1.0 DESCRIPTION OF SERVICES. This Performance-Based Work Statement (PBWS) outlines the requirement for a Performance Based Acquisition (PBA) in support of the Versatile Depot Automatic Test Station (VDATS). This tester is an integral part of the Government’s in-house electronics repair capability and this PBA contract is being initiated to support its fielding and operational utility. The Government’s intent is to establish a flexible means by which the tester, and other related hardware, may be purchased and then supported with guaranteed availability of serviceable replacement components. The performance-based nature of the contract should encourage, and allow contractor efficiencies and emphasize system reliability improvements.
1.1 The prioritized objectives for this effort are to: 1) support Department of Defense (DoD) activities, including potential future Foreign Military Sales (FMS) customers, in such a way that maximizes their ability to test and produce Units Under Test (UUT), 2) minimize VDATS total ownership cost to the Government, 3) maintain clear Government visibility into the program, and 4) be flexible enough to permit the contractor to innovatively manage the requirements of the program in such a way that is mutually beneficial to the Government and to the contractor.
1.2 VDATS was developed and identified to serve as a standard depot automated test system for the United States Air Force. It is a member of the DoD Family of Testers. The current VDATS has a baseline test capability which will require further enhancements as new support requirements are identified. Therefore, as the overall VDATS system capability evolves and grows so too will the production and support requirements grow and evolve.
1.2.1 The scope of this contract will include efforts related to the development, modification, enhancement and maintenance of the VDATS system capability to include any sub-systems or instrumentation currently or subsequently integrated into the VDATS architecture for the operation of VDATS as a wholly reconfigurable test system. This would include, but not be limited to, the stimulus and response measurement of current digital, analog, radio-frequency (RF) test capability enhancements to include, but not limited to, electro-optical, microwave, and cryptological test capability enhancements deemed necessary to support future test requirements. This would include any other sub-system or instrumentation that will contribute to the continuous overall functionality of the VDATS as a system.

4.2.1 The contractor shall provide serviceable components to the Government on demand. The list of replaceable components to be supported is contained in Appendix B. The Government reserves the right to amend the list of items being supported as the VDATS design evolves.
4.2.1.1 Parts availability support will be required on an annual per tester basis to support the availability requirement as described in paragraphs 4.2.2 and 4.2.3. Testers produced subsequent to contract award will be prorated based upon receipt of a valid parts availability, order, tester delivery date (subject to government acceptance), and the remainder of the contract year in which the tester is delivered.
4.2.2 Upon notification of a requirement, the contractor shall provide serviceable assets to the Government within two business days subject to the following exceptions:
4.2.2.1 The contractor will be provided a “grace” period of up to 90 days ARO to allow initial lay-in of assets. However, the Government may place parts availability orders upon contract award based on the contractor proposed CLIN activation date within the grace period. Activation of this CLIN shall be based on the contractor’s proposed start date. No payments for the parts availability CLIN support shall be paid until this CLIN is activated. Any unfilled requisitions in existence when the grace period ends shall be subject to the delivery requirement beginning the first business day after grace period expiration.
4.2.2.2 Any delivery date falling on a generally recognized U.S. Federal holiday will be extended to the first business day following that holiday.
4.2.2.3 A business day is defined as Monday through Friday, 7 a.m. to 5 p.m. local time at destination.
4.2.2.4 If a requisition is not satisfied by the required delivery date (as outlined in paragraph 4.2.2), it will count as a failure to meet availability in the calculation of availability performance by the contractor. Should an asset fail to be delivered by its initial delivery date, it shall be delivered within two business days following that missed delivery date. Each missed delivery date for the same requisition will be counted as another failure to meet the availability metric. This cycle shall continue until the asset is delivered to the government.
4.2.2.5 If a delivered asset is found to be unserviceable upon receipt, the Government will initiate a material deficiency investigation. The contractor shall initiate a replacement requisition upon notification of the deficiency. This new requisition must meet the same delivery requirements outlined above. If the deficiency is found to be caused by contractor processes, the original requisition delivery requirement will be deemed not satisfied and will count against the availability metric.
4.2.3 On time delivery of all requisitions shall be 90% for the year. Example – 10 requisitions received, 9 filled within the delivery requirements of paragraphs 4.2.2 equals 90% on time.
4.2.3.1 For the purposes of this PBWS, delivery is defined as the point in time when a Government representative signs for and takes possession of the serviceable asset.
4.2.4 For all requisitions requiring delivery outside the continental United States (OCONUS), the contractor shall ship the item to a CONUS Air Force Base such as Dover AFB or Travis AFB for further transportation by Air Force carrier as directed by WR-ALC. Instrument performance shall be as described in the Original Equipment Manufacturer (OEM) specifications.
4.2.5.2 The contractor has the authority to condemn components they deem to be beyond economical repair. The Government will not provide the contractor relief from the delivery schedule due to asset condemnation except as outlined in paragraph 4.2.5.3.
4.2.5.3 Items received by the contractor that are deemed to be beyond physical repair due to gross negligence on the part of the Government or acts of God, shall be brought to the attention of DCMA and the WR-ALC PCO for equitable resolution.
4.2.5.3.1 The VDATS will be used by the Government in both development and production environments. Although the equipment will not be used beyond its intended purpose, the VDATS used in a development environment are subjected to different usage and stressors than those VDATS in production environments. This contract covers VDATS components used in both production and development environments and failures due to development stressors do not constitute gross negligence on the part of the Government.
4.2.6 Complete VDATS component carcasses resulting from item failures shall be shipped to the contractor (at contractor’s expense) within 14 calendar days from the date the associated requirement is filled. If the Government fails to return carcasses within this schedule, and that failure impacts the contractor’s ability to meet the availability metric, the contractor may be granted relief from the contract requirements. Items with missing sub-assemblies will immediately be brought to the attention of the WR-ALC PCO, in contractor format, for disposition instructions.
