About this file
The document is an Addendum #001 to Invitation to Negotiate (ITN) FDC ITB-25-071 issued by the Florida Department of Corrections (FDC) for the Operation and Management of Contractor-Operated Correctional Facilities at Lake City Correctional Facility. The addendum provides responses to written questions from potential bidders regarding the solicitation, covering various aspects of the contract including facility operations, inmate services, staffing requirements, medical services, programming, and transition plans. The solicitation seeks a contractor to manage a 893-bed minimum/medium/close custody male youthful offender facility, with bids due by May 23, 2025, and a planned service commencement date of July 1, 2026. The initial contract term is three years, with options for successive two-year renewal terms.
The addendum clarifies key details such as the facility's plans to house approximately 55-70 inmates aged seventeen (17) and under, the requirement for an Extended Day Program, and specifics on medical services, staffing, and performance standards. The document indicates that the per diem will be a blended rate for both the seventeen (17) and under population and the general population (18-24), with vendors expected to provide a single per diem certification. The state will cover costs for physical plant changes to accommodate the younger inmate population and expects the contractor to maintain American Correctional Association (ACA) accreditation and meet specific inmate program participation requirements. The addendum also addresses technical aspects of the contract, including subcontracting rules, staffing approvals, criminal background checks, and various reporting and compliance requirements.

Many current FDC contracts include “Notice of Claims” as Section 8.6 and read as follows:
“NOTICE OF CLAIMS. Within five (5) calendar days after receipt by the Department, or of any agent, employee or officer thereof of a summons in any action, or within five
(5) calendar days of receipt by the Bureau or the Department, or of any agent, employee or officer thereof, of notice of claim, the Department or any agent, employee or officer, shall notify Contractor in writing of the commencement thereof. The notice requirement is intended to ensure that Contractor’s defense of the claim is not harmed by failure to comply with the notice requirements. Failure to comply with the notice requirements may result in Contractor’s refusal to indemnify the Department or any agent, employee or officer, but only if such failure to notify results in a prejudice to Contractor, the Department, or any agent, employee or officer. Contractor shall provide the Department similar notice of claims.”
Can FDC please clarify why this language was removed and will it please consider restoring it?
FDC can only commit to what it believes it can, in good faith, accomplish. FDC is the largest state agency in Florida with major facilities across the state. When the clause you reference was included as part of the current contract, the Bureau of Private Prisons was housed at the Florida Department of Management Services where the seven contractor-operated correctional facilities were the only prisons monitored by that agency. The Bureau transferred to FDC in October 2023 where the seven contractor-operated correctional facilities were added to FDC’s portfolio for a total of 135 facilities statewide.
