STATEMENT OF WORK
USAF Band of Mid-America “Spirit of the Season” – Kris Allen Guest Artist 9 November 2026 – 10 December 2026
1. BACKGROUND
The United States Air Force (USAF) Band of Mid-America is a musical organization whose mission is to inspire immediate and long-lasting morale and esprit de corps for Scott Air Force Base, IL and the United States of America. To support this effort, the Band of Mid-America reaches over 70 million listeners via live and televised events each year. Under the direction of the Commander, Air Force Bands actively design a wide variety of musical events to bridge language and cultural differences to engage, inform, entertain, and inspire audiences. Bands perform the right music for the right event and utilize performing styles and techniques to establish a sense of commonality and community with targeted audiences. In support of this mission, the Band of Mid-America is seeking the services of a professional featured Vocalist for its annual Spirit of the Season (SOTS) performances to be held at professional quality concert venues in St. Louis, MO, Columbia, MO, and Kansas City, MO. The events will be performed for in-person audiences and will also be recorded for future broadcasts on television as well as Air Force media and social media outlets.
2. DESCRIPTION OF REQUIREMENT.
The purpose of this Statement of Work is to define the professional vocal, speaking, promotional, rehearsal, performance, travel-coordination, and related services required for Kris Allen’s participation in the USAF Band of Mid-America’s “Spirit of the Season.” The period of performance is 9 November 2026 –10 December 2026, including required travel days, rehearsals, sound checks, and performances.
Authorized recordings may be used in whole or in part on official Government platforms, television stations, and other authorized media outlets, including during the 2027 holiday season, as provided in this SOW.
Kris Allen Engagement: The Contractor shall secure and provide the professional vocal, speaking, promotional, rehearsal, and performance services of Kris Allen for all activities specified in this SOW.
The Contractor shall enter into and administer all agreements necessary to furnish Kris Allen’s services.
The Contractor remains fully responsible for performance regardless of whether Kris Allen is secured through an agent, manager, subcontractor, or other intermediary.
The Contractor shall ensure that Kris Allen and Kris Allen’s authorized representative understand and accept the required dates, locations, services, recording activities, promotional obligations, and authorized media uses. Kris Allen is essential to performance of the contract. No substitution is authorized. The Contractor shall notify the Contracting Officer immediately upon learning of any circumstance that could affect Kris Allen’s availability.
Recording and Media License: The Contractor shall obtain all permissions within the Contractor’s responsibility necessary for the Government to record Kris Allen’s rehearsals and performances and use the resulting audio and audiovisual recordings as authorized by this SOW. These permissions shall be included in the contract price at no additional cost to the Government.
The Contractor grants, or shall obtain for the Government, a nonexclusive, worldwide, royalty-free perpetual license to edit, excerpt, caption, reproduce, distribute, publicly display, perform, broadcast, stream, archive, and post recordings from the 4, 8, and 9 December 2026 performances. Authorized outlets include official Department of the Air Force websites, official Government social-media accounts, official YouTube channels, television stations, media outlets, and Government archival repositories.
Authorized editing may include reasonable excerpting, abridgment, captioning, formatting, and incorporation into promotional or historical productions, provided the material is not used to imply Kris Allen’s endorsement of a commercial product, political candidate, or unrelated activity.
Before award, the Contractor shall disclose all proposed restrictions involving platforms, geographic territory, duration, editing, advertising, monetization, archival availability, or reuse.
Third Party Rights: The Contractor shall identify any musical compositions, sound recordings, backing tracks, arrangements, photographs, or other materials requiring permission from a publisher, record label, union, or other third party. The Contractor shall obtain the permissions assigned to it by this contract and shall disclose any excluded rights or additional restrictions before award. Nothing in this SOW transfers ownership of copyrights held by songwriters, publishers, record labels, or other third parties.
Musical Arrangements: The Government may retain and reuse musical arrangements created by Government personnel. The Contractor shall ensure that Kris Allen raises no objection to the Government’s continued use of those Government-created arrangements. This provision does not convey copyrights or licenses controlled by composers, publishers, record labels, or other third parties.
Promotional Support: The Contractor shall ensure that Kris Allen publishes at least three promotional social-media post(s) concerning the Spirit of the Season performances through Kris Allen’s official social media (Instagram, Facebook, X, etc.) account(s). The post(s) shall be published no later than 02 December 2026 and shall remain publicly available for at least eight days, except for temporary story-format content.
The Government will provide event information, approved links, and applicable branding materials.
Proposed content shall be submitted to the Government POC at least two business days before publication for review of factual accuracy, operational security, and authorized use of Government marks. The Contractor shall provide links or screenshots demonstrating publication.
Kris Allen shall deliver Government-furnished scripted remarks and brief transitions associated with the musical program. The Government will provide final scripts no later than two days before the first performance. Kris Allen will not be required to deliver political, fundraising, commercial-endorsement, or policy-advocacy content. Material script changes after the first rehearsal will be coordinated with the Contractor and Kris Allen.
Professional Conduct: While performing contract requirements at Government facilities or Government-sponsored events, the Contractor and Kris Allen shall comply with applicable federal, state, and local laws; installation and venue rules; safety and security requirements; and Government instructions concerning access and conduct. Kris Allen shall maintain professional conduct and shall not perform while impaired by alcohol or illegal drugs. Harassment, unlawful discrimination, threatening conduct, unauthorized possession or use of controlled substances, and material disruption of rehearsals or performances are prohibited.
Government-Furnished Property and Services: The Government will furnish the performance and rehearsal venues, stage, house lighting, house sound reinforcement, standard vocal microphones and monitors, accompaniment by the USAF Band of Mid-America, Government-created musical arrangements, event recording services, dressing-room space, venue credentials, parking, final scripts, approved promotional materials, and the sheet music identified in this SOW.
Contractor-Furnished Travel and Related Expenses: Except for the Government-furnished property and services expressly identified in this SOW, the Contractor shall provide all property, services, equipment, personnel, and expenses necessary to perform the contract. The Contractor shall arrange and fund all travel required for Kris Allen’s participation, including transportation to and from the performance area, lodging, local ground transportation, meals, baggage charges, parking, tolls, and incidental expenses.
Contract Price: All such expenses shall be included in the total firm-fixed price and allocated among CLINs 0001 through 0005 as required by the solicitation. No travel or related expense will be separately reimbursed by the Government. The Contractor may not submit separate invoices for travel, lodging, local transportation, meals, incidental expenses, deposits, booking commissions, or other contractor-responsible costs. The Contractor’s firm-fixed price shall include all contractor-responsible costs identified in this SOW. The supporting price breakdown required by the solicitation is for price-analysis purposes only and does not create separately reimbursable cost elements.
Government Cancellation: If the Government cancels a performance for reasons including but not limited to severe weather, unsafe conditions, emergency circumstances, or closure or unavailability of the venue prevents the performance, the cancelled performance will not be rescheduled, and the Contractor shall not provide a substitute or remote performance. Upon written request from the Contracting Officer, the Contractor shall submit an itemized termination settlement proposal identifying all actual, reasonable, allocable, unavoidable, and documented costs incurred before receipt of the cancellation notice. The Contractor shall provide supporting records, describe its mitigation efforts, and identify all avoided costs, refunds, credits, insurance proceeds, and other recoveries. Submission of the proposal does not establish entitlement to payment. Any settlement will be determined by the Contracting Officer in accordance with the contract’s applicable termination provisions. Anticipated profit on unperformed services, consequential damages, duplicative costs, avoidable costs, and unsupported costs will not be allowed. Cancellation or termination of one CLIN does not cancel or terminate any other CLIN, and the Contractor shall continue all unaffected performance unless otherwise directed in writing by the Contracting Officer. Only the Contracting Officer may approve a settlement or authorize payment.
Inspection, Acceptance, and Payment: The Government will inspect and accept each CLIN based on timely attendance and satisfactory completion of the rehearsal or performance identified under that CLIN, together with the associated requirements and deliverables allocable to that event. Unless the contract provides otherwise, the Contractor may invoice after completion and Government acceptance of the applicable CLIN.
The Contractor shall not separately invoice for travel, lodging, local transportation, meals, incidental expenses, deposits, commissions, media permissions, promotional support, overhead, or profit. Those amounts are components of the firm-fixed CLIN prices.
Final payment may be conditioned upon completion and acceptance of any outstanding contract-wide deliverables, including promotional documentation and required media permissions, as provided by the contract.
Note: The Government POC may coordinate schedules, deliverables, and technical matters but is not authorized to change the contract, increase the contract price, alter the scope, or authorize additional services. Only the Contracting Officer may modify the contract.
The contractor shall ensure that Kris Allen provides all necessary services to include the following:
