masts and leads, including tower cranes, 100 ft. from ground up, fifty cents ($.50) per hour additional will be paid for each increment of 25
ft. over 100 ft. On cranes with booms (including jibs, masts and leads) 200 ft. and over, two (2) operators will be required. When two (2) operators are employed, no Oiler will be required. Booms to be measured from the ground up.

FOOTNOTE:
A. PAID HOLIDAYS: Memorial Day, Independence Day, Labor Day, Thanksgiving Day and five personal holidays provided employee works at least one day in the three work days before and at least one day in the three work days after the said holiday. Emloyee earns a personal holiday every two months, provided employee has worked twenty-six day in each consecutive two month period, up to a maximum of five per calendar year. After 130 work days the employee is entitled to all five personal holidays.
B. PAID VACATION: Employee will earn one vacation day for every two months, provided employee has worked twenty-six day in each consecutive two month period, up to a maximum of five vacation days per calendar year. After 130 workdays the employee is entitled to all five days of vacation. Employees with 5 years of seniority, earn an additional week of vacation, accrued in the same way.
WELDERS - Receive rate prescribed for craft performing operation to which welding is incidental.
Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the
Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses
(29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate
(weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or
"UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010
08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour
Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the
Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the

Project Title: Mid-Atlantic Social Security Center HVAC Renovation Project, 300 Spring Garden Street, Philadelphia, PA Solicitation: GS-03-P-17-AZ-C-0013

Provide all materials and labor for the renovation of the Heating, Cooling, and Air Conditioning System at the Mid-Atlantic Social Security Center (MATSSC) at 300 Spring Garden Street, Philadelphia, PA. Specific requirements include replacement of eight (8) twelve-ton chilled water computer room air conditioning units, replacement of three hundred (300) existing two-pipe fan coil units, repair and replacement of various internal components of four (4) existing air handling units, replacement of fourteen (14) existing pipe expansion compensators, replacement of three hundred (300) existing four-pipe fan coil units, and replacement of all pipe insulation on most risers and run-outs.
The HVAC control system components being replaced in this project must be fully compatible with the existing control systems, the Andover Continuum Brand, for seamless functioning.
Purpose
The purpose of this pre-proposal conference is to afford interested contractors the opportunity to see the site of the requirement, ask questions, receive answers either at the conference or later regarding any concerns they may have regarding the contract provisions and requirements of this project. Answers, especially those that require further study, shall be deferred and answered in the minutes to this meeting and issued as an amendment to the contract.
Please keep conversations to a minimum during the walk-through so you don’t miss important announcements.
In order to prevent unnecessary extension of the proposal due date, we request that any questions you may have during or following this meeting be submitted in writing by the close of business, May 2, 2017. The Government cannot guarantee a response to questions submitted later than May 2, 2017.

Oral statements made by a Government representative during today’s pre-proposal conference or any site visit, or any written record of such oral statements as may be furnished to the offeror will not qualify or be deemed to have the effect of adding to, modifying, or otherwise varying from the written provisions of the Request for Proposal. In the event the discussion or questions raised during today pre-proposal conference or during any other site visit, indicate a need to modify the Request for Proposal, an amendment to the solicitation will be issued in writing. Any amendment to the solicitation must be acknowledged on SF 1442.
3. Contractual Preview
a. Contract type: firm fixed price (FFP).
b. NAICS Code: 238220, Plumbing, Heating, and Air Conditioning.
c. The estimated FAR total cost range for this project is between $5,000,000 and $10,000,000.
d. Period of performance. The project period of performance is five hundred forty seven
(547) calendar days from of notice to proceed (NTP), which includes security clearances and badging. This period of performance includes final cleanup of the premises. Any change made to the period of performance will be issued in an amendment prior to award, and in a modification after award.
e. Options. There are no options for this requirement. Any references to options in technical specifications shall be considered to be part of the base requirement.
f. Bonding requirements:
a. A performance bond for 100% of the contract price and a payment bond for 100% of the contract price will be required within 10 days of award.
b. A bid bond is required in the penal amount of 20% of the total price of the contract. It will be submitted with the proposal.
g. Insurance requirements. The contractor must furnish the contracting specialist with a current certificate of insurance, listing the Government as a co-insured party and meeting the requirements specified in this solicitation within ten (10) days of award.
Refer to The Agreement, Section III.A.12. “Insurance Requirements.” The contractor may not begin actual work on the site until the performance bond and certificate of insurance have been received and found acceptable. Please note the language required on the certificate of insurance as specified in this solicitation is different from the standard language provided by insurers, so take care to ensure the language on the certificate complies with the requirements of this solicitation.
h. Wage and fringe benefits: Contractors are to pay the minimum wage and fringe benefits required by the Davis Bacon Act, Labor Standards, GSA Form 3505, (FAR 52.222-11 and FAR 222-6. If the Davis Bacon wage requirements change after receipt of proposals and prior to issuance of award, contractors shall have the opportunity to adjust their price proposal.
i. Liquidated damages. If the contractor fails to complete the work within the required time, the contractor shall pay liquidated damages to the Government in the amount $934.92 per calendar day until the work is completed and accepted.
j. Invoice requirements. Payments will be made within fourteen (14) days after receipt of the contractor’s invoice.
The percentage of work completed will be determined at the inspection meeting and after the actual percentages of work completed is determined and acceptable by all parties based upon approved schedule of values, the contractor will submit a finalized original invoice the contracts specialist, Jeff Linskens. Payment certification is required with each payment request issued to GSA Finance, and a Release of Claims form is required with the final invoice.
The contractor shall submit an SF 2419, Certification of Payment, to subcontractors and suppliers with each invoice. Payment requests shall include an updated project schedule, and invoices will be returned if the schedule is not included. Full payment may be made for satisfactory progress; however, up to 10% may be withheld from the requested amount for unsatisfactory progress. The contractor’s record documents will be reviewed each month during invoice inspection.
k. Request for sensitive but unclassified documents. This solicitation includes sensitive but unclassified (SBU) building information. SBU documents provided under this solicitation are intended for use by authorized users only. In support of this requirement, GSA requires offerors to exercise reasonable care when handling documents relating to SBU building information per the solicitation. The contractor and all subcontractors agree that they will abide by this agreement and will only disseminate SBU building information to other authorized users under the conditions set forth above.
l. FAR 52.222.23: Notice of Requirement for Affirmative Action to Ensure Equal
Employment Opportunity for Construction (Feb 1999). The goal for minority participation for each trade is 17.3%, and for female participation is 6.9%.
m. Covered area. As used in this solicitation, the “covered area” is Philadelphia County, Pennsylvania.
n. Subcontracting plan. Because this solicitation is set aside for small business, a subcontracting plan is not required to be submitted.
4. Price and Technical Proposals
a. Price. Each contractor is required to submit the proposal price on block number 17 of the SF 1442, Solicitation of Offer and Award, and complete the Block 17 Continuation Sheet.
b. Technical factors are considered significantly more important than price. The following are technical criteria listed in descending order of importance: prior experience on relevant projects, past performance, and key personnel qualifications. It is a good practice to provide technical factor information in the same order and using the same language used to describe the technical factors in the Solicitation.
c. Owner Reference / Evaluation Forms were provided in Item 13 of the solicitation.
Offerors are to provide the forms to the references they cite in “Prior Experience on Relevant Projects.” The owner reference will email the completed form to jeffery.linskens@gsa.gov so that it arrives not later than the proposal due date and time.
d. Please carefully review each factor and provide all information asked for. An early and thorough review of the Solicitation will afford Offerors an opportunity to ask clarifying questions prior to submission of their proposal.
e. Note that the qualifications of the project manager and superintendent will be reviewed during the proposal evaluation and incorporated into the contract at time of award.
Consequently, the project manager and superintendent must be maintained during the pendency of the contract. After award, requests for substitution of such personnel must be submitted to the contracting officer for review and approval.
f. Standard Form 1442 is the solicitation offer and award form. Fill this form out completely and acknowledge all amendments on this form, or sign and return the amendment as your acknowledgement of the amendment.

Applicability of Contractor Information Worksheet Use this Contractor Information Worksheet for all GSA contractors.

Transmitting the Contractor Information Worksheet Do not save completed forms on your workstation. Per GSA requirements:
If Personally Identifiable Information (PII) needs to be transmitted over the Internet, it must be sent using encryption methods defined in Chapter 5, Paragraph 7 of GSA Order CIO P 2100.1E GSA Information Technology (IT).
o All passwords must be encrypted in storage.
o All sensitive information, such as PII, as deemed by the data owner, which is transmitted outside the GSA firewall, must be encrypted. Certified encryption modules must be used in accordance with FIPS PUB 140-2, “Security requirements for Cryptographic Modules.”
o When using password generated encryption keys, a password of at least 8 characters with a combination of letters, numbers, and special characters is required. A password of at least 12 characters is recommended.
o Systems implementing encryption must follow the key management procedures and processes documented in CIO IT Security Procedural guide 09-43, “Key Management.”
If PII needs to be emailed within the GSA network, please use Google E-Mail. For additional protection the information also can be encrypted as described in Chapter 5, Paragraph 7 of this IT security policy.
If PII needs to be sent by courier, printed, or faxed several steps should be taken. When sending PII by courier mark "signature required" when sending documents. This creates a paper trail in the event items are misplaced or lost. Don't let PII documents sit on a printer where unauthorized employees or contractors can have access to the information. When faxing information use a secure fax line. If one is not available, contact the office prior to faxing so they know information is coming and contact them after transmission to ensure they received it. For each event the best course of action is limit access of PII only to those individuals authorized to handle it, create a paper trail, and verify information reached its destination.
