FAR 52.212-1, INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS (Sep 2023)

The provision FAR 52.212-1 is tailored as follows:

a. QUOTE FORMAT

i. Operating System and Applications Quotes will be accessed with the Microsoft Windows 10 Operating System. Quote files must be submitted using only the applications listed below:

Application / File Valid Extensions Portable Document Files .pdf Microsoft Word .docx Microsoft Excel .xlsx

Documents submitted in any extension other than the three listed above will not be evaluated.

This may result in a quote being considered unresponsive.

ii. Virus Free Electronic Submission Offerors must ensure that quotes are virus-free. The Offeror must certify, in the quote cover letter, that all electronic quote information delivered throughout the evaluation is virus free.

Offerors should specify the software, version, and virus definition used to check the data.

iii. Multimedia and Graphics Sound and video (e.g., MPEG) files must not be imbedded within the quote. Offerors should:

a. Avoid submitting large files

b. Simplify color palettes and minimize the use of color images or graphics

c. Minimize size of graphics files

d. Avoid scanned images

iv. Fonts: Quotes text fonts shall not be smaller than Times New Roman, 11-point font, single column, with normal character spacing and position. The text for charts, tables, graphs, and figures shall be no smaller than Times New Roman, 10-point font. Line spacing shall be at least single- spaced.

v. Pages: All pages must be formatted as 8.5” x 11” letter size with one-inch margins all around.

11” x 17” is allowed for charts, tables, and graphs only. Any quote text included on these pages, other than the information specific to the graphics, will not be considered in the evaluation. One 11” x 17” page will be counted as two pages. All material must be contained within the page limits identified below for each section, and all appendices, charts, graphs, diagrams, tables, photographs, drawings, etc., are included in the page count. Not included in the page count are title pages, tables of content, glossaries of abbreviations, acronyms, or definitions, or copies of certificates (i.e. ISO9000).

vi. Headers and Footers: Information contained in headers and footers must only provide company name, solicitation number, disclosure markings (FAR 52.215-1(e)), dates, or page numbers. Text sizes must be no smaller than Microsoft Word, Times New Roman, 9-point font.

b. TECHNICAL VOLUME #1:

FACTORS: The technical volume will not make any reference to cost or price data but will include the following 3 technical factors:

i. Sub Factor #1: Corporate Experience: The offeror must submit no more than three (3) examples of contracts (commercial or government) that exhibit corporate experience in completing Grounds Maintenance services as specified in the Performance Work Statement, proving the contractor has experience with large-scale (1000+ acre) grounds maintenance services within the United States and it must be verifiable by government personnel. Contractors are encouraged to provide contact information for previous customers in order to meet this requirement. It is the contractor’s responsibility to explain how the positions and scopes of their corporate experiences are similar in nature to this requirement.

Prior experience that is not properly related to this requirement will not be considered for technical acceptability. For example, a contract for food services with no additional explanation on how it relates to this contract will not be considered in the evaluation.

ii. Sub Factor #2: The contractor must have a minimum of two years Artificial turf qualifications for contractor employees who will be conducting artificial turf services in accordance with PWS 1.1.13.6.

iii. Sub Factor #3: The contractor must have herbicide applicants required permits, licenses and certifications in accordance with PWS paragraph 4.32.

Past performance will be evaluated to assist in determining contractor responsibility in accordance with FAR 9.104-1 but will not be included as a sub factor or rated. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. In those cases of no meaningful past performance, the offeror will be determined to have unknown past performance. In the context of acceptability/unacceptability, if the offeror exhibits corporate experience and has unknown past performance, then they will be considered Acceptable. If the offeror does “not” exhibit corporate experience, whether they possess past performance or unknown past performance, they will be considered Unacceptable.

c. PRICE: VOLUME #2

i. Total Evaluated Price: The offeror “must” fill out and include Attachment II_Total Evaluated Price Matrix_FA487726QA0001 for the Pricing Volume as it delineates each CLIN price among ordering periods and the Total Evaluated Price (TEP).

ii. Reps and Certs: If an offeror has completed the annual representations and certifications via the System for Award Management (SAM) website, and after reviewing the SAM database information, the offeror verifies by submission of this offer that the representation and certifications currently posted electronically at FAR 52.212-3, Offeror Representations and Certifications—Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer, then the offeror does not need to include a copy of the representations and certifications with the quote.

However, if any information within 52.212-3 has been updated for this solicitation only, or if there are any other changes, then the offeror must include those changes within the price volume.

NOTE REGARDING FAR 52.217-8: The extension option authorized by 52.217-8 will be considered evaluated as being the same rate as the period of performance preceding its use.

Offerors are NOT to submit separate pricing to account for this option; separate pricing will not be evaluated or included in the resultant contract.

FAR 52.212-2, EVALUATION – COMMERCIAL ITEMS (Nov 2021) – ADDENDUM

The provision FAR 52.212-2, is tailored as follows:

Evaluation Factors for Award Procedures

Pursuant to FAR 12.602 contract award will be made using Simplified Acquisition Procedures in accordance with FAR 13.106. Vendor submissions will be evaluated based upon the following:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation exhibits the lowest price determined to be technically acceptable. In the event the lowest-priced offer is found to be technically unacceptable, the subsequent lowest quote will be evaluated. This process will continue until an acceptable quote is identified. For the purposes of this solicitation, technical capability and past performance when combined is less important than cost or price.

The following factors will be used to evaluate the quotes:

Technical Acceptability: Offerors must provide the necessary and requested information found herein this solicitation in order to fully demonstrate their technical capability in fulfilling this requirement for Grounds Maintenance.

i. Sub Factor #1: Corporate Experience: Offeror demonstrates the corporate experience to successfully complete grounds maintenance services by providing no more than three (3) a prior contract examples (commercial or government) that justifies their capabilities proving the contractor has experience with large-scale (1000+ acre) grounds maintenance services within the United States. The offer will discuss their approach to the tasks identified in Performance Work Statement Section 1.1. Do not copy and paste the PWS as a means and methods. The quote will show an understanding of the requirement by dovetailing existing contractor efforts to include the total size and complexity as it relates with the Government work statement.

ii. Sub Factor #2: The contractor must submit proof of a minimum of two years Artificial turf qualifications for contractor employees who will be conducting artificial turf services on applicable fields and will be validated in accordance with PWS 1.1.13.6. Certifications from the organization will be acceptable.

iii. Sub Factor #3: The contractor must submit proof of their required permits, licenses and certifications in accordance with PWS paragraph 4.32. Permits shall be included as a factor in the contractor’s bid price. Training can be done at “licensing@azda.gov” and provide copy of approved license with quote submission.

Table I- Technical Acceptability Ratings

Rating Definition

Acceptable The contractor’s technical volume clearly meets the 3 technical requirements of this solicitation and Performance Work Statement for Corporate Experience completing large scale Grounds Maintenance Services >1000 acres, Artificial Turf qualifications and State/Federal pesticide certification.

Unacceptable The contractor’s technical volume does not clearly meet the 3 technical requirements of the solicitation and Performance Work Statement.

Price Evaluation – The Government will evaluate the offeror’s price quote, to include all ordering periods, for price completeness and reasonableness as described below.

i. Complete and submit the Total Evaluated Price Matrix in its original formatting.

ii. Completeness - The offeror’s price quotes will be evaluated for completeness by confirming the offeror has provided unit and total price for all CLINs.

iii. Reasonableness - The offeror’s price will be evaluated for reasonableness through one or more of the methods specified in FAR 13.106-2 & 3.

iv. The Contracting Officer has determined there is a probability of adequate price competition in this acquisition. Upon examination of the initial offers, the Contracting Officer will review this determination and if, in the Contracting Officer’s opinion, adequate price competition exists, no additional information will be requested. However, if at any time during this competition the Contracting Officer determines that adequate price competition no longer exists, offeror’s may be required to submit information to the extent necessary for the Contracting Officer to determine the reasonableness of price.

v. An offeror’s quotes may be rejected if the Contracting Officer determines the lack of reasonable price information contained in any portion of an offeror’s price volume, or if an offer is deemed unbalanced.

a. BASIS FOR CONTRACT AWARD: The evaluation of quotes will be based on two factors: Lowest Price and Technical Acceptability. The evaluation process will proceed as follows:

1.) The quote offering the Lowest Price will initially be evaluated for Technical Acceptability.

2.) If the Lowest Price quote is determined to be Technically Acceptable, no further evaluations will be conducted, and award will be made to that offeror.

3.) If the Lowest Price quote is not deemed Technically Acceptable, the government will evaluate the next lowest-priced quote for Technical Acceptability.

4.) This process will continue, evaluating quotes in ascending order of price, until a quote that represents the Lowest Price and is also deemed Technically Acceptable is identified and award will then be made.

b. The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.

c. Ordering Periods: The Government will evaluate offers for award purposes by adding the total price for all ordering periods to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the ordering period prices are significantly unbalanced.

d. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, will result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
