PROCUREMENT AND CONTRACT REQUIREMENTS

1. General.

a. General Construction Codes.

The contractor shall comply with the latest edition of, including but not limited to, the following building codes for any construction under this contract. The contractor shall have a copy of each of these documents for use during the term of the contract and furnish one (1) complete set to the government at the beginning of the contract. The contractor shall maintain these code books current throughout the life of the contract by obtaining copies of any and all revisions/updates as they become available, not to exceed 30 days of the release of the revision. If there is a conflict between these codes, regulations and specifications, the most stringent requirement shall apply. All updates or additions to these documents shall become part of this contract at the time of issuance of any change(s).

All standard specifications, pertaining to procurement and contract requirements and applicable to the scope of effort identified in each task order (TO) in the most recent version (as of the award date of this contract) of, including but not limited to, the following specifications are incorporated into this specification by reference. If there is a conflict between these specifications, the most stringent requirement shall apply. All updates or additions to these documents shall become part of this contract at the time of issuance of any change(s).

DIVISION 0074

SPECIAL PROVISIONS FOR WORKING ON OR NEAR

THE AIRFIELD OR AIRFIELD HANGAR(S)

The following provisions apply when work is required on the active airfield/hangar, or within the clear zones or primary surfaces.

a. Airfield Requirements.

Clause entitled "Airfield Safety Precautions," of the solicitation applies to this contract.

b. Closures.

All runway, taxiway or hangar closures will require the coordination of Base Operations through the Contracting Officer (CO) not less than 30 calendar days prior to the requested closure, unless otherwise provided in the specifications of the TO. The contractor shall make the maximum utilization of time during the requested closure period. The contractor shall notify the CO when finished with the work requiring the closure. The contractor shall schedule operations in phases if necessary so as to minimize the effect of construction closures on normal base operations.

c. Coordination of Work.

The contractor shall coordinate with the CO before initiating any work and will notify the

CO of proposed location of work and time of operation. The contractor shall contact Base

Operations for daily construction restrictions involving the flight line, taxiway, and runway areas and shall comply with the following:

(1) DFARS 252.236-7005, Airfield Safety Precautions

(2) AFI 13-213, Airfield Driving

d. Personnel Safety Precautions.

Jet aircraft and support equipment operating in/near hangars, on/near the runways, taxiways, and aprons make the area of construction a zone of high level noise. The contractor shall take the necessary precautions, such as the use of ear plugs or muffs to prevent injury to personnel working in the area.

e. Restrictions.

No contractor vehicles, equipment, or personnel shall be on or crossing any active runway or taxiway, except during construction period closures as outlined herein or when clearance is requested from and granted by the control tower. All contractors needing to operate vehicles on the airfield will check in with the Airfield Management Office prior to entering the Airfield control areas. All instructions from the Airfield Management Office shall be strictly adhered to. If required, the contractor’s vehicle will be identified by mounted operating electric battery operated low intensity, red or amber flashing lights. When contractor operations require crossing an active runway or other controlled area on a regular basis, the contractor shall furnish a two-way radio in order to maintain contact with the control tower. The government will provide the contractor with the correct frequency.

Use of the government provided radio frequency for other purposes will be strictly prohibited.

f. Cleanliness of Work Area.

Contractor shall maintain cleanliness of hangars, taxiways, runways and apron pavements at all times during progression of work in order to alleviate foreign object damage (FOD).

All construction materials shall be secured so as to prevent damage to government property or equipment. The contractor shall remove and secure all materials and equipment a safe distance from the runway or aircraft parking area at the close of each work day. This distance will be determined by the CO. The contractor will not be allowed to stockpile any materials or store any equipment within the controlled areas of the airfield without prior coordination from the Airfield Management Office through the government SABER

Project Manager and approved by the CO.

g. Emergencies.

There may be periods of time when the contractor will be required to vacate the work site and move his personnel and equipment a distance of several hundred feet away from the work site due to declared aircraft emergencies. Such evacuations will be given on short notice and expeditious action will be required. Whenever the contractor is required to clear the runway or a hangar, the contractor, accompanied by the SABER Project Manager or

Air Force representative, will make an inspection sweep of the entire work site or hangar to ensure all tools, equipment, and personnel have been removed from the runway, active taxiway and hangar. Any evacuations are the responsibility of the contractor and no cost will be incurred by the government as a result.

DIVISION 0111

SUMMARY OF WORK

a. Description.

This is an indefinite delivery, indefinite quantity (IDIQ) contract for construction efforts at

Dover Air Force Base, Delaware. The government will award construction projects by individual TOs on an as-needed basis. The contractor shall furnish all personnel, equipment, tools, materials, supervision, and other items and services necessary to design, manage, and accomplish a broad range of maintenance, repair, alteration, and/or new construction work. During the contract period, the Base Civil Engineer (BCE) will identify construction projects and the CO will issue individual TOs to the contractor to complete the work. The contractor shall maintain an office on Dover Air Force Base in order to receive work requests and other related requirements to accomplish each individual TO. Projects will include tasks in a variety of trades, including, but not limited to the following:

(1) Site Work, Concrete, Masonry, Metals, Wood and Plastics, Thermal and Moisture

Protection, Doors and Windows, Finishes, Specialties, Equipment, Special

Construction, Conveying Systems, Mechanical, and Electrical.

(2) Commercial Repair and Remodeling.

(3) Abatement of Hazardous Material.

b. Ordering Procedures.

(1) As the need arises for performance under the terms of this contract, the CO or his/her authorized representative will notify the contractor of the requirement. Upon receipt of this notification, the contractor shall respond to the needs of the government within two

(2) work days by visiting the proposed work site in the company of the CO or his/her representative and the government SABER Project Manager to further define the scope of the requirement.

(2) The contractor shall provide, at no additional cost to the government, one (1) hard copy of the unit price data to consist of the R.S. Means® cost data books (one (1) complete set) as listed below. Upon award, and then annually thereafter when the update occurs

(usually in December or January of each year), the contractor shall provide the latest edition of these books to the SABER Management. The Contracting Officer shall also receive a hard copy of Facilities Construction Cost Data Book annually. All of these books will be made available to the government within 30 days of initial award, annually thereafter within 30 days of the latest release (normally in December/January).

If an item is not found in the R. S. Means® Electronic Database used with the estimating system, the contractor shall use the first nine (9) of the following books to locate the item and develop the task order estimate. The contractor shall consider the item non-prepriced ONLY if the item cannot be located in any of the first nine guides.

(3) Upon establishment of the scope of the individual requirement through a government furnished formal SOW, the contractor shall prepare and submit a proposal for accomplishing the requirement.

(a) The “Bare Cost” unit price data (most recent version) provided by the R.S. Means

Company shall serve as the basis for establishing the value of the work performed on a unit price basis. 4Clicks® Solutions, LLC. (or approved equal) shall be utilized as the software program for estimating purposes.

(b) The contractor must include justification for any non-pre-priced work included in an individual requirement. The contractor shall first attempt to price all unit prices using the R.S. Means® computerized database. If an item is not included in this database, the contractor shall use the hard copy of the R.S. Means® Facility Cost

Guide to price the items. If the contractor cannot locate the required item from these sources, the contractor shall extend the search to the following R.S. Means® pricing guides before considering it a non-priced item.

(c) The R.S. Means® Facilities Construction Cost Data, most current update, shall serve as the basis for establishing the value of the work to be performed on a unit price basis. Upon receipt of any annual update, or quarterly City Cost Index update, the most current database shall be the basis for re-estimating projects that have not been awarded for actual construction, estimating new projects, or estimating any modifications to existing task orders where new work is being incorporated. The annual update shall be used immediately upon receipt. For application of the City

Cost Index (CCI) and the coefficient, see Exhibit 2.

(d) Items of work not covered by this contract, but within its scope and general intent, and necessary to complete the requirements of a specific task order may be negotiated and incorporated into the task order by the Contracting Officer. Non-prepriced work shall be so noted on each task order. The contractor must include justification for any non-prepriced work included in an individual requirement. If an item is not in the R.S. Means® Electronic Database, research the item in the R.S.

Means® hard copy book prior to considering the item a non-prepriced. To permit recurrent use, a NPI must be incorporated by supplemental agreement into the

Locally Developed Unit Price Guide (LDUPG), Attachment 10. This may be accomplished at any time during the contract period. Once a previously NPI is added to the LDUPG and becomes a pre-priced item (PPI). The coefficient shall not apply to any item included in the LDUPG. There is no provision for adjustment of any item added to the LDUPG. Once an item is added to the LDUPG, the price shall be firm throughout the life of the contract. For an item (material and/or labor) to be considered a non-priced item, it must be supported with a minimum of three

(3) independent quotes. Any item determined to be non-priced shall not be subject to the CCI adjustment. Only the portion of the R.S. Means® line item not being adjusted may receive the CCI adjustment.

(e) The use of R.S. Means® published labor rates to cover equipment operators or investigative services which are not covered by any established line item shall be limited to the number of hours actually required to complete the task and shall only be used as a last resort and as approved by the CO. The labor rate to be used in these instances shall be the “Rate with O & P” as published in the back of the

Facilities Construction Cost Data. The coefficient, applicable to the TO, shall not be applied to these labor rates.

(f) Most SABER requirements are to perform work inside existing occupied facilities.

The use of R.S. Means® published “Labor Adjustment Factors” shall be used as considerations on a case by case basis as stipulated in the R.S. Means® books.

They shall not be considered as “automatic entitlements”. The operational condition of a facility and/or construction area will not automatically deem the area occupied. These factors, if used, will be adjusted to a negotiated cost percentage, not a default percentage as established in some estimating software. Examples of such adjustment factors are “Occupied Building” or “Congested Area”.

(g) The contractor’s proposal must be supported by necessary documentation to indicate that engineering and planning to accomplish the TO requirements have been completed. Documentation that shall be submitted with the proposal (unless otherwise noted by the CO) includes but is not limited to a detailed cost estimate, drawings, calculations, catalog cuts, specifications, site and demolition plans, etc.

The documentation shall be used to support and verify the contractor's cost estimate and proposed construction methods.

(h) The CO will determine the time for submittal of the contractor’s proposal for individual TO requirements based on the following:

1 For proposals requiring limited design (projects that have been previously designed to 35%) or projects that do not require increased effort of engineering the maximum allowed time period will not exceed 10 calendar days from initial notification by the CO unless otherwise determined by the CO.

2 For proposals requiring increased engineering effort (includes designs for structural, mechanical, and designs requiring an Engineering stamp) by building and construction codes the maximum allowed time period for submittal of a proposal will not exceed 30 calendar days unless otherwise determined by the

CO.

3 Contractor proposals which are considered unacceptable (i.e., clarity, completeness, cost, etc.,) or which require changes will be resubmitted within three (3) work days after written request by the CO (unless otherwise determined by the CO) with all necessary changes.

4 Proposals for modifications or addenda to TOs already under contract will be submitted within five (5) calendar days of written notification or as otherwise determined by the CO.

5 Proposals for emergency work orders will be submitted within four hours of notification by the CO, or as otherwise determined by the CO.

(i) Upon receipt of the contractor’s proposal, the government will review the proposal.

The contractor's submission of the proposal shall serve as proof of acknowledgment that the contractor is prepared to immediately negotiate the TO. The government will negotiate with the contractor all quantities for pre-priced items, non-prepriced items, performance time, and any other required considerations.

(4) Task Orders will then be issued by the CO using a Department of Defense (DD) Form

1155, Order for Supplies or Services. Each TO will include the following information.

(a) Date of the TO.

(b) Contract number and TO number.

(c) Item number, description, material submittal requirements, quantity and unit prices for pre-priced and non-pre-priced items and total.

(d) Task Order price and delivery or performance date.

(e) Accounting and appropriation data.

(f) Liquidated damages.

(g) SOW, drawings, or other pertinent data.

(h) Base Civil Engineer’s project number

(i) GFP (if applicable)

(j) Statutory cost limitation (if applicable)

(5) The government reserves the right from time to time to execute changes in delivery dates of on-going TOs to accommodate higher priority TOs.

(6) The requirements in the SOW included in each TO will supplement and take precedence over the contract specifications and/or drawings, sketches, etc., included with each TO as required to properly perform work.

(7) The acceptable proposal which includes the contractor’s processes, line items and quantities shall take precedence over the SOW. The contractor is obligated to provide everything included in the proposal.

(8) Once a TO is awarded, the negotiated coefficient shall remain constant throughout the performance period of the TO. This coefficient shall be applied to any work added to or deleted from the TO. In the case of additional work being added to a TO, the current

CCI at the time of issuance of the Addendum shall be applied to the “new” work only.

Work which is being adjusted due to process change, requirements, etc., already covered in the proposal shall remain at the CCI that was in effect at the time of award.

Any credit to the government shall be at the coefficient and CCI which was applied to the original line item(s).

c. Location.

The contractor shall accomplish all work under this project at Dover Air Force Base, Delaware and/or Dover Air Force Base remote properties located at Port Mahon DE (Kent

County) (fuel delivery port approximately 10 miles from the base) and Ellendale DE

(Sussex County) (our NEXRAD site which is approximately 30 miles from the base).

d. Key Management Staff.

(1) The project manager, assistant project manager, and personnel in the following key positions; engineering/design, superintendents/inspectors, administrative support, quality control and safety personnel, are considered essential to the performance of any resultant task orders under this contract. Prior to diverting the project manager, assistant project manager, or other key personnel to other programs/projects, the contractor shall notify the Contracting Officer at least ten (10) working days in advance of the proposed diversion. Replacement personnel shall be fully qualified to perform the vacated positions(s). The on-base contractor’s office shall be maintained with essential personnel during normal working hours, 7:30 AM to 4:30 PM, Monday through Friday, excluding Federal Holidays or days observed as Federal Holidays, reference Section H, paragraph H-002. A contractor’s representative that has signatory authority shall be available at all times during normal working hours. Should work be accomplished/required in “other than normal duty hours”, a contractor superintendent from the prime contractor’s workforce shall be on site at all times while work is progressing.

(2) The contractor shall provide an on-site staff to respond to the requirements of this contract. The contractor’s organizational approach shall integrate with this staff to provide project management, project engineering and design, quality control, site superintendence/inspectors, subcontractor purchasing and administration. The project manager shall have sufficient authority to effectively manage all facets of the contract, including but not limited to full signatory authority, regardless of dollar amount on all

TOs issued.

(3) The on-site project manager is subject to approval by the CO. At award of the contract and for any changes in personnel during the course of the contract, the contractor shall submit documentation in resume format for approval of the on-site project manager.

As a minimum, the on-site project manager shall have at least 10 years of construction experience which includes at least three (3) years of construction management. The construction management experience shall include as a minimum, multi-task, multi-skill management involving structural, mechanical, concrete, pavements, roofing, carpentry (rough and finish), and electrical construction. The project manager shall ensure detailed cost estimates for the requirements of this contract are complete and accurate.

(4) Additional on-site management staff shall meet the following criteria. At least one member of the additional on-site staff shall be designated as assistant project manager and shall have complete authority to manage all project manager functions in the absence of the project manager. This authority shall be designated in writing at the inception of the contract and is subject to approval by the CO. At award of the contract and for any changes in personnel during the course of the contract, the contractor shall submit documentation in resume format for approval of the on-site assistant project manager. The assistant project manager shall have at least seven (7) years of construction experience which includes at least three (3) years of construction management. The construction management experience of the assistant project manager shall include as a minimum, multi-task, multi-skill management involving structural, mechanical, concrete, pavements, roofing, carpentry (rough and finish), and electrical construction. All on-site management and administrative personnel shall posses experience to include a working knowledge of computer technology to include word processing, spreadsheets, and use of e-mail communications. At a minimum, on-site staff shall include a permanent project manager and permanent assistant project manager at all times during the performance of the contract.

(5) In addition, the contractor shall provide in writing, a designated site superintendent for each active work site. The site superintendent shall have sufficient authority to discuss and act on all matters at the job site to ensure construction processes are performed in accordance with specifications and codes. A site superintendent shall be present at each construction site at all times during active construction.

(6) At a minimum, the contractor’s project manager and assistant project manager shall carry a cell phone for immediate response to contract requirements. The contractor shall notify the CO when the project manager plans to be absent from Dover Air Force

Base. If the contractor’s project manager is absent from the base, the assistant project manager must be on the base.

(7) Subcontractors utilized to perform work for this contract are subject to approval by the

CO. Subcontractors performing work under this contract shall posses the necessary qualifications to accomplish the tasks in accordance with specifications. This includes but is not limited to licenses, skill levels, authorities for performing work for warranty purposes, etc.

2. Contractor Use of Premises.

a. Government-Furnished Facilities.

The government will provide a SABER contractor area in the north end of Facility 638 which shall only be used for the purpose of the SABER contract. This location has approximately 2,490 square feet of heated and air-conditioned administrative office area and approximately 300 square feet of chain link fence enclosed, heated storage area. In addition, latrines for both men and women are located in this contractor area. These latrines will be shared with government personnel in the adjoining area. Access to the storage area can be made through the administration area or through a ten-foot wide roll-up door. Any outside contractor storage shall be in an acceptable, enclosed suitable container

(conex box or trailer), painted Glidden “Eagle Feather Tan” or approved equal and shall be located near facility 919 or other location as approved by the CO. The contractor shall also be responsible for the reasonable care of the contractor office site. In the event of a fire or any damage to the building, the contractor shall notify the Base Civil Engineer Fire

Department immediately. The contractor is responsible for insuring his/her own contents.

The government shall not be liable for any loss or damage to the contractor’s property, including stock, or for expenses incidental to such loss or damage. The contractor shall be responsible for custodial services of the contractor’s area including the latrines during the term on the contract. Prior to the expiration date of the contract the contractor shall repair and paint all contractor office areas to the original condition, including the latrines and storage areas.

b. Contractor Identification Signs.

The contractor shall erect a sign for his/her office and/or storage area. The sign shall be in compliance with base requirements and color scheme and approved by the CO before being erected.

c. Government Furnished Services.

(1) Government-Furnished Utilities: If available (i.e. existing and in service), the government will provide utility access (electricity and water) at construction sites, reference FAR 52.236-15 entitled Availability and Use of Utility Services. Utility services furnished to the contractor by the government from the government’s existing system outlets and supplies will be at no cost to the contractor at construction sites only. Where utility services are not available from existing system outlets and supplies, the contractor may include the required utility services in the proposal for the TO. The contractor shall install all temporary services at the inception of each TO as required and shall remove said services after completion of the TO.

(2) Utility service hookups required for a job site trailer will be the responsibility of the contractor. The contractor shall be responsible for all costs associated with connection and disconnect of utility services.

(3) Communication Services: The government will not provide telephone, internet services etc., to the contractor. All communications equipment, connections, and services shall be installed and maintained at the contractor’s expense.

(4) Refuse Collection: The contractor is responsible for disposing of all rubbish, construction debris and contractor-generated refuse safely and properly in accordance with supplemental specification 02 61 10 Dover AFB Environmental Specifications.

Rubbish hauling/handling includes the total process of collecting and disposal of rubbish/debris which may result from construction projects. This includes, but is not limited to collection, compaction charges (no air), dumpsters, landfill fees, transportation to and from landfill, etc. Payment for construction rubbish/debris hauling/handling will only be made in accordance with the single line item included in the LDUPG, item number 02-41-19-23-2000. Coefficients and the City Cost Index for the City of Dover do not apply to this line item. Note: This item shall not be used for removal and relocation of soil that may remain on Dover AFB, DE. This line item does not include chutes. All refuse containers (construction type or otherwise) used on

Dover Air Force Base, Delaware or its housing areas shall be painted Glidden color

“Eagle Feather Tan” or an approved equal. The contractor shall take all necessary actions to preclude unauthorized use. The government accepts no responsibility for unauthorized use of the contractor’s refuse containers. Rubbish generated by the contractor at the on-site office location will be disposed of at the contractor’s expense.

(5) Grounds Maintenance: The contractor will be responsible for grounds maintenance at construction sites as indicated in each TO. At a minimum, grass shall be mowed and necessary trimming (i.e., weed-eating) shall be performed twice a month during the growing season at construction sites. Failure to maintain the job sites in a neat and orderly fashion including upkeep of grounds maintenance could result in the accomplishment of the work by government personnel with the cost being charged to the contractor. Grounds maintenance as required at individual construction sites will be priced on each TO. If the contractor or subcontractor does not protect surrounding areas causing damage or disturbance to additional square footage outside of the negotiated square footage, it will be the prime contractor’s responsibility to restore the area to the extent determined by the CO at no additional cost to the government.

(6) Security Police and Fire Protection: The government will provide security police and fire protection to the extent necessary to ensure a secure and safe installation. In return for these services, the contractor shall adhere to the security and fire directives, instructions, and policies of Dover AFB.

(7) Emergency Medical Services: In the event of an emergency which requires government services, 436 Med Group, Dover Air Force Base, will respond and transport, if necessary, a contractor employee to one of the local hospitals. The contractor shall reimburse the government for any government provided medical or emergency services.

3. Work Sequence.

a. Commencement of Work.

(1) Project Execution.

(a) Working Conditions: The work performed under this contract will be in occupied and unoccupied facilities. In occupied facilities, the contractor shall accomplish all work in a manner that minimizes inconvenience to the using agencies. The contractor shall perform all work in accordance with the approved schedule for the

TO. The contractor shall protect all government, or personal effects (equipment, property) within the work area from dust, debris, and damage. The government will hold the contractor responsible for any damages as a result of contractor's work.

The contractor shall ensure hallways are clear, and emergency exits are lighted, free of debris and safe at all times. Work sites shall be cleaned up daily to remove debris, waste, rubble, etc. Contractor personnel shall strictly adhere to OSHA and

AFOSH Safety standards and practices at all times during the term of the contract.

(b) Emergencies: In case of emergency, the Base Civil Engineer, CO, Base Fire Chief, Security Forces, Safety Officer or their representative(s), have the authority to order the contractor to terminate work and clear the area of personnel and equipment.

The contractor shall comply to such an order immediately upon notification.

(c) Interruption of Utility Services: The contractor shall not hold the government responsible for temporary interruptions of utility service, or liable for contractor delays, damages, or increased costs as a result of interruption of service.

Temporary interruptions are defined as interruptions of four (4) hours or less.

(d) Work in Secure Areas: The contractor shall comply with security regulations imposed by the installation commander and/or the agency responsible for the project location. Projects in a secured area are subject to a local agency check of the contractor, his/her employees, and all subcontractors through the base security police prior to commencement of on-site work. The government will provide an escort that must accompany contractor personnel when working in a controlled/restricted area. The contractor shall schedule work requiring escorts, to include site visits for project estimating purposes, seven (7) calendar days prior to starting work unless the CO waives this requirement. Due to specific mission requirements inherent in the nature of these restricted areas, the government may direct the contractor to leave the restricted area at any given time. The government will not be liable for these temporary delays or increased costs caused by interruptions of four hours or less.

(e) Base Exercises: The contractor may expect base exercises a minimum of six (6) times per year with moderate to minimal impact on TOs. The government will endeavor to preclude contractors from the impact of exercises.

(f) Pest Control Services: All pesticide applications shall be coordinated through the

436th Civil Engineer Squadron Pest Management Shop and approved by the Major

Command (MAJCOM), Pest Management Consultant (PMC) prior to application.

Applications shall be submitted 15 calendar days in advance for coordination.

Additional requirements may be necessary based on the pesticide and application needs. A list of approved chemicals, for use on Dover AFB, can be obtained from the 436th Civil Engineer Squadron Pest Management Shop upon request.

Insecticide applications within the contractor’s area shall be at the expense of the contractor.

DIVISION 0130

TASK ORDER PROPOSALS

The contractor shall prepare and submit a proposal to the CO within 10 work days of written notification of a job requirement for projects with limited design and within 30 calendar days of written notification for projects requiring an increased amount of engineering as stated in

Division 0111, paragraph 1.b.(2).(g) unless otherwise determined by the CO. Units of weights and measures used on all proposals shall be the same throughout. Each proposal shall be complete and in sufficient detail to allow ready determination of compliance with project requirements. The submittal package shall contain sufficient documentation, providing evidence of adequate design and preparation to include summary page, execution narrative, technical description, assumptions, proposed performance period, drawings and details, and engineering calculations, etc. “Execution narrative” is defined as a brief written description of the major elements of work and how the project will be carried out to completion, taking into consideration the site condition(s), any obstacles that may have to be overcome during the construction process, and/or any additional items of special interest or concern.

2. Design Submittals.

Design submittals will be required as indicated in each project SOW provided by the government. The contractor shall not construe the CO’s approval of design submittals as a complete check, but only an indication that the general method of construction, materials, detailing or other information are satisfactory. Approval will not relieve the contractor of the responsibility for any error, which may exist. Under the contractor’s quality control requirements of this contract, the contractor is responsible for dimensions, the design of adequate connections and details, and the satisfactory construction of all work. If applicable, the contractor shall make corrections required by the CO and resubmit for approval. After the

CO approves a design submittal, the government will not consider any re-submittal for the purpose of substituting materials or equipment unless accompanied by an acceptable explanation of why a substitution is necessary.

3. Design Documentation.

Design documentation shall include (at the CO’s discretion) shop drawings and sufficient calculations to support the adequacy of equipment/materials proposed for the project and the proposed assembly of structural components. The possibility exists that particular designs may require proof of licensing (i.e., an Engineer’s stamp). The government anticipates less than five (5) percent of the designs will require an engineer’s stamp. However, when such conditions do occur, the contractor shall provide said proof for the discipline appropriate to the design. This requirement is not an additional cost under the contract and should be included in the coefficients.

a. Shop Drawings.

Drawings submitted by the contractor, subcontractor, and any lower tier subcontractor, pursuant to a construction contract, shall show in detail proposed fabrication and assembly of structural elements and/or the installation (i.e., form fit and attachment details) of materials or equipment. Drawings shall clearly define the scope of work, with details sufficient to effectively establish the methods and materials intended. Drawings shall have sufficient detail to ensure soundness of design. Drawings shall be developed to the extent necessary to enable both the contractor and the government to accomplish independent estimates. For the purpose of this contract, the term drawings includes actual shop drawings, diagrams, layouts, schematics, descriptive literature, illustrations, schedules, performance and test data, and similar materials furnished by the contractor to explain in detail specific portions of the work required by the TO.

(1) When required, the contractor will provide three (3) sets of drawings to the CO with the proposal. Drawing size shall be 24”x36”. The contractor shall also provide one copy of the drawings on CD(s). The CD drawings shall be in the native file format used by

Autodesk®, AutoCAD and capable of being loaded without conversion on the government computers being used. The contractor shall acquire any updates as they become available.

(2) All drawings submitted prior to issuance of a TO shall be considered “Concept” drawings and shall not be used for actual construction.

(3) The contractor shall incorporate any changes to the drawings, brought about by changes in scope or as a result of proposal evaluation, and provide three (3) revised sets along with new disk files to the CO before issue of the TO.

(4) All drawings delivered under this contract become property of the government to use in any manner deemed appropriate.

(5) The CO will approve the submittal for acceptable shop drawings and return one set to the contractor. On disapproval, the CO shall annotate the government’s reason for disapproval of the drawing(s). The contractor shall resubmit disapproved items in three

(3) work days with the required changes after written notification of disapproval. If the contractor initiates any work before receiving approval, the contractor assumes all risk for that work.

(6) Upon issuance of the TO, “For Construction” drawings shall be provided when required. At a minimum these should include: Structural Designs, Reflective Ceiling

Plans, Layouts, and similar drawings which depict how the end product will look.

(7) The contractor shall keep the most recent approved copy of applicable drawings at the

TO site. Errors that occur as a result of the contractor and/or subcontractor(s) not having the most current approved drawings at the site shall be the contractor’s responsibility.

b. Calculations.

To substantiate appropriate equipment or material selection/sizing and component assembly, the contractor shall supply the following calculations at the request of the CO or as stated in the request for proposal for each TO.

(1) Mechanical: HVAC load analysis and unit sizing, pipe sizing, duct sizing, or other calculations necessary to determine proper equipment sizing as required for each TO.

(2) Electrical: Electrical system capacity, conductor, conduit, protective devices, and other equipment sizing as applicable for each TO.

(3) Structural: Structural system, roofing system, and foundation sizing or other necessary calculations as required for each TO.

(4) Pavements/Site Work: Area run-off quantities, drainage capacities, and grading slopes, or other necessary calculations as determined for individual TOs.

4. Record Drawings (As-Builts).

a. During the progress of the work, the contractor shall keep a careful record at the job site of all changes and corrections from the layouts shown on the drawings, if applicable, regardless of whether they are a part of the construction effort or not. This shall include any hidden or subsurface data discovered during construction. The contractor shall enter such changes and corrections on a copy of the technical proposal drawings (submitted with the TO proposal) and provide the CO with a copy of the updated drawings.

b. The record drawings shall indicate all physical changes to the construction area and the actual location of any subsurface utilities. The drawings shall indicate all valves, splice boxes, and appurtenances by dimensions along the utility run from a reference point.

5. Progress Schedules and Reports.

Upon award of the TO, the contractor shall accomplish the reports contemplated by the clause

FAR 52.236-15 entitled “Schedules for Construction Contracts” on and in accordance with instructions pertaining to AF Form 3064, Contract Progress Schedule, and AF Form 3065, Contract Progress Report. The contractor has the option, subject to the CO’s approval, to submit alternative schedule forms (i.e., PERT charts, GANT charts, etc.) developed using scheduling software, provided these documents convey the same information as the AF Forms

3064 and 3065.

6. Material Approval Submittals.

With each TO issued, the government will identify material and articles requiring approval in accordance with FAR 52.236-5 entitled Materials and Workmanship. An AF Form 3000, Material Approval Submittal, an original and three (3) copies will be submitted to the CO unless otherwise specified. All contractor supplied submittals shall be submitted within 10 work days of award of the applicable TO or as authorized by the CO. The government will review submittals for completeness and clarity. Submittal approval or disapproval will be returned to the contractor within 10 work days. Disapproved submittals shall be corrected and resubmitted within five (5) work days of notification of disapproval or as required by the CO.

Any items installed without approval by the CO are subject to removal by the contractor at no cost to the government.

a. Approved Materials/Equipment.

Once the government approves an item of material or equipment, the contractor need not resubmit an AF Form 3000 on the item for the duration of the contract unless directed to do so by the CO or as required by the TO. The contractor shall provide adequate justification and obtain approval from the CO for re-submittals of materials/equipment originally approved. Once approved, the CO, SABER Management and the government SABER

Project Manager shall be provided the submittal in electronic format.

b. Submittal Register.

The contractor shall develop and maintain a submittal register in the form of a Microsoft®

Excel spreadsheet to record and track all approved material submittals. An alternate computer generated program may be authorized if it is compatible with government software. The contractor shall number all material submittals consecutively throughout the life of the contract beginning with “1”. For re-submittals after disapproval, or re-submittals upon request of the CO, the contractor shall use the original submission number and an alpha, beginning with “(A)” after the original submission number. For example, if the CO disapproved the original submission numbered 500, the first resubmission of this submittal shall be number 500(A). The second resubmission shall be number 500(B), etc. The contractor shall provide an updated, consolidated submittal register by e-mail to the CO and SABER Management for tracking and monitoring purposes no later than the seventh day of each month.

7. Quality Control on Design Submittals.

The contractor shall thoroughly review all design submittals for accuracy, completeness, and compliance with contract requirements, and shall indicate approval thereon as evidence of such coordination and review. The contractor shall include constructability, architectural and system compatibility, operability, and maintainability considerations in each review.

a. Proposed Alternative Approaches.

The design submittal shall clearly identify any proposed alternatives from the original design concept envisioned to meet the project requirements.

(1) If the contractor’s shop drawings show variations from the design concept originally discussed during initial design of the project, the contractor shall submit a narrative description of the variations to the CO.

(2) Any deviations that are discovered during negotiations shall be justified by the contractor. The government reserves the right to reject the contractor's proposal without award or cost to the government (including using the design multiplier) if agreements can't be reached in the negotiation process. Also, if proposals are not submitted in a timely manner, the government reserves the right of cancellation at no cost to the government.

b. Accuracy.

(1) All measurements shown on shop drawings and used in developing cost estimates shall be exact dimensions. Use of the R.S. Means price data is applicable to this section.

Unit prices include all waste. The government will NOT allow additional SF, SY, LF, CY, etc., for waste. For example, when estimating ceiling tile for a room 14 feet by 14 feet totals 196 square feet, the contractor’s proposal shall reflect 196 square feet for the removal and installation of the ceiling tile.

(2) In instances when exact quantities cannot be determined, the TO may reflect estimated quantity line items. For these items, the contractor shall submit a daily total of quantities used on days the contractor uses the item. These submittals may be delivery tickets, weigh bills, worksheets, etc., to meet the specific requirement. The contractor shall provide these submittals to the project SABER Project Manager who will validate and forward them to the CO. If quantities of items from the proposal included in the

TO or any modification thereto, are not utilized, the government reserves the right to claim reimbursement for subject line items. Deviations from processes involving subject line items shall be approved by the CO prior to execution. If the variation will cause an increase in the time necessary for completion, the contractor may request, in writing, an extension of time. The contractor shall submit this request a minimum of 10 calendar days before the beginning of the delay. Upon receipt of a written request, the

CO will ascertain the facts and may make an adjustment, if justifiable and reasonable, extending the performance period.

c. Codes, Standards, and Instructions.

(1) All design documentation and subsequent construction practices shall comply with

Federal, State, and Local codes. Building Officials and Code Administrators (BOCA)

International, Inc. has established the basic building code standards for construction, renovation, repair, and maintenance. These standards, commonly referred to as BOCA

National Codes, shall constitute the minimum acceptable levels of design, function, and safety for all projects performed under this contract.

(2) All designs, material selections, construction, renovation, repair, and maintenance shall comply with the specifications contained (or referenced) herein as well as the base and

Air Mobility Command architectural standards. The government documents these two latter standards in the base’s Architectural Compatibility Plan, Local MILCON and

SRM Design Guide and in a series of pamphlets published by the command. The CO will provide these documents to the contractor upon request. During the course of the contract, the contractor shall comply with any additions or revisions to these standards upon official notification by the government. Failure to comply with the specifications and standards of this contract may result in re-accomplishment of the work by the contractor at no additional cost to the government.

(3) Manufacturer’s instructions pertaining to the use or installation of products, materials, or equipment used or installed in the execution of work under this contract form a part of these specifications as though specifically set forth herein. These instructions apply whether furnished as a normal, usual, or customary practice of the manufacturer or if furnished in response to a requirement stipulated herein.
