Addendum #2

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

i. Technical: Offer must clearly demonstrate that the offeror is capable of meeting the performance standards of the Performance Work Statement (PWS) with respect to:

SUB-FACTOR 1 – Technical Approach:

ELEMENT 1.1. – Water Treatment. The offeror’s technical capabilities and expertise in the area of water treatment will be evaluated. Element 1.1 will be met when the offeror has described and explained the following:

(1)What chemicals will be used and how the quantity of chemicals will be determined.

(2)The processes and procedures to be used for adding chemicals to both cooling towers and closed-loop heating systems.

ELEMENT 1.2. - Testing. The offeror’s technical capabilities and expertise in the area of testing will be evaluated. Element 1.2. will be met when the offeror has explained in detail the processes and procedures to be used for each of the routine and non-routine tests specified in the PWS.

ELEMENT 1.3. - Studies. The offeror’s technical capabilities and expertise in the area of studies will be evaluated. Element 1.3 will be met when the offeror has explained in detail the processes and procedures to be used for each of the studies specified in the

PWS.

ELEMENT 1.4. – Sample Problem. The sample problem is provided at Addendum to

52.212-1, Volume I, Technical Capability, Sub-Factor 1, Element 1.4. The offeror’s overall technical capabilities and expertise in industrial water treatment will be evaluated based on the proposed solution to the sample problem. The evaluation will be based on a review of the offeror’s proposed solution including evaluating reasonableness of assumptions made. Element 1.4 will be met when the offeror demonstrates an understanding of the requirements in the PWS and the technical capability expertise to perform this contract.

SUB-FACTOR 2 – Personnel:

ELEMENT 2.1. – Resumes. The offeror’s capability to provide skilled personnel, on site, that meet the personnel requirements of this solicitation will be evaluated. Resumes will be evaluated through a review of the proposed personnel’s qualifications, resumes and their commitment to work for the offeror.

(1) Direct field experience in commercial/industrial boiler and cooling water treatment

(2) Working knowledge of water treatment technologies along with testing and treatment procedures

Element 2.1 will be met when the offeror demonstrates the manning qualifications needed to perform this contract.

ELEMENT 2.2. - Sub-contractors. If anticipated to utilize subcontractors, the offeror’s capability to provide skilled sub-contracting personnel, on site, that meet the personnel requirements of this solicitation will be evaluated. Company information and resumes will be evaluated through a review of the proposed personnel’s qualifications, resumes and their commitment to work for the offeror.

Element 2.2 will be met when the offeror demonstrates the manning requirements needed to perform this contract with use of sub-contractors if used.

SUB-FACTOR 3 – Quality Control Plan:

ELEMENT 3.1. & 3.2. – The proposal provides quality control procedures that demonstrate adequate understanding of the PWS requirements. The Quality Control Plan must be determined workable and acceptable with only minor clarifications.

(1) The proposal includes the descriptions of the duties and responsibilities of the quality control inspectors.

(2) The proposal specifies the roles/functions of other key personnel involved with regard to quality control.

(3) The proposal includes the minimum requirements of the quality control plan as required in Addendum to FAR 52.212-1, Instructions To Offerors, Section 3, Sub Factor

3).

Element 3.1. will be met when the offeror has provided detailed method of quality control procedures. Element 3.2. will be met when the offeror has listed the minimum requirements of the quality control plan.

SUB-FACTOR 4 - Scheduling Methodologies:

ELEMENT 4.1. – The proposal shall include a realistic work schedule with a notification plan for daytime and after hour emergencies along with a plan in a crisis situation that exhibits an understanding of the work by addressing all requirements listed in the PWS. Element 4.1 will be met when the offeror demonstrates a realistic work schedule needed to perform this contract.

ELEMENT 4.2. - The proposal includes a workable staffing plan that includes a schedule and an adequate number of employees. Element 4.2 will be met when the offeror demonstrates the staffing requirements needed to perform this contract.

ELEMENT 4.3. - The proposal includes a notification plan for both daytime and after hour emergencies and a plan for a crisis situation (reference PWS, Section I). The proposal shall address the procedures taken to notify all personnel. Element 4.3. will be met when the offeror has explained in detail the processes and procedures to be used for notification in crisis situation.

SUB-FACTOR 5 - Equipment/Supplies:

ELEMENT 5.1. - This element is met when offeror provides equipment and supplies to include size, number and type of equipment and supplies to be maintained and used in performance of this contract.

SUB-FACTOR 6 – Past Experience

ELEMENT 6.1. - This element is met when offeror provides past experience for a minimum of three relevant contracts/jobs performed within the past five (5) years.

Offerors are required to explain what aspects of each contract are deemed relevant to the proposed effort. Offerors are permitted, but not required, to submit information on significant achievements considered relevant to the PWS requirements.

ii. Price: The total evaluated price of an offer will be calculated as the sum of the extended prices (unit quantity multiplied by unit price) for Contract Line Item Numbers (CLINs) 0001 through 4009 for the base performance period and option periods I through IV. See paragraph (b) below regarding evaluation of pricing for the Option to Extend Services IAW FAR 52.217-8.

Technical is approximately equal in importance to price. The Government will initiate concurrent evaluation of all of the above factors on all offers. The Government will consider, throughout the evaluation, the "correction potential" of any proposal uncertainty. The judgment of such "correction potential" is within the sole discretion of the Government. If the Government cannot determine if a proposal’s Technical factor is acceptable pursuant to initial or subsequent evaluation and the proposal, in the Government’s judgment, is considered correctable, the

Contracting Officer may open or continue discussions. If at any time during the evaluation, a proposal’s Technical factor is determined to be unacceptable or not correctable pursuant to a proposal uncertainty, no further consideration will be given to that proposal for award.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s). The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. For the purpose of exercising the Option to Extend Services, prices will be considered to have been evaluated based on the prices submitted in the offeror’s proposal that resulted in award of the contract or based on prices in the contract subsequent to a bilateral modification after award. The Government may exercise the Option to Extend Services in accordance with the clause at FAR 52.217-8 at anytime during the life of the contract. The pricing of the Option to Extend Services will be at the prices in effect during the performance period in which the

Option to Extend Services is exercised.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
