STATEMENT OF WORK

BLU-136/B WARHEAD PRODUCTION

10 July 2019

1. DESCRIPTION: This Statement of Work (SOW) addresses activities to be performed by the contractor to manufacture the BLU-136/B Warhead for the Department of the Air Force.

1.1. Background: The Government has a requirement to replace the CBU-87 and CBU-103 cluster weapons with the BLU-136/B warhead to obtain necessary improvements to cluster munitions. The BLU- 136/B is a Next Generation Area Attack Weapon being developed in response to the 2008 OSD Cluster Munitions Policy for Unexploded Ordinance (UXO) limitation. The initial requirement driven by the policy is <1% UXO for cluster munitions. The BLU-136/B will be a 2000lb unitary fragmenting warhead design that will be compatible with the existing GBU-31 JDAM Guidance system and the DSU-33 height of burst sensor to provide combatant commanders an effective area attack weapon. BLU-136/B will be integrated on the F-16 Block 40/50 as a Threshold platform with compatibility to all USAF GBU-21V3 JDAM platforms. This unitary fragmenting warhead addresses the area attack capability gap created by 2008 Cluster Policy.

1.2. Scope: This SOW defines the roles and responsibilities of the contractor in providing the production, materials, data, and support for the production and delivery of BLU-136/B Penetrator Warhead Assemblies in accordance with (IAW) the Technical Data Package (TDP). The Contractor shall be available and prepared to perform all requirements identified in this scope and provide the necessary management, material support services, labor, supplies and equipment deemed necessary. The contractor shall demonstrate how personnel with appropriate skills and training meet the specific requirements of the prescribed standard. EXAMPLE: Welding processes and personnel performing welding shall be certified in accordance with America Welding Society (AWS) Standard D17.1. Specific requirements for production will be identified at the delivery order level. Delivery Orders issued under this contract are considered in the scope of this SOW and contract to the extent that the support provided is in direct relation to the BLU-136/B production requirements. Delivery orders issued under this contract may contain a more defined requirement as reflected in the contract Section B, CLIN descriptive data or as shown as an attachment to the order as a Statement of Work, Integrated Master Plan, or other requirements type document as mutually agreed to by the contracting parties. In no case shall an order be issued under this contract that is not in direct support of the BLU-136/B.

2. PERFORMANCE PERIOD: The basic contract ordering period shall not exceed seven (7) years from the date of contract award. Performance on orders shall not exceed three (3) years beyond the last day of the basic contract ordering period.

3. PLACE OF PERFORMANCE: The performance on this contract will take place at the contractor’s designated production facility and/or their subcontractor’s facilities.

4. ORDERING PROCEDURES: Orders will be issued by a Procuring Contracting Officer (PCO) in accordance with the ordering procedures identified in Attachment 3 of the Basic IDIQ Contract.

5. BUSINESS RELATIONSHIPS: The Contractor is responsible for any subcontract management necessary to integrate work performed on this requirement and shall be responsible and accountable for subcontractor performance on this requirement. The Contractor shall manage work distribution to ensure there are no Organizational Conflict of Interest (OCI) considerations.

6. APPLICABLE DOCUMENTS: All drawings, specifications, and standards applicable to the BLU- 136/B program are included in the TDP, contract and/or delivery orders.

7. SECURITY: The contractor will not require access to classified source data. The contractor shall protect the TDP, drawings, and data pertaining to the BLU-136/B Warhead production as “For Official Use Only” as specified in the National Industrial Security Manual (NISPOM) DoD Manual 5220.22-M, dated 28 February 2006. An unclassified document containing FOUO information shall be marked “For Official Use Only” at the bottom on the outside of the front cover (if any), on each page containing FOUO information, and on the outside of the back cover (if any). Each paragraph containing FOUO information shall be marked as such.

The contractor shall protect all technical documents, e.g. BLU-136/B Technical Data Package, that are determined to contain critical technology and are marked with a Distribution Statement D: “Distribution Authorized to Department of Defense and U.S. DoD Contractors Only, Critical Technology, 20 June 2015.

Refer Other Requests For This Document to AFLCMC/EBDA, Eglin AFB, FL, 32542.” Further dissemination shall be in accordance with the provisions in DoD Instruction 5230.24 and Distribution Statement D.

The contractor shall protect all technical documents, e.g. BLU-136/B Technical Data Package, that are determined to contain export –controlled technical data and are marked: “WARNING – This document contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et q.), or the Export Administration Act of 1979, as amended Title 50, U.S.C, App.2401 et seq.

Violations of these export laws are subject to severe criminal penalties. Disseminate in accordance with the provisions in DoD Directive 5230.25.” When it is technically infeasible to use the entire statement, an abbreviated marking may be used, and a copy of the full statement added to the “Notice to Accompany Release of Export Controlled Data” required by DoD Directive 5230.25 (reference (c)).

8. GENERAL REQUIREMENTS: The specific amounts and level of support required for Government-directed deliverables will be defined within individual delivery orders under the IDIQ contract. Orders placed under the basic contract will be issued in accordance with the ordering procedures identified in Attachment 3 of the Basic IDIQ Contract.

8.1. Contract Data Requirements List (CDRL): Contract level reporting will be identified in accordance with DD Form 1423 Contract Data Requirements List (CDRL). CDRLs will be addressed at the individual order level. The contractor shall deliver the CDRL data items via the Automated Technology Information Management System (ATIMS) an electronic information distribution system.

Access to this system will be provided by the Government. Deliverables shall be documented in a Master Data Schedule (to include submittals and Government responses).

8.2. Government Furnished Property (GFP): There will be no Government Furnished Property (GFP) provided.

8.3. Defense Contracting Management Agency (DCMA) Inspections and Audits: A Defense Contracting Management Agency (DCMA) representative and/or other authorized Government representative shall be allowed to inspect and review all phases of the production process at the contractor’s facilities.

8.4. Packaging and Marking Requirements: Packaging and marking shall be in accordance with commercial and government practices to prevent damage during shipment and to ensure safe arrival. As required, additional special preservation, packaging, packing and marking instructions shall be set forth in the individual delivery order.

8.5. Support: The contractor shall maintain communication with the Government to ensure visibility into program schedule, technical performance, and risk. The Government reserves the right to visit the contractor’s facilities to observe manufacturing operations and tests. The Government will work with the contractor to minimize the interference caused by technical visits. Government support contractors will accompany Government personnel during these visits, as required. The contractor shall not construe advice, reviews, and/or clarifications by these personnel as direction by the Government. The PCO shall be the only individual authorized to redirect the effort in any way or modify any terms of this contract to include delivery orders.

8.6. Risk Management: The contractor shall utilize their risk management process to address risk associated with this effort.

8.7. Configuration Management: The Government maintains configuration control of the TDP and drawings. The contractor shall utilize their Configuration Management (CM) process to control key aspects of CM. Changes to the TDP and/or drawings are not authorized and changes deemed to be necessary must be approved by the Government prior to implementation. The contractor shall submit any deviations, waivers and/or engineering change proposals for Government Configuration Control Board (CCB) approval.

9. CLOSEOUT: The contractor shall perform program closeout activities. Tasks will include but not limited to the assembling, boxing, cataloguing and archiving of manufacturing and quality records.

Examples of these are build records including any nonconformance reports, x-rays, inspection reports with data; records shall be free of proprietary markings. Residual hardware and material will be collected, crated, and/or disposed of in accordance with Government instructions.

10. USE OF NON-GOVERNMENT ADVISORS: The Government has entered into a contract (Engineering, Professional and Administrative Support Services (EPASS), FA8622-15-F-8120) with Odyssey Systems Consulting Group, DCS Corporation, MacAulay-Brown Incorporated, IPT Associates, and Alion Science and Technology for services to provide technical, engineering, evaluation, and acquisition management support for program activities.

In the performance of this contract, the contractor agrees to cooperate with the above listed contractors by:

responding to invitations from authorized personnel to attend meetings; providing access to technical information and research, development and planning data such as, but not limited to, design and development analyses, test data and results, equipment and process specifications, test and test equipment specifications and procedures, parts and quality control procedures, records and data including proprietary information, bid or proposal information, source selection sensitive information, manufacturing and assembly procedures, and schedule and milestone data, financial data including the contractor's cost/schedule management system/records and accounting system, all in their original form or reproduced;

discussing technical matters relating to this program; providing access to contractor facilities utilized in performance of this contract; and allowing observation of technical activities by appropriate support contractor technical personnel. The program support contractor personnel are authorized access to any program information required under their orders, including classified on a need to know basis, pertaining to this contract.

Service contractor personnel are not authorized to direct a contractor in any manner. Service contracts contain an organizational conflict of interest clause that requires the service contractors to protect the data and prohibits the service contractors from using the data for any purpose other than that for which the data was presented.
