About this file

This is a Federal Required Certification document mandated by 44 C.F.R. Part 18 for the City of Pasadena Department of Water and Power's Distributed Energy Resource - Rooftop Wind Microturbine Project in California. The certification pertains to lobbying activities and compliance with federal appropriations regulations. Contractors submitting proposals for the design, engineering, permitting, procurement, and maintenance of a minimum 5 kW rooftop wind turbine to be installed on a municipally owned building at the City Maintenance Yards must execute this certification as a prerequisite for contract award. The document requires the contractor's authorized official to certify that no federal appropriated funds have been or will be paid to influence agency officers, members of Congress, or congressional employees in connection with this federal contract or any related subawards.

The certification establishes that if non-federal funds are used for lobbying purposes, contractors must submit Standard Form-LLL, "Disclosure Form to Report Lobbying." Contractors are required to incorporate this certification language into all subawards at all tiers, including subcontracts and subgrants. Submission of this certification is mandatory and constitutes a material representation of fact. Failure to file the required certification subjects the contractor to civil penalties ranging from $10,000 to $100,000 for each violation. The contractor's authorized official must sign and date the certification, affirming the truthfulness and accuracy of all statements and acknowledging that the provisions of 31 U.S.C. Chapter 38, Administrative Remedies for False Claims and Statements, apply to the certification and any related disclosures.
