Section L - Instructions, Conditions, & Notices to Offerors or Quoters

Header Miscellaneous Text (Modified):

PROPOSAL INSTRUCTIONS:

A. To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separate volumes, Volume I - Technical Proposal, Volume II - Price Proposal.

B. The Contracting Officer (CO) has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers, the CO will review this determination and if, in the CO's opinion, adequate price competition exists, no additional price information will be requested and certification under FAR will not be required. However, if at any time during this competition the CO determines that adequate price competition no longer exists; offerors may be required 15.406-2 to submit information to the extent necessary for the CO to determine the reasonableness of the price.

C. Exchanges of source selection information between Government and offerors will be controlled by the Contracting Officer. Email may be used to transmit such information, only if the email can be sentence crypted, and must include "Source Selection Information - See FAR 2.101 and 3.104"in the subject line of the email.

Otherwise, source selection information will be transmitted via direct mailing or facsimile. In order to facilitate the sending and receiving often crypted emails, offerors must use MS Outlook email configured to support encryption or a different email product that is S/MIME compatible and configured to support encryption. If you intend to submit your source selection information via encrypted email, you will need to contact the Buyer/Contracting Officer indicated on the face page of the solicitation prior to that first submittal to exchange certificates used for encryption. To ensure the process is working correctly, send a test encrypted message first (without including any source selection information). Otherwise, source selection information will be transmitted via direct mailing or AMRDEC SAFE athttps://safe.amrdec.army.mil/safe/guide.aspx.

When submitting source selection information via email, file suppression utilities, to include but not limited to zip files, will not be accepted.

Section M - Evaluation Factors for Award

Header Miscellaneous Text (Modified):

EVALUATION FACTORS:

A. SOURCE SELECTION

1. Basis for Contract Award: This acquisition will utilize Lowest Price Technically Acceptable (LPTA) in accordance with Federal Acquisition Regulation (FAR) 15 - Contracting by Negotiations, as supplemented by the FAR Overhaul, Defense Federal Acquisition Regulation Supplement (DFARS), and DoD Source Selection Procedures, dated 20 August 2022 and Department of Air Force Mandatory Procedures 5315.3 to make an integrated assessment for award decision. These regulations are available electronically athttps://www.acquisition.gov/. The Government intends to award one contract as a result of this solicitation to the Woman Owned Small Business offeror with the LPTA proposal who is deemed responsible in accordance with FAR Part 9.1, as supplemented, whose proposal conforms to the solicitation's requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation), meets all requirements set forth in the RFP, based on the results of the evaluation as described in this solicitation Section M.

2. Number of Contracts to be Awarded: The Government intends to award one contract for this requirement.

3. Discussions: The Government reserves the right to award a contract without discussions or the opportunity for proposal revisions. If, during the evaluation period, it is determined to be in the best interest of the Government to hold discussions, offeror responses to Evaluation Notices(ENs) and the Final Proposal Revision (FPR) will be considered in making the source selection decision. Offerors may be required to respond with their FPR within 24 hours. If the offeror's proposal has been evaluated as acceptable at the time discussions are closed, any changes or exceptions in the FPR are subject to re-evaluation and may introduce risk that the offeror's proposal will be determined unacceptable and ineligible for award. If the Government elects to open discussions, the competitive range may or may not include proposals removed for unfavorable ratings or pricing at the sole discretion of the Government. A competitive range, if required, may be further reduced for purposes of efficiency pursuant to FAR 15.306(c)(2).

4. Solicitation Requirements, Terms and Conditions: Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical requirements, in addition to those identified as factors or subfactors. Failure to comply with the terms and conditions of the solicitation may result in the offeror being ineligible for award.

5. Proposal Evaluation Approach:

a. Step 1: Evaluate all timely proposals for completeness.

b. Step 2: Evaluate all complete proposals for technical acceptability.

c. Step 3: Evaluate all proposals to determine whether the price is fair and reasonable (IAW FAR 15.404) then ranked by Total Evaluated Price (TEP).

d. Step 4: The Government may request clarifications, communications, or discussions for proposals through Evaluation Notice(s).

e. Step 5: The Contracting Officer will compile the contractors to make up the competitive range, those with the most highly qualified and technically acceptable proposals. The Contracting officer will then determine the lowest price of those technically acceptable

6. Responsibility: In addition to the evaluation factors noted above, the offeror must be determined responsible according to the standards in FAR Subpart 9.1 Responsible Prospective Contractors.

B. EVALUATION FACTORS

1. Evaluation Factors and Subfactors: The following evaluation factors and subfactors will be used to evaluate each proposal. The Government will evaluate proposals for acceptability but will not rank the proposals by the non-price factors or subfactors.

Factor 1: Technical

Subfactor 1: Work Plan

Subfactor 2:Technical Risk

Factor 2: Price.

2. Relative Importance: The Government will conduct a competitive source selection in which technical (including technical risk)rating, will be evaluated on a basis equally important to price considerations.

1. Volume I - Technical Factor The Government's technical evaluation team shall evaluate the combined workplan/technical risk/past performance of proposals by assigning one of the ratings described below, to determine if the offeror provides a sound, compliant approach that meets the requirements and demonstrates a thorough knowledge and understanding of the specs and SOW and their associated risks. For each subfactor, the offeror identifies risks, if any, associated with the proposed approach and actions the offeror will take to mitigate the identified risks. If no risks/mitigations are identified in the offeror's proposal, it indicates the offeror does not consider there to be any risk associated with their proposed approach. Only those proposals determined to be technically acceptable or higher, either initially or as a result of discussions, will be considered for award. However, the offeror is reminded that the Government reserves the right to award this effort based on the initial proposal, as received, without discussion.

Combined Technical/Risk Rating Table Adjectival Rating: Description

Acceptable: Proposal demonstrates an exceptional approach and understanding of the requirements and contains multiple strengths and/or at least one significant strength, and risk of unsuccessful performance is low. Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength or significant strength, and risk of unsuccessful performance is low to moderate. : Proposal meets or exceeds the requirements and indicates an adequate to Good exceptional approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.

Unacceptable: Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is Marginal to high. :

Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is un awardable, and/or risk of Unacceptable performance is unacceptably high. Combined Technical/Technical Risk Rating: The technical rating evaluates the quality of the offeror's technical solution for meeting the Government's requirement. Technical risk, which is manifested by the identification of weaknesses, assesses the degree to which an offeror's proposed approach for the requirements of the solicitation may cause disruption of schedule, increased costs, degraded performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance. The evaluation shall address the Source Selection Team's identification of any weakness as well as the offeror's identified risks and proposed mitigation (if applicable)and document why that is or is not manageable. Each Technical subfactor identified below will receive one of the adjectival ratings described in the DoD Source Selection Procedures table above, which focuses on the strengths ,weaknesses, significant weaknesses, uncertainties, and deficiencies of the offeror's proposal. The adjectival rating depicts how well the offeror's proposal meets the Technical subfactor requirements. Subfactor ratings shall not be rolled up into an overall rating for the Technical factors. The proposals shall be evaluated against the following technical subfactors:

Subfactor 1: Work Plan Description: This subfactor evaluates the offeror's work plan. Measure of Merit: This requirement is met when the offeror's proposal provides a Gantt Chart (or similar) highlighting a breakdown of the items/tasks (milestones)identified in the specifications/drawings and how the offeror plans on accomplishing each individual task within the performance period specified for the project. Additionally, the offeror shall clearly and thoroughly depict the critical path to complete the project within the performance period
