FA5000-14-R-0022 – Draft Statement of Work – 30 January 2014
STANDARD NOTES FOR SCHEDULE OF BASIC CONTRACT:
NOTE 1: STANDARD WORKING HOURS for the contractor are from 7:30 a.m. to 4:30 p.m., Monday through Friday, excluding Saturdays, Sundays, and Federal Holidays. If the Contractor desires to work during non-standard working hours, on a Standard Working Hours Delivery Order, additional Government inspection forces may be required. The Contractor shall notify the Contracting Officer in writing, either by letter or email, three working days in advance of his/her intention to work during periods other than Standard Working Hours. This notification shall allow the inquiry into the availability of additional Government Inspectors. If the Contracting Officer confirms that additional Government Inspectors are reasonably available, the Contracting Officer may authorize the Contractor to perform work during periods other than Standard Working Hours.
NOTE 2: NON-STANDARD WORKING HOURS will be defined on individual delivery orders and shall be outside the definition of the standard working hours and not in controlled areas.
NOTE 3: STANDARD WORK HOURS IN CONTROLLED AREAS will be specified in each affected delivery order. Concerning work inside the controlled areas, the prices will be based on the usual item unit price format, but will be affected by the corresponding controlled area coefficient. All work in restricted areas is assumed to be within standard working hours. All work inside of controlled areas may be subject to brief delays due to security processing (30 minutes time each process on and off per visit to the controlled area) or interruption to the normal work schedule to permit the completion of mission essential operations. Such interruptions, if required, will be given on short notice and expeditious action will be required. Each interruption may last up to sixty (60) minutes. The contractor shall not be compensated for said delays other than the coefficient for this type of work. Interruptions that may be experienced over and above those mentioned will be handled on an individual basis termed as defined later in this contract.
NOTE 4: NON-STANDARD WORKING HOURS IN CONTROLLED AREAS will be outside the definition of the standard working hours and concerning work inside the controlled areas. All work inside of controlled areas may be subject to brief delays due to security processing (30 minutes time each process on and off per visit to the controlled area) or interruption to the normal work schedule to permit the completion of mission essential operations. Such interruptions, if required, will be given on short notice and expeditious action will be required.
Each interruption may last up to 60 minutes. The Contractor shall not be compensated for said delays other than the coefficient for this type of work. Interruptions that may be experienced over and above those mentioned above will be handled on an individual basis termed as defined later in this contract.
NOTE 5: PROPOSALS WITHOUT AWARD is defined as follows: Occasionally, the Contractor will prepare and negotiate a proposal, but the delivery order will not be awarded by decision of the Government. In these cases the contractor will be paid for the proposal in accordance with the fixed price schedule line 0001AM of the contract
PRICING SCHEDULE.
NOTE 6: PROPOSAL PREPARATION FEE: For all contractor proposals for delivery orders that are awarded, the contractor's proposal preparation costs shall be included in the contractor's coefficient. For proposals that are not awarded, see above NOTE 5. For contractor proposals that are paid for under the fixed price schedule line 0001AM of the contract PRICING SCHEDULE but then are later awarded, the contractor shall credit the Government for the paid ‘proposal without award’ fee.
NOTE 7: Proposal prices must be entered for all items of the Proposal Schedule. (Coefficients are factors that are multiplied against the standard unit prices in calculating delivery order (D.O.) prices. Coefficients include cost elements of: overhead, profit, minimum design costs, general and administrative expenses, quality control, bond premiums, Federal, State and local permits, site investigation, and any other contractor incurred costs. Coefficients are to be carried out not more than two (2) decimal points.
NOTE 8: DESIGN: Minimum design effort, that which is incidental to accomplishing the required task, is required by all Contract Line Item Numbers (CLINs).
NOTE 9: MAXIMUM CONTRACT AMOUNT: The "maximum" shall not exceed $100 million. This maximum amount includes the base year.
NOTE 10: MINIMUM GUARANTEED AMOUNT: The minimum guaranteed amount of work to be ordered under the basic contract period is $20,000.00.

STATEMENT OF WORK
C 101 PROJECT DESCRIPTION: All work shall be in conformance with the requirements of the contract including, but not limited to, furnishing all materials, labor, plant, tools, equipment, transportation, supervision, management, and other services (including engineering/technical design support), items, and incidentals necessary for the successful completion of each issued delivery order. This contract is for a broad range of maintenance, repair, and minor construction work at Joint Base Elmendorf Richardson (JBER), The contract is an Indefinite Delivery, Indefinite Quantity (IDIQ) for Simplified Acquisition of Base Engineer Requirements (SABER). The contract consists of four major elements as follows:
C 101.1 Detailed delivery orders specifications encompassing most aspects of Base Civil Engineer Work.
C 101.2 Units of measure and corresponding prices for each of the specifications and delivery order.
C 101.3 General and Special Provisions.
C 101.4 No monetary amount shall be obligated by the award of the contract. Monetary amounts are obligated by the issuance of delivery orders only.
C 102 COMMENCEMENT OF WORK:
The first 90 calendar days following contract implementation will be designated a start-up period, after which the Contractor shall have all equipment and personnel in place to fully execute the requirements of the contract.
The Contractor will be allowed the first 21 calendar days of the start-up period to mobilize without being notified by the Contracting Officer of a performance requirement. During the remainder of the start-up period the Contractor shall have the required capability to accept Requests for Proposal (RFP’s), provide proposals, negotiate, and receive awarded Delivery Orders at a volume in accordance with the following schedule:

The Contracting Officer may request work over the above specified capability requirements; however, the Contractor will be allowed to decline, without penalty, if he is not sufficiently mobilized to take on the additional work.
Within sixty (60) calendar days after contract award, the Contractor shall be capable of actually performing work on the awarded delivery orders.
C 103. TECHNICAL SPECIFICATIONS: The contractor will comply with the Technical Specification identified as a part of this Contract.
C 103.1 The Technical Specifications for use with this SABER contract will be the Gordian Group Technical Specifications associated with the contract Construction Task Catalog (CTC) customized for JBER.
The contractor shall provide these Technical Specifications as a part of the (CTC). The Technical Specifications are numbered and organized by the Construction Specification Institute's (CSI's) MasterFormat and are available for review from the government. All specifications are filed in Divisions 01000 through 44000 per the Gordian Group guidelines.
C 103.2 The cross references at the end of each section of the Technical Specifications provides cross reference to the Construction Task Catalog (CTC)). Some specifications are broad scope in nature and contain a variety of items; therefore, they will have several CTC designators. Other specifications will not have CTC pricing information; these items are those which are special ordered from the manufacturer or the items involved would be proprietary to each manufacturer’s own equipment.
C 103.3 The intent of the specifications is to furnish standards for maintenance, repair, and minor construction of Government facilities. Where a conflict exists between these specifications and others included in the contract, the most stringent shall take precedence.
C 103.4 Occasionally a project will require the use of guidelines and regulations that do not fit under typical CSI's. In these cases, it will be the responsibility of the government to provide to the contractor the regulations or guidelines that do apply, prior to any efforts put toward this project.
C 103.5 All environmental requirements will be based on JBER OPLAN 19-3 Environmental
Management Plan and are available for review from the government. These requirements will prevail over any CSI environmental sections or Gordian Group guidelines.
C 103.6 As a general practice and unless otherwise specified, the contractor shall use sustainable environmental practices, including acquisition, when practicable, of energy-efficient, water-efficient and recycled-content products, and use of paper of at least 30 percent post-consumer fiber content, electronic products with Electronic Product Environmental Assessment Tool (EPEAT) registration or Energy Star products, energy efficient lighting and environmentally sound practices with respect to disposition of waste and debris.
C 104 REGULATIONS:
C 104.1 The Contractor shall comply with all applicable Federal, State, Local, Air Force, Army, and DOD regulations, including supplements pertaining to safety, traffic control, and fire prevention.
C 104.2 The delivery orders shall be designed in accordance with the design and construction standards contained in the latest version of the Unified Facilities Criteria (UFC) 1-200-01 and all core UFC codes and other codes referenced therein including but not limited to: International Building Code, National Fire Code, Life Safety Code, National Electrical Code, International Plumbing Code, and other applicable Department of Defense and Air Force regulations, manuals, engineering technical letters, and energy conservation criteria including Guiding Principles for Federal Leadership in High Performance and Sustainable Buildings.
C 104.3 The Contractor may view the Government CD-ROM library that contains most applicable Air Force and Corps of Engineer publications as well as some commercial product data information. However, the Air Force will not furnish the Contractor reference materials, codes, regulations, or guide specifications.
These may be acquired from the Government Printing Office or from other federal agencies.
C 104.4 The latest edition of the following Building Codes shall be used and maintained for all construction under this contract.

C 104.5 The Contractor shall have a current copy of each of these documents available for use during the term of this contract.
C 104.6 If there is a conflict between these codes, regulations, and specifications, the most stringent requirements shall apply at all times.
C 105 MATERIALS FOR DESIGN:
C 105.1 The Government will provide project design information and drawings at a level it deems necessary for the contractor to perform the delivery order work. The contractor shall perform incidental design work as may be necessary to the construction. The Contractor’s proposal must be supported by necessary documentation to indicate that adequate engineering and planning to accomplish the requirement has been accomplished. Example of documentation that might reasonably be expected would include sketches or drawings, calculations, catalog cuts, specification, etc. The contractor is not expected to perform design services or to provide stamped engineering drawings in violation of applicable Federal Acquisition Regulations. Stamped engineering drawings that are included as a part of a manufacturer’s package, such as pre-engineered building packages, etc., are not considered to be design services.
Specialty systems that require stamped drawings to comply with life safety codes, such as fire sprinkler systems and fire alarm systems, shall be provided as a part of the fire system installation and not considered to be design services.
C 105.2 Reference Drawings: The Government (673 CES) will furnish, if requested, available blueprints of as-built drawings which are pertinent to the facility/area involved in the Statement of Work to the Contracting Officer who, in turn will provide them to the Contractor.
C.105.2.1 The Government (673 CES) does not guarantee the accuracy or adequacy of the available as-built drawings. The Contractor shall verify, by field investigation, all conditions and information relevant to the project, including dimensions, prior to the issuance of each delivery order. This confirmation of accuracy shall enhance the quality of the delivery order's design. The Contractor shall advise the Contracting Officer, or his/her authorized representative, in writing of any discrepancies prior to submitting the proposal.
C.105.2.2 Where exact locations are not given in the Statement of Work for the positioning of equipment, devices, and work; they shall be positioned to comply with applicable codes and permit easy access for maintenance and for removal and replacement of component parts with Government approval.
The Contractor is responsible for the coordination and proper relation of the work with the existing surroundings.
C 106 EQUIPMENT/SUPPLIES: The Contractor awarded this contract will be required to provide to the
Government and to maintain the following equipment and programs at the Contractor's expense:
C 106.1 Electronic Format: All electronic correspondence of information outside of e-mail shall be done in Microsoft Word, Microsoft Excel, Adobe Acrobat Pro or Microsoft PowerPoint. Contractors and their personnel will not be granted access to JBER Local Area Network (LAN). All access to the World Wide Web (WWW) will be accomplished through the use of an independent internet contractor. Access to the WWW is mandatory.
C 106.2 Publications: The Contractor shall provide the Government with the number of copies indicated below of the following publications, the latest edition, and any updates, for the life of the contract. If there is a conflict between these codes, regulations, and specifications, the most stringent requirements shall apply at all times. These publications shall be furnished to the Contracting Officer no later than 30 days of contract award and with-in 30 days of each exercised option year.

These publications shall remain the property of the government.
C 106.3 Online Subscriptions and Software: The Contractor shall be responsible for bearing all costs associated with procurement and access to The Gordian Group’s (“Gordian”) Simplified Acquisition of Base Engineering Requirements (“SABER”) system (“Gordian SABER System”) for the JBER program. The Gordian SABER System purchased by the Contractor shall, at a minimum, include twelve (12) government user licenses and two (2) contractor user license for access to Gordian’s proprietary eGordian® SABER management system, Construction Task Catalog® and Technical Specifications;
annual updates of the Construction Task Catalog and Technical Specifications for the term of the Contract; and annual training for JBER and Contractor staff. The number of government user licenses requested is subject to change to a maximum of fifteen (15) during the term of this Contract if requested by the government. The minimum contractor user licenses shall be increased as necessary to ensure he has adequate licenses to meet the Request for Proposal (RFP) volume and required turnaround time required by the Government. The Contractor shall use the Gordian SABER System for preparing and submitting price proposals. Government users may use the software to prepare estimates, receive electronic proposals from the Contractor and manage the SABER process. Contractor access to eGordian will require a broadband internet connection. For more information on available pricing and licensing terms for Gordian’s SABER System, please contact Neil Tuck of The Gordian Group at ntuck@egordian.com or 800-874-2291. The Gordian SABER System purchased by the Contractor shall be renewed upon award of each option year at no additional expense to the Government. Renewal at each option year shall incorporate the updated CTC (in accordance with C 301.3). The licenses shall provide for additions and changes to be made to the Construction Task Catalog and Technical Specification by Gordian as requested by JBER.
C 106.4 Training: The contractor shall provide onsite training by Gordian on the eGordian® SABER management system, Construction Task Catalog® and Technical Specifications for JBER and Contractor staff at no additional cost to the Government. Training shall commence as soon as practicable after award of this contract. Location and timing of the training shall be coordinated with JBER 673 CES.
Use of Government facilities for the training is allowed but any expenses associated with this use of these facilities shall be paid for by the contractor. Follow on training shall be provided annually for JBER and Contractor staff upon award of each contract option year.
C 106.5 Communication Equipment: The Contractor shall provide and maintain three way communications for
(1) Project Management, (2) Project Site and (3) JBER at all times. This should be accomplished by providing all field contract staff with cellular telephones. The Government provides such communication means for Government staff only.
C 107 DESIGN CERTIFICATION: RESERVED
C 108 RECORDING AND PRESERVING HISTORICAL AND ARCHAEOLOGICAL FINDS: All items having any apparent historical or archaeological interest which are discovered in the course of any construction activities shall be carefully preserved. The Contractor shall leave the archaeological find undisturbed and shall immediately report the find to the Contracting Officer, or his/her designated representative, so that the proper authorities may be notified.
C 109 STANDARD PRODUCTS: Materials and equipment shall be standard products of a manufacturer regularly engaged in the manufacture of-such products, which are of a similar material, design, and workmanship. The standard products shall have been in satisfactory commercial and/or industrial use for 2 years prior to use. The 2-year use shall include applications of equipment and materials under similar circumstances and of similar size. The 2-year experience must be satisfactorily completed by a product that has been sold or is offered for sale on the commercial market through advertisements, manufacturers' catalogs, or brochures. Products having less than a 2-year field service record will be acceptable, if a certified record of satisfactory field operation, for not less than 6,000 hours exclusive of the manufacturer's factory or laboratory tests, can be shown and approved by the Government. The Contractor shall not purchase "close-out" products that are being discontinued by the manufacturer.
C 109.1 Recovered Materials Procurement: In accordance with Executive Order 13514 the contractor shall use sustainable environmental materials, including acquisition of bio-based, environmentally preferable, energy-efficient, water-efficient, and recycled-content products. The materials shall be non-ozone depleting and non-toxic odorless products, where such products and services meet project performance requirements. The applicable materials are given by the U.S. EPA Comprehensive Procurement Guidelines and the USDA BioPreferred Catalog. Determination of feasibility of using these materials shall be in accordance with FAR 23.405(c).
C 109.1.1 The Contractor shall provide the Government with a list of locally available sustainable environmental materials as listed by the U.S. EPA Comprehensive Procurement Guidelines in the Construction Products and Landscaping Products categories as well as the USDA BioPreferred Catalog for the life of the contract. The list shall be furnished to the Contracting Officer no later than 30 days of contract award and updated with-in 30 days of each exercised option year. Additionally it shall be updated as requested by the Contracting Officer.
C 110 PERFORMANCE OF WORK BY CONTRACTOR:
C 110.1 The Contractor shall maintain an organizational chart showing the total organization, onsite staff and engineering support team. The onsite staff shall include the relationship of the site superintendent and quality control. A final organizational chart shall be provided to the government at the start of the contract and after any personnel changes.
C 110.1.1 The Organization chart shall provide clear, logical lines of authority from Program Manager to subcontracting management, demonstrating technical sufficiency, including site superintendents and quality control.
C 110.1.2 The Contractor shall provide a position description of the onsite staff. This shall include a brief job description, qualifications, responsibilities and decision-making authority of each member.
C 110.2 The Contractor shall provide an onsite superintendent. The superintendent must provide onsite decision-making authority.
C 110.3 Contractor Performance Bond: Upon contract award for the base period and as each option period is exercised, the contractor shall provide a letter of commitment from a surety or a blanket bond equal to the maximum contract value for the year. The obligation of the surety under the letter of commitment shall be equal to the contract price. The letter of commitment shall express the surety‘s willingness to provide the required bonding within 10 calendar days after notification that the need is transmitted to the surety by the contractor. A blanket bond to cover this amount is acceptable but not required. If a blanket bond is not provided at the start of each contract year, a bond will be required for each delivery order and adjusted as necessary to cover any delivery order modifications. All costs associated with bonds shall be included in the coefficient. The penal amount of the bonds shall be 100 percent of the contract price, unless the Contracting Officer determines that a lesser amount would be adequate for the protection of the Government. The Government may require additional bond protection when a contract price is increased. The increase in protection shall generally equal 100 percent of the increase in contract price. The Government may secure additional protection by directing the contractor to increase the penal amount of the existing bond or obtain an additional bond. The contractor performance bond amount for individual delivery orders shall be determined based on the total of prepriced and non-prepriced items.
C 111 APPLICATION OF WAGE RATES AND FRINGE BENEFITS: For the application of the wage rates and fringe benefits contained in the Decision of the Secretary of Labor; attached to and a part of this contract, all work shall be considered Heavy and Highway Construction, Building Construction, or Residential.
C 112 SAFETY: Compliance with the current U.S. Army Corps of Engineers "Safety and Health Requirements
Manual", (EM 385-1-1); Occupational Safety and Health Act (OSHA) standards, and current JBER safety regulations is mandatory. The prime Contractor shall be held responsible to insure that his/her workforce and any subcontractor or supplier workforce comply with the above safety requirements.
C 112.1 JBER has a hospital on site. Should an injury occur, base medical staff can provide emergency medical treatment. Follow-on care after initial emergency treatment will not be provided. The Contractor will be required to reimburse the Government at an established rate for non-beneficiaries in accordance with DOD Regulation 6010.15.
C 112.2 SAFETY ASSURANCE The Contractor shall prepare and submit a safety plan detailing the means and methods that will be implemented to ensure that there is full compliance with all safety regulations, practices, and standards.
C 112.2.1 Preconstruction Safety Meeting: Representatives of the Contractor shall meet with the Contracting Officer for the purpose of reviewing the Contractor’s safety and health programs and discussing implementation of all safety and health provisions pertinent to the work to be performed under the contract. The contractor shall be prepared to discuss, in detail, the measures he/she intends to take in order to control any unsafe or unhealthy conditions associated with the work to be performed under the contract. This meeting may be held in conjunction with the preconstruction conference, if so directed by the Contracting Officer. The conduct of this meeting is not contingent upon a general preconstruction meeting. The level of detail for the safety meeting is dependent upon the nature of the work and the potential inherent hazards. The Contractor’s principal on-site representative(s), the general superintendent and his/her safety representative(s) shall attend this meeting.
C 112.2.2 Compliance with Regulations: All work, including the handling of hazardous materials or the disturbance or dismantling of structures containing hazardous materials shall comply with the applicable requirements of 29 CFR 1926/1910. Work involving the disturbance or dismantling of asbestos or asbestos containing materials; the demolition of structures containing asbestos; and/or the disposal and removal of asbestos shall also comply with the requirements of 40 CFR, Part 61, Subparts A and M, ETL 1110-1-118 and DA Circular 40-83-4. All work shall comply with applicable state and local safety and health requirements. Where there is a conflict between applicable regulations, the most stringent shall apply. The Contractor or any of his subcontractors responsible for handling hazardous and toxic materials shall have the necessary certification before doing so.
C 112.2.3 Contractor Responsibility: The Contractor shall assume full responsibility and liability for compliance with the applicable regulations pertaining to the health and safety of personnel during the execution of work, and shall hold the Government harmless for any action on his part or that of his employees or subcontractors, which results in illness, injury, or death.
C 112.2.3.1. Materials and Equipment: Special facilities, devices, equipment, clothing, and similar items used by the Contractor in the execution of work shall comply with the applicable regulations.
C 112.2.3.2. Hazardous Materials: The Contractor shall bring to the attention of the Contracting Officer any previously known material suspected of being hazardous which he encounters during execution of work. A determination will be made by the Contracting Officer as to whether the Contractor shall perform tests to determine if the material is hazardous. If the Contracting Officer directs the Contractor to perform tests, and/or if the material is found hazardous and additional protective measures are needed, a contract change may be required, subject to equitable adjustment under the terms of the contract
C 112.3 Special Safety Requirements: The Contractor shall comply with Air Force and local fire regulations and NFPA 241-1986 "Safeguarding Building Construction and Demolition Operations." Fire extinguishers rated and approved by the National Fire Protection Association, of sufficient size, type, and quantity to cope with all known hazards shall be provided by the Contractor at the construction site during the execution of this contract; the extinguishers shall be removed upon acceptance of the project.
C 113 PARTNERING:
C 113.1 The Government intends to encourage the formation of a cohesive partnership with the Contractor. This partnership will be structured to draw on the strengths of each organization to identify and achieve reciprocal goals. The objective is effective contract performance in achieving completion within budget, on schedule and in accordance with plans and specifications.
GENERAL CONDITIONS
C 201 LOCATION OF STAFF: The Contractor will be required to maintain an on-site project management staff, equipped with cellular phone and electronic mail capabilities, to respond to the requirements set forth in this contract. The Contractor will be provided the use of a parcel of land approximately 100’x100’. This parcel is located on JBER-Richardson, Quartermaster Road, adjacent to Building 730. The Contractor shall provide the structure to house his staff. The structure shall convey the image of a professional office and have the appearance of being permanent. As such, it must appear to be constructed so that it is an on grade structure (trailers must have skirts to grade). The exterior of the building must be maintained free of unsightly damage and the area around the office kept free of debris and in an orderly appearance. The Contractor may place a sign of no more than 4’x8’ adjacent to the structure displaying the company name and logo.
C 202 STAGING/STORAGE AREA: Area will be provided by the Government in a separate location from the location of the Contractor’s on site office space.
C 202.1 Fence: The Contractor shall maintain the storage area as a fenced area for the term of the contract.
Fence will be 6 feet high privacy fence to avoid any unsightly material or equipment stockpiles.
C 202.2 Sign: At the Outside Storage Area, the Contractor shall erect a sign in accordance with JBER sign standards. The sign will prominently display the company's name and phone number and the words "SABER Contractor."
C 202.3 Housekeeping: The Contractor shall perform normal housekeeping functions, at the Contractor's expense, inside and outside his/her facilities at the Office and Staging/Storage Areas as outlined in Base regulations and as directed by the Contracting Officer. Such functions include snow and ice removal, sweeping, mopping, dusting, disposal of accumulated waste materials and rubbish, and other operations necessary to present a neat appearance at all times. Contractor facilities shall conform to base standards, including the color of the temporary office space. All rubbish and waste materials shall be removed daily and shall be placed in approved containers outside the building where designated. Trash disposal is at the Contractor's expense. The Contractor shall not allow grass/weeds within the staging/storage area to exceed six inches in height.
C 202.4 Facilities and Equipment: At the time of contract authoring there are no Government furnished equipment or facilities.
C 202.5 Utilities:
C 202.5.1 UTILITIES (CONTRACTOR’S OFFICE ON JBER LOCATION) Contractor office utilities, such as electrical, water, sewage, etc., shall be provided by the JBER. The Contractor shall pay for these services at the below rates. These rates will typically be adjusted yearly, but may be adjusted semi-yearly if utility prices change substantially within the year. Yearly rate adjustments will typically occur in January for the upcoming calendar year. Connections to these tie-in points shall be the responsibility of the Contractor. Installation of all required meters and utility service line extensions shall be at the cost of the Contractor. The Contractor will be required to sign a JBER utility purchase agreement for the use of the utilities.

C 202.5.2 UTILITIES (PROJECT WORK RELATED) Site available water and electrical may be used in this work at no cost to the Contractor. Contractor shall make arrangements for such services with the Contracting Officer or his designated representative. Water in Quantities for Minimum Operations; Contractor can connect to nearest existing Base service point as approved by Government personnel. This use is voluntary, and all connections, service lines and meter shall be made and removed at the expense of the Contractor. Electricity is available at contractor's expense.
All connections, service lines and meters shall be made and removed at the expense of the Contractor. All temporary outages of any utility services required for the performance of work shall be scheduled with JBER no less than 14 calendar days in advance of such outages.
C 203 VEHICLES, PASS AND IDENTIFICATION, SECURITY REQUIREMENTS:
C 203.1 Search, Inspection, and Seizure: All vehicles, personnel, and hand-carried items, entering or exiting any base control point, or while on the base, are subject to search and inspection and seizure of any prohibited item, at any time. Random, unannounced, and regular searches and inspections can be conducted. These searches and inspections are intended to assure prohibited articles are not introduced into, and government property is not removed from the base or its facilities. These delays will not be charged to the Government, as they are to be expected entry procedures for the installation. Delays entering the installation can be experienced during military exercises and increased threat postures; the contractor assumes all liabilities associated with such delays.
C 203.2 Parking: Parking of the Contractor's vehicles shall be restricted to the area of work. The company name shall be prominently displayed on all construction vehicles parked where work is being accomplished.
C 203.3 Driver's Licenses: All persons entering or working on JBER that are required to operate a motor vehicle shall possess a valid Driver's License. For personnel operating specialized equipment, a Commercial Drivers License (CDL) is required as appropriate.
C 203.4 The use of seatbelts by all vehicle operators and passengers is mandatory on Elmendorf AFB. Vehicle operators caught not wearing seatbelts will lose their driving privileges, subject to laws governing Military and Civilian Employees.
C 203.5 On-base contractor employees shall ensure the following pass and identification items required for contract performance, are obtained for employees and non-government owned vehicles.
C 203.6 Base Access: All contractor personnel are required to pass security checks prior to being issued a base pass allowing them access to JBER. The Contracting Officer or his designated representative will provide instructions and forms for the contractor to fill out and return to the Contracting office. These will be reviewed and forwarded to the security office for approval. Once approval/disapproval has been received, they will be forwarded to the contractor. This will be notice that the employees may go to the visitor’s center and get their access pass.
C 203.7 Retrieving Identification Media. The contractor shall retrieve all identification media, including vehicle passes from employees who depart for any reason before the contract expires; e.g., terminated for cause, retirement, etc.
C 203.8 For Official Use Only (FOUO). The contractor shall comply with AFI 37-131, Freedom of Information
Act Program (FOIA) requirements. The regulation sets policy and procedures for the disclosure of records to the public and for marking, handling, transmitting, and safeguarding FOUO material.
C 203.9 SECURITY REQUIREMENTS The Contractor shall comply with security requirements imposed by the Installation Commander and/or the agency occupying the space where work is to be performed, including any necessary security clearances. Prior to mobilization the Contractor shall provide the Contracting Officer or authorized representative a list of personnel requiring authority to work on JBER.
The list shall be kept current and the Contracting Officer or authorized representative shall be notified as to any changes in the list.
C 203.9 .1 Additional Security Requirements: In accordance with DOD 5200.1-R, and AFI 31-401, the contractor shall comply with requirements identified in AFSSI 9100, Communications Security (COMSEC), Command, Control, Communications and Computer (C4) Systems Security, Security Awareness Training Education (SATE), and Operations Security (OPSEC).
C 203.10 Reporting Requirements. The contractor shall comply with AFI 71-101VI, "Counterintelligence
Awareness and Briefing Program" requirements. Contractor personnel shall report to an appropriate authority any information or circumstances of which they are aware may pose a threat to the security of DOD personnel, contractor personnel, resources, and classified or unclassified defense information.
Contractor employees shall be briefed by their immediate supervisor upon initial on-base assignment.
C 203.11 Traffic Laws. The contractor and its employees shall comply with base traffic regulations.
C 203.12 Key Control. The contractor shall establish and implement methods of making sure all keys issued to the contractor by the Government are not lost or misplaced and are not used by unauthorized persons.
The contractor shall not duplicate any keys issued by the Government.
C 203.12.1 The contractor shall immediately report to the Contracting Officer any occurrences of lost or duplicated keys.
C 203.12.2 In the event keys, other than master keys, are lost or duplicated, the contractor may be required, upon written direction of the Contracting Officer, to re-key or replace the affected lock or locks without cost to the government. The government may, however, at its option, replace the affected lock or locks or perform re-keying and deduct the cost of such from the monthly payment due the contractor. In the event a master key is lost or duplicated, the government shall replace all locks and keys for that system and the total cost deducted from the progress payment due the contractor.
C 203.12.3 The contractor shall prohibit the use of keys, issued by the government, by any persons other than the contractor's employees and the opening of locked areas by contractor employees to permit entrance of persons other than contractor employees engaged in performance of contract work requirements in those areas.
C 203.13 Lock Combinations: The contractor shall control access to all government provided lock combinations to preclude unauthorized entry.
C 203.14 Controlled/Restricted Areas. The contractor shall implement local base procedures for entry to JBER controlled/restricted areas where contractor personnel will work.
C 204 CONTRACTOR'S TELEPHONE:
C 204.1 Upon Award: At the beginning of the contract, prior to telephone installation, the Contractor shall provide the Contracting Officer with a Telephone Directory at which the Contractor staff may be contacted at any time during standard working hours.
C 204.4 Costs: All costs incurred as a result of the telephone installation and service shall be borne by the
Contractor.
C 204.5 Emergency Phone Number: An after standard hours emergency telephone number for the Contractor shall be provided to the Contracting Officer or his/her authorized representative. Updates shall be provided to the Contracting Officer, or his/her authorized representative in a timely manner.
C 204.6 Communications Security (COMSEC): All communication with Department of Defense (DOD) organizations are subject to COMSEC review. Contractor personnel will be aware that telecommunications networks are continually subject to intercept by unfriendly intelligence organizations. The DOD has authorized monitoring of the military phone calls originating from or terminating at DOD organizations. Therefore, civilian Contractor personnel are advised that any time they place a call to or receive a call from a USAF organization, they are subject to COMSEC procedures.
The Contractor will assume the responsibility for ensuring wide and frequent dissemination of the above information to all employees dealing with official DOD information.
C 205 EMPLOYEE STANDARDS: The Contracting Officer may, in writing, require the Contractor to remove from the site any employee the Contracting Officer deems incompetent, careless, or otherwise objectionable.
The following shall apply:
C205.1. All work under this contract shall be performed in a skillful, workmanlike, and professional manner.
C 205.2. Proper Attire: Improper attire, i.e. attire not providing sufficient safety protection and a professional appearance (minimum of long trousers, shirt and shoes) will be reported to the Ground Safety Office and the Contracting Officer respectively. In addition, no profane, illegal, offensive or discriminatory language/symbols shall be displayed.
C 205.3. Subcontractors: The Government shall not exercise any supervision or control over the Contractor's employees performing service under this contract; such employees shall be accountable not to the Government, but solely to the Contractor, who in turn, is responsible to the Government.
C 205.4. Unauthorized Personnel: Circulation of said personnel will be limited to official business only. Persons in violation of the above will be apprehended and appropriately disciplined.
C 206 PROHIBITED ITEMS: Certain items are prohibited on base. Personnel who are found to be in possession of prohibited items will be challenged and the item confiscated pending an investigation. Personnel in possession of prohibited items are subject to disciplinary action, withdrawal of access authorization, or arrest and prosecution. The following non-government owned items are prohibited on base, unless an exception is noted:
C 206.1 Smoking is permitted in designated, outside smoking areas only. No smoking will be allowed within any base facility.
C 206.2 Alcohol, controlled substances including illegal drugs and associated paraphernalia, except for prescription medicine.
C 206.3 Firearms, ammunition, and other dangerous or deadly weapons, explosives or incendiary devices.
C 206.4 Cell phone use while driving is prohibited on JBER.
C 206.5 Pets, wild or domestic.
C 206.6 Other items prohibited by local, state, or federal law.
C 206.7 Other items prohibited by Wing Instructions and regulations, Air Force Instructions, or DOD regulations.
C 207 GOVERNMENT FURNISHED EQUIPMENT/MATERIALS (GFE/M): Government furnished materials will not be provided to the Contractor as a general rule. However, the government reserves the right to use
GFE/M on any task order. In such cases, the Contractor shall provide receipt for these materials to the Government and the non-priced item line item material cost shall be excluded from the price of the task order.
The Contractor shall follow the instructions of the Contracting Officer's representative regarding the disposition of all government-furnished property not consumed in performance of the task order.
C 207.1 Property Administrator: The Base Civil Engineer, or his/her authorized representative, is designated as
Property Administrator for Government-furnished equipment/material to be furnished to the Contractor for performance under this contract.
C 207.2 Transportation: The Contractor, with his own forces, shall transport all Government furnished equipment/materials (GFE/M), if any described on the delivery order. The equipment/material shall be transported from the Government storage area to the work site indicated on the delivery order.
C 207.3 Contractor Responsibility: The Contractor assumes the risk and responsibility for the loss or damage to the Government-furnished property.
C 208 GOVERNMENT LIABILITY: The Government shall not be liable for any loss or damage to the
Contractor's property, including stock or for expense incidental to such loss or damage. Suspected theft shall be reported to the Security Forces as soon as possible.
C 209 WORK:
C 209.1 Scheduling: Before any of the work is initiated under any individual delivery order, the Contractor shall confer with the Contracting Officer, or his/her authorized representative(s), and agree on: a sequence of procedure; means of access to premises and building; space for storage of materials and equipment;
delivery of materials and use of approaches; use of corridors, stairways, elevators, and means of communications; and the location of partitions, eating spaces, and restrooms for Contractor's employees.
C 209.2 Permits: The Contractor is responsible for acquisition of all permits required by JBER, State, and
Federal Governments, to include 673rd Wing Form 3 or 4 (Dig Permit) and Work Clearance Request.
Required permits may include, but are not limited to, environmental permits, such as asbestos disposal documents and storm drainage permits, transportation permits, and welding permits, (The Contractor shall obtain a welding permit from the Base Fire Chief immediately prior to performing any welding by a certified welder.)
C 209.3 Concealed Work / Concrete Work: All items of work to be concealed shall be Government inspected prior to concealment. Contractor shall notify the Contracting Officer's /673 CES SABER representative of his/her intention to conceal / place concrete a minimum of 24 hours in advance and no items shall be concealed until the contractor has received approval to do so from the Contracting Officer's 673 CES SABER representative.
C 209.4 Furniture Moving: Furniture and portable office equipment in the immediate area shall be moved by the
Contractor and replaced to original position as identified in each Delivery Order upon completion of the work. If the work required by the delivery order will not allow furniture and portable office equipment to be replaced to its original position, new locations will be designated by the Contracting Officer or the Contracting Officer's representative for replacement by the Contractor. This work will be identified in the Delivery Order as a line item.
C 209.5 Material Delivery: Delivery of materials and equipment shall be made with a minimum of interference to Government operations and personnel.
C 209.5.1 Incoming Supplies: The Contractor shall coordinate with suppliers and shippers to ensure incoming materials are properly identified with the Contractor's name, contract number, and delivery order description. Also, a designated individual shall be identified to receive shipments.
No covered storage area is available for the Contractor's use.
C 209.6 Material Testing: The Contractor shall notify the Contracting Officer or the Contracting Officer’s Representative a minimum of 24 hours in advance of when and where testing is to be performed so the Government will have the option of witnessing the test.
