In addition, the prime offeror and all subcontractors must include a written statement as to whether or not an employer-sponsored health insurance plan will be provided to the workers who are to be employed in the performance of the contract. If a plan is offered, the following information shall be submitted in order to calculate the contribution the prime offeror and/or subcontractor will make towards the premium or subscription share of the employer-sponsored health benefits plan:
i. The total basic pay for all employees for this contract for the basic period and all option periods;
ii. The total dollar amount contributed by the offeror for premium or subscription share of its employers sponsored health benefits plan for all employees for the basic and all option periods; and
iii. The percentage of premium or subscription share contribution paid by the offeror for the employer sponsored health benefits plan for all employees for the basic and all option periods as defined by the total premium or subscription dollars/total basic pay for all employees. (The figure from paragraph ii. Divided by the figure in paragraph i.)
iv. The prime offeror and all subcontractors shall certify in the Attachment 13 prescribed in this Amendment that to the best of its knowledge and belief, the data submitted under these subparagraphs are accurate, complete and current as of the Amendment due date.
4. Section M:
a. Page M-8, para M-901e(c): Inserted the following text at the end of the paragraph:
In addition, subsection 8014 (a)(3) of the DoD Appropriation Act, 2005, prohibits conversion to contractor performance if the contractor received an advantage for a proposal that would reduce costs for the Department of Defense by either not making an employer-sponsored health insurance plan available to the workers who are to be employed in the performance of the activity, or offering to such workers a plan that requires the employer to contribute less towards the premium or subscription share of an employer-sponsored health insurance plan than the amount paid by the DoD for health benefits for civilian employees. OMB has established the DoD percentage contributed to health benefits for civilian employees at 5.5% of employee basic pay. Therefore, based on the data received from the contractor in response to section L-901h(1)(a)(ii)b, an additional adjustment of up to 5.5% will be made to the total evaluated cost for those offerors whose contributions do not meet or exceed 5.5%.
b. Page M-10, para M-903(b)(4): Inserted the following text at the end of the paragraph:
In addition, any adjustments made to the proposed cost in accordance with M-901e(c) to meet the requirements of subsection 8014 (a)(3) of the DoD Appropriation Act, 2005, will be carried over to the cost comparison with the in-house cost estimate.
