Section 00100 - Bidding Schedule/Instructions to Bidders
PROPOSAL INSTRUCTIONS
SECTION 00100
1. The proposal acceptance period is specified in Block 13D of the Standard Form 1442 of the solicitation. By signing the SF 1442, the contractor agrees that the proposal price is valid for at least the number of days listed in Block 13D.
A. BASIS FOR CONTRACT AWARD: The Lowest Price Technically Acceptable (LPTA) source selection process will be used. Offerors’ technical proposal will be evaluated on an acceptable/unacceptable basis.
If lowest priced proposal was deemed technically acceptable, no other proposal will be evaluated. In addition, the Government will evaluate offers for award purposes by adding the total price for all CLINs to the total price for the basic requirement. By submission of its offer, the offeror accedes to all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements. Failure to meet a requirement may result in an offer being determined non-responsive and thereby excluded from further consideration. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale along with providing any assumptions in their proposals.
2. These instructions prescribe the format of proposals and the submission requirements. They are designed to ensure that the contractor understands the proposal requirements, and what will be needed for the Government to accurately evaluate the proposal data to determine technical sufficiency and price fair and reasonableness; both are required prior to the Government making an award. These instructions permit the contractor to include any pertinent data that they deem relevant to the Government’s understanding of both the proposed technical approach, and cost information that may be above and beyond what is explicitly requested in these instructions.
3. The contractor shall either mail, hand carry, or e-mail their proposal to the below address no later than the date specified in Block 13A of the 1442. Email is the preferred method. A receipt confirmation is recommended.

4. Hard copy proposals shall be accompanied by either a DVD with electronic versions of the proposal document and all associated attachments, or, an e-mail with the proposal document and all associated attachments. Please be advised that the Schriever AFB firewalls or servers may delay or prevent the electronic transfer of large data files (10MB) via e-mail. Because of this, the contractor is encouraged to separate their e-mails labeling them as follows: (1 of.., 2 of..., 3 of…, etc.).
5. Discrepancies: If an offeror believes that the requirements in these instructions or within the solicitation documents contain an error, omission, or are otherwise unsound, the offeror shall immediately notify this office in writing with supporting rationale.
6. Mandatory Submission: The offeror shall submit copies of the SF 1442, front and back, the appropriate signatures, and acknowledgements of all amendments as required. The 1442 shall have a unit price, and total price annotated for each CLIN; and Block 30A, B, and C shall be signed by an authorized representative of the offeror’s company.
7. Section 00100
A. Technical: In addition to the completed SF 1442, the contractor shall submit a proposal that adequately annotates the contractor’s technical approach and that reflects adequate understanding of the scope of work. Technical information submitted shall include, but is not limited to the following areas:
i. Proposed Labor Mix, including Hours and Quantity for each labor mix category.
ii. Proposed Schedule. The schedule shall be commensurate with the Period of Performance defined in the Statement of Work and shall include project milestones such as design phases, submittals, mobilization, construction progress, testing, and closeout activities.
iii. Management Approach. This shall include personnel structure, project manager’s qualifications and past projects, site superintendent’s qualifications and past projects, and relevant certifications. Subcontractor information and qualifications should also be included if known at time of submission. This information can be submitted in the contractor’s preferred format.
iv. Proposed Material Cost and Quantity. This shall include a list of materials corresponding to the requirements defined in the Statement of Work.
B. Price: The price proposal can be submitted in the offeror’s own format; however, this portion of the proposal shall contain enough information for the Contracting Officer to evaluate the data so as to determine a fair and reasonable price. This data shall reflect price breakouts of equipment, materials, and labor; and/or, the offeror’s estimating processes to include:
i. The judgmental factors applied and the mathematical or other methods used in the estimate, including those used in projecting from known data; and
ii. The nature and amount of any contingencies included in the proposed price.
C. Proposal Evaluation:
i. The offeror’s proposal will be evaluated for both technical acceptability and understanding, and for price fair and reasonable determination. Both shall be determined acceptable by the Contracting Officer prior to any award made under this solicitation. Technical Evaluation factors other than cost or price are approximately equal to cost or price.
ii. Technical Evaluation: The Government will review the contractor’s proposal in response to the requirements set forth within the instructions, section “00100” of this solicitation, the statement of work, and the attached specifications.
iii. The Government reserves the right to seek clarifications IAW FAR 15.306(a) with the contractor regarding areas of their proposal that either conflict with, or display a perceived misunderstanding of the scope of work. The contractor’s proposed schedule will also be evaluated by the Government for acceptability.
i. Price Evaluation: The Government plans to award a contract resulting from this solicitation IAW FAR 15.101-2 to the responsible offeror whose proposal conforming to the solicitation represents the lowest price technically acceptable. The price evaluation will document the reasonableness and completeness of the proposed price. In the event that the Government cannot determine a reasonable price, the Contracting Officer may request additional data from the contractor to the extent necessary to determine a fair and reasonable price IAW FAR 15.402(a)(3). If additional data is still not sufficient, the Contracting Officer may request negotiations with the contractor.
D. Clarifications conducted to resolve minor or clerical errors will not constitute discussions and the contracting officer reserves the right to award a contract without the opportunity for proposal revisions.
The government intends to award a contract without discussions with respective offerors. The government, however, reserves the right to conduct discussions if deemed in its best interest.

(b) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions), Government agencies are not permitted to use funds appropriated (or otherwise made available) for contracts with an entity that requires employees or subcontractors of such entity seeking to report waste, fraud, or abuse to sign internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting such waste, fraud, or abuse to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information.
(c) The prohibition in paragraph (b) of this provision does not contravene requirements applicable to Standard Form 312, (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(d) Representation. By submission of its offer, the Offeror represents that it will not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).

52.203-19 PROHIBITION ON REQUIRING CERTAIN INTERNAL CONFIDENTIALITY AGREEMENTS OR
STATEMENTS (JAN 2017)
(a) Definitions. As used in this clause-- Internal confidentiality agreement or statement means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.
Subcontract means any contract as defined in subpart 2.1 entered into by a subcontractor to furnish supplies or services for performance of a prime contract or a subcontract. It includes but is not limited to purchase orders, and changes and modifications to purchase orders.
Subcontractor means any supplier, distributor, vendor, or firm (including a consultant) that furnishes supplies or services to or for a prime contractor or another subcontractor.
(b) The Contractor shall not require its employees or subcontractors to sign or comply with internal confidentiality agreements or statements prohibiting or otherwise restricting such employees or subcontractors from lawfully reporting waste, fraud, or abuse related to the performance of a Government contract to a designated investigative or law enforcement representative of a Federal department or agency authorized to receive such information (e.g., agency Office of the Inspector General).
(c) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.
(d) The prohibition in paragraph (b) of this clause does not contravene requirements applicable to Standard Form 312 (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.
(e) In accordance with section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015, (Pub. (2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.
52.209-11 REPRESENTATION BY CORPORATIONS REGARDING DELINQUENT TAX LIABILITY OR A
FELONY CONVICTION UNDER ANY FEDERAL LAW (FEB 2016)
(a) As required by sections 744 and 745 of Division E of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), and similar provisions, if contained in subsequent appropriations acts, the Government will not enter into a contract with any corporation that--
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless an agency has considered suspension or debarment of the corporation and made a determination that suspension or debarment is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that--

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 180 days ANP. *The time stated for completion shall include final cleanup of the premises.
52.216-1 TYPE OF CONTRACT (APR 1984)
The Government contemplates award of a Firm Fixed Price Contract (FFP) contract resulting from this solicitation.
52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS (OCT 2014) - ALTERNATE I (SEPT 2015)
(a) Definitions. As used in this provision--
Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.
Service-disabled veteran-owned small business concern--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and the size standard in paragraph (b) of this provision.
Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States, and
