Industry Comments with Responses to Draft RFP

1. Economic Price Adjustment clause: As discussed at the Industry Day and due to the uncertainty of steel prices would the Government consider including an Economic Price Adjustment clause in the contract?

Response: FAR clause 52.216-04 is already included in the RFP. The Government will only allow for material adjustments. The will be no adjustments allowed for labor.

2. Statement of Work paragraph 5, Closeout: Per the Industry Day discussion, does the US Government intend to modify the SOW closeout paragraph to clarify the true expectations? I.E.

specify that closeout activities will not take place until after product warranty expiration and modification of the examples to remove any requirement to turn over machine programming software and data (proprietary process/manufacturing data).

Response: The SOW paragraph was revised to remove language related to machine programming software and data, but did not include language regarding warranty expiration.

3. Is the contractor responsive to the RFQ if we provide a different initial delivery schedule for LRIP as long as all deliveries for LRIP occur within the allotted 18 month period?

Response: Yes, Offerors are allowed to modify the delivery schedule to propose their own delivery schedule. The only requirement is that once deliveries begin, all deliveries must be completed within 12 months.

4. If the contractor proposes an LRIP delivery schedule beyond 18 month to account for FAAT and PRR, are we still considered responsive?

Response: Yes, see comment above.

5. Attachment 8 (Packaging Requirements), Section 2 (additional markings) – please clarify if the second sentence is a required marking and clarify where and how these additional markings are to be applied.

Response: No, it is not an additional required marking.

6. Section B, page 2, Item 1001, Descriptive Data states ‘the contractor shall manufacture and deliver up to 1,000 LRIP BLU 137/B assets” for LRIP option. 1,000 units is also indicated as max quantity for LRIP Option in Section F, page 11, Item 1001. Attachment 3, BLU-137/B Pricing Worksheet for LRIP requires pricing for up to 3,500 units. Is this a discrepancy?

Response: Attachment 3 has been updated to remove the additional price bands beyond 1,000 units.

7. Attachment 11, paragraph 5 – what is the minimum quantity that will be awarded with the LRIP award per awardee?

Response: Attachment 11 has been updated to indicate the minimum guarantee per awardee, if there is more than one contract awarded. The percentage split for the initial award will be determined based on the outcome of the source selection.

8. Section L-3.4.6, - Does this apply if we don’t suggest any changes to the TDP?

Response: Paragraph L-3.4.6 from the Draft RFP Section L has been removed.

9. SOW Para 4.1 – References CDRL A001. A001 states in remarks section under Block 10, 11, 12, and 13 “ … report shall be due 60 calendar days prior to Production Qualification Testing (PQT).” The ‘PQT’ activity is not mentioned elsewhere in the package. Is PQT synonymous with FAAT & FAI or is PQT a separate activity we need to account for within the LRIP timeframe?

Response: CDRL A001 has been updated to remove the reference to PQT and instead references

FAAT.

10. SOW Section 8 second paragraph – This paragraph seems to be missing amplification or additional directions. As written it implies we cannot share any of the TDP with potential vendors (who may also be DOD contractors). It will be impossible to obtain quotes for these items without the authority to share the TDP with potential vendors. Will the government clarify this paragraph as to its intent and how a Prime should proceed with potential subcontractors.

Response: The paragraph has been revised to allow offeror to share the TDP with other DoD contractors; however, the responsibility is placed on the prime contractor to verify the entity the information is being shared with is an active DoD contractor and is not foreign-owned or controlled.

11. Reference: Draft RFP FA8681-17-R-0036 Attachment 12, Section L-4.2.2 Item (8) Risk Matrix, Page 10 of 14; Attachment 13 Section M; and Attachment 14 Proposal Cross Reference Matrix.

Issue: Need a Clarification of Government’s Expectations for the required Risk Matrix.

Question: Does the Government desire a traditional 5x5 Risk Square with Red, Yellow and Green colors or another style, such as a Table addresses Risk, Risk Level, Mitigation Approach, and the Resulting Mitigated Risk Level?

Response: The reference to risk matrix has been removed from Section L, paragraph L-4.2.2 Volume Organization. How the offeror complies with the Section L and Section M requirements to address the risk within the technical subfactors is based on their approach to compiling their proposal in response to the RFP.

12. Issue: Funding of LRIP and FRP Lots

Discussion: Most small businesses need a level of initial funding for each Firm Fixed Price Contract based on the total lot production requested in order to optimize critical purchases

Response: The Government is unable to forward fund this requirement, but can provide progress payments based upon an agreed upon progress payment schedule with a small business. The Government has inserted clauses FAR 52.232-16 and DFARS 252.232-7004 into the RFP.

13. Issue: Minimum Quantity Range for BLU-137/B Unit Pricing Worksheets and How to Handle Non-Recurring Engineering (NRE) in Pricing Worksheets.

Discussion: The lowest range of Quantity Bands in the BLU-137/B Pricing Worksheets for LRIP and FRP require Offerors to submit a single unit price for a wide Quantity Band of 0 units through 500 units. A minimum quantity for the lowest Quantity Bands needs to be specified in the BLU-137/B Pricing Worksheets. In addition a minimum quantity the Government is seeking additional sources for the production of the BLU-137/B. Any new manufacturers will need to expend funds for NRE to set up its production line. Incumbent companies may have already been reimbursed for their NRE costs for production line set up through prior developmental and LRIP/FRP production contracts.

Response: The pricing worksheets, Attachments 3 through 7, have been updated to allow for lower quantity bands, but were not changed to include separate pricing for NRE. All NRE costs should be included in the overall unit price.

14. Multiple comments were received on the Technical Data Package which drove revisions to the TDP and advisory documents. A new TDP will be provided will the final RFP. The Government will provide a summary sheet to indicate all the changes that were made between the TDP provided with the Draft RFP and the TDP available with the Final RFP.
