SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

The following have been modified:

L1 PROPOSAL PREPARATION AND SUBMITTAL INSTRUCTIONS

1. To assure timely and equitable evaluation of proposals, offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors or subfactors. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale. The response shall consist of three (3) separate parts; Part I - Price Proposal, Part II - Technical Proposal, and Part III - Past Performance Information.

2. The contracting officer has determined there is a high probability of adequate price competition in this acquisition. Upon examination of the initial offers including the pricing breakdown (AF form 3052), the contracting officer will review this determination and if, in the contracting officer's opinion, adequate price competition exists no additional cost information will be requested and a Certificate of Current Cost or Pricing Data (under FAR 15.406-2) will not be required. However, if at any time during this competition the contracting officer determines that adequate price competition no longer exists; offerors may be required to submit information to the extent necessary for the contracting officer to determine the reasonableness and affordability of the price.

3. Specific Instructions:

NOTICE TO OFFERORS: the magnitude of this project does not warrant Joint Venture or Teaming Arrangements, therefore offers received in such form shall be rejected and not considered for award.

a. PART I – PRICE PROPOSAL - Submit original only

(1) Complete blocks 14, 15, 16, 19 (only if amendments are issued) and 20A through 20C of the RFP Section A, SF1442. In doing so, the offeror accepts the contract terms and conditions as written in the RFP Sections A through K without exception. These sections constitute the model contract.

(2) Insert proposed unit and extended prices in Section B for each Contract Line Item Number (CLIN) using the amount resulting from the completion of the price breakdowns AF form 3052.

(3) Complete the necessary fill-ins and certifications in Sections I through K.

(4) Stamp and initial all pages of the solicitation. The entire solicitation Sections A through M as well as the AF form 3052 shall be returned in their entirety.

b. PART II – TECHNICAL PROPOSAL - Submit only 1 copy. Limited to no more than 40 pages (excluding Government released documents which are not subject to any page limitation restriction). Non Italian firms shall submit their Governmental authorities equivalent documentation with an English translation attached.

This part consists of three (3) distinctive Subfactors:

(i). Subfactor 1. Legal Standing. Provide documentation that satisfies the requirement of Section K provision entitled: QUALIFICATION OF FIRMS PURSUANT TO ITALIAN DECREE: DECRETO DEL PRESIDENTE DELLA REPUBBLICA (D.P.R.), JANUARY 25, 2000, NO. 34. The acceptable documentation is represented by the following:

a. All of the documentation cited in the actual provision or certificate of enrollment with the Chamber of Commerce with the appropriate statement of compliance with reference to this decree. The documentation must not be greater than 90 days old from date of present offer; and

(ii). DURC document issued by Italian authorities or equivalent document issued by member nation of the European Community. The DURC document shall be submitted for direct hire employees as well as any self employed person and subcontractors. This document must not be older than 30 days from date of proposal

(iii). Subfactor 2. Experience. The Offeror must submit evidence of at least 3 contracts performed within the last 5 years that involved substantially the same work/trades, complexity as the instant contract.

(iv). Subfactor 3. Qualification. Copy of the valid SOA certification for category OG11 or OS30 classification II work.

4. PART III – PAST PERFORMANCE INFORMATION - Limited to no more than 2 pages per contract listed.

Offerors shall provide evidence, in the form of at least three (3) references, of successful performance of contracts performed within the last five (5) years where the Offeror is/was responsible for the execution of the work. The submitted references must relate to work, previously performed by the offeror, which is similar in type, scope, magnitude and complexity to the work described in this solicitation and includes:

a. Name of commercial customer or contracting activity

b. Point of Contact (POC) name, valid phone number and email address

c. Contract title

d. Contract identification number

e. Contract Value/Amount

f. Period of Performance

g. Description of work performed to include all trades involved identifying those that were subcontracted.

Failure to provide this information within the timeline specified will not constitute a late proposal; however offerors are cautioned that all required proposal information must be provided by the proposal due date or the proposal may considered non-responsive.

5. Format for proposal Parts II and III shall be as follows:

Pages exceeding the page limitations set forth herein will not be read or evaluated, and will be removed from the proposal.

(1) The proposals will be no bigger than A4 size paper except for fold-outs used for charts, tables, or diagrams, which may not exceed A3 size paper.

(2) A page is defined as one face of a sheet of paper containing information.

(3) Typing shall not be less than 12 pitch.

(4) Elaborate formats, bindings or color presentations are not desired or required.

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

M1. PROPOSAL EVALUATION

BASIS FOR CONTRACT AWARD

1. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is determined to be the lowest priced technically acceptable offeror with satisfactory performance. The following factors shall be used to evaluate offers:

a. Technical Evaluation. Technical evaluation shall be on an acceptable/unacceptable basis and determined based on submittal of acceptable documentation, certifications and past experience. The offeror will be evaluated on the following subfactors:

(i) Subfactor 1. Legal Standing. Provide documentation that satisfies the requirement of Section K provision entitled: QUALIFICATION OF FIRMS PURSUANT TO ITALIAN DECREE: DECRETO DEL PRESIDENTE DELLA REPUBBLICA (D.P.R.), JANUARY 25, 2000, NO. 34. The standard is met when the following valid documentation is included in the offer:

All of the documentation cited in the actual provision or certificate of enrollment with the Chamber of Commerce with the appropriate statement of compliance with reference to this decree. The documentation must not be greater than 90 days old from date of present offer; and

(ii). DURC document issued by Italian authorities or equivalent document issued by member nation of the European Community. The DURC document shall be submitted for direct hire employees as well as any self employed person and subcontractors. This document must not be older than 30 days from date of the proposal.

(iii) Subfactor 2. Experience. The Offeror must submit evidence of at least 3 contracts performed within the last 5 years that involved substantially the same work/trades and complexity as the instant requirement. The standard is met when the past experience documentation submitted evidences that the offeror has performed substantially the same work/trades and complexity required to perform the project of this solicitation and is therefore technically capable to successfully complete the work.

(iv) Subfactor 3. Qualification certification. The Standard is met when a copy of the valid SOA certification for the category OG11or OS30 classification II is submitted with the offer.

b.

Past Performance - Past performance shall be rated as satisfactory/unsatisfactory and evaluated based upon contractor-provided evidence of performance of contracts for work which is similar in type, scope, magnitude and complexity to the work described in this solicitation. The Government reserves the right to seek past performance information from other sources, such as the Contractor Performance Assessment Report System (CPARS). Any additional information will be evaluated in the same manner as offeror supplied references.

The government will rate the offerors past performance as follows:

(a) Satisfactory: The contractor has provided evidence, in the form of three (3) references, of successful contract performance within the last 5 years where the contractor is/was responsible for performing work similar in type, scope, magnitude and complexity to the work described in this solicitation.

(b) Unsatisfactory: (i) The offeror has failed to provide evidence, in the form of three (3) references, of successful contract performance within the last 5 years where the contractor is/was responsible for performing work similar in type, scope, magnitude and complexity to the work described in this solicitation; or

(ii) the past performance information sought and obtained by the Government reflects other than satisfactory performance by the offeror.

The standard for past performance is met when the offeror is determined to have satisfactory past performance.

c.

Price. The offer will be evaluated on the total price of all Contract Line Item Numbers (CLINS) contained in the schedule. Failure to include all prices may exclude the offeror from further consideration for award, as the Government may award without discussions. However, the government does reserve the right to conduct discussions. The standard for price is met when the price is determined fair and reasonable.

2. Initially offers shall be ranked according to price, lowest to highest. Technical evaluation shall then be performed on the lowest priced offer and subsequently the performance confidence evaluation shall be performed if the technical evaluation results in an “Acceptable” assessment. If the lowest priced offer has an evaluated “Acceptable” rating for the Technical factor and a Satisfactory Performance Confidence, award will be made to that firm and the evaluation process will stop at that point. If instead the low priced offer has not been assessed a “Acceptable” rating for the technical factor or a satisfactory assessment for performance confidence, the next lowest priced offeror will be evaluated and the process will continue (in order by price) until an offeror is judged to have an “Acceptable” Technical factor rating and a Satisfactory Performance Confidence or until all offerors are evaluated.

3. A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
