Section L - Instructions, Conditions and Notices to Bidders
INSTRUCTIONS TO OFFERORS
A. GENERAL INSTRUCTIONS. This section provides general guidance for preparing proposals as well as specific instructions on the format and content of the proposal. This information is supplemental to FAR 52.215-1 and 52.215-1 Alt I. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, in addition to those identified as Factors. The proposal shall be compliant with the requirements as stated in the Statement of Objectives (SOO) and the remainder of the RFP. Failure to meet a requirement may result in an offer being ineligible for award. Alternate proposals will not be accepted.
(1) Include Sufficient Detail: The technical proposal/Contractor’s Statement of Work (CSOW) shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of the stated claims. The proposal/CSOW shall not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale and details that address how the Offeror intends to meet these requirements. Offerors shall assume that (1) the Government has no prior knowledge of their facilities and experience, and (2) the Government will base the evaluation on the information presented in the Offeror’s proposal/CSOW.
(2) Page Limitations/Size: Offeror’s proposal shall consist of (2) separate parts: Part I – Technical Proposal/CSOW, Part II – Price Proposal. Part I shall only include the technical proposal. Part II shall include all detailed pricing information ( See Factor 2) and all completed clauses. Part I shall not exceed 50 pages . A page is defined as each face of a sheet of paper containing information. When both sides of a sheet display printed material, it shall be counted as two pages. Each page shall be counted except cover pages, table of contents, and glossary. If exceeded, the excess pages will not be read or considered in the evaluation of the proposal/CSOW. Page size shall be 8.5 x
11. Pages may be single- spaced, but shall have at least double-spacing between paragraphs and factors. The text size shall be no less than 12-point Times New Roman type except for table’s charts, graphs, and figures, which shall be no smaller than 8-point. Neither the Technical Proposal nor the Price Proposal shall be bound. Both should be stapled one time in the upper left hand corner.
(3) Number of Copies: In reference to Block 13A Offerors shall submit three hard copies and one soft copy (VIA
EMAIL) of the technical proposal; Offerors shall submit one hard and one soft copy (VIA EMAIL) of the pricing proposal. DUE TO CHANGES TO INSTALLATION MAIL DELIVERY TIMELINESS WILL BE
DETERMINED BY RECEIPT OF THE SOFT COPY (RECEIVED VIA EMAIL).
(4) Proposal Acceptance and Validity Dates: The proposal acceptance period is specified in Section 00010 on the
Solicitation/Contract Form. The offer shall complete Block 17 or accept the minimum stated in Block 13D.
(5) Disposition of Proposals: In accordance with FAR 4.803(a)(10) (Contents of Control Files), the Government will retain one copy of all unsuccessful proposals. Unless the offer requests otherwise, the Government will destroy extra copies of such unsuccessful proposals.
B. GENERAL INFORMATION
(1) Point of Contact: The Contracting Officer (CO) and/or Contract Specialist (CS) are the only points of contact for this acquisition. Address any questions or concerns you may have to the CO or CS. Conversely, please provide a
Offeror POC including email address, phone number, and extension in the cover letter of the proposal.
(2) Discrepancies: If an offeror believes that the requirements in these instructions contain an error, omission, or are otherwise unsound, the offeror shall immediately notify the CO in writing with supporting rationale. The offeror is reminded that the Government reserves the right to award this effort based on the initial proposal/CSOW, as received, without discussion.
(3) Distribution of Proprietary Data: To facilitate review and evaluation for this source selection, the Government proposes to transmit data via commercial systems. Distributed material will be identified as source selection sensitive and distribution strictly limited to appropriate personnel. Should any offeror object to their proprietary information being shared between source selection evaluators and advisors via email as described above, please advise the CO.
C. FACTOR 1 -- TECHNICAL PROPOSAL/CONTRACTOR’S STATEMENT OF WORK (CSOW)
(1) Offerors shall provide the specific and actual methodology you will use to accomplish/satisfy the technical factor.
Do not merely reiterate the objectives or reformulate the requirement specified in the solicitation. Identify submitted technical proposal/CSOW by corresponding subfactors herein. Your responses to the factor will be evaluated in accordance with Section M “Evaluation Factors for Award” of the solicitation.
(2) If an offeror is subcontracting/teaming with another vendor, provide a clear distinction between functions performed by the subcontractor and the prime to include: nature of work, criticality of work, and the percentage of overall effort performed by each subcontractor in each area of work provided. Failure to provide the information for each subcontractor in a teaming arrangement shall render submitted proposal nonresponsive and unacceptable.
(3) Offeror shall address its proposed approach to meeting or exceeding the minimum performance or capability requirements of each subfactor as follows:
SUBFACTOR 1– COMPANY RESOURCES. Address proposed labor categories and the number of on-site personnel in each category, and the experience/qualifications of on-site personnel in each category.
SUBFACTOR 2 – INSTALLATION PLAN. Provide a detailed installation plan for ensuring completion of the requirement as described in the SOO in a timely manner.
SUBFACTOR 3 – LIST OF MATERIALS. Provide a list of materials that will be used for the project IAW the
SOO.
SUBFACTOR 4 – QUALITY CONTROL. Provide a descriptive quality control process to be used for this requirement.
SUBFACTOR 5 – SCHEDULE. Provide a detailed schedule for the installation and deliverables of all components of the project.
SUBFACTOR 6 – SAFETY AND SECURITY. Provide a detailed discussion that meets all the identified in the
SOO.
SUBFACTOR 7 – TEST PLAN. Provide a detailed test plan capturing testing procedures identified in the SOO.
D. FACTOR 2 – PRICE PROPOSAL
(1) Completion of the model contract, Section B, CLIN 0001 will constitute the total firm fixed price proposed for the entire project. Proposals shall be firm fixed price IAW the attached SOO and CDRLS. To access the corresponding
DIDs visit website https://assist.daps.dla.mil/quicksearch/.
(2) Each offeror’s price proposal shall also contain at a minimum:
a. Material Cost including nomenclature, quantities, and prices.
b. Labor Cost including labor classifications, rates, and the number of hours per classification.
c. Other Costs including ODC, travel, bonds, insurance, and equipment rentals.
d. Name, email, and phone number of POC for proposal questions.
https://assist.daps.dla.mil/quicksearch/
(3) Unrealistically low or high proposed price, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the Offeror does not understand the requirement or has submitted an unrealistic proposal. The burden of proof for credibility of proposed prices rests with the Offeror at the time of proposal or during subsequent discussions (if any are held).
(4) The price proposal shall not include information beyond that required by this instruction unless the Offeror considers it essential to document or support Offeror’s price position. All information relating to the proposed price, including all required supporting documentation must be included in this part of the proposal. Under no circumstances shall this information be included in the Technical Proposal/CSOW.
(5) The CO has determined there is a high probability of sufficient price competition in this acquisition. However, if at any time during this competition, the CO determines that sufficient price competition no longer exists; offers may be required to submit information to the extent necessary for the CO to determine the reasonableness of price.
(6) All dollar amounts (units and extended prices and other price factors) provided shall be rounded to the nearest penny
(two decimal places only). Failure to round unit prices to no more than two decimals may result in rejection of the proposal.
E. CONTRACT DOCUMENTATION
(1) The purpose of this section is to provide information to the Government for preparing the contract document and supporting file. The offeror’s proposal shall include a signed copy of the Model Contract. Additional information within the Sections include:
SF 33 Page 1 and 2 – Solicitation/Contract Form: Completion of blocks 15 through 18 of the SF 33. Signature by the offeror on the SF 33 constitutes an offer, which the Government may accept.
Section B – Supplies or Services and Costs/Prices: One firm fixed price should be proposed for the entire project under Contract Line Item Number (CLIN 0001). Please see Factor 2 – Price Proposal above for more information regarding the pricing information required as part of the Price Proposal.
Section F – Deliveries of Performance: The offeror shall submit a schedule as part of their technical proposal/CSOW.
Section K – Representations and Certifications: ORCA (Representations, Certifications, and other Statements of
Offerors). Offeror shall submit complete and accurate ORCA representations, certifications, acknowledgments and statements. In addition, include those specified within Section K of this RFP. Clauses 52.204-8, 52.209-7, 52.222-
22, and 252.204-7007, and include fill-in sections and must be returned with the model contract. ORCA can be accessed at http://orca.bpn.gov. C. EVALUATION METHODOLOGY.
(1) Technical acceptability will be evaluated on all offers. Only those Offerors determined to be technically acceptable, either initially or as a result of discussions, will be considered for award. Then, price will be evaluated and the proposals will be listed from lowest to highest price based on the total evaluated price.
(2) Award will be made to the lowest evaluated priced proposal meeting the acceptability standards for the non-cost factors.
