Question Government Response
1 In reference to the Questions and Answers, Dated 10 August 2011, Number 13 discusses Construction Licenses. To fully understand the requirement, are Offerors bidding as a Prime required to submit a Construction License issued by the Governor of Okinawa Prefecture, or Minister of Land, Infrastructure and Transport (Minister of LIT) under the specific Prime bidders Company Name and not as an Individual from another company (e.g. Subcontractor)? Furthermore, when bidding as Joint Venture (JV), are Offerors required to submit both Bidding Parties Construction Licenses? In short, if the Prime Bidders Construction Licenses do not meet the requirements as indicated in the Construction Business Act in Japan (May 5, 1949, Act 100) be considered “Unacceptable” and excluded from bidding this solicitation?
Question 1.a. “…are Offerors bidding as a Prime required to submit a Construction License issued by the Governor of Okinawa Prefecture, or Minister of Land, Infrastructure and Transport (Minister of LIT) under the specific Prime bidders Company Name and not as an Individual from another company (e.g. Subcontractor)?”
Government Response: The principle requirements for a proposal from an offeror are in CONST-L-7300. This provision does not require the prime contractor to submit a copy of its license to undertake construction projects.
By making a proposal, the offeror represents that it is authorized to conduct business and operate in Japan in accordance with DFARS 252.225-7042 (Apr 2003). A successful offeror will obtain the necessary licenses and permits required to perform the contract if it does not already have those licenses or permits in accordance with FAR 52.236-7 (Nov 1991).
CONST-L-7300, paragraph K.1 (a) (i), requires providing copies of licenses for key personnel. CONST-L-7300, para K.1 (a) iii), requires providing copies of key licenses for key subcontractors. Neither of these requirements requests copies of licenses for the offeror.
Question 1.b. “…when bidding as Joint Venture (JV), are Offerors required to submit both Bidding Parties Construction Licenses?”
Government Response: See response to 1.a above
Question 1.c.. “…if the Prime Bidders Construction Licenses do not meet the requirements as indicated in the Construction Business Act in Japan (May 5, 1949, Act
100) be considered “Unacceptable" and excluded from bidding This solicitation?
Government Response: Offeror's licenses have not been requested for this solicitation;
the licenses of the offeror will not be evaluated as part of this source selection.
This applies even if a construction license is submitted by an offeror as part of the
