Acquisition Strategy
This acquisition strategy is still in the process of being approved by AFRL HQ
Sources Sought Notice: Announcement posted to FedBizOpps on 08 Aug 2016.
As a result of the Government’s market research, it was determined that ACT 2 will be a total Small Business Set Aside.
In making R&D small business set-asides (SBSA), there must be a reasonable expectation of obtaining the best scientific and technological sources consistent with the demands of the proposed acquisition for the best mix of cost, performances, and schedules from small businesses.
The Defense Acquisition Regulations Council (DARC) Director has requested an interim FAR rule be drafted, which implements section1651 of the National Defense Authorization Act for FY 2013. This allows SB to meet their own performance requirements by subcontracting to other SBs.
Anticipate 4-6 Prime contractor awards. However, if it is determined to be in the best interest of the Government, the Government reserves the right to award more or less than the anticipated amount.
The Government will be posting a DRAFT RFP to FedBizOpps and will solicit comments from Industry. The DRAFT RFP will be based on a Sample Order(s).
Type Contract: It is anticipated this will be a multiple award, IDIQ contract with FFP and CPFF clauses. FFP and CPFF to be determined on an Order by Order basis based on length of Order and technical requirements.
Individual Orders will be competed unless one of the FAR exceptions to fair opportunity applies (FAR 16.505(b)(2))
The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays;
Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized;
The order must be issued on a sole-source basis in the interest of economy and efficiency as a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order.
It is necessary to place an order to satisfy a minimum guarantee.
Ceiling Price of ACT: $950M*

Minimum Ordering Amount Based on the most current information available to the Government:
The first Order is expected to be the delivery of a detailed Systems Engineering Management Plan (SEMP). The dollar amount associated with the delivery of a SEMP is the minimum quantity the Government is certain to order (IAW FAR16.504).
This minimum quantity has been determined to be more than a nominal quantity and sufficient consideration for the contract to ensure that the intent to form a binding contract is present, considering the nature of the acquisition as a whole (e.g., unpredictability of the Government‘s requirements).
Meeting short lead times is critical to the success of ACT.
Streamlined approach is being developed.
Suggestions from Industry are necessary to facilitate an efficient ordering process.
Government expects Industry to formulate a process that ensures timely responses to urgent requirements (i.e. CCCPD within 5 days?).
Local presence is not required, however base support will be evaluated/determined on an Order by Order basis.
Primes MUST be willing to bid on Orders to ensure competition and decrease lead time for urgent requirements.
Some Government concerns:
Does Industry feel a quick turnaround time is possible?
Does Industry feel they can implement a process to meet the Government’s short lead time requirements?
