SUBJECT: Ozone Depleting Chemicals, XUMU16-1149A, Fac# 85240, Repair/Upgrade Driveway and Parking Lot at Breakers

1. In accordance with (IAW) an Air Force Acquisition Circular 92-29, dated 26 May 93, as Implemented in section 326 of the FY93 Defense Authorization Act (DAA) and the Secretary of the Air Force Memorandum Policy Letter, dated 7 Jan 93 which both states Elimination of Use of Class 1, Ozone Depleting Chemicals (ODC) substance in certain Federal Government (U.S. Military Facilities) Procurement Contracts.

2. The materials, parts or goods to be acquired under this agreement are legitimate and freeof prohibited ODC substances and it’s a good representation as a bonafide need of the fiscal year in which these funds are obligated. It is to believe that this effort does not require the Contractor to use Class 1, ODC substance in performance of this contract, nor does it require delivery of a separately identifiable Class 1, ODC substance, as an item of supply or as part of any service be part of this acquisition contract.
