About this file

This document is Exhibit N from the Texas Department of Agriculture and addresses the treatment of confidential or proprietary information under the Texas Public Information Act (PIA). The exhibit serves as a formal notice to respondents regarding disclosure requirements and provides instructions for protecting sensitive information submitted with proposals. Respondents are required to select one of three checkboxes indicating whether their proposal submission contains confidential or proprietary information, and this exhibit must be submitted as part of the response package. Blanket assertions of confidentiality are not permitted; only specific information clearly marked as confidential or proprietary will receive protection from disclosure.

The document outlines three submission options for respondents: submitting a proposal that is entirely exempt from disclosure under the PIA with original materials clearly marked as confidential or proprietary; submitting a proposal with confidential or proprietary information along with a separate "Public Information Act Copy" as specified in Section II, Paragraph 5.2 of the solicitation; or submitting a proposal containing no confidential or proprietary information without a separate redacted copy. The exhibit requires authorization by an official company representative with printed name, signature, and date. This certification mechanism ensures compliance with Texas transparency requirements while providing a structured process for third parties to defend their proprietary interests through the Attorney General's office if necessary.
