About this file
This document contains questions and answers regarding a joint venture's submission for a federal contract opportunity. The opportunity involves providing contractor logistics support services for the Link-16 Alaska system, including program management, cybersecurity, help desk support, training, repair, software distribution, and other tasks. The contract is anticipated to be a five-year indefinite delivery/indefinite quantity contract with the Air Force, priced using firm fixed price, cost plus fixed fee, and cost reimbursable no fee arrangements. The document clarifies that each member of a joint venture must submit up to three separate past performance submissions individually, rather than combining efforts onto single submissions. Additionally, if a joint venture member performed as a subcontractor on another member's past project, it must submit two separate past performance submissions for those efforts.

Question 1 Section L E.(2) discusses the submission of the FACTS sheets and states as follows:
(2) The requested present and past performance information shall be provided in a separate volume (i.e., 3-ring binder) labeled "Volume III - Past Performance". A summary page shall be provided for this acquisition, describing the proposed role of the offeror and any joint venture member (nature of work and percentage of overall work). Each offeror/joint venture member shall complete a separate FACTS Sheet for three (3) active or completed contract (with preferably at least one year of performance history) in the past five (5) years from the issuance date of the RFP, that the offeror/joint venture member considers relevant in demonstrating its ability to perform the proposed effort. No more than three (3) efforts shall be submitted from each offeror/joint venture member.
Do we interpret this to mean each member of the JV MUST submit three past performance FACTS Sheets EACH?
Answer 1
The RFP reference allows up to three efforts for each JV member. So, in this case, the JV could submit a total of 6 efforts three for JV Member #1 and 3 for JV Member #2. However, there is no penalty for not submitting the maximum 3 efforts each for evaluation.
Question 2
The original intention was to submit three submissions from JV member #1 and one additional submission from JV member #2. On two of the JV member #1 contracts, JV member #2 was a subcontractor with relevant experience. We were writing about both companies’ contributions under those unified FACTS Sheets, but it occurred to us during a review that this approach may be considered non-compliant. Would you please let us know if the expectation is three separate PP write-ups for each JV member?
Answer 2
Yes, the efforts should be separated for each JV member instead of presented as a combination. So in the situation presented above where JV member #2 performed as a subcontractor, JV member #3 would provide 2 separate FACTS Sheets for those efforts and identify they performed as a subcontractor, with the subcontract-specific information included on the FACTS sheet.
