GREEN PROCUREMENT

PART 1: GENERAL

1.1 RELATED SPECIFICATION SECTIONS:

1.1.1. Section 01 00 00, General Requirements.

1.2 GREEN PROCUREMENT & POLLUTION PREVENTION

1.2.1. Green Procurement is the purchase and use of recycled content; environmentally preferable, biobased, and energy-efficient products; non-ODS substances; and alternative vehicles and fuels.

1.2.2. Green Procurement is a mandatory component of the Air Force pollution prevention program. On 27 Aug 2004, the Under Secretary of Defense issued a policy memorandum, “Establishment of the DoD Green Procurement Program (GPP).” It states: “The DoD goal is to achieve 100% compliance with mandatory Federal GPP programs in all acquisition transactions. This goal applies to all acquisitions from major systems programs to individual unit supply and service requisitions.”

1.2.3. Currently, reporting of green procurement purchases is limited to contracts having a total value greater than $100,000.00, which includes the purchase of any amount of U.S. EPA-designated items.

1.2.4. This document contains guidelines for implementing the RCRA, EO, DOD, and Air Force requirements.

1.4 REGULATORY BACKGROUND

1.4.1. Section 6002 of RCRA requires federal agencies to give preference in the acquisition process to products and practices that conserve and protect natural resources and the environment. EO 13101 requires federal agencies to expand waste prevention and recycling programs, implement affirmative procurement programs for the United States Environmental Protection Agency (EPA) –designated items, and procure other environmentally preferable products and services. The stated purpose of the Green Procurement Program is to stimulate the market for recovered materials. As a result of EO 13101, the EPA issued the Comprehensive Procurement Guidelines (CPG’s) that have established the mandatory procurement by federal agencies of many items produced with recovered materials. The EPA has also issued Recovered Material Advisory Notices (RMANs) to accompany the CPGs and provide detailed information on the designated items.

1.4.2. Public Law 107-171, Farm Security and Rural Investment Act of 2002 (http://www.usda.gov/farmbill/conference_report/title9.pdf), known as the Farm Bill, was signed by President George W. Bush on 13 May 02. Section 9002 establishes a biobased product program that parallels RCRA, section 6002, requirements for recycled-content purchasing. The USDA will designate biobased products for federal agencies to purchase and provide product recommendations. Once the final list is published in the Federal Register, federal agencies will be required to include biobased products in their APPs. They must then purchase products with biobased content unless there is a price, performance, or availability reason not to do so. The USDA will also create a voluntary labeling program for biobased products.

1.4.3. Please direct all questions regarding the plan to the Contracting Officer for forwarding to the 12 MSG/CEAN Environmental Flight, 652-4668.

1.5 DOD AND AIR FORCE REQUIREMENTS

1.5.1. Green Procurement programs are required of all Air Force (USAF) installations. AFI 32-7080, Pollution Prevention Program, 12 May 94 contains the requirements and responsibilities for affirmative procurement and biobased programs. AETCI 32-7001, AETC Affirmative Procurement Program, 21 Dec 01 provides command policy guidance directing the establishment of an affirmative procurement team and preparation of an affirmative procurement plan. Undersecretary of Defense Memorandum on the Establishment of the DoD GPP, 27 Aug 04 merges the APP (recycled content purchases) with purchasing requirements set up in other regulations: environmentally preferable, biobased, and energy-efficient products; non-ODS substances; and alternative vehicles and fuels.

1.9.1.2. The product is not available within a reasonable period of time.

1.9.1.3. The product does not meet the performance standards in applicable specifications or fails to meet reasonable performance standards of the procuring agency.

1.9.1.4. The product is not available at a reasonable price. For Air Force purposes, “unreasonable price” is defined as follows: If the lifecycle cost of the recycled-content product exceeds the lifecycle cost of a non-recycled item, then the price is considered unreasonable. The Office of Federal Procurement Policy (OFPP) policy letter 92-4 requires federal agencies to use lifecycle cost analysis.

1.9.2. Each contractor is responsible for completion of AETC Form 51 with respect to his or her work and products being provided. Each contractor shall provide written documentation to support his/her decision not to acquire items meeting the minimum content levels. This documentation shall be forwarded to the Contracting Officer for review and approval. In the event the documentation fails to support the contractor’s findings, the Contracting Officer shall return the documentation to the contractor citing the reason(s) for disapproval. The contractor shall resubmit and address the deficiencies.

1.10 APPLICABILITY

1.10.1. These procedures apply to all contractors employed in the construction of, or providing services to or for, this project.
