Section L

MULTIPLE AWARD CONSTRUCTION CONTRACT (MACC IV) FA8201-20-D-MACC Sept. 2020
Question #ReferenceDiscussionQuestion/CommentGovernment Response
1Section L: 3.3.3 – Subfactor 3Attachment 2 – Section L: 3.3.3 – Subfactor 3, Contractor RequirementsParagraphs B and C each require three projects. Please clarify whether a TOTAL of three project examples are required (B and C), or a TOTAL of six projects (B + C).A TOTAL of three (3) project examples are required for Paragraph B, and a TOTAL of three (3) project examples is required for Paragraph C. Offerors are allowed to use the same example project for Paragraph B and C as long as they meet the requirements of each.
2Section L 1.3, 1.3.1 GeneralSection L 1.3, 1.3.1 General, Table 1: Proposal OrganizationThere is no page limit stated for Subfactor 4 AND it is not included in the 200-page limit for Volume II. Please confirm that there is no page limit on Subfactor 4.The page numbers for each Subfactor have been corrected. Subfactor 1 has been changed to 30 pages, and Subfactor 4 has been included as 100 pages. The total pages for Volume II is now 230.
3Section L 4.0Section L: 4.0, Volume III, Factor 3: Past PerformancePlease explain “3 pages per submission” – Does “submission” equal “project example”?Yes, each project submission is limited to three (3) pages a piece.
4Section L (various paragraphs)Section L (various paragraphs) regarding Volume I A-E and Constructor Example Projects (format per Appendix C, Example Project) and Volume III, Factor 3, Past Performance (Appendix A, Past Performance Questionnaire). These requirements seem to be redundant. Please explain the difference between these two requirements.Section L Volume I does not require example project submission.

Section L Volume II - Example projects are used to determine technical proficiency - no evaluation of how the offeror performed on the example projects is considered under this volume.

Section L Volume III – Past projects are used to determine how well the contractor performed.

These may not be the same projects, it will be up to the Offeror to decide whether or not one project can meet the criteria of Volume I and Volume III.

5Section L 3.3.1.1 & 3.3.4.1Section L 3.3.1.1 (SUBFACTOR 1, Basic MACC IV Plans), regarding a Safety Plan – states: “Offeror shall submit an initial Contract Occupational Safety and Health Plan that meets the requirements outline in MACC IV Basic SOW, Section 3.3.1 and Appendix C.”
Section L 3.3.4.1, regarding SUBFACTOR 4 - the solicitation states: “Offeror shall submit a tailored Safety Plan that meets the requirements outlined in the Sample Project SOW, Section 5.4.”How do these two requirements differ, if at all, and where should the response be presented in the proposal if these requirements are for the same information? The Government has updated Section L 3.3.4.1 to rename the "Safety Plan" to the "Safety/Accident Prevention Plan."

The Government expects these two plans to differ. The Safety Plan required in Section L 3.3.1.1 is for the overall Basic MACC IV. The Safety/Accident Prevention Plan required in Section L 3.3.4.1 is for the Sample Project and shall be tailored for it.

6 Section L 3.3.1.2 & 3.3.4.2 Section L 3.3.1.2 (SUBFACTOR 1, Basic MACC IV Plans), regarding a Construction Quality Control Plan – states, in part, “Offeror shall submit an initial Contraction QCP that meets the requirements outlined in MACC IV Basic SOW Section 3.1 and IAW UFGS 01 45 00.”

Section L 3.3.4.2, regarding SUBFACTOR 4 – the solicitation states: “Offeror shall submit a tailored Quality Control Plan that meets the requirements outlined in the Sample Project SOW, Section 5.5.” How do these two requirements differ, if at all, and where should the response be presented in the proposal if these requirements are for the same information? The Government has updated Section L 3.3.4.2 and 3.3.4.2 to rename the "Quality Control Plan" to the "Construction Quality Control (CQC) Plan."

The Government expects these two plans to differ. The CQC Plan required in Section L 3.3.1.2 is for the overall Basic MACC IV.

The CQC Plan required in Section L 3.3.4.2 is for the Sample Project and shall be tailored for it.

7 Section L 3.3.2-c & Section M 4.2.-c L 3.3.2-c and M.4.2-c – require that the proposal provide “an example of a past project that was designed by the partnered A-E firm and was successfully certified as LEED Silver or higher certification” Most frequently, projects designed and built for the Government – and especially for DOD – are required to be built to LEED guidelines, but are not required to be certified. Will the Government consider accepting a project example that was built to LEED guidelines, but not certified? Yes, Section L 3.3.2-c, and Section M 4.2-c have been updated to reflect this. In addition, the Basic SOW Section 1.4.2 has been updated to include the UFC reference for energy efficient buildings, which the offeror must provide detail showing they followed this guidance if they do not have a LEED silver or higher certificate.

Section M

MULTIPLE AWARD CONSTRUCTION CONTRACT (MACC IV) FA8201-20-D-MACC Sept. 2020
Question #ReferenceDiscussionQuestion/CommentGovernment Response

1 Section M Section M, Volume III, Factor 3, Past Performance, Section M.5.0. The second paragraph of M.5.0 states, “In addition any information regarding Offeror’s current having one (1) or more current Cure Notices at the time of the RFP issue date will result in an automatic rating of unacceptable for the Past Performance Factor and disqualification for award.” Where should the response to this requirement be presented? It is not mentioned in Section L, Instructions for Past Performance. This does not necessarily require an Offeror response. The Government will evaluate the past performance the Offeror provides; however, in accordance with Section L 4.1, "Government will use data provided by each Offeror in this volume and data obtained from other sources in the evaluation of past performance." If the Government obtains data that indicates an Offeror has a current cure notice due to poor performance at the time of the RFP issue date, then, the Offeror will receive an Unacceptable rating.

Section M 5.0 has been updated to state, “In addition any information regarding Offerors currently having one (1) or more Cure Notices due to poor performance at the time of the RFP issue date will result in an automatic rating of unacceptable for the Past Performance Factor and disqualification for award.”
