About this file
This is a Questions and Answers document for federal contract solicitation FA440727Q8000 issued by the U.S. Air Force for guest artist services featuring Kris Allen with the USAF Band of Mid-America.
The document addresses two key inquiries regarding contractor responsibilities and payment terms. The first question concerns travel arrangements and funding for the artist, which Amendment A01 clarified must be procured and paid entirely by the contractor at their own expense. All travel, lodging, local transportation, meals, and incidental expenses must be included in the total firm-fixed price and allocated across CLINs 0001-0005, with no separate government reimbursement available. The second question addresses payment for canceled performances, noting that if the government cancels any rehearsal or performance—including due to weather or venue closure—the affected CLINs will not be automatically paid in full. The contractor may submit a settlement request for services performed and reasonable, substantiated actual costs incurred because of the cancellation, including documented nonrefundable costs after the artist has traveled to the required location. The contractor must mitigate costs and account for all refunds, credits, and avoided costs, with any settlement subject to contracting officer review and written approval and not exceeding the price of the affected CLIN or CLINs.

Number Question Answer
The Description of Requirement (page 2) and the SOW “Contract Price” section state that the contractor shall arrange and fund Kris Allen’s travel, lodging, and meals as part of the quoted price. Factor 1 and the Price Evaluation section state that Government-funded travel will be arranged and paid separately and not included in the quoted price. Based on our coordination with the Band of Mid-America, our understanding is that Kris Allen’s travel will be booked through DTS and reimbursed directly to him after the tour, and that CLINs 0001-0005 should cover artist services only. Can you please confirm?
No, Kris Allen's travel will not be booked through DTS or reimbursed separately by the Government. After clarification of the travel policies as they pertain to contractors, it was determined that booking travel outside of this contract is not permissible, therefore all travel arrangements and expenses will need to be procured and paid by the contractor. Amendment A01 has been posted, which amendes the solicitation documents for this clarification. In accordance with Amendment A01, the contractor shall arrange and fund all required travel, lodging, local transportation, meals and incidental expenses. These costs must be included in the total firm-fixed price and allocated among CLINs 0001-0005. Therefore, CLINS 0001-0005 cover both the required artist services and all associated contractor-responsible costs for performance. No separate reimbursement for travel or related expenses will be provided. Any prior technical coordination with the Band of Mid-America does not modify the solicitation. Only the Contracting Officer may authorize a change to these requirements in writing.
The SOW states the Government will not pay for a rehearsal or performance that is canceled, including Government cancellation, weather, or venue closure. If the Government cancels a rehearsal or performance after Kris Allen has traveled and reported on site, will that CLIN still be paid? If not, would the Government consider paying CLINs canceled for reasons outside the artist’s control once he has arrived?
The revised SOW posted with Amendment A01 addresses this circumstance. If the Government cancels one, some, or all performances—including as a result of a weather closure or Government-directed venue closure—the affected CLINs will not automatically be paid in full. The contractor may submit a settlement request for the services performed and reasonable, substantiated actual costs incurred because of the cancellation, including documented nonrefundable costs incurred after the artist has traveled to and reported at the required location. The contractor must mitigate its costs and account for all refunds, credits, and avoided costs. Any settlement is subject to review and written approval by the Contracting Officer and may not exceed the price of the affected CLIN or CLINs.
