About this file

This is a Designation of Confidential and Proprietary Information form submitted by a bidder in response to Bid/Proposal #MA170724 for Certified Central Monitoring Station Services with the Wisconsin Department of Military Affairs. The Department of Military Affairs is seeking a single contract award for UL Certified Central Monitoring Station (CMS) security alarm services to support approximately 110 military facilities throughout Wisconsin. The services must operate twenty-four hours a day, seven days a week to monitor existing Intrusion Detection System (IDS) panels and receive alarm signaling Contact Identification Codes (CID) from Ademco VISTA-128BPT equipment. The bidder has submitted this form to request that specific pages of their bid response be treated as confidential material under Wisconsin Open Records Law, as those pages contain trade secrets or proprietary information as defined under Wisconsin Statutes section 19.36(5) and section 134.90(1)(c).

The bidder acknowledges that pricing information cannot be kept confidential and will become public upon bid opening, but seeks protection for other materials qualifying as trade secrets. The bidder agrees to provide legal counsel or other necessary assistance to defend the confidentiality designation if challenged and agrees to hold the state harmless for any costs or damages related to the state's decision to withhold the designated materials. The form requires the bidder to specifically identify which pages are designated as confidential by section, page number, and topic. Failure to submit this completed form may result in all bid information being subject to public examination and copying under Wisconsin's Open Records Law. The bidder also agrees to hold the state harmless for any damages resulting from the release of materials not specifically identified on this form as confidential.

DESIGNATION OF CONFIDENTIAL AND PROPRIETARY INFORMATION

The attached material submitted in response to Bid/Proposal #MA170724 includes proprietary and confidential information which qualifies as a trade secret, as provided in s. 19.36(5), Wis. Stats., or is otherwise material that can be kept confidential under the Wisconsin Open Records Law. As such, we ask that certain pages, as indicated below, of this bid/proposal response be treated as confidential material and not be released without our written approval.

Prices always become public information when bids/proposals are opened, and therefore cannot be kept confidential.

Other information cannot be kept confidential unless it is a trade secret. Trade secret is defined in s. 134.90(1)(c), Wis. 2.

The information is the subject of efforts to maintain its secrecy that are reasonable under the circumstances.

We request that the following pages not be released.
