Attachment 3 Ordering Procedures – Multiple Award Contracts
The Government is only obligated to award the guaranteed minimum quantity on any resulting Indefinite Delivery, Indefinite Quantity (IDIQ) contract. The guaranteed minimum quantity will be awarded on the first delivery order at the same time the basic IDIQ contract is awarded.
In accordance with FAR 16.505 (b), future requirements will be competed between the IDIQ contract awardees with consideration given to all or any combination of price, production capacity, delivery schedule, and past performance, to include consideration of price only. Assessment of past performance will be based on prior performance under this contract; contractors shall not provide additional past performance information. The Government will notify contractors which factor(s) will be utilized in the evaluation of future requirements including their relative importance. In determining the best overall value, the Government reserves the right to make a tradeoff and award to other than the lowest priced contractor in accordance with the relative importance of factors identified.
a. The Government intends to conduct a competition among the awardees for each future lot buy;
however, the Government reserves the right to issue a single delivery order, without competing, if it is determined that an exception to Fair Opportunity applies in accordance with FAR 16.505(b)(2).
b. No Protest Rule and Ombudsman: In accordance with 10 U.S.C. Section 2304c(e)(1), no protest under FAR Subpart 33.1 is authorized in connection with the issuance or proposed issuance of an order except for a protest on the grounds that the order increases the scope, period, or maximum value of the contract or exceeds $25 million. The address, phone number, and e-mail address for the ombudsman are provided in AFFARS Clause 5352.201-9101, Ombudsman. The ombudsman will review complaints from the contractors and ensure all contractors are afforded a fair opportunity consistent with the procedures in this solicitation.
c. The Government will reserve the right to divide future requirements on any basis and combination as determined to be in the best interest of the Government. The total seven (7) year maximum IDIQ contract ceiling for the BLU-136/B is $600,000,000.00. If two (2) or more IDIQ contract awards are made, the cumulative orders placed under the multiple award IDIQ contracts shall not exceed $600,000,000.00. Therefore, each contract final ceiling will vary based upon the outcome of the fair opportunity process described above.
