About this file

This is a Payment and Performance Bond form required by the County of Volusia, Florida for the Hurricane Nicole Seawall Extensions and Repairs project affecting three locations—14th Avenue, 15th Avenue, and 29th Avenue in New Smyrna Beach, Florida. The bond serves as a guarantee that the contractor will perform the work as specified in the contract documents and make timely payments to all suppliers and laborers. The project addresses storm surge damage from Hurricane Nicole that eroded dunes and rendered seawalls ineffective, requiring extension of seawall returns westward to stabilize public beach access points, backfill erosion damage, and reestablish public access to dune walkovers and beach areas across the three distinct work sites.

The bond amount is to be completed by the contractor and surety upon execution and is intended to protect the County of Volusia against contractor default, non-payment to claimants, and losses resulting from contractor negligence or misconduct. The surety assumes joint and several liability with the contractor for performance and payment obligations per Florida Statutes Section 255.05, including indemnification of the County against liabilities caused by contractor negligence, recklessness, or intentional wrongdoing. The bond requires execution by the contractor and a corporate surety authorized to conduct business in Florida, with verification through A.M. Best and NAIC numbers, and remains in force for the duration of contract performance and the specified warranty period for all work and materials furnished.
